ADMINISTRATION OF ESTATES ACT.
Act No. 40, 1954.
An Act to amend the law of intestacy; for this
and other purposes to amend the Wills,
Probate and Administration Act, 1898,
the Testator's Family Maintenance and
Guardianship of Infants Act, 1916, and
certain other Acts in certain respects; and
for purposes connected therewith. [Assented
to, 6th December, 1954.]

E it enacted b y t h e Queen's Most Excellent Majesty,
b y a n d with t h e advice a n d consent of t h e Legis­
lative Council a n d Legislative Assembly of New South
Wales in P a r l i a m e n t assembled, a n d b y t h e a u t h o r i t y of
the same, as follows :—
1. (1) T h i s A c t m a y be cited as the " A d m i n i s t r a t i o n
of E s t a t e s Act, 1 9 5 4 . "
(2) T h e Wills, P r o b a t e a n d A d m i n i s t r a t i o n Act,
1898, a s amended by subsequent Acts a n d by this Act,
m a y be cited a s the Wills, P r o b a t e a n d A d m i n i s t r a t i o n
Act, 1898-1954.
(3) T h e T e s t a t o r ' s F a m i l y M a i n t e n a n c e a n d Guar­
d i a n s h i p of I n f a n t s Act, 1916, a s a m e n d e d b y subsequent
A c t s a n d b y t h i s Act, m a y be cited as the T e s t a t o r ' s
F a m i l y Maintenance a n d G u a r d i a n s h i p of I n f a n t s Act,
1916-1954.
(4) T h e Public T r u s t e e Act, 1913, a s amended by
subsequent A c t s a n d by this Act, m a y be cited a s the
Public T r u s t e e Act, 19i3-1954.
(5) T h e Conveyancing Act, 1919, as a m e n d e d by
subsequent Acts a n d by this Act, m a y be cited as the
Conveyancing Act, 1919-1954.

(6) T h i s Act shall commence u p o n t h e first d a y of
J a n u a r y , one t h o u s a n d nine h u n d r e d a n d fifty-five.
2 . (1) T h e Wills, P r o b a t e a n d A d m i n i s t r a t i o n
1898-1947, is a m e n d e d —
( a ) b y i n s e r t i n g n e x t a f t e r section sixty-one
following n e w D i v i s i o n : —

49. (1) Subject a s aforesaid, a n d subject to
t h e p r o v i s i o n s of sections fifty, fifty-two and
fifty-three
of this Act, t h e r e a l a n d p e r s o n a l
e s t a t e , v e s t i n g a s aforesaid, as to which a n y
p e r s o n (in t h i s section r e f e r r e d to a s " t h e
i n t e s t a t e " ) dies i n t e s t a t e shall—
( a ) be held by t h e a d m i n i s t r a t o r on in­
testacy, or in t h e case of p a r t i a l intes­
t a c y by t h e executor or a d m i n i s t r a t o r
with the will annexed, as t h e case m a y
be—
(i) as to the
estate—

