At the information meeting Thursday the 30th of October 2014 it
was stated that the tender strategy was 3 construction contracts

After the feedback from the technical dialogue, a more detailed
assessment for the construction schedule and the logistics of the
project it was concluded to be more beneficial with 2 contracts:

II.1.5) Short description of the contract
•
A concrete high bridge crossing the fjord with embankments
•
A total strech of around 8 km.
•
Throughout the recreational housing area on Tørslev Hage the
road is to be built between sheet piles on about 0.5 km long
stretch.
•
Around 10 smaller structures
•
The fjord is a Natura 2000 area.
•
Very nature sensitive areas and densely populated cottage area
•
D&B contract.
III.1.3) Legal form for applicants
•
As a general rule no particular legal form is required, however
•
Consortia og JV’s
•
•
If a group of economic operators (e.g. a consortium or JV) applies, the
members of the group must undertake joint and several liability and appoint
a joint representative.
•
Due to restrictions in the Danish public procurement rules based on the
case law regarding changes in the composition of a prequalified applicant
prior to submission of tender, all interested operators are encouraged to
explore the possibilities of forming consortia prior to the deadline for
submission of prequalification application.
Subcontractors or other entities
•
If the applicant relies on the capacity of other entities, the applicant must
provide proof that the applicant has at its disposal the necessary resources.
•
The DRD has provided a form which can be used for such declaration. The
form is published on the Supplier Portal in Danish and English
III.2.1) Information of the applicant
•
Information of the company:
•
The full name of the business, address, business reg. no. (CVR no.),
corporate form and ownership, including information about affiliated
companies.
•
•
Furthermore, the name, telephone and e-mail address of the contact person of the
applicant should be stated.
•
It should be clearly stated in the application which legal entity is
applying for prequalification
•
If the applicant several companies the information must be stated for
each company, and it should be clearly stated in the application
whether they apply as a consortium, JV or as supplier.
If the applicant is a group of operators or the applicant relies on
the capacity of other entities, a change of the composition of the
applicant may only take place with the contracting authority’s prior
written acceptance.
III.2.2) Economic and financial ability
•
•
The applicant must provide a solemn declaration regarding the
total annual turnover for the 3 most recent financial years
available.
•
The solemn declaration must either be certified by auditors or a copy of the
three most recent financial statements must be enclosed.
•
For a group of operators (e.g. a consortium), the information must be
submitted for each participating operator in the group.
The minimum requirement is:
•
A total annual turnover of at least DKK 2 billion in each of the three
most recent financial years available.
•
For groups, consortia's, JV’s or other entities the turnover is calculated
as the total turnover.
III.2.3) Technical capacity - Minimum requirements
•
The applicant must have experience in turnkey contracts – design and
build – of the following types of tasks:
•
Construction works in Natura 2000 protected areas/sites
•
Road bridge with a total length of 500 m.
•
Bridge over open water, rivers or lakes with total length of 500 m.
•
Bridge with spans of 40 meters and with a total length of 500 m.
•
Foundation works below water
•
Construction of roads with total length of 3 km.
•
Pooling of projects can be accepted as long as the minimum requirement
of each individual bullet is complied with by one single project.
•
If the applicant is a group of operators or relies on the capacity of other
entities, the minimum requirement will be complied with if the references,
overall show experience with the types of tasks required.
III.2.3) Technical capacity (cont.)
•
The references can not be more than 5 years old due to the rules
in the currently in force Public Procurement Directive
•

or more of the following means according to the nature, quantity or importance,
and use of the works, supplies or services:”

IV.1.2) Limitations on the number
of operators who will be invited to tender or to participate:
•
A number of 5 applicants will be prequalified
•
The limitation of applicants invited to tender will take place after
the evaluation of which applicants have documented the most
relevant references/deliveries of the services covered by the
contract, see section II.1.5).
•
Please note that each applicant should only submit one
application for the prequalification, see section VI.3)
IV.3.6) Language
•
As a general rule the application must be submitted in Danish or
English
•
The exception to the general rule is that annexes to the
prequalification application in Norwegian or Swedish will be
accepted. E.g. but not comprehensive.

Competitive dialogue
•
Background
•
An important and complex infrastructural project in very sensitive
surroundings
•
The very sensitive surroundings must be accommodated in the best
possible way with as little an effect as possible
•
A very fruitful and giving technical dialogue has made the Danish Road
Directorate more knowledgeable of different technical and legal
solutions
•
The Danish Road Directorate and our principal consultant has
obtained more knowledge about the complexity of the project e.g. the
soil conditions, which will lead to the basis of the competitive dialogue
•
The tender material needs to be tested to ensure no new, smart or
innovative solutions is ruled out
•
A traditional tender process could create a greater risk for
misconceptions og discrepancies in a project of this complexity
Competitive dialogue (cont.)
•
The purpose of the competitive dialogue is to:
•
Clarify the technical, legal and financial solutions the market can
offer
•
To accommodated the very sensitive surroundings
•
Minimizing the complexity of the project and clarify risks
•
After the more thorough considerations within the project group
and the many excellent technical and legal inputs in the technical
dialogue, the Danish Road Directorate wishes to ensure the most
market-conforming tender material with the proportionate degree of
freedom
•
To ensure the needs and requirements of the Danish Road
Directorate can be fulfilled within an acceptable financial
framework
•

Competitive dialogue (cont.)

As for now the Danish Road Directorate expects:
•
Two rounds of competitive dialogue
•

Possibility of a third round
•
DRD will set out the themes for the dialogue to ensure that the
time management and the costs for the contractors are kept down

A fee is given for participating in the rounds of competitive dialogue
•
There will be a possibility for a reduction of the number of
operators during the competitive dialogue as per Contract Notice
IV.1.3)
DRD are aware that the cost of this procedure is higher but intend
to keep the costs for the contractors as low as possible
Language
•
The language of the contract is Danish
•
Working language will be Danish and/or English
•
The tender material will be in Danish and English

The Danish documents will be supported by as a English service

If discrepancies the Danish version is the contractually legal

III.1.5) Deposits and guarantees required

A bid bond of DKK 50 million must be provided after award of
contract but before the signing of the contract.

The bid bond will be replaced by the performance guarantee. The
guarantee must be provided by a third party. No possibility for
Parent Company Guarantee (PCG)

The bind bond will be superseded by the ABT § 6 guarantee

A performance guarantee of 15 % of the contract sum must be
provided after signing of the contract as per ABT § 6.

A requirement is made for the level of the guarantor’s credit rating

The requirement will continue in the contract. The rules here for
will be given in the tender material.
The purpose of the guarantees and the rating of the guarantor is
a wish to ensure that DRD if needed can make use of the
guarantee in all stages of the project.
