What is a Conditional Use Permit?
A Conditional Use Permit is required for a use
that is generally compatible with the other
uses permitted in a zoning district but requires individual review of its location, design, configuration, nature and intensity of
use, and structures. The application may
require the imposition of appropriate conditions in order to ensure the compatibility of
the use in that location.

Occupation Permits
The County issues Home Business Permits, which
are frequently associated with Conditional Use
Home Occupation Permits are typically for
uses that will not add any additional traffic or detract from the residential character of the neighborhood. Home Business
Permits are for businesses that have a
more intense use, which is why a public
hearing is required. Home Business Permits help protect existing residential
neighborhoods by maintaining residential
characteristics while allowing a growing
industry of small, local entrepreneurs.
Often Home Business Permits require a
Conditional Use Permit (CUP). CUPs allow
a level of individual review of the use of
the surrounding neighborhood to ensure
compatibility, as well as mitigation of any
negative elements such as additional traffic or noise.
Home Businesses Permits are required for
businesses that have three or fewer employees. If your business does not have
any employees you may only need a Home
Occupation Permit; check with the Planner of the Day.

A difference between a home business and a
home occupation is the number of employees affiliated with the business. A home business is
allowed to have two persons employed that live
off site in addition to the home owner. A home
occupation may not have any off site employees
and is run by the person that lives in the home.
It is important to note that not more than 25% of
the maximum habitable floor area of the house
can be used for the home business. However, all
or part of the outbuildings (like a garage or shed)
that are non-habitable can be used as part of the
home business area.
Day care is a special case. A day care that
serves six or fewer children is classified as a
home occupation. A day care that serves
seven to twelve children is classified as a
home business.
If your home business has an employee that resides off site, you
need a home business permit.
