RESOURCE CONSENT CHECKLIST - ENCROACHMENT OF RECESSION PLANE
The following checklist has been formulated as a guideline in relation to the information that is required by Schedule 4 of
the Resource Management Act 1991 (RMA) and the Timaru District Plan to complete a resource consent application for
encroachment of recession plane. The checklist is a guide only and is not intended to replace the information
requirements stated by the before mentioned documents.
Where the relevant information on requirements are not adequate, the Council may within 10 working days of receipt of
the application determine that the application is incomplete and return the application with reasons for the determination.
If the application is subsequently relodged, it will be treated as a new application.
A recession plane is a plane inclined at an angle from the site’s boundary toward the interior of the site to determine
whether a proposed building will shade a neighbouring property more than is permitted. If the building shade more than is
permitted on the neighbouring property, it intrudes the recession plane and requires resource consent.

THE APPLICATION FORM
A completed application form that has been signed by the applicant.
APPLICATION LODGEMENT FEE
Please check Council’s “Fees and Charges” for details.
Please note that additional charges will be invoiced as required.
PLANS
Please note that all plans shall be drawn at an appropriate scale and include a north point.


Site Location Plan
The plan shall contain sufficient details of features in the vicinity of the site so that the site’s location can be easily
identified.

Site Layout Plan
- The site layout plan shall show all existing and proposed buildings and landscaping on the site.
- It shall indicate the distance to site boundaries of all existing and proposed buildings.
- It shall show the dimension of all proposed buildings.
- It shall show the location and extent of parking and access areas/points including the number of car parks,
dimensions and circulation space.

Floor Plans
- The use of each room/area shall be indicated on the plan.

Elevation Plans
- The dimensions (including height, width and length) of the proposed building and recession line diagrams shall
be shown on the plans.
CERTIFICATE TITLE

A copy of the site(s) Certificate of Title.
WRITTEN APPROVALS


The written approval(s) from adjoining owners and occupiers of neighbouring properties where the recession plane
is broken.
ASSESSMENT OF ENVIRONMENTAL EFFECTS
The written aspect of the assessment will be required to address the following:

A statement to explain the reasons why it is impractical to comply with the recession plane.

Describe the extent the encroachment may affect the neighbouring property/properties.

Describe if the proposed building may affect the amenity of any residences or public facilities? If yes, discuss the
extent of the effects.
