(See next page.) Also, please visit www.apscuf.org/members/contract to see the contract language. Of course information is being made available so that members can make an informed decision when voting on the proposed CBA. Voting will take place on campus- March 4, 5 and 6. Process-wise, the CBA “framework” was approved unanimously by the chapter presidents, and the “tentative agreement” was then approved overwhelmingly by the Legislative Assembly delegates from the 14 campuses on February 8th thus sending the proposed CBA to the full membership for a vote. Ratification of the proposal required simple majority of the voting members (50% plus 1) to vote in the affirmative. A few comments: Though the proposed CBA does include some concessions and creates a twotiered faculty structure (due to required spousal health insurance for new hires after July 31, 2013), some members have been relieved by us avoiding some of PASSHE’s yet more egregious proposals, e.g. 35% compensation cut for adjuncts, the Administrative appointment of chairs, etc. Others are just relieved to have a contract, and to think a strike has apparently been avoided. Personally, I can understand the frustration of having concessions, and the sense of relief related to potential ratification. Though each of us has a different unique perspective on the pros and cons of the proposed CBA, we can be proud that our campus was highly supportive of the negotiating team, and the mobilization efforts on all campuses which culminated in the Board of Governors rally on January 24, 2013. Having 500+ members walking for 3 hours with the temperature at 20°, sent a strong message of resolve and unity to the BOG. In Solidarity, Brendan APSCUF/SU Union Newsletter Page 1 Negotiations Committee Approves Tentative Agreement with PASSHE February 4, 2013- Sent By: Steve Hicks, State APSCUF Dear Colleagues, Yesterday morning negotiations between APSCUF and the State System of Higher Education ended with the two sides agreeing to a framework for a contract. This evening APSCUF’s Negotiations Committee unanimously voted to approve that framework as a tentative agreement. After two years of negotiating, we feel that we have finally reached an agreement that is fair to both faculty and students. The following is a summary of the substantive changes included in the tentative agreement reached between APSCUF and PASSHE: SALARY The salary increases in the tentative agreement are consistent with the statewide pattern: o 2011-12 0 percent and no step o 2012-13 1 percent effective Fall 2012 and one step effective 11th or 14th pay, as applicable o 2013-14 1 percent and one step effective Fall 2013 o 2014-15 2 percent and one step effective Fall 2014 Faculty at step 13 will receive a cash payment of 2.5 percent in the last three years of the contract with the same effective dates as the step increments outlined above. The agreement also includes increases in both summer and overload compensation, which will now be a percent of salary and increase as salary increases. HEALTH CARE The tentative agreement includes a plan for the State System to reconcile premium payments with actual costs to avoid future overpayments by faculty. Effective July 1, 2013, co-pays under the PPO plan will increase to the following: o Office visit copays $15/$25 (primary/specialist) o Prescription copays $5/$18/$36 (generic/formulary brand/non-formulary brand) for 30-day supply o Emergency Room Copay $100 (waived if admitted) The agreement ensures that domestic partner health care coverage will be available to retirees. The two sides will negotiate a future defined contribution retiree plan as a voluntary alternative to current retiree health care plan. CURRICULUM AND CLASS SIZE For the first time, class size will be included in the collective bargaining agreement as an issue subject to curriculum committee recommendations. If the university president disapproves any recommendation of the curriculum committee, he or she must provide a written explanation. DISTANCE EDUCATION The compensation for the development and redevelopment of distance education course will be eliminated effective Fall 2014, but the perstudent payment continues under the agreement. The universities will provide technical support personnel and instructional design professionals to assist faculty. Failure to provide technical support and instructional design professionals will result in the continuation or restoration of development and redevelopment fees. The tentative agreement also makes changes to the grievance and arbitration procedures, clarifies the retrenchment article, increases PASSHE’s contributions to the Health and Welfare Fund, and adds dollars to the Faculty Professional Development Program. There is a side letter agreement for a Voluntary Retirement Incentive Program that will provide an incentive payment to eligible faculty members based on base pay and years of service. We know that working without a contract for the last 18 months has been stressful for all of you. We believe that this tentative agreement is a fair one that maintains quality public higher education at our 14 institutions. To view the Tentative Agreement please go to www.apscuf.org. APSCUF/SU Union Newsletter Page 2 Faculty Tentative Agreement Ratification Vote Dear Faculty Member: On February 4, 2013, the APSCUF Negotiations Committee voted to approve a Tentative Agreement and forward to the faculty delegates of the APSCUF Legislative Assembly. On February 7, 2013, the faculty delegates of the APSCUF Legislative Assembly voted to recommend this tentative agreement to the membership for a ratification vote. The ratification vote is scheduled for Monday, Tuesday and Wednesday, March 4, 5 and 6. Each local chapter needs to select two days for voting (the third day is optional). Please contact your local chapter office to find out the dates, times and locations of the voting on your campus. You may view the actual Faculty Tentative Agreement – July 1, 2011 – June 30, 2015 contract language on the State APSCUF website. In addition, copies of the actual contract language may be viewed or obtained from your APSCUF chapter office. I urge you to read these documents