IN exercise of the powers conferred by sectio·n 36 of the Food Act 1983
[Act 281], the Minister makes the followi~g ·r egulations:
Citation and commencement
1. (1) These regulations may be. eited as the Contwl of Tobacco Product
(Amendment) (No. 2) Regulatio~s 2009.
(2) These Regulations come

Amendment of regulation 2
2. The Control of Tobacco Product Regulatio ns 2004 [PU. (A) 324/2004],
which are referred to as· the " principal Regulatio ns" in these Regulations, are
amended in regulation 2(a) by inserting -before the' definition of "public transport terminal" the
following definition:
' "retail selling price" means the retail selling price fp,r a
tobacco product as declared by the manufacturer pi: illlporter to
the. Director in accordance with regulation 8A ; '; an& ·
(b) by inserting after the definition of " healthcare professional'~ the
following de finition:
' "price promotion" means any approa~h nsed to promote,
directly or indirectly, the sale of a tobacco !>toduct that results
in the selling price for a unit of tobacco prpduct lower than the
retail selling price for that unit of tobac~ prod,u,ct;'.
New regulations 8A, 8s, 8c, 8n and 8E
3. T he principal Regulations are amended by inserting after regulation 8 the
following regulations:
"Declaration of retail selling price of tobacco product
8A. (1) Every mano.facturetor importer of a tobacco product sha ll declare
in writing to the Director-:-:(a) the retail sellin·g pri9e of any tobacco product, within fourteen
days a fter the date ofc;oming into operation of these Regulations;
and
(b) the retail selling price of a new tobacco product introduced after
the date of coming into operation of t hese Regulations within
fo urteen days prior to such introd uction,

and such retail selling pnce shall take effect from the date of the
declaration.
(2) The manufacturer or importer shall declare in writing to the
Director every time there are changes to the retail selling price o f any
tobacco product referred to in subregulation (1) d11e to the following
circumstances:
(a) any i ncrease in the retail selling
pric~ of the wb-acco product
resulting from an increase of excise d·tl't;y. or tax imposed on the
tobacco product within fourteen days after suq'b increase; or
(b) any adjustment of the retail seiti.ng price of the tobacco product
within fourteen days prior tQ that adjustment

(3) The adjustment of the n;ta.it selfulgpriee of tobacco product referred

(4) Any m.a,nnfacturer or importer who contravenes this regulation
commits ari offence and shall, on co nviction, be liable to a fine not
exceeding ten thousand ringgit or to imprisonment for a.tenn ·not exceeding
two years or to:b'oth.

that there is a discount or a cheap sale for the tobacco product(a) on any part of the packet
ot ~label of the tobacco product; or
(b) on any display rack or counter or any place w here the tobacco
product is displayed for sale or offered for sale.

(4) Any person who contravenes this regulation commits an offence
and shall, on conviction, be liable to a fine not exceeding ten thousand
ringgit or to imprisonment for a term not exceeding two years or to
both.
Minimum cigarette price
8c. (1) A price specified in column (2) of the Ninth Schedule shall be
a minimum price for each packet of cigarettes 10entioned in column (1)
of t he Schedule.
(2) Any person who sells ot offers for sale any cigarette shall at all
time display conspicubu.sly a notice as specified in the Tenth Schedule
in respect of the minimu;m dgarette price referred to in subregulation
(1) at the counter or the p-lace where the cigarettes are displayed for
sale or offered for sale.
(3) The notice refuned to in su.bregulation (2) shall not contain any
logo, brand~ trade matk or any description associated with cigarette.
(4) Any person who contravenes this regulation commitS a11 .offence
and s4all, on conviction, be liable to a fine not exceeding ten tkotrsall..d
ringgit or to impriso.n ment for a term not exceeding two yeaq; or to
both.

Prohibition on selling packet of cigarettes below minimum cigarette
price
8o. (1) No person shall sell or offer for sale a;ny pack~t of cigarettes
below the minimum cigarette price for that packet. of cigarettes as
specified in the Ninth Schedule.
(2) Any person who contrave nes su.bregulation (1) commits an offence
and shall, on conviction, be liable to a fiJJ.e· not exceeding ten thousand
ringgit or to imprisonment for a term not exceeding two years or to
both.

8E. (1) No person shall -8ell or offer for sale a packet of cigarettes
without a price label as specified in the Eleventh Schedule.
(2) Any person who contravenes snbregulation (1) commits an offence
and shall, on conviction, be liable to a fine not exceedin g ten thousand
ringgit or to imprisonment for a term not exceeding two years or to
both .".

Amendment of regulation 16
4. Sub regulation 16(1) of the principa l R egulations is amended by substituting
for the words " not less than twenty" the words ''twenty to twenty-five" .
