I, SATENDRA KUMAR, Director Plant Biosecurity, with the delegated authority of
the Minister for Primary Industries in pursuance of section 3A of the Plant Diseases
Act 1924 (“the Act”) and in pursuance of sections 3(2) and 4 of the Act, being of the
opinion that the importation, introduction or bringing of certain banana plant material,
bananas and other things into New South Wales is likely to introduce the disease
Banana freckle into New South Wales, make the following Order regulating and
prohibiting the importation, introduction or bringing of certain banana plant material,
bananas and other things into New South Wales.

This Order is the Plant Diseases (Banana Freckle Disease) (No 2) Order 2015.

Commencement
This Order commences on the date it is published in the NSW Government
Gazette.

Interpretation
In this Order:
banana means the fruit of any plant belonging to the family Musaceae.
Banana freckle means the disease of banana plant material and bananas caused
by fungal species within the genus Phyllosticta that are primarily pathogenic on
banana plant material and bananas, excluding the species Phyllosticta maculata.
Banana freckle area freedom certificate means a certificate:
(a)
approved by the officer responsible for plant biosecurity in another State or
Territory, and
(b) certifying that the State or Territory, or part of the State or Territory, is free
of Banana freckle.
banana plant material means any plant or part of a plant (excluding fruit)
belonging to the family Musaceae.
Act means the Plant Diseases Act 1924.
used agricultural equipment means any equipment, machinery or vehicle that
has been used in the cultivation or harvesting of banana plant material or bananas.
used packaging means any covering, packaging or other thing that has come into
contact with fungal species within the genus Phyllosticta that are primarily
pathogenic on banana plant material and bananas, excluding the species
Phyllosticta maculata.
Note: covering or package have the same meaning as in the Act.

Revocation of Order O-452
Pursuant to sections 4 and 3(2) of the Act, the Order titled “Plant Diseases
(Banana Freckle Disease) Order 2015” published in NSW Government Gazette
No. 32 on 17 April 2015 at pages 993-996 is revoked, as is any Order revived as a
result of this revocation.

Prohibition on introduction of certain pathogens and anything infected with
Banana freckle
The importation, introduction or bringing into New South Wales of any of the
following is prohibited:
(a)
fungal species within the genus Phyllosticta that are primarily pathogenic
on banana plant material and bananas, excluding the species Phyllosticta
maculata; or
(b) anything infected with Banana freckle.

Regulation of the movement of banana plant material
Banana plant material must not be imported, introduced or brought into New
South Wales unless a Banana freckle area freedom certificate is currently in force
in respect of the State or Territory, or part of the State or Territory, where the
banana plant material (or the plant from which banana plant material was
derived) was grown or packed.

Regulation of the movement of bananas
Bananas must not be imported, introduced or brought into New South Wales
unless a Banana freckle area freedom certificate is currently in force in respect of
the State or Territory, or part of the State or Territory, where the bananas were
grown or packed.

Regulation of the movement of used agricultural equipment
Used agricultural equipment must not be imported, introduced or brought into
New South Wales unless a Banana freckle area freedom certificate is currently in
force in respect of the State or Territory, or part of the State or Territory, in which
the used agricultural equipment was last used.

Used packaging must not be imported, introduced or brought into New South
Wales unless a Banana freckle area freedom certificate is currently in force in

10 Regulation of the movement of soil in which bananas have been grown or
that contains banana plant material
Soil in which bananas have been grown or soil that contains banana plant material
(“the soil”) must not be imported, introduced or brought into New South Wales
unless a Banana freckle area freedom certificate is currently in force in respect of
the State or Territory, or part of the State or Territory, from which the soil was
derived.

