 NOTICE OF REFUSAL OF
AN OFFICIAL PLAN AMENDMENT
BY THE COUNCIL OF THE
MUNICIPALITY OF MIDDLESEX CENTRE
TAKE NOTICE that the Council of the Municipality of Middlesex Centre refused an
application for official plan amendment by Tridon Group Ltd. on behalf of Don Black
Investments Ltd. on the 24th day of August, 2016 under section 22 of the Planning Act,
R.S.O. 1990, c. P.13, as amended. Council refused to amend the Middlesex Centre
Official Plan for the purposes of altering the land use schedule of Komoka-Kilworth and
the introduction of a special policy for the property at 10293 Glendon Drive that would
allow attached garages to protrude into front yards of residences. Council considered all
written and oral submissions received regarding this application, the effect of which
helped Council to make an informed decision.
AND TAKE NOTICE THAT a person or public body that requested an amendment to
the Official Plan of the Municipality of Middlesex Centre may appeal the refusal of the
requested amendment to the Ontario Municipal Board in respect of all or any part of the
requested amendment by filing a notice of appeal with the Clerk of the Municipality of
Middlesex Centre NOT LATER THAN the 15th day of September, 2016. An appeal to
the Ontario Municipal Board must be accompanied by a fee in the amount of $300.00
that is made payable to the Minister of Finance and filed with the Clerk of the
Municipality. The notice of appeal must set out the reasons for the appeal and be
submitted using the form available from the Ontario Municipal Board’s website:
http://elto.gov.on.ca/omb/. The decision of the Council of the Municipality of Middlesex
Centre is final if a notice of appeal is not received on or before the last day for filing a
notice of appeal.
No person or public body shall be added as a party to the hearing of the appeal unless,
before the requested official plan amendment was refused, the person or public body
made oral submissions at a public meeting, if any, or written submissions to the council
or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add
the person or public body as a party.

EXPLANATORY NOTE
THE PURPOSE OF THE OFFICIAL PLAN AMENDMENT APPLICATION is to change
the land use schedule for the Urban Settlement Area of Komoka-Kilworth as it relates to
the property at 10293 Glendon Drive. The effect of the amendment would be to change
the collector road and multi-use trail locations on the property; remove the aggregate
overlay; alter the park configuration; and to include a school location. A location map
and an illustration of the proposed changes are attached.
The proposed official plan amendment also includes a request to introduce the following
new special policy within the Middlesex Centre Official Plan that would apply only to the
subject land:
“5.7.4 d) i) Notwithstanding Section 5.7.4 d) private garages for residential development
shall be permitted to protrude to the street line a maximum of 3.0 metres from the
habitable portion or porch on the main floor of the building for all single detached
dwelling units and a maximum of 1.5 metres for attached dwelling units on lands
situated on Pt. Lot 7-8 Concession 1 (former Geographic Township of Lobo). The
subject lands are depicted on Draft Plan of Subdivision File # 39T1301.”
THE SUBJECT LAND IS LEGALLY DESCRIBED Part of Lots 7 and 8, Concession 1
(geographic Township of Lobo) in the Municipality of Middlesex Centre. The subject
land is located on the south side of Glendon Drive (County Road 14) and west of
Springfield Way in Kilworth.
THE LAND IS ALSO SUBJECT to draft plan of subdivision (County of Middlesex File
No. 39T-MC1301) and zoning by-law amendment applications that have been filed for
the development of low and medium density residential land uses together with
commercial, parks and recreation as well as school uses. The applicant has appealed
the draft plan of subdivision and zoning by-law amendment applications to the Ontario
Municipal Board in accordance with Sections 51(34) and 34(11) of the Planning Act,
R.S.O. 1990, c. P.13, respectively (OMB Case No. PL160523).
