OYEZ Volume 36, Number 1 February 2017 President’s Letter The New Year is upon us and it is a great time to reflect on 2016 and the incredible contributions made by many people to keep the Alexandria Bar Association going strong. We function only because of the time and talents that are donated by the members and staff of this organization and I want to express appreciation on behalf of the Board of Directors for all that has been given. Maya Angelou once said, “When we give cheerfully and accept gratefully, everyone is blessed.” Just as that is true for individuals, it is also true for associations. It would be impossible to individually thank every person or group who has made a contribution this year, given space limitations. However, I still would like to recognize some specific contributions. As many of you know, we had some minor organizational turbulence this year when we lost a staff member. Our Executive Director, Peggy McCoy stepped into the void to make sure that the association continued to run effectively. Despite her own external time commitments, Peggy ended up working extra hours for an extended period of time so that Lawyer Referral Service could continue to function smoothly. All the while Peggy continued to work hard to ensure that meetings and events were well run and that membership was properly informed of what was going on as an association. In good news, we have hired a new Deputy Director, Ann Loughlin, who we are very excited to welcome aboard and look forward to working with as well. The Association has many committees that have been doing great things. The Beat the Odds Committee has been hard at work making sure that this program, which is close to the heart of so many in our organization, has the ability to continue awarding scholarships to Alexandria youth. The Little Theater event was a great success and it was because the members of this Committee, in coordination with the Office of the Commonwealth’s Attorney, gave of their time to sale tickets, provide food and drinks for the reception, and make sure that event worked smoothly. An extra thank you to Jeanne Franklin and Foster Friedman who initiated the idea of running a raffle as an extra fundraiser to replace the silent auction. What a great new initiative! We are very excited for the annual Gridiron event that will be taking place on Thursday, February 16th at 6:00 at the Patent and Trademark Office (please contact the Bar Office to purchase tickets)! We are very grateful for the continued work of Doug Steinberg and the Gridiron cast who put countless hours into developing and performing creative skits. Year after year, these talented individuals collaborate to keep us entertained and to provide a wonderful social opportunity for the membership as we reflect on the lighter and more humorous side of our profession. If you have not had the opportunity to attend an event sponsored by the Young Lawyers Committee, you should definitely do so. Curcio, a partner with Curcio Bergeron, was awarded the Attorney of the Year 2016 at the Good Scout Award luncheon on Thursday, December 8, 2016. The event, hosted by the National Capital Area Council of the Boy Scouts of America, was held at the Wardman Park Marriot in Washington, D.C. The ‘Good Scout’ Attorney of the Year Award is given to leaders in the law “for characterizing all of the professional and personal attributes of a good scout.” Kim Keenan, President and CEO of Multicultural Media, Telecom and Internet Council, was also honored. The National Capital Area Council of the Boy Scouts of America serves thousands of Scouts and spans from Fredericksburg, Virginia to Frederick, Maryland. The event raised over $75,000, which will be used to fund these local Boy Scout programs to further the Scout mission of empowering youth with life skills. 3 The Swearing in Ceremony for Marion W. Jackson: (Clerk of the General District Court for the City of Alexandria) Postal Service. There was also temporary work that I did with the Department of Taxation for the State of Virginia trying to find a most challenging way to give back to a community. On December 12, 2016, Marion W. Jackson was sworn in as the new Clerk of the General District Court. Below is more information about Ms. Jackson and her thoughts about the new position in her own words. I hail from Tarboro, North Carolina and was raised in a family of 10 siblings. After graduating High School, I enlisted in the US Army, from which I retired in August 1994. From this retirement I held several jobs from working with, but not limited to, newspapers, magazines, and the US I then embarked on a career with the Worker’s Compensation Commission in 1998. This wasn’t exactly what I was looking for, so I moved to the Alexandria General District Court in the year 2000 as a Deputy Clerk. I found this venture to be very exciting with challenges I embraced and a learning curve that goes on forever. I was promoted to Supervisor in 2004, then Chief Deputy Clerk in 2009. I’ll be forever grateful for my appointment to Clerk of Court and will carry out the duties assigned with the upmost accuracy and in accordance with appropriate policies and judicial instructions. My name is Ann Leppert Loughlin and I am thrilled to be the new Deputy Director of the Alexandria Bar Association. I grew up here in Alexandria just down the George Washington Parkway and I now live in the City of Alexandria. After I graduated from George Mason Law School, I had the privilege of clerking for The Honorable James C. Cacheris at the Federal Courthouse on Washington Street. We walked to many local restaurants for lunch, so it is fun for me to be back at work in Old Town. After my year with Judge Cacheris, I became an Assistant Commonwealth’s Attorney in Fairfax County. I remember many members of this bar from my time in Fairfax. There are many lawyers, and