t r u s t u n d e r this section; a n d
in default of a n y p e r s o n t a k i n g a n in­
t e r e s t u n d e r p a r a g r a p h (a) of this sub­
section or u n d e r section fifty of this
Act, belong to the Crown as bona
vacantia.
T h e C r o w n m a y , out of any p r o p e r t y
devolving upon it u n d e r this p a r a g r a p h ,
p r o v i d e , in accordance with existing
p r a c t i c e , for d e p e n d a n t s , w h e t h e r kin­
d r e d or not of the i n t e s t a t e , and o t h e r
p e r s o n s for whom the i n t e s t a t e m i g h t
r e a s o n a b l y h a v e been expected to m a k e
provision.
(2)
(2) (a) W h e r e u n d e r this section r e a l
a n d p e r s o n a l e s t a t e of a n i n t e s t a t e or a n y p a r t
thereof is directed t o be held in s t a t u t o r y t r u s t
for the issue of the i n t e s t a t e , the same shall
be held u p o n the following t r u s t s , n a m e l y : —
(i) I n t r u s t , in equal s h a r e s if m o r e than
one, for all or a n y the children or child
of the i n t e s t a t e , living a t the d e a t h of
the i n t e s t a t e , a n d for all or a n y of the
issue living a t t h e d e a t h of t h e i n t e s t a t e
of a n y child of the i n t e s t a t e who pre­
deceases the i n t e s t a t e , such issue to
take t h r o u g h all d e g r e e s , according to
t h e i r stocks, in equal s h a r e s if m o r e
t h a n one, the s h a r e which t h e i r p a r e n t
would have t a k e n if living a t the death
of the i n t e s t a t e , a n d so t h a t no issue
shall take whose p a r e n t is living at the
death of the i n t e s t a t e a n d so capable
of taking.
(ii) W h e r e the real a n d p e r s o n a l e s t a t e of
the i n t e s t a t e held in s t a t u t o r y t r u s t for
issue is divisible i n t o s h a r e s , then any
money or p r o p e r t y which, by w a y of
a d v a n c e m e n t or on the m a r r i a g e of a
child of the i n t e s t a t e , h a s been p a i d to
such child by the i n t e s t a t e or settled by
the i n t e s t a t e for the benefit of such
child (including a n y life or less interest
a n d including p r o p e r t y covenanted to
be p a i d or settled) shall, subject t o a n y
c o n t r a r y i n t e n t i o n e x p r e s s e d or appear­
ing from the circumstances of the case,
be taken as b e i n g so p a i d or settled
in or t o w a r d s satisfaction of the
s h a r e of such child or the s h a r e
which such child would h a v e t a k e n
if living a t t h e d e a t h of the intes­
tate, a n d shall be b r o u g h t into account,
a t a v a l u a t i o n ( t h e value to be reck­
oned a s a t the d e a t h of the i n t e s t a t e ) ,
in accordance with the r e q u i r e m e n t s of
the
the a d m i n i s t r a t o r , executor or a d m i n i s ­
t r a t o r with the will annexed, as the case
m a y be.
This subparagraph
applies
only
where the i n t e s t a t e dies totally intes­
t a t e or, t h o u g h leaving a will, dies
i n t e s t a t e as to the complete beneficial
i n t e r e s t in his r e a l a n d p e r s o n a l estate.
(b) W h e r e u n d e r t h i s section r e a l
a n d p e r s o n a l e s t a t e of a n i n t e s t a t e or a n y p a r t
thereof is directed to be held in s t a t u t o r y t r u s t
for a n y class of r e l a t i v e s of the i n t e s t a t e , other
t h a n issue of the i n t e s t a t e , t h e same shall be
held in t r u s t c o r r e s p o n d i n g to the s t a t u t o r y
t r u s t for the issue of t h e i n t e s t a t e (other t h a n
the provision for b r i n g i n g a n y money or
p r o p e r t y into account) a s if such t r u s t (other
t h a n as a f o r e s a i d ) w e r e r e p e a t e d w i t h the
s u b s t i t u t i o n of references to the m e m b e r s or
m e m b e r of t h a t class for references to the
children or child of t h e i n t e s t a t e .
(3) No executor a s such shall be entitled
to take beneficially a n y residue n o t expressly
disposed of by the will of the t e s t a t o r , unless
it a p p e a r s by the will t h a t the executor is
intended so to take.
(4) A h u s b a n d a n d wife shall for all pur­
poses of d i s t r i b u t i o n or division u n d e r the
foregoing p r o v i s i o n s of this section be t r e a t e d
a s two p e r s o n s .
(5) References in this section a n d in sec­
tion fifty of this A c t to a child or issue living
a t the d e a t h of a n y p e r s o n include a child
or issue en v e n t r e sa m e r e a t the death.
50. (1) Subject to subsection two of this
section, a n y h u s b a n d o r wife shall be entitled
on the d e a t h of t h e other (in t h i s section
referred
r e f e r r e d to a s " t h e i n t e s t a t e " ) , as to the
p r o p e r t y as to which he or she dies i n t e s t a t e ,
to t h e following s h a r e s o n l y : —
(a) w h e r e t h e r e is issue living a t the d e a t h
of the i n t e s t a t e —
(i) in the case w h e r e such issue com­
p r i s e s or includes two or m o r e
children of the i n t e s t a t e , to onet h i r d s h a r e of such p r o p e r t y ;
(ii) in a n y o t h e r case, to one-half
s h a r e of such p r o p e r t y .
(b) where t h e r e is no issue living a t the
d e a t h of the i n t e s t a t e , a n d in case of
t o t a l intestacy—
(i) where the net value of
e r t y of the i n t e s t a t e
exceed the sum of t h r e e
p o u n d s , to the whole
property;