Commencement

Interpretation
In this Order:
authorised person means an inspector or a person authorised pursuant to section 11 (3) of the Act.
banana means the fruit of any plant belonging to the family Musaceae.
banana plant material means any plant or part of a plant (excluding fruit)
belonging to the family Musaceae.
infected property means premises or land which has had a positive Panama disease Tropical Race 4 detection.
Panama disease Tropical Race 4 means the disease caused by the Tropical Race 4 strain of the fungus Fusarium oxysporum f.sp. cubense.
Plant Health Certificate means a document (known as a Plant Health Certificate) issued by:
(a)
an authorised person; or
(b) a person authorised to issue such a certificate under a law of another State
or Territory that relates to plant biosecurity.
suspect property means premises or land containing plants which may have been
exposed to the Panama disease Tropical Race 4.
Act means the Plant Diseases Act 1924.

revived as a result of this revocation.

The importation, introduction or bringing into New South Wales of any of the

Race 4; or
(c)
used agricultural equipment; or
(d) used packaging; or

Regulation of the movement of banana plant material
Banana plant material must not be imported, introduced or brought into New
South Wales unless the banana plant material is as tissue cultured plantlets in
sealed containers from QBAN (Quality Banana Approved Nursery) accredited
nurseries.

Regulation of the movement of bananas
(1) Bananas from any area outside of New South Wales must not be moved
into New South Wales, unless subclauses (a), (b) and (c) below are
satisfied:

(a) the bananas are free of soil, banana plant material and other organic
matter; and
(b) vehicles, bins or packaging or coverings containing bananas are free of
soil, banana plant material and other organic matter; and
(c) in the case where bananas have originated from or have moved through
an infected property or suspect property, the bananas are accompanied
by a Plant Health Certificate certifying that the conditions in
subclause (a) and (b) above are satisfied.
(2) Bananas from any area outside of New South Wales must not be moved
through (into, within and out of) New South Wales, unless subclauses (a),
(b) and (c) below are satisfied:
(a) any bins or packaging or coverings containing bananas remain intact
and secured; and
(b) vehicles, bins or packaging or coverings containing bananas are free of
soil, banana plant material and other organic matter; and
(c) any transport vehicles, bins or packaging or coverings containing
bananas are not unloaded within New South Wales.

Explanatory note
This Order is made under section 324 (1) of the Water Management Act 2000 (the Act). The object of this is to impose
temporary water restrictions on the water sources listed in Schedule 1.

This Order is the Temporary Water Restrictions Order Lower Darling 2015.

Commencement
This Order commences on 23 October 2015 and will remain in force until Friday, 30 June 2017, unless it is repealed
or modified by a further s 324 Order before that date.

Temporary water restrictions
The taking of water from the water sources specified in Schedule 1 is restricted as specified in Schedule 2.

Interpretation
Unless otherwise defined, words and expressions that are defined in the Act or in regulations to the Act have the same
meaning in this Order
Schedule 1 Water Source
This Order applies to the Lower-Darling Regulated River Water Source as described in the Water Sharing Plan for the New
South Wales Murray and Lower Darling Regulated Rivers Water Sources 2003.
Schedule 2 Restrictions
The taking of water from the water source specified in Schedule 1 is restricted to the use of water for the following purposes
only:
(a) Town water supply
(b) Domestic use
(c) Stock watering; and
(d) Existing permanent plantings such as vineyards and orchards.
Note: It is an offence, under section 336C of the Water Management Act 2000, to fail to comply with this direction. An
individual found guilty of an offence under section 336C is liable to a penalty not exceeding $247,500 and, in the case
of a continuing offence, a further penalty not exceeding $66,000 for each day the offence continues. A corporation
found guilty of an offence under section 336C is liable to a penalty not exceeding $1.1 million and, in the case of a
continuing offence, a further penalty not exceeding $132,000 for each day the offence continues.

