Attachment 1 CITY OF VINCENT POLICY MANUAL TECHNICAL COMMUNITY SERVICES - ENGINEERING ALTERNATIVE USES FOR ON ROAD CAR BAYS POLICY POLICY NO: 2.2.13 POLICY NO: 2.2.13 ALTERNATIVE USES FOR ON ROAD CAR BAYSPARKLETS OBJECTIVES To: enhance the interest, amenity and vitality of parts of the City by encouraging temporary, well designed, safe and functional On Road Cafés and PARKlets Parklets in compatible public spaces. promote vibrancy in the City’s Town Centres by providing alternatives uses to the City’s car parking bays provide the opportunity for safe community meeting places for pedestrians within the City’s Town Centres provide clear procedural guidelines for the assessment and approval of On Road Cafés and PARKlets Parklets in the City DEFINITION What are Parklets? The On Road Cafés or Parklet concept has been popular in Europe and in parts of the US, initially as a response to narrow footpaths preventing outdoor dining. In these situations, outdoor public seating is permitted to be provided ‘on road’ in the kerb side lane., generally only during the warmer months of the year. Parklets are small public parks set into the existing streetscape. A Parklet repurposes part of the street into a public urban space for people and enhances the streetscape by adding interest and beauty to our streets. Parklets provide a public open space for anyone to use with simple amenities such as shade, bike parking and seating. A Hosted Parklet is funded, designed, constructed and maintained by a local business or community group in accordance with the Vincent Parklet Manual and a separate written agreement with the City to house the semi-permanent Parklet for up to twenty four (24) months. In some cases, Temporary Parklets (i.e. constructed and operating for a short period of time, or only during particular hours) are also an option. A City Parklet is funded, designed, constructed and maintained at the cost of the City. When a Hosted Parklet is housed adjacent to a sponsoring business (‘the applicant’), seating is open to the general public, and is not solely reserved for customers of any one particular café or business. A business cannot provide table service to a Parklet, however patrons of the business can order and pay for goods and bring it outside to the Parklet. The cost of design, construction and maintenance of each On Road Cafés is generally paid for and maintained by the sponsoring Cafe(s) ‘the applicant’ whilst a PARKlet is paid for and maintained by the City. The consumption of alcohol and smoking is not permitted. Seating is normally open to the general public, and is not solely reserved for customers of any one particular café. A café does not generally provide table service at an On Road Cafe, however patrons using the café can order and pay for food inside the cafe and bring it outside to the On Road Café. Page 1 of 19 H:\Devl&Env\Agenda Items\2015 Attachments\September\Parklets\parklets1.doc Attachment 1 CITY OF VINCENT POLICY MANUAL TECHNICAL COMMUNITY SERVICES - ENGINEERING ALTERNATIVE USES FOR ON ROAD CAR BAYS POLICY POLICY NO: 2.2.13 The On Road Cafés and PARKlets usually takes up one or more vehicle parking spaces (excluding footpath areas) and may also include such amenities as bicycle racks, planter boxes, benches/other seating, landscaping and other amenities. The cost of design, construction and maintenance of each On Road Cafés is generally paid for and maintained by the sponsoring Cafe(s) ‘the applicant’ whilst a PARKlet Parklet is paid for and maintained by the City. POLICY STATEMENT 1.0 Mandatory Requirements Proposals for On Road Cafés and PARKlet a City Parklet or Hosted Parklet must satisfy all of the following mandatory requirements. Where the proposal does not meet the following requirements the application may be recommended for refusal. Application Guidelines are appended to this policy: 1.1 The proposed installation shall be located on a road where the posted speed limit is less than or equal to 40kph or where adequate protection/traffic calming is in place and the associated speed limit is not greater than 50kph; 1.2 The proposed installation will not be permitted on a street which is classified as a Primary Distributor or a four (4) lane District Distributor Road. 1.3 The proposed installation will not result in the loss of a space that serves a valuable public purpose such as space for the purpose of public transport, taxis, service vehicles, or people with disability. The Council may consider a variation to this requirement where the applicant demonstrates that suitable alternative arrangements can be made to compensate for the loss in space. 1.4 The location and design of the On Road Café or Parklet will not impede or negatively impact upon pedestrian or vehicular movement or sightlines at road junctions and vehicle access crossovers, or impede emergency vehicle movements. 1.5 The proposal demonstrates that it will be constructed in such a manner that it is capable of being removed and the road reserve reinstated, to the same condition as it was previously to the proposed installation, within a twenty four (24) hour period. 