p r o p e r t y exceeds the sum of

the d a t e of the d e a t h until pay­
ment a t the r a t e of four p o u n d s
p e r centum p e r a n n u m shall be a
c h a r g e upon the whole of such
p r o p e r t y ; a n d in addition t h e r e t o
to one-half s h a r e of the residue
of such p r o p e r t y after the p a y ­
m e n t of such sum of three
t h o u s a n d p o u n d s a n d interest, if
any.
(c) where t h e r e is no issue living at the
d e a t h of the i n t e s t a t e a n d in case of
p a r t i a l intestacy, to one-half s h a r e of
such p r o p e r t y .
(2)
( 2 ) N o t h i n g in subsection one of this
section affects a n y i n t e r e s t t h a t the s u r v i v i n g
h u s b a n d o r wife m a y be entitled to u n d e r
p a r a g r a p h ( a ) of subsection one of section
forty-nine of this A c t in default of a n y
other person taking an interest under that
paragraph.
5 1 . ( 1 ) W h e r e , on o r after the first d a y of
J a n u a r y , one t h o u s a n d nine h u n d r e d a n d fiftyfive, the m o t h e r of a n illegitimate child dies
i n t e s t a t e a s r e s p e c t s all o r a n y of h e r r e a l or
p e r s o n a l p r o p e r t y , a n d does not leave any
l e g i t i m a t e issue h e r s u r v i v i n g , the ille­
g i t i m a t e child, or, if he is dead, his issue, shall
be entitled to take a n y i n t e r e s t t h e r e i n to
which he or such issue would h a v e been en­
titled if he h a d been b o r n legitimate.
( 2 ) W h e r e , on or a f t e r the first d a y of
J a n u a r y , one t h o u s a n d nine h u n d r e d a n d
fifty-five, a n illegitimate child dies i n t e s t a t e
in respect of all or a n y of his r e a l or p e r s o n a l
p r o p e r t y , his m o t h e r if s u r v i v i n g shall be
entitled to t a k e a n y i n t e r e s t therein to which
she would h a v e been entitled if the child had
been b o r n legitimate and she h a d been the
only s u r v i v i n g p a r e n t .
(b) by i n s e r t i n g in section one next after the m a t t e r
r e l a t i n g to Division 2 of P a r t I I the following:—

