Policies and Procedures for Locate Requests Lookout Mountain Water District Adopted November 2014 Overview: Utility Locate Requests are generated by Colorado811 and are processed by the District’s Operator, currently, Treatment Technology LLC. Colorado811 information can be found at: http://colorado811.org/ Facility Owner: The Lookout Mountain Water District is defined as a Facility Owner because it is a political subdivision and a public utility provider. A Facility Owner owns and operates underground facilities. (5)(a) “Operator” or “owner” means any person, including public utilities, municipal corporations, political subdivisions, or other persons having the right to bury underground facilities in or near a public road, street, alley, right-of-way, or utility easement. Public Water Lines - Underground Facilities: “Underground facility” means any item of personal property which is buried or placed below ground for use in connection with the storage or conveyance of water or sewage, electronic, telephonic, or telegraphic communications or cable television, electric energy, or oil, gas, or other substances. Excavator Responsibilities and Property Owner Responsibilities: See http://colorado811.org/web/guest/services/ The party doing the actual excavation (Homeowner or Contractor) must create a locate request in their name. The exact address of the property must be provided and posted. No intersections, lot numbers or extended dig areas are accepted. Intersection requests and requests to extend markings beyond the address boundaries will be aborted without notice. Private Property, Engineering Requests and Private Locate Companies: The underground facility owner(s)/operator(s) are only required to locate the facilities they own or operate. There are also privately owned facilities. If an underground utility exists but is not owned by the Facility Owner, it is the excavator’s responsibility to make every effort possible to contact the owner(s)/operator(s) of the private facility. Requesting information from the landowner is usually a starting point. Legislation requires one-call participation of all utilities that are in or near a public right-ofway. Property owners who want to plan or design projects (“engineering projects”) but are not currently excavating or who need excavation on property not in the public right-of-way should use a private locate company. Colorado811 maintains a list of locate providers at http://colorado811.org/web/guest/privatelocatecompanies Lookout Mountain Water District customers should be aware that individual service lines and private lateral lines are private property. The Lookout Mountain Water District undertakes no responsibility to locate water lines of any size or depth that are on private property, unless such lines are owned and operated by the District, in the public-right-of–way, or in a utility easement. Locate Requests accepted by Colorado811 but found to be private property will not be processed. If the private line enters a public-right-of-way, it will attempt to be located. 1 Policies and Procedures for Locate Requests Policies and Procedures for Locate Requests Lookout Mountain Water District Adopted November 2014 Items of Personal Property: These include but are not limited to: pipes, sewers, service lines, valves, lines wires, manholes, and attachments thereto. Procedures: 1) Lookout Mountain Water District SHALL: a) Participate in the “one-call” system as required by the State of Colorado. LMWD shall respond as required by and through the District Operator. b) Locate ONLY those mains that are owned and operated by LMWD. c) Inform the requesting party whether there are any known private property including known service lines in the area. d) NOT process ‘Locate Requests’ for private property . e) Review all Locate Requests by and through its Operator. Staff will respond responsibly to each request. f) The District’s Operator can choose to refer any ‘Locate Request’ to a professional locate company as agreed to by the LMWD and the District’s Operator . g) The District’s Operator shall be considered an agent of LMWD when making locates on behalf of the LMWD, unless contrary to law. h) The District’s Operator, in coordination with its Administrator, may choose a professional locate company to respond to a ‘locate request’. Any such company shall not be considered an agent of the LMWD. 2) PRIVATE PROPERTY OWNERS (within and without LMWD): a) Need to be aware that individual service lines and private lateral lines are PRIVATE PROPERTY. These lines are not owned by LMWD.
