TAKE NOTICE that an application will be made by the Respondent, 658051
Ontario Limited, before the Honourable Madam Justice K. M. Homer, at the Court House,
611 4t` Street SA in the City of Calgary, in the Province of Alberta, on Monday, the
21' 't day of March, 2005, at the hour of 1:00 o'clock i the afternoon, or so soon thereafter
as counsel may be heard for:
(a)
An Order permitting the Respondent, 658051 Ontar'lo Limited, to engage
the services of a condominium consultant for the purposes of taking all
necessary steps to put the condominium corporation in a proper state of
affairs so that individual units may be refinanced or said;
(b)
An Order directing that the costs of the consultant as well as all other
reasonable costs relating to preparing the condominium
units for
refinancing or sale, be paid from the revenues of Bonaventure Court;
(c)
An Order abridging the time for service of this Notice of Motion; and
(d)
An Order directing that service of any documents oi,i the parties by fax be
deemed good and sufficient.

AND FURTHER TAKE NOTICE that the grounds for this application are as follows:
1.
In order for the individual condominium units to be mfinanced or sold, it will
be necessary to bring the condominium corporation into good standing,
which will include, among other things, the following:
a)
A reserve fund study to be conducted; and
b)
Such other matters as a condominium consultant may direct.
2. It is in the best interests of all beneficial owners thal these steps be taken
as soon as possible in order to prevent future delay in refinancing or selling
the units on an individual basis;
The Respondent, 658051 Ontario Limited, does not have the power to deal
with these matters without authority from the Court; and
4.
Rule 548(1) of the Alberta Rules of Court.
AND FURTHER TAKE NOTICE that in support of the application will be read the
earlier Orders granted in this proceeding, together with such further and other material as
counsel may advise and this Honourable Court may permit.