( 2 ) ( a ) T h e Public T r u s t e e Act, 1 9 1 3 - 1 9 4 2 , is
amended by o m i t t i n g p a r a g r a p h s (b) a n d (c) of
subsection one of section t h i r t y - t h r e e .
(b) T h e a m e n d m e n t m a d e by p a r a g r a p h ( a ) of
this subsection does not a p p l y to or in respect of an in­
t e s t a t e or deceased p e r s o n who died before the commencement of this Act.
(c)
(c) S a v e as p r o v i d e d in this subsection n o t h i n g
in this section affects the o p e r a t i o n of the Public T r u s t e e
Act, 1913-1954.
(3) T h e
amended—
Conveyancing
Act,
1919-1953,
is
(a) by i n s e r t i n g in subsection one of section t h i r t y t h r e e after the w o r d s " t h i s A c t " the words
" b u t before the commencement of the Adminis­
t r a t i o n of E s t a t e s Act, 1 9 5 1 " ;
(b) b y i n s e r t i n g in the same subsection after the
w o r d s " l a s t m e n t i o n e d A c t " the w o r d s " a s in
force immediately before the commencement of
the A d m i n i s t r a t i o n of E s t a t e s Act, 1 9 5 4 " ;
(c) b y i n s e r t i n g next after the same subsection the
following new subsection:—
(1A) W h e r e , u n d e r the t e r m s of a n y i n s t r u ­
ment coming into o p e r a t i o n after the commence­
m e n t of the A d m i n i s t r a t i o n of E s t a t e s Act, 1954,
a n y p r o p e r t y vests in—
( a ) the h e i r s of a n y p e r s o n ; or
(b) the n e x t of kin of a n y p e r s o n ; or
(c) the next of kin of a n y p e r s o n to be
d e t e r m i n e d in accordance with the
Wills, P r o b a t e a n d A d m i n i s t r a t i o n Act,
1898,
the p r o p e r t y shall vest in the p e r s o n s who on
the d e a t h of such p e r s o n i n t e s t a t e would be
beneficially entitled to his r e a l a n d p e r s o n a l
e s t a t e u n d e r Division 2A of P a r t I I of the said
lastmentioned Act, a n d in the same s h a r e s :
P r o v i d e d t h a t the s h a r e of the h u s b a n d or
wife of such p e r s o n shall be as follows:—
(a) w h e r e t h e r e is issue s u r v i v i n g —
(i) in the case w h e r e such issue
comprises or includes two or
m o r e children of such p e r s o n ,
one-third
share
of
the
property;
(ii)
(ii) in a n y o t h e r case, one-half
s h a r e of the p r o p e r t y ;
(b) w h e r e t h e r e is no issue surviving, onehalf s h a r e of the p r o p e r t y .
3 . T h e Wills, P r o b a t e a n d A d m i n i s t r a t i o n Act, 1 8 9 8 1 9 4 7 , is f u r t h e r a m e n d e d —
( a ) by o m i t t i n g from section t h i r t y t h e w o r d s
" d e p o s i t e d a n d p r e s e r v e d a t the S u p r e m e Court­
house or a t such o t h e r one place in Sydney u n d e r
the control of the C o u r t a s the G o v e r n o r m a y
by notice in the Gazette d i r e c t , " a n d b y
i n s e r t i n g in lieu thereof the w o r d s " p r e s e r v e d
u n d e r the control of the C o u r t in such m a n n e r as
the P r o b a t e J u d g e m a y d i r e c t , " ;
(b) by i n s e r t i n g in section t h i r t y - s i x after the w o r d s
" a D e p u t y R e g i s t r a r " the w o r d s " o r D e p u t y
Registrars";
(c) b y omitting from section t h i r t y - e i g h t t h e w o r d s
" T h e D e p u t y R e g i s t r a r " a n d b y i n s e r t i n g in
lieu thereof the w o r d s " A D e p u t y R e g i s t r a r " ;
(d) by i n s e r t i n g next after p a r a g r a p h (c) of section
f o r t y - t h r e e the following new p a r a g r a p h s : —
(ci) the m a k i n g of special o r d e r s u n d e r sub­
sections one, ( 1 A ) a n d two of section
eighty-five of t h i s A c t a n d the m a k i n g
of o r d e r s u n d e r subsection four of t h a t
section;
(cii) t h e o r d e r i n g of a n executor, a d m i n i s t r a ­
t o r or t r u s t e e , summoned before the
court u n d e r subsection two of section
eighty-seven of this Act, to file an in­

ceased p e r s o n shall file or file a n d p a s s his
accounts r e l a t i n g t h e r e t o within such time,
a n d from time to time, a n d in such m a n n e r
a s m a y be fixed b y the rules of Court, or as
the C o u r t m a y specially o r d e r .
N o t h i n g in this subsection affects the
o p e r a t i o n of section 35A of t h e Public
T r u s t e e Act, 1913-1954.
(ii) by i n s e r t i n g a t the end of the same section
the following new subsection:—
(4) W h e r e t h e Court, in p a s s i n g any
such accounts, disallows in whole or in p a r t
the a m o u n t of a n y disbursement, the C o u r t
m a y o r d e r the executor, a d m i n i s t r a t o r or
t r u s t e e to refund the a m o u n t disallowed to
the estate of the deceased.

