RESOLUTION NO. 96-7893
A RESOLUTION GRANTING VARIANCE PETITION 96-V22, IN ORDER TO PERMIT A VARIANCE
FROM THE LIMITATION ON COMPACT CAR SPACES FOR THE ROBB & STUCKY STORE, LOCATED
AT 2777 9TH STREET NORTH, MORE PARTICULARLY DESCRIBED HEREIN; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Section 106-103(b)(3) of the Code of Ordinances permits a maximum of
10% of the total required off-street parking spaces to be designated
as compact car spaces; and
WHEREAS, Robb & Stucky has petitioned for a variance in order to permit 20%
of the required off-street parking spaces to designated as compact
car spaces; and
WHEREAS, the Planning Advisory Board, following an advertised public hearing,
considered the public input and the recommendation of staff, and
recommended by a vote of 7 to 0 that Variance Petition 96-V22 be
approved; and
WHEREAS, after considering the recommendation of the Planning Advisory Board
and providing the petitioner an opportunity to speak, the City
Council finds that the petition should be granted;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NAPLES, FLORIDA:
Section 1. That Variance Petition 96-V22 is hereby granted, in order to permit
a variance from the limitation on compact car spaces for the Robb &
Stucky store, located at 2777 9th Street North, more particularly
described as:
Moorings Unit 3, Block 1, Lot 3, as recorded in Official
Records Book 240, Page 112, of the Public Records of
Collier County, Florida; Moorings Unit 3, Block 1, Lot
2, as recorded in Official Records Book 867, Page 112,
of the Public Records of Collier County, Florida; and
Moorings Unit 3, Block 1, Lot 1E, 225 feet less right of
way as recorded in Official Records Book 1694, Page 737,
of the Public Records of Collier County, Florida.
Section 2. This resolution shall take effect immediately upon adoption.
PASSED IN OPEN AND REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF NAPLES,
FLORIDA, THIS 18TH DAY OF DECEMBER, 1996.
