Section 12(1) of the Freedom of Information Act states that a public authority is not obliged to comply
with a request for information if the authority estimates that the cost of complying with the request
would exceed the “appropriate limit”. For Police forces in the UK, the "appropriate limit" is considered
to be up to 18 hours of work on one request. This information is given in the Freedom of Information
(Fees and Appropriate Limit) Regulations 2004.
It is estimated that it will take more than 31 hours to provide an answer to this request.
To provide you with information in response to your questions concerning ‘gross misconduct’ we would
have to manually read through each individual case file that we hold. We have 188 case files and it is
estimated that it would take a minimum of 7 minutes to read an individual case file. This time is added
to a period of 10 hours work that has already been spent on researching other parts of your request.
188 case files x 7 minutes = 1,316 minutes (21.9 hours)
I am not able to suggest any method by which your request could be pared down to allow us to provide
information to this part of your request that is within the cost limits allowed under the Freedom of
Information Act.
Although excess cost removes the force’s obligation under the Freedom of Information Act, as a
gesture of goodwill, I have supplied information, relative to your request, that was retrieved or
available before it was realised that the fees limit would be exceeded. I trust this is helpful, but it does
not affect our legal right to rely on the fees regulations for the remainder of the request.
