FENCE REGULATIONS
1. Interpretations: in these regulations unless the context otherwise requires:
a) “act” means the municipalities act, 1998.
b) “council” means the town council of pouch cove.
c) “town” means the town of pouch cove as defined by paragraph 2 of the
municipalities act, and made under the provisions of the said act.
d) “street” means the land reserved for a public road, street, lane, sidewalk or other
public way with a minimum width of 12m (40 feet) and such greater width of up to
and including 20m (66 feet) as council may prescribe.
2. All fences may be erected only after a permit in writing has been issued by council.
3. No person shall erect or repair a fence except in accordance with these regulations.
4. No person, except with approval of council in writing shall erect any fence at a distance
of less than 4.8m (16 feet) from the center of any street or road under council’s
jurisdiction.
5. The minimum required distance for any fence from a fire hydrant shall be 1m (3.3 feet)
radius.
6. The material or materials used in the erection or repair of a fence shall be a type which
meets the approval of the council.
7. Every person who owns a fence shall maintain said fence in a good state of repair.
a) Fence components are not broken, rusted, rotten or in a hazardous
condition.
b) The fence does not present an unsightly appearance deleterious to abutting
land or to the neighborhood.
8. No fence shall be permitted to be erect that obscures a clear view of street intersection,
pedestrian pathways, driveways or other points of access or egress of vehicles or
pedestrian traffic.
9. Unless otherwise specified by the council, the maximum height of a fence erected or
constructed shall be 1.8m (6 feet).
10. No person shall erect an electrical fence on any land.
11. Unless otherwise specified by the council, no person shall erect a fence consisting
wholly or partly of barbed wire or other barber material.
12. From the date of these regulations all fences erected on any street reservation within
the town may be removed by council at the owners’ expense.
13. Any person who violates any of the provisions of these regulations shall be guilty of an
offence and shall be liable on the summary conviction to a fine not exceeding one
hundred dollars or in default of payment of such fine to imprisonment for a period not
exceeding ninety days.
14. These regulations shall come into effect on the 28 day of October, A.D. 1998 and may be
cited as the town of pouch cove (fence) regulations, 1998.
Pursuant to the authority conferred by the section 180 of the municipalities act, the town of
pouch cove approved and adopted the following fencing regulations effective October 28,
1998.