in lieu thereof the w o r d s " , a d m i n i s t r a t o r or
trustee";
(iii) by o m i t t i n g from subsection two of the same
section the w o r d s " o r a d m i n i s t r a t o r " and
by i n s e r t i n g in lieu thereof the w o r d s " , ad­
m i n i s t r a t o r or t r u s t e e " :
(iv) by i n s e r t i n g in the same subsection after
the w o r d " w h y " the w o r d s " , in the case
of an executor or a d m i n i s t r a t o r , " ;
(v) by i n s e r t i n g a t the end of the same sub­
section the w o r d s " o r , in the case of a
t r u s t e e , he should not be o r d e r e d to file or
file a n d p a s s such accounts in t h e C o u r t
forthwith";
(vi) by o m i t t i n g from subsection t h r e e of the
same section the w o r d s "or a d m i n i s t r a t o r "
a n d by i n s e r t i n g in lieu thereof the w o r d s
" , a d m i n i s t r a t o r or t r u s t e e " ;
( g ) by o m i t t i n g from section eighty-eight the w o r d s
"or a d m i n i s t r a t o r " a n d b y i n s e r t i n g in lieu
thereof the w o r d s " , a d m i n i s t r a t o r or t r u s t e e " ;

C o u r t , " a n d by i n s e r t i n g in lieu thereof the
words " s o l i c i t o r s of the S u p r e m e C o u r t , commissioners for t a k i n g affidavits";
(1) by omitting subsection two of section one
h u n d r e d a n d fifty-four a n d by i n s e r t i n g in lieu
thereof the following subsection:—
(2) All such rules shall—
(a) be published in the G a z e t t e ;
(b) take effect from the d a t e of publication
or from a l a t e r d a t e to be specified in
the r u l e s ; and
(c) be laid before both H o u s e s of P a r l i a
m e n t within fourteen s i t t i n g d a y s after
the publication thereof if P a r l i a m e n t
is in session, a n d if not, then within
fourteen sitting d a y s after the com­
mencement of the next session.
If either H o u s e of P a r l i a m e n t p a s s e s a

4 . (1) T h e T e s t a t o r ' s F a m i l y Maintenance

G u a r d i a n s h i p of i n f a n t s Act, 1916-1938, is a m e n d e d —
( a ) (i) b y i n s e r t i n g in subsection (1A) of section

w o r d s " ( h e r e i n a f t e r called ' t h e intes­

(ii) by o m i t t i n g from the same subsection the
w o r d s " t h e provisions of sections fifty a n d
fifty-one of the Wills, P r o b a t e a n d A d m i n i s
t r a t i o n Act, 1898-1938," a n d by i n s e r t i n g in

w o r d " i s " a n d by i n s e r t i n g in lieu thereof
the w o r d s " , or children, or a n y or all of
them, a r e " ;
(iv) by o m i t t i n g from the s a m e subsection the
w o r d s " h e r p r o p e r m a i n t e n a n c e , " a n d by
i n s e r t i n g in lieu thereof the w o r d s " t h e i r
p r o p e r m a i n t e n a n c e , education, or advance­
m e n t in life as the case m a y b e , " ;
(v) by i n s e r t i n g in the same subsection after
the w o r d s " s u c h w i d o w , " the w o r d s " o r
children, or a n y of t h e m , " ;
(vi) by i n s e r t i n g in the same subsection after
the w o r d " m a i n t e n a n c e " w h e r e lastly
occurring the words
" , education, a n d
advancement";