1.6 The proposed installation will not interfere with the functioning, or result in the damage or permanent removal, of existing infrastructure such as hardstand infrastructure (kerbing, paving, crossovers or road drainage), verge trees, lighting, underground services and/or other services. 1.7 The proposed installation will be made available for use by any member of the public regardless of whether or not they are customers of the business responsible for the On Road Café Hosted Parklet. 1.8 A maximum of four (4) Parklets hosted by food or café service businesses will be permitted in each Town Centre. Note: 2.0 This clause does not apply for PARKlets as they are a public space not associated with a business. Design Criteria Proposals for On Road Cafés and PARKlets Parklets that satisfy all of the above requirements will be considered for approval having regard to the following criteria: Page 2 of 19 H:\Devl&Env\Agenda Items\2015 Attachments\September\Parklets\parklets1.doc Attachment 1 CITY OF VINCENT POLICY MANUAL TECHNICAL COMMUNITY SERVICES - ENGINEERING ALTERNATIVE USES FOR ON ROAD CAR BAYS POLICY POLICY NO: 2.2.13 2.1 The design shall: be interesting and creative, and demonstrate an improvement in the quality of public space; be compatible with the established improvement in the quality of public space; be compatible with the established streetscape character; encourage neighbourhood interactions; provide adequate disability and universal access; and maintain or improve public safety in the street. 2.2 The location and design shall not negatively impact upon the amenity of occupiers in buildings in close proximity to proposed installation. 2.3 The character of the design should be unique and should not have an overt visual relationship with any nearby businesses 2.34 The proposed installation shall contribute to a diversity of uses in the locality. 2.45 The loss of public parking space(s) shall not be significantly detrimental to the parking needs of the immediate locality. 2.56 In the case of an ON ROAD CAFÉ, The maximum number of existing street parking spaces that may be replaced shall not exceed two (2) and only the parking space(s) directly in front of the premises occupied by the person/business proposing the proposed installation may be proposed for replacement, following liaison with adjoining business proprietor/s. 2.67 In the case of a PARKlet The maximum number of existing street parking spaces that may be replaced shall not exceed two (2) following liaison with adjoining business proprietor/s. Extension to a parking bay adjacent to an adjoining property may be permitted in some circumstances where a parking bay straddles two (2) properties. The written consent of the owner and occupier of the adjacent premises must accompany an application to request usage of the street frontage abutting the adjacent premises. 2.7 The location of the proposed installation is in an area where the existing footpath width is too narrow to adequately accommodate vibrant street activities, such as alfresco dining, as well as pedestrian movements. 2.8 The proposed installation shall comprise of easily removable components and be located in an area with adequate lighting. 2.9 The majority of construction (as much as possible) should be completed off site, in advance of installation; 2.910 The proposed installation shall display signage, to the satisfaction of the City, indicating that the installation is for public use. 2.1011 The City reserves the right to determine the number of installations in a street/area to maintain adequate parking amenities. 3.0 Technical Criteria for an On Road Café a Parklet. All Hosted Parklets and City Parklets shall: 3.1 Be located directly in front of the applicant’s premises, and/or have written approval from neighbouring businesses and property owners; Page 3 of 19 H:\Devl&Env\Agenda Items\2015 Attachments\September\Parklets\parklets1.doc Attachment 1 CITY OF VINCENT POLICY MANUAL TECHNICAL COMMUNITY SERVICES - ENGINEERING ALTERNATIVE USES FOR ON ROAD CAR BAYS POLICY POLICY NO: 2.2.13 3.2 Extend no longer than the frontage of the applicant’s establishment (where possible); 3.3 Be designed by an appropriately qualified person from approved materials; 3.4 Durable and comfortable seating for individuals and groups of all ages and abilities; 3.5 Be semi-permanent structures that must withstand the rigours of everyday outdoor use. Materials and design should be durable and low-maintenance. Designs that encourage use in rainy weather should be considered; 3.6 Planter boxes or an element of greenery are a required design element. 