Under section 126 of the Anti-Discrimination Act 1977
(NSW), an exemption is granted from sections 8 and 51 of
the Anti-Discrimination Act 1977 NSW, to Wollongong City
Council, to advertise and recruit one Aboriginal and Torres
Strait Islander person for the Council’s Cadet, Apprentice and
Trainee Program over a period of seven years. The person
will either be placed in the Cadet, Apprentice or Trainee

SUSPICIOUS DEATH
One Hundred Thousand Dollars ($100,000) Reward
On 19 March 2005, Jordan William THOMPSON, aged
21 months, was found lying face down in a bathtub at a
residential unit in Singleton, NSW. He was later pronounced
dead at Singleton Base Hospital after numerous, unsuccessful
attempts were made to resuscitate him. Jordan THOMPSON’s
death has been determined as being caused by a lethal
overdose of prescription medication.
Notice is hereby given that a reward of up to one hundred
thousand dollars ($100,000) will be paid by the Government
of New South Wales for information leading to the arrest
and conviction of the person or persons responsible for the
suspicious death of Jordan William THOMPSON.
The allocation of this reward will be at the sole discretion of
the Commissioner of Police.

Background
1. His Excellency General The Honourable David Hurley AC DSC (Ret'd) was appointed
to the office of Governor on 2 October 2014.
2. Prior to the Governor’s appointment the Premier, the Hon. Mike Baird MP,
requested that the Statutory and Other Offices Remuneration Tribunal (the Tribunal)
make a special determination, pursuant to clause 3 of Schedule 6 of the Statutory
and Other Offices Remuneration Act 1975 (SOOR Act), in respect of the remuneration
payable to the holder of the office of Governor.
3. The Constitution Amendment (Governor’s Salary) Act 2003 amended the Constitution
Act 1902 and the SOOR Act to allow the Tribunal to determine the remuneration of
the Governor commencing with the appointment of His Excellency General The
Honourable David Hurley AC DSC (Ret'd).
4. The special determination was made on 5 June 2014 and provided for the holder of
the office of Governor to receive a salary of $445,100 per annum, with effect on or
after the commencement date of the Constitution Amendment (Governor’s Salary)
Act 2003 being 2 October 2014.
5. The SOOR Act does not require that an annual determination in respect of the
Governor’s salary take effect from 1 July. Instead, annual determinations of the
Governor’s salary take effect from the anniversary of the commencement of the
special determination being 2 October.

6. The Tribunal is required, when making determinations under Part 3 of the SOOR Act,
to give effect to any policy concerning the remuneration of office holders as declared
by the regulations, rather than those policies that the Industrial Relations
Commission is required to give effect to under section 146C of the Industrial
Relations Act 1996 (the IR Act).

7. Section 6AB of the SOOR Act applies to the Tribunal’s determinations in respect of
the Governor. Government policy concerning the remuneration of office holders to
which Part 3 of the SOOR Act applies is declared in the Statutory and Other Offices
Remuneration (Judicial and Other Office Holders) Regulation 2013 (the SOOR
Regulation).
8. In accordance with the SOOR Regulation any increase the Tribunal may determine in
excess of 2.5 per cent, be it a general increase available to all office holders, or an
increase provided to an individual office holder or group of office holders based on
changes in work value, can only be paid if officer-related cost savings for the office
holder (or group of office holders) have been achieved to fully offset the increased
officer-related costs resulting from increased payment.
Government Submission
9. The Tribunal invited Mr Blair Comley PSM, Secretary of the Department of Premier
and Cabinet (DPC), to make a submission on behalf of the Government prior to
making its annual report and determination.
10. Mr Comley provided the Government submission to the Tribunal on 9 September
2015. The Government submits that the Tribunal should determine an increase of
2.5 per cent for the Governor which is consistent with the NSW wages policy and
reflects the NSW Government’s intent, pursuant to section 6AB of the SOOR Act and
SOOR Regulation.
11. The Tribunal also notes and supports the following statement made by Mr Comley in
respect of the Governor’s work over the past year:
“As the Tribunal considers its report and determination, I would like to formally
acknowledge and commend the work of His Excellency General The Honourable
David Hurley AC DSC (Ret’d). The Governor has done an outstanding job in his first
year of tenure. He is deeply involved in community organisations and events. The
Governor has travelled widely across New South Wales to engage our citizens. He
speaks at a large number of events and reaches out to all levels of the community,
from the State’s school children to the international Diplomatic Corp.”
