NAVIGATION (WIRELESS TELE­
GRAPHY) AMENDMENT ACT.
Act No. 44, 1935.
A D Act to m a k e provision relating t o wireless
installations on s h i p s ; t o a m e n d t h e N a v i ­
gation Act, 1901, as a m e n d e d b y subsequent
A c t s ; a n d for purposes connected t h e r e w i t h .

E it enacted b y t h e K i n g ' s Most Excellent Majesty,
b y a n d w i t h t h e advice a n d consent of t h e Legis­
lative Council a n d Legislative Assembly of New South
Wales in P a r l i a m e n t assembled, a n d b y t h e a u t h o r i t y of
t h e same, as follows :—
1 . (1) T h i s A c t m a y be cited as t h e " N a v i g a t i o n
( W i r e l e s s T e l e g r a p h y ) A m e n d m e n t Act, 1 9 3 5 . "
(2) T h e N a v i g a t i o n Act, 1901, as a m e n d e d b y sub­
sequent A c t s , is in this A c t r e f e r r e d to as t h e P r i n c i p a l
Act.
(3) T h e P r i n c i p a l Act as a m e n d e d by this Act m a y
be cited as t h e N a v i g a t i o n Act, 1901-1935.
(4) T h i s Act shall commence u p o n a d a y to b e
a p p o i n t e d b y t h e G o v e r n o r a n d notified by p r o c l a m a t i o n
published in t h e Gazette.
2 . T h e P r i n c i p a l A c t is a m e n d e d —
(a) by i n s e r t i n g in P a r t V I I next a f t e r section one
h u n d r e d a n d n i n e t h e following new D i v i s i o n : —
DIVISION 2A.—Wireless
telegraphy.
109A. I n this Division—
" P r e s c r i b e d " m e a n s p r e s c r i b e d by this
Division or t h e r e g u l a t i o n s .
"Regulations"
" R e g u l a t i o n s " means regulations made
in r e l a t i o n to a n y of the m a t t e r s r e ­
f e r r e d to in this Division.
" T e l e g r a p h y " includes a n y m e t h o d of
t r a n s m i t t i n g t e l e g r a p h i c or telephonic
m e s s a g e s by m e a n s of electricity.
109B. T h i s Division shall a p p l y to all sea­
going ships except—
(a) ships, not c a r r y i n g p a s s e n g e r s , w h e n
going to sea on a voyage n o t exceeding
twenty-six n a u t i c a l m i l e s ;
(b) ships when being towed by a ship p r o ­
vided w i t h a wireless t e l e g r a p h y instal­
lation ;
(c) ships, not c a r r y i n g p a s s e n g e r s , on a voy­
age to a p o r t for the p u r p o s e of u n d e r ­
going a t t h a t p o r t n e c e s s a r y r e p a i r s or
periodical overhaul, a n d on t h e r e t u r n
v o y a g e from t h a t p o r t ; or
(d) sailing ships.
109c. (1) T h e M i n i s t e r m a y , on the recom­
m e n d a t i o n in w r i t i n g of a committee of advice,
e x e m p t from compliance with t h e r e q u i r e m e n t s
of t h i s Division a n d the r e g u l a t i o n s a n y ship or
class of ships w h e r e , h a v i n g r e g a r d to the n a t u r e
of the voyage on which the ship or class is
engaged, or o t h e r circumstances of the case, he
is of opinion t h a t it would be u n n e c e s s a r y or
u n r e a s o n a b l e to r e q u i r e such compliance.
(2) A committee of advice shall be con­
s t i t u t e d as p r e s c r i b e d , a n d different committees
of advice m a y be constituted for different ships
or different classes of ships.
109D. E v e r y sea-going ship to which this Divi­
sion applies shall, unless exempted from com­
pliance with the r e q u i r e m e n t s of this Division
a n d the r e g u l a t i o n s (a) be p r o v i d e d w i t h t h e p r e s c r i b e d wireless
telegraphy installation;
(b)
(b) m a i n t a i n the p r e s c r i b e d wireless
graphy service; and
(c) c a r r y a wireless s i g n a l l e r :

Provided that—
(i) where a certificated o p e r a t o r pos­
sessing the p r e s c r i b e d qualifica­
tions is carried, it shall n o t be
n e c e s s a r y to c a r r y also a wireless
signaller;
(ii) w h e r e such a certificated o p e r a t o r
is not c a r r i e d the p r e s c r i b e d w i r e ­
less t e l e g r a p h y i n s t a l l a t i o n shall
include
an
automatic
distress
sender.
109E. (1) T h e m a s t e r of a sea-going ship
to which this Division applies a n d which is n o t
exempted p u r s u a n t to section 109c of this A c t
shall not take h e r to sea a n d the owner of a n y
such ship shall not p e r m i t h e r to go t o sea
unless the r e q u i r e m e n t s of this Division a n d the
r e g u l a t i o n s a r e complied with.
(2) A n y m a s t e r or owner who contra­
venes the provisions of subsection one of this
section shall be liable to a p e n a l t y n o t exceeding
one h u n d r e d pounds.
109F. T h e G o v e r n o r m a y m a k e r e g u l a t i o n s
not inconsistent w i t h this Act p r e s c r i b i n g all
m a t t e r s which by this Division a r e r e q u i r e d or
p e r m i t t e d to be p r e s c r i b e d or which a r e
n e c e s s a r y or convenient to be p r e s c r i b e d for
c a r r y i n g o u t or g i v i n g effect to the p r o v i s i o n s
of this Division, a n d in p a r t i c u l a r a n d without
prejudice to the g e n e r a l i t y of t h e foregoing
p o w e r m a y make r e g u l a t i o n s r e l a t i n g t o —
(a) the n a t u r e of the wireless t e l e g r a p h y in­
stallation to be p r o v i d e d on s h i p s ;
(b) the wireless t e l e g r a p h y service to be
m a i n t a i n e d by s h i p s ;
(c) the qualifications of wireless s i g n a l l e r s ;
(d) h o u r s of watch of wireless s i g n a l l e r s ;
(e) a u t o m a t i c d i s t r e s s senders.