3.7 The structure shall have vertical elements (e.g. planters, umbrellas) so that it is visible from vehicles. All furniture and other approved structures including planter boxes are to be free standing; 3.8 Where ‘café’ umbrellas are to be used as a sun shade they shall be; 3.8.1 adequately secured to ensure they do not become dislodged in high winds; and 3.8.2 the outer edge of the umbrella must not extend beyond the outer (roadside) edge of the structure; 3.9 Each structure shall be finished with quality materials, preferably using recycled or sustainably harvested products; 3.10 Promote visibility to passing traffic and maintain clear sightlines at intersections and crossings; 3.11 Installation should be freestanding and not require anchoring into the City’s road infrastructure; 3.12 Installation must be performed by a certified contractor; 3.13 The Parklet shall only be accessible from the adjoining footpath. The footpath-facing side shall be permeable to pedestrians. The footpath-facing side must include an unobstructed section at least 1.5 metres wide. The platform (or other approved structure) or a portion of the platform, shall be flush with the footpath wherever possible to provide wheelchair access; 3.14 A positive edge must be formed along the sides of the Parklets facing the roadway and parking bays to offer adequate protection for Parklet users from moving vehicular traffic; 3.15 The structure shall not be wider than 2.0m to ensure there is at least a min 0.3m buffer between the outer edge of the parking bay and the edge of the structure; 3.16 Kerbside drainage channel must not be impeded; 3.17 The structure shall be designed to have sufficient load-bearing capacity for its intended use; and 3.18 Electrical and/or Gas Installations shall not be permitted within the structure. Page 4 of 19 H:\Devl&Env\Agenda Items\2015 Attachments\September\Parklets\parklets1.doc Attachment 1 CITY OF VINCENT POLICY MANUAL TECHNICAL COMMUNITY SERVICES - ENGINEERING ALTERNATIVE USES FOR ON ROAD CAR BAYS POLICY POLICY NO: 2.2.13 4.0 Administrative and Operational matters relating to proposed On Road Café Hosted Parklet installations 4.1 An applicant can comprise one or more businesses or business/community group who will fund/take ownership of the installation; 4.2 Applicant/s shall pay a Preliminary Application Fee, and upon approval of the design by the City, and prior to the issue of a permit the applicant shall pay a one off Approval Fee as specified in the City of Vincent’s Schedule of Fees and Charges. Should the applicant wish to renew the permit beyond twelve (12) months, an Annual Renewal Fee will be requested to be paid. 4.3 The applicant shall be responsible for all costs associated with the design and installation of the Hosted Parklet; 4.4 An approval granted for the Hosted Parklet shall initially be for a period of twelve (12) months. Notification of an approval will include a statement that the city retains absolute discretion in determining whether to approve any subsequent applications to renew the approval, and if an approval is renewed it may be for a shorter period than the original approval; 4.5 Unless otherwise specified, at the end of the approval period the Hosted Parklet shall be removed and the road reserve reinstated to the same condition as existed prior to the installation; NOTE: Any and all costs associated with reinstatement of the infrastructure would be at the cost of the applicant; 4.6 The City will notify occupiers of businesses and residential premises adjoining and opposite the proposed Hosted Parklet location that a Hosted Parklet proposal has been received and that, following this community notification, the matter will be considered by the City’s Officers. A determination will be made under Delegated Authority by the Chief Executive Officer or Director Community Services; 4.7 The applicant shall agree to enter into a Legal Agreement with the City. 4.8 Insurance & Indemnity: The applicant will be required to carry commercial general liability insurance with at least $10,000,000 limit as per the City’s Risk Management Policy (refer clause 7.1) and indemnify the City for damages, loss, costs or otherwise arising from the installation, existence or operation of the Hosted Parklet. 4.9 Cleaning: The applicant will be required to keep the Hosted Parklet free of debris, grime, and graffiti. The applicant must clean the surface of the Hosted Parklet and rinse out the area beneath the Hosted Parklet at least once per week. Seating should be dried after rainfall if necessary. 4.10 Landscaping: The applicant is to keep plants in good health, including watering, weeding, and trimming when necessary. Design and maintenance of any landscaped areas must follow the City’s Verge Treatments, Plantings and Beautification Policy. 4.11 Table Service: Hosted Parklets are free and open to all members of the public to use. The applicant will be responsible for ensuring that there is no table Page 5 of 19 H:\Devl&Env\Agenda Items\2015 Attachments\September\Parklets\parklets1.doc Attachment 1 CITY OF VINCENT POLICY MANUAL TECHNICAL COMMUNITY SERVICES - ENGINEERING ALTERNATIVE USES FOR ON ROAD CAR BAYS POLICY POLICY NO: 2.2.13 service at the Hosted Parklet, including the placement of condiments or napkins. 4.12 Smoking and the consumption of Alcohol in the Hosted Parklet area shall not be permitted A Hosted Parklet may have to be temporarily or permanently removed under certain circumstances. The City reserves the right to remove part or all of the Hosted Parklet for street improvements, utility work, emergencies, or repeated violations of the Legal Agreement. Advanced notice will be given in case of planned maintenance. 