even some lawyers who are now judges, who I remember having cases with during my five and half years in Fairfax. It is so nice to see so many familiar faces! After my time in Fairfax, I joined the Civil Division at the U.S. Department of Justice. I was assigned to the Commercial Litigation branch and worked on complex banking cases that were part of the fall-out from the Savings and Loan crisis in the 1970s. It was quite a transition to move from prosecuting criminal cases to trying to stop big banks from winning hundreds of millions of dollars in damages against the Federal Government. One day I was working with experts in DNA and accident reconstruction and, the next day, I was working with experts in accounting and statistics. During my time at DOJ, I was detailed to the White House and worked in the Office of the Counsel to the President. I worked on ethics issues and vetted Presidential appointees on the White House staff and in federal agencies for financial conflicts of interest. After about a year at the White House, I went back to the Justice Department and worked in the Office of Legal Policy. The Office of Legal Policy is the section of the Justice Department that, among other things, vets potential federal judges, including Supreme Court Justices. That office is certainly very busy right now with a new Supreme Court nomination coming soon. After the Office of Legal Policy, I joined the Civil Rights Division at DOJ. I was in the Employment Litigation Section. This particular section enforces civil rights laws against states and municipalities to ensure they do not use any discriminatory practices in their workforces. I worked on cases against the D.C. EMS department and the NYC Department of Education. I was fortunate enough to be asked to come back to the White House. On my second tour there, I again served in the Counsel’s office, this time as the attorney in charge of vetting all the President’s appointees for any possible issues that could interfere with their confirmation by the Senate or embarrass the President. It was fascinating to meet so many people from all across the country who are willing to dedicate themselves to Government service. At the end of my service at the White House, I took a career break to be at home with my three children. I enjoy volunteering at their schools and coaching their tennis and lacrosse teams. My kids also love playing basketball. My husband is the basketball expert in the family. Finally, I am really looking forward to working with all of you. I’m hopeful that I can make a valuable contribution to the Alexandria Bar Association. If you have any questions or need help with a particular matter, please feel free to call or stop by the office. 7 January Monthly Membership Dinner with Guest Speaker, John Cruden (1/19/17):*** Assistant Attorney General John Cruden spoke to the Alexandria Bar at the monthly membership dinner which took place on January 19. At the time, John was leading the Environmental and Natural Resources Division of the Department of Justice in Washington D.C. (in fact he joined us immediately following his final day in that position). He was nominated by President Obama and unanimously confirmed by the Senate at the end of 2014. John is a graduate of West Point and served in the military in airborne, ranger, and special-forces before graduating from law school and becoming a military lawyer, ultimately becoming the chief legislative counsel of the army. He then moved to the Department of Justice as Chief of Environmental Enforcement for the U.S. John was subsequently promoted to be the Deputy Assistant Attorney General for the Division. In 2011, he became the President of the Environmental Law Institute and then returned to DOJ in January 2015. John’s presentation was so interesting and informative, that we thought a more detailed summary was warranted for those who were unable to attend the dinner. The presentation was in three segments: responsibilities and accomplishments of the environment division, key legal actions of the past year, and his views of environmental issues facing the Trump administration. The environment division at DOJ has about 650 people, including 450 lawyers, and is responsible for over six thousand cases and matters. It has both affirmative responsibilities with civil and criminal enforcement responsibilities. They represent every agency of the federal government but primarily the Environmental Protection Agency, the Department of the Interior, the Department of Commerce, the Department of Defense and the Department of Agriculture. In 2016 the division was recognized as a “best place to work in the federal government”. As one example of DOJ enforcement, John joined our governor and attorney general last month in Richmond to announce the settlement with Dupont Company which will provide over $40 million for cleanup efforts in and near the South River and the south fork of the Shenandoah River. John then discussed three key legal events from the past year, all handled by the environment division: the settlement with BP concerning the Deepwater horizon oil spill into the Gulf of Mexico, the civil and criminal prosecution of Volkswagen, and the defense of the President’s Clean Power Plan. The BP settlements were approved by the court in April and the DOJ announced it as the largest settlement with a single defendant in the history of the department, collectively exceeding $20 billion. Most of that money is dedicated solely to restore the gulf. After explaining in detail the illegal activity by Volkswagen in marketing and selling their diesel cars and SUVs in the U.S., John explained the three civil consent decrees governing VW. Basically, VW must buy back or fix to designated standards all of the diesel vehicles. And, they will provide additional compensation for car owners and establish