101518 Advert T&Cs.pdf 1 11/04/2011 12:40 BCLB 1672 TERMS OF ENTRY The following terms and conditions apply exclusively to the aforementioned promotion and all participants in the promotion are deemed to have read, understood and accepted the same: ELIGIBILITY 1. This promotion is restricted to persons over the age of eighteen (18) years only. 2. Employees of East African Breweries Ltd Group of companies (KBL, UDV, EAML, CGI) its distributors and stockists, MCL Saatchi & Saatchi Ltd, Smart printers Ltd, Ogilvy PR Ltd, Metal Crown Ltd, PricewaterhouseCoopers, Mobile Planet Ltd and any other supplier or third party directly involved with the facilitation of this promotion, and their immediate families, are not eligible to participate in the promotion. PROMOTION PERIOD 3. The promotion will run will run from 4th April to 15th June 2011. 4. East African Breweries Limited in conjunction with the Betting Control and Licensing Board reserves the right to change the promotional dates as it deems fit. HOW TO PARTICIPATE 5. The Promotion will be open to consumers who are already taking Guinness in the participating bar. 6. There are 100 participating outlets countrywide divided into 10 Zones made up of 10 outlets each. 7. Each bar will hold Guinness Football Quizzes every Wednesday for 10 weeks. 8. To enter the Guinness Football Wednesdays Quiz, loyal Guinness consumers must register in one of these participating outlets. 9. Participants can play in any bar in their Zone. The participating bars and their respective groupings into Zones will be published in a leading newspaper. 10. Teams must comprise a minimum of 1 person and a maximum of 6 people. 11. Once registered, teams can play in any bar in their Zone and accumulate points to their running total. 12. Team captains must show their registration cards at each quiz. Until week 8, the team members can vary as long as the team captain is present. DRAW AND SELECTION OF WINNERS 13. The various prizes are: • Branded T-shirts • Branded caps • Branded footballs • A trip to Brazil – Grand Prize 14. The top three winning teams in every outlet every week will receive branded footballs, branded Tshirts and branded caps, in that order. 15. Each week, there will be a maximum of 100 points available. The top scoring team after 9 weeks is the Zone winner and will go through to the national final to play the other Zone winners. 16. The finals will be held at a venue selected by the Guinness team. 17. The team members may not be changed from week 8 of the campaign. 18. The team members that play in the national final must have represented their team from week 8 onwards. 19. East African Breweries Limited reserves the right to change participating outlets at any point in the promotion. 20. After the tallying of points by the independent BTL agency (Swivel Ltd) and selection of the team with the highest points is done, the decisions made on the same by East African Breweries Limited (EABL) and Betting Control and Licensing Board (BCLB), shall be final and binding. Weekly winners will be communicated to immediately and awarded their prizes at the end of the quiz; if not available at the end of the quiz, they will be communicated to via a phone call. 24. By agreeing to participate in the promotion, all winners of the prizes agree that their name, picture, video footage and other details be made public in such media that EABL may choose, and that they will further agree to participate in all public relations and marketing activities of EABL, on such terms as EABL may require, without any additional consideration. 25. All the ownership and intellectual property rights in the footage and visuals taken of any participant, his/her family and surrounding onlookers is and shall at all times remain the sole property of EABL. 26. Use of the materials stated above shall be at EABL’s discretion and EABL shall be entitled to disclose any of the participant’s details for administering the promotion, marketing and researchrelated activities, fraud prevention and such other purposes as may be provided in the terms and conditions herein and the law. DISQUALIFICATION AND TERMINATION 27. The promotion is offered at the sole discretion of EABL and EABL reserves the right, subject to any discretion from the BCLB, to amend or vary these terms and conditions or to suspend/amend/terminate the promotion at any time. In case any of these circumstances arises, notice will be given by EABL through media advertisements. The notice will be effective immediately, or on such a date as shall be set out in such notifications. 28. On termination of this promotion for any reason, participants will be required to redeem their prizes within thirty (30) days after the termination date. 29. EABL reserves the right to terminate any participant’s participation in the promotion or their registration upon: • Detection of fraud or attempted fraud relating to the participant or their registration; or • Breach of any of these terms and conditions; or • Such circumstance as may be determined by EABL. 30. If participation in the promotion is terminated under any of the circumstances set out above, the participant will loose the right to redeem his/her prize and the same will be deemed to have been forfeited. In addition, EABL reserves the right to take appropriate legal action, as it deems necessary, and recover damages and other expenses incurred in pursuing such action. OTHER TERMS 31. This competition remains subject to the provisions of the Betting Lotteries and Gaming Act (Cap 131 Laws of Kenya) 1991 and all other applicable laws. Any disputes arising hereunder shall in the first instance be resolved in accordance with the aforementioned provisions. 32. All queries should be directed to the Customer Care Number: 8644014. 33. EABL reserves the right to amend and adjust the quiz format, questions and timings as it deems fit. 34. EABL reserves the right to amend the merchandise prizes as it deems fit at any point in the promotion. 35. EABL DOES NOT require you to send money, airtime or Mpesa funds, or any other consideration in order to participate or claim any prize in this promotion, and EABL will not be liable for any losses or other damage incurred by any person who does not heed this caution. 36. Although EABL has used reasonable efforts to ensure that all information and materials relating to the promotion are accurate, EABL shall not be liable for any inaccuracy or errors in such information and/or material. EABL, its agents and subcontractors will also not bear responsibility for any loss or damage to a participant, whether caused by themselves or any third party, arising from: • Matters outside the control of EABL, its agents and sub-contractors including, but not limited to, force majeure events such as acts of God, computer viruses, power outages etc. • Any technical failure or malfunction, or any other problem with any machine, telephone network or system, service provider, software or 21.