5.0 6.0 Administrative matters relating to City Parklet installations 5.1 The City shall be responsible for all costs associated with the design and installation of the City Parklet; 5.2 The City shall be responsible for overseeing/cleaning the City Parklet and maintaining any plants, shading etc.; and 5.3 The City will notify occupiers of business and residential premises adjoining and opposite the proposed City Parklet that it is to be considered under Delegated Authority. Assessment Procedure for Hosted Parklets A brief overview of the process for establishing a Hosted Parklet is as follows 7.0 6.1 A Hosted Parklet application shall be submitted to the City’s Community Services Directorate by completing the application form which forms part of the Guidelines in Appendix 1; 6.2 The City’s Technical Services and Community Services will undertake a site visit and a traffic engineering review and discuss with the City’s Planning Services. This may result in the need for the applicant to implement any necessary improvements. The City may require the structure, furniture, barrier or other items be removed at any time to allow street works, maintenance or cleaning to be undertaken; 6.3 All potentially affected businesses in the street will be notified regarding the proposal; 6.4 The City will determine the decision under Delegated Authority of the Chief Executive Officer or Director of Community Services. 6.5 Should the matter be approved, a permit will be issued and the City will enter into a legal agreement with the applicant. Hosted Parklet Permit 7.1 A Hosted Parklet permit shall be issued when the applicant has submitted the prescribed form, detailed plans, any additional information that may be relevant to the application and the prescribed Preliminary Application Fee and the City is satisfied that the application complies with the necessary requirements. 7.2 A permit for a Hosted Parklet shall be valid for twelve (12) months after which the applicant will need to apply for another permit (refer clauses 4.2 and 4.4). Therefore for each recipient of a permit, after twenty four (24) months, if applications have been received from other businesses the permit may not be renewed and the permit issued to another applicant on a ‘first come, first served’ basis. If no other applications are pending consideration may be given to extending the existing permit for a further twelve (12) month period. Technical Criteria for an ‘On Road’ Café: An ‘On Road’ Café shall: 2.1 Only be available to food businesses premises that have local planning approval and are registered with the City under the Food Act 2008; 2.2 Be located directly in front of the applicant’s premises; 2.3 Extend no longer than the frontage of the applicant’s establishment (where possible); 2.4 Be supported by the local business community; 2.5 Be designed by an appropriately qualified person from approved materials; 2.6 Be open to the general public; 2.7 Be clean and well maintained; 2.8 Be universally accessible; 2.9 Be interesting and welcoming spaces that encourage passersby to pause, sit, relax, interact with others, or people watch; 2.10 Durable and comfortable seating for individuals and groups of all ages and abilities. Materials and design should be durable and low-maintenance. The character of the design should be unique and should not have an overt visual relationship with any nearby businesses; 2.12 Have signage denoting the ‘On Road’ Café as publicly accessible must be clearly and prominently displayed. Any additional signage or logos must be approved by the City; 2.13 Respond to surrounding conditions; 2.14 Promote visibility to passing traffic and maintain clear sightlines at intersections and crossings; and 2.15 Consider travel patterns and behaviour of people walking and biking in order to minimise potential conflicts and maximise contribution to public life and public realm. An ‘On Road’ Café’ shall not be located in: 3.0 2.16 A traffic lane where moving traffic is permitted at any hour of the day; 2.17 A bus stop; 2.18 Front of a fire hydrant; and 2.19 Front of an active driveway. Safety and Accessibility relating to proposed ‘On Road’ Café installations The following requirements are meant to ensure that ‘On Road’ Cafés are safe and accommodate users of all ages and abilities: 3.1 ‘On Road’ Cafés should be constructed of high quality, durable materials. The use of recycled or sustainably harvested products is encouraged; 3.2 The majority of construction (as much as possible) should be completed off site, in advance of installation; 3.3 Installation should be freestanding and not require anchoring into the City’s road infrastructure; 3.4 Installation must be performed by a certified contractor; 3.5 ‘On Road’ Cafés must be able to bear at least 7.2kpa; 3.6 Clear sightlines to the street must be maintained at all times; 3.7 The footpath-facing side shall be permeable to pedestrians; 3.8 The footpath-facing side must include an unobstructed section at least 1.5 metres wide that is flush with the footpath to enable access for people of varying abilities; and 3.9 A positive edge must be formed along the sides of the ‘On Road’ Cafés facing the roadway to protect ‘On Road’ Cafés users from moving traffic. A continuous railing is an example of a positive edge but other materials and methods may be used. Notification of an approval will include a statement that the city retains absolute discretion in determining whether to approve any subsequent applications to renew the approval, and if an approval is renewed it may be for a shorter period than the original approval. 