a $2.7 billion mitigation fund to reduce nox emissions in the U.S. In addition VW pled guilty to felonies and DOJ indicted seven VW officials. John led the settlement discussions with both BP and VW. Finally, John described the historic argument before the D.C. Circuit Court of Appeals in September as the en banc court considered the President’s Clean Power Plan designed to substantially reduce carbon dioxide emissions in the U.S. The argument went over 7 hours before a very active and questioning group of ten distinguished judges. The court has not yet ruled in the case which has a number of states on both sides of the litigation. The final segment of the talk related to key environmental issues facing the Trump Administration. John outlined a few, such as infrastructure improvement and the role of the National Environmental Policy Act, abandoned mines, and cities like Flint, Michigan with significant lead issues. He then covered issues the incoming administration had mentioned like promoting oil pipelines, such as the XL and Dakota pipelines, reducing the impact of the Endangered Species Act, giving states more of a role or even transferring federal land to states, reducing regulations, and specifically targeting such rules as the recent COE rule covering “waters of the United States.” Following the presentation a couple of questions were answered and it was revealed that John is a neighbor who lives in the City on Union Street near Oronoco. Since his presentation John has indicated that he intends to join the Alexandria Bar as an Associate Member which we look forward to very much. However, first on his agenda was an immediate vacation in Williamsburg to begin considering the next chapter of his life. *** The Alexandria Bar Association would like to thank Mr. Cruden not only for speaking to us in January, but also for writing the majority of this article about his talk. His assistance was greatly appreciated as the Bar Office would not have been able to adequately summarize his presentation. 8 bell ringing and holiday reception—12.15.16: We then rolled right into more holiday spirit with a reception hosted by all of the City of Alexandria judges. The reception took place on the 4th Floor of the courthouse. We are thankful for the large amount of time that the Alexandria Judges put into being with members of our Bar Association and attending events. It is also wonderful to be able to use space at the courthouse for this event. We were also honored to have Philip Hirschkop as our guest speaker. For those who don’t know, Mr. Hirschkop is one of the attorneys who represented the Lovings in the landmark case of Loving vs. Virginia. Being able to hear about the case from It was a blustery day for bell ringing (to say the least), but our Bar Association volunteers were not deterred (not that we really gave them a choice). $597.42 was raised in the tundra that day! We are grateful to everyone who made a donation to the Beat the Odds Program in December. We also collected a large amount of toys which were primarily donated to Volunteer Alexandria. A portion of them were also donated to the Alexandria’s Domestic Violence Project. the perspective of Mr. Hirschkop was an experience which we will not soon forget. Also, his visit was timed quite well given that the movie about the Lovings had recently been released. We greatly appreciate his willingness to spend the evening with us. Bernard Cohen also represented the Lovings and although he wanted to also speak to the Association about the case, he was unable to make the trip to Alexandria that evening. David S. Mercer and Lucia Anna “Pia” Trigiani, principals with MercerTrigiani law firm based in Alexandria, VA, have been named the 2017 presidents of Virginia’s two most prestigious legal organizations. Mercer was installed as the 129th president of the Virginia Bar Association (VBA) during the association’s annual meeting held on Jan. 21 in Williamsburg, VA. The VBA is Virginia’s largest statewide voluntary professional organization serving more than 5,500 lawyers and judges. “This is a particularly exciting year for the VBA leadership as we prepare to greatly enhance our member services with the 2017 relocation of our Richmond headquarters to the Bank of America Center on Main Street where we will unveil a new, innovative and state-of-the-art member business center called, VBA on Main,” stated Mercer. Trigiani, a past president of the VBA, was named president of the Virginia Law Foundation (VLF) during early January. The VLF recognizes and encourages excellence in community service and the practice of law through its Fellows program and offers continuing legal education through Virginia CLE®. David S. We will focus on expanding the Foundation's grants program, increasing our donor base, solidifying educational programs with Virginia CLE and recognizing the contributions of accomplished citizen lawyers.” 13 young lawyers happy hour—12.8.16: Little Theater Event and 50/50 Raffle (1/13/17): For those who missed it, this year’s Little Theater event to benefit the Beat the Odds Program was quite a success with roughly 140 tickets sold to see Cole Porter’s, Anything Goes. Everyone in attendance agreed that this was a very entertaining show even for younger audience members. It was a packed house. The out-pouring of support from Association members, guests, and the community brought in roughly $4,990 in show ticket and $1,665 in raffle ticket sales. The top prize winner of the 50/50 cash raffle was the Honorable Lisa Kemler. Judge Kemler generously donated her winnings back to the Beat the Odds Program. The second prize winner of the two night stay at Warner Hall Bed and Breakfast in Gloucester, VA was “Terrie.” Next year we will endeavor to get more information about our prize winners, but congratulations Terrie – we are very happy for you!