(vii) by inserting a t the end of t h e same sub­
section the w o r d s —
In this subsection " c h i l d r e n " includes
children (being u n d e r the age of twenty-one
y e a r s a t the death of the i n t e s t a t e ) of any
child of the i n t e s t a t e who died before the
intestate.
(b)
(b) by o m i t t i n g subsection two of section four a n d
by i n s e r t i n g in lieu thereof the following sub­
section :—
(2) A n y o r d e r m a d e u n d e r subsection (1A)
of section t h r e e of this A c t in respect of the
e s t a t e of a deceased p e r s o n shall, subject to this
Act, o p e r a t e a n d take effect a s a modification of
the provisions of the Wills, P r o b a t e a n d Adm i n i s t r a t i o n Act, 1898, as a m e n d e d by subse­
quent Acts, t h a t a r e applicable to the distribu­
tion of t h a t e s t a t e as on intestacy.
(c) (i) by o m i t t i n g the proviso to subsection one of
section five;
(ii) b y i n s e r t i n g n e x t after subsection two of
the same section the following new subsec­
tion :—
(2A) N o t w i t h s t a n d i n g a n y t h i n g in sub­
sections one a n d two of this section—
( a ) the time for m a k i n g a n application
u n d e r either of those subsections may
be extended for a f u r t h e r p e r i o d by
the court, a f t e r h e a r i n g such of the
p a r t i e s affected a s t h e c o u r t thinks
necessary, a n d t h i s p o w e r extends to
cases w h e r e the time for a p p l y i n g
h a s a l r e a d y expired, including cases
w h e r e it h a s e x p i r e d before the com­
mencement of the A d m i n i s t r a t i o n of
E s t a t e s Act, 1954; b u t e v e r y applica­
tion for extension shall be m a d e
before the final d i s t r i b u t i o n of t h e
estate, a n d no d i s t r i b u t i o n of any
p a r t of the e s t a t e m a d e before the
application shall be d i s t u r b e d by
reason of the application or of an
order made thereon;
(b)
(b) if, in any case to which the provision
of subsection one of section t h r e e of
this A c t a p p l y , all the children a n d
the widow or widower, as the case
m a y be, shall in writing, a t a n y time
after the d e a t h of the t e s t a t o r ,
w h e t h e r the t e s t a t o r died before
or after the commencement of t h e
A d m i n i s t r a t i o n of E s t a t e s Act, 1954,
a g r e e to be bound by the will of the
t e s t a t o r a n d if t h e r e a r e infants such
a g r e e m e n t is confirmed by the Court,
t h e n no application shall be m a d e
t h e r e a f t e r u n d e r t h a t subsection;
(c) if, in a n y case to which the provisions
of subsection (1A) of section t h r e e
of this A c t a p p l y , all the children a n d
the widow shall in w r i t i n g , at a n y
time after the d e a t h of the i n t e s t a t e ,
w h e t h e r the i n t e s t a t e died before or
after the commencement of the
A d m i n i s t r a t i o n of E s t a t e s Act, 1954,
a g r e e to be bound by the p r o v i s i o n s
of t h e Wills, P r o b a t e a n d A d m i n i s t r a ­
tion Act, 1898, as a m e n d e d by
subsequent A c t s , t h a t a r e applicable
to the d i s t r i b u t i o n of the i n t e s t a t e ' s
e s t a t e as on i n t e s t a c y a n d if t h e r e a r e
infants such a g r e e m e n t is confirmed
by t h e court, then no application
shall be m a d e t h e r e a f t e r u n d e r t h a t
subsection.
I n t h i s p a r a g r a p h " c h i l d r e n " in­
cludes children (being u n d e r the age
of twenty-one y e a r s a t the death of
the i n t e s t a t e ) of a child of the intes­
t a t e who died before the i n t e s t a t e .
(2) (a) T h i s subsection shall be r e a d and con­
s t r u e d a s one with subsection (1A) of section t h r e e of the
T e s t a t o r ' s F a m i l y Maintenance and G u a r d i a n s h i p of
I n f a n t s Act, 1916-1954.
(b)
(b) The amendments made by paragraph (a)
of subsection one of this section apply in all cases,
whether the intestate died before or after the commencement of this Act:
Provided that no distribution of any part of the
estate of an intestate tbat has been made before
that commencement shall be disturbed by reason of any
application made by virtue of those amendments or by
reason of any order made on any such application.