prior to submitting your vote. APSCUF policy calls for campus meetings before the vote to allow discussion of the tentative agreement’s contents. For some of those, members of your Negotiations Team may be available, schedules permitting. We hope you avail yourself of these opportunities to learn more about the tentative agreement before you vote. All ballots are secret ballots. No one will know how you voted on this tentative agreement, nor will anyone know how each campus voted on the tentative agreement. The uncounted ballots are forwarded to State APSCUF at the close of voting on the last day. Members of the Nominations and Elections Committee will be in Harrisburg on March 8 to count the ballots and announce the results. A news release, as well as posting on the APSCUF website and the hotline (1-800-932-0587, ext. 5), will be issued immediately following the verification of the ballot vote. If the members ratify the agreement, the Board of Governors will vote as soon as possible. The results of that vote will be communicated immediately to the chapter offices. All chapters are to be congratulated on the hard work and effort expended to effects this tentative agreement. Without the intense strike preparations, local public relation and stalwart support generated by our members, this tentative agreement would not have been reached. I wish to thank all members of the Faculty Negotiations Team for their tireless efforts in obtaining this tentative agreement. In addition, our Office Managers and Harrisburg staff members are to be commended for their assistance throughout the process. (This was done on February 8, 2013) • Campus General Faculty Meetings to be held-February 21, 2013 • March 4-6, 2013 – full membership vote (you can become a member the day of voting and still vote) – Our rules say there must be two days of voting of 6 hours each (chapters have the option of a third day) – Ballots will be paper, placed in an sealed envelope and sent to state APSCUF Vote Count March 8, 2013 • Ballots and sign-in list of voters are overnight mailed to state office. • State Nominations and Elections Committee (three faculty members with help of appropriate staff) reconcile sign-in list with number of envelopes. • After reconciliation, Committee opens envelopes and counts votes. • After reconciliation, there is no segregation of campuses. • Ratification is a simple majority vote (half plus one). Those faculty who are on any type of leave this semester should contact the APSCUF office with your address so that we can mail absentee ballots to you on March 29, and they will be due back at the APSCUF/SU office by Wednesday, April 3. We cannot send ballots electronically. Shared Governance Positions APSCUF/SU is responsible for organizing the elections for the shared governance positions, but the departments determine who will be on the ballot for these important roles in the university-wide shared governance process. The APSCUF/SU office has sent memos to the department chairs requesting names of faculty nominees for University Curriculum Committee, Faculty Representatives to Forum, and the University-Wide Promotion Committee. This info is usually presented at departmental meetings in February or March and each department selects candidates to run for the positions and notifies the APSCUF office at [email protected] . Diana prepares the ballots based on information provided by the department. All full-time faculty are eligible to run for Shared Governance positions, regardless of APSCUF membership. All positions are two-year terms and are voting members of the local APSCUF Executive Committee. Newly elected members take their seats on May 15th. You must be available for meetings the third Thursday of each month (including summer except July except under unusual circumstances) at 3:30pm. Depending on the issues to be addressed, these meetings may run 2-3 hours. Occasionally meeting dates and times will be altered, but mostly held on a Thursday. Following are short descriptions of these positions. What is the Gender Issues/Social Justice Chair? Serves as leader of our local Gender Issues & Social Justice committee and convenes regular meetings. Represents S.U. at meetings of the state GISJ Committee twice/year in Harrisburg. What is the Legislative Chair? Represents APSCUF/SU with local legislators and other groups with political interests. Attends meetings of the State Legislative Committee at Legislative Assembly sites twice/year. Attends Lobby Day in Harrisburg once a year. Keeps faculty informed of relevant legislation and promotes grassroots lobbying on campus. What is Legislative Assembly? The Legislative Assembly meets three or four times per year (September, November, February & April) at various sites in Pa. Elected delegates from all 14 PASSHE local APSCUF chapters meet to conduct business and share information. Assemblies begin on Thursday night and adjourn Saturday mornings. It is important that you are able to be present for that entire time! All delegate hotel, meal, and mileage expenses are paid by APSCUF. What is Meet & Discuss? Perhaps the most important committee in shared governance is the “Faculty-Management Committee,” also called “Meet & Discuss.” This committee is mandated by our contract in Article 9.A & B. This committee must meet monthly for the purpose of discussing matters related to implementing the Contract. While the Contract sets out rules for many working conditions, many of those rules need to be interpreted, and most need to be turned into practical policies that may be unique to each university in the state system. That’s why sometimes there are differences among campuses on things like rules for turning in promotion packets or maximum number of hours adjunct faculty can teach. The CAP (Committee for Action through Politics) CAMPAIGN will run from February 1, 2013 through April 1, 2013. During the campaign, APSCUF is asking its members to complete dues rebate cards if they have yet to do so. The dues rebate card offers members three choices for the $25 rebate: Ø The $25 could be given to APSCUF/CAP, the organization’s political action committee Ø The $25 could be left in the APSCUF treasury Ø