4.8 Unless otherwise specified, at the end of the approval period the ‘On Road’ Café shall be removed and the road reserve reinstated to the same condition as existed prior to the installation. NOTE: Any and all costs associated with reinstatement of the infrastructure would be at the cost of the applicant. 4.9 additional permits and approvals may be applicable and required under relevant City of Vincent local laws or other legislation where an ‘On Road’ Café is proposed to be used for a certain purpose, for example an outdoor eating area licence will be required if an ‘On Road’ Café is intended to be used for outdoor dining associated with an eating house as defined in the City’s Outdoor Eating Areas Local Law. 4.10 ‘On Road’ Café proposals shall be determined having regard to the requirements of the policy as well as any other relevant City Policies or other matters that may apply. 4.11 the City will notify occupiers of businesses and residential premises adjoining and opposite the proposed ‘On Road’ Café that an ‘On Road’ Café proposal has been received and that, following consultation, the matter will be considered by the Council. The Chief Executive Officer provide a recommendation to the Council for determination (refer clause 1.3 and 1.4). 4.12 The applicant shall agree to enter into a Legal Agreement with the City (refer clause 1.5). Suitable Locations ‘On Road’ Cafés/PARKlets shall only be considered on roads in District Centres where ‘protected’ embayed parking currently exists and/or not subject to clearway restrictions or where the posted speed limit is less than or equal to 40kph or where adequate protection/traffic calming is in place and the associated speed limit is not greater than 50kph; 6.1 Leederville: 6.2 Mount Hawthorn: 6.3 7.0 Selected side streets (assessed on a case by case basis) Perth: 6.6 Angove Street, between Fitzgerald and Daphne Street? The written consent of the owner and occupier of the adjacent premises must accompany an application to request usage of the street frontage abutting the adjacent premises. 7.3 The platform (or other approved structure) or a portion of the platform, shall be flush with the footpath as wherever possible to provide wheelchair access. 7.4 Kerbside drainage must not be impeded. 7.5 The structure shall be designed to have sufficient load-bearing capacity for its intended use. 7.6 The structure must be publicly accessible and signed as such. 7.7 The structure shall have vertical elements (e.g. planters, umbrellas) so that it is visible from vehicles. All furniture and other approved structures including planter boxes are to be free standing. 7.8 Each structure shall be finished with quality materials, preferably using recycled or sustainably harvested products. 7.9 The structure shall include a continuous physical barrier along the street facing perimeter while maintaining clear visual sightlines to the street. 7.10 The footpath-facing side of the structure shall be open to pedestrians. 7.11 The structure shall not be wider than 2.0m to ensure there is at least a min 0.3m buffer between the outer edge of the parking bay and the edge of the structure. 7.12 The maximum length of the structure shall not be longer than the frontage of the applicant’s establishment (refer clause 5.2). 7.13 Chairs and tables shall be brought indoors each night (‘On Road’ Café only). 7.14 The City’s Technical Services Directorate will assess each site and determine what necessary traffic safety improvements, including but not limited to, traffic markings, flexible bollards, and wheel stops. The City may require the structure, furniture, barrier or other items be removed at any time to allow street works, maintenance or cleaning to be undertaken. 7.15 Where ‘café’ umbrellas are to be used as a sun shade they shall be: 7.15.1 adequately secured to ensure they do not become dislodged in high winds; 7.15.2 must be removed at the close of business each day; and 7.15.3 the outer edge of the umbrella must not extend beyond the outer (roadside) edge of the structure. 