The $25 could be paid direct to the member The money collected by CAP is used to advance the causes of higher education, the faculty, and state system students by supporting candidates that are both pro-higher education and pro-labor. APSCUF cannot use membership dues for political action purposes. APSCUF must collect money for political purposes by asking members to designate their dues rebate to CAP and by encouraging members to give to CAP through payroll deductions. If you have already designated your rebate to CAP you need not sign another card. If you have not done so, please consider designating your rebate of $25 to CAP this time. Please also consider making a new payroll deduction or increasing the amount of your current payroll deduction. Payroll Deduction Forms and Dues Rebate Cards are available in the SU APSCUF office. Page 7 Members Only Forum UPDATE The “Members Forum” site, formerly the “Members Only” site, on the APSCUF website at www.apscuf.org has been recently upgraded. It still has all of the same features, but with an enhanced interface and easier registration. You will continue to access the forum in the same way – via the “Members Forum” link in the upper right-hand corner of the APSCUF.org. There is only one caveat. APSCUF members with an active accounts will need to re-register since this is a completely new platform. Registration is simple. Members can simply click on the register button in the “Members Forum”; agree to the terms; and then complete the registration information. Please note that when you re-register for the APSCUF “Members Forum” site that you need to complete the “name” fields provided on the registration page. State APSCUF cannot register you without your name. Overload and Distance Ed Payments OVERLOAD AND RELATED PAYMENTS According to the attached instruments, overload and related payments must be submitted locally between now and by no later than March 1, 2013. Overload and related payments will be included in the March 22, 2013 paychecks. If a faculty member has not received an overload payment in his or her March 22, 2013 paycheck, there are three likely possibilities: either (1) the faculty member has not yet earned credit overload (see explanation below); or (2) the paperwork to authorize the payment was not sent to your Payroll Office; or (3) your Payroll Office has questions about the paperwork. In any case, please keep in mind that the affected faculty member will have forty (40) days from March 22, 2013 to file a grievance if he or she has not received an overload payment or disputes the amount paid. This means that such grievances must be filed at Step Two of the Grievance Procedure by no later than September 30, 2013 ( Summer Extension) in order to be timely. Please remember that most faculty members who teach 15 credits in the fall do not earn credit in the fall even if they are scheduled to teach 12 credits this spring, as their workload could be modified to 9 credits in the spring, making them ineligible for overload compensation. If the faculty member actually does teach 12 credits this spring, he or she will have then earned the credit overload in the spring. DISTANCE EDUCATION PAYMENTS According to the attached instructions, distance education payments must be submitted locally between now and by no later than March 29, 2013. Distance Education payments will be included in the April 19, 2013 paychecks. If a faculty member has not received a distance education payment in his or her April 19, 2013 paycheck, either the paperwork to authorize the payment was not sent to your Payroll Office or your Payroll Office has questions about the paperwork. In any case, the affected faculty member will have forty (40) days from April 19, 2013 to file a grievance if he or she has not received a distance education payment or disputes the amount paid. This means that such grievances must be filed at Step Two for the Grievance Procedure by no later than September 30, 2013 (Summer Extension), in order to be considered timely. APSCUF/SU College Level Student Awards Faculty are reminded to please announce to your students that APSCUF/SU is once again giving the THREE College level awards of $500 each. These awards are named in honor of three of our past active union members: College of Arts & Sciences- the Bob Winter Award; College of Business – the Bill Knerr Award; and College of Education & Human Services – the Sally McGrath Award. APSCUF/SU Departmental Awards Faculty are also reminded that APSCUF/SU will continue to provide funding for the departmental student awards so that each department can recognize the achievements of its’ students. Each year all 26 academic departments are given $200 which can be awarded to undergraduate or graduate students for their talents, academic accomplishments, and service. Each department can decide how to allocate the money. Also, each department will develop its own application, nomination, and selection procedures. All money must be expended to the students by the departments in the academic year that it is given to the departments by APSCUF. You must submit a letter declaring your intent to apply for tenure to the President of the University by May 1, 2013. In this letter you explain why you should be granted tenure. 2. Also by May 1, 2013, you must submit a copy of that letter, the signed Candidacy for Tenure form (attached) and your package of supporting documentation (Tenure dossier) to your department. 3. After departmental review, obtain original letters of support from the Department PAC and department chairs as well as their signatures on the Candidacy for Tenure Form. You must deliver these documents along with your application packet (i.e. Tenure dossier) to the University Tenure Committee on or before 4:00 pm, October 1, 2013. 4. Also by October 1, 2013, your department chair and DPAC chair should forward copies of their support letters to the President and the Provost. 5. The University-Wide Tenure Committee will review applications and make its recommendation to the President by November 1, 2013. Sign up is on a first to respond/first served basis. The fundraisers usually look for a foursome but sometimes less or more.