7.16 Electrical and/or Gas Installations shall not be permitted within the structure 7.17 Include a compulsory design element to the ‘On Road’ Café, to include planter boxes or greenery of any kind. Page 12 of 19 H:\Devl&Env\Agenda Items\2015 Attachments\September\Parklets\parklets1.doc Attachment 1 CITY OF VINCENT POLICY MANUAL TECHNICAL COMMUNITY SERVICES - ENGINEERING ALTERNATIVE USES FOR ON ROAD CAR BAYS POLICY POLICY NO: 2.2.13 8.0 Responsibilities of the Successful Applicant The City will retain ownership of the ‘On Road’ Café structure and is responsible for any major repairs. However, the sponsoring organisation is expected to regularly oversee and clean the ‘On Road’ Café, and to maintain any plants incorporated into the design. Successful applicants will be required to enter into a legal agreement that commits to the following; 8.1 Insurance: The applicant will be required to carry commercial general liability insurance with at least $10,000,000 limit as per the City’s Risk Management Policy (refer clause 7.1) 8.2 Cleaning: The applicant will be required to keep the ‘On Road’ Café free of debris, grime, and graffiti. You must clean the surface of the ‘On Road’ Café and rinse out the area beneath the ‘‘On Road’ Café at least once per week. Seating should be dried after rainfall if necessary. 8.3 Landscaping: The applicant keep plants in good health, including watering, weeding, and trimming when necessary. Design and maintenance of any landscaped areas must follow the City’s Verge Treatments, Plantings and Beautification Policy. 8.4 Movable Furniture: Any movable items, such as tables and chairs, must be either locked down at night or taken inside. Unsecured furniture is not permitted after business hours. All tables and chairs must be different from what you are using as part of your business, including sidewalk cafe’ tables and tables inside the restaurant. 8.5 Table Service: ‘On Road’ Café s are free and open to all members of the public to use. The applicant will be responsible for ensuring that there is no table service on your ‘On Road’ Café, including the placement of condiments or napkins. 8.6 Annual Renewal Fee: The applicant should commit to looking after the ‘On Road’ Café for a minimum of two (2) years. The applicant will be required to pay a $500 annual renewal fee to help recover City costs associated with the program. ‘On Road’ Cafés may have to be temporarily or permanently removed under certain circumstances. The City reserves the right to remove part or all of the ‘On Road’ Café for street improvements, utility work, emergencies, or repeated violations of the letter Agreement. Advanced notice will be given in case of planned maintenance. 9.0 Smoking and Alcohol Smoking and the consumption of Alcohol in the ‘On Road’ Café area shall not be permitted Page 13 of 19 H:\Devl&Env\Agenda Items\2015 Attachments\September\Parklets\parklets1.doc Attachment 1 CITY OF VINCENT POLICY MANUAL TECHNICAL COMMUNITY SERVICES - ENGINEERING ALTERNATIVE USES FOR ON ROAD CAR BAYS POLICY POLICY NO: 2.2.13 10.0 11.0. Public Liability Insurance (‘On Road’ Café Only): 10.1 All permits issued will be conditional upon the permit holder maintaining continuously acceptable public liability cover. The Certificate of Currency for Public Liability Insurance cover is be not less than $10 million, and be from a reputable Insurance Underwriter acceptable to the Chief Executive Officer. The proprietor must submit a copy of the annually renewed public liability, and in the case that the liability lapses, the tables and chairs must be removed from Council property immediately. In addition the applicant must: 10.2 The permit holder is required to indemnify the City and its employees, agents or contractors, against all actions, suits, claims, damages, losses and expenses made against or incurred by the City arising from any activity, action or thing performed or erected in accordance with the permit, and maintain current Public Liability Insurance for the duration of the permit. Permit – On Road Cafe (‘On Road’ Café only): 11.1 An ‘On Road’ Café permit shall be issued when the applicant has submitted the prescribed form, detailed plans, any additional information that may be relevant to the application and the prescribed application fee and the City is satisfied that the application complies with the necessary requirements. 11.2 A permit for an ‘On Road’ Café shall be valid for twenty four (24) months after which the applicant will need to apply for another permit (refer clause 3.3). 11.3 Only a limited number of parking bays will be allowed to be taken up for this purpose in any particular street to ensure that adequate parking remains. Therefore for each recipient of a permit, after twenty four (24) months, if applications have been received from other businesses the permit may not be renewed and the permit issued to another applicant on a ‘first come, first served’ basis. If no other applications are pending consideration may be given to extending the existing permit for a further twelve (12) month period. Initial Concept Description: A brief summary explaining your project goals and the vision for you ORC. You do not need to have hired a designer at this stage but drawings may be provided to describe the proposed project. 5. Proof of Notification: Proof that your building or property owner has been notified is required for all proposals. 6. Policy and Guidelines: Provide an acknowledgement that you have read the Policy and Guidelines and you are familiar with all the requirements.
