You often find an anvil in a blacksmith shop. An anvil is a heavy steel or iron block
with a flat top, concave sides, and typically a pointed end, on which metal can be
hammered and shaped. Have you ever felt you are being ‘fired’ and ‘pounded’ but
you’re not sure what shape you can expect to be once removed from the flames?
When a tool emerges from a blacksmith’s anvil, there is no question as to what it is
for or why it was made. One look at the tool and you instantly know its function.
You grab a hammer and you know that it was made to hit nails. You pick up a saw
and you know that it was made to cut wood. You see a screwdriver and you know
that it is for tightening screws.
Similarly, as individuals, we must emerge from the anvil of the blacksmith shop with no question about our purpose. The time on
the anvil should help us clarify our mission and define our purpose. We have to become better professionals, more skilled practitioners, more perceptive visionaries, and more precise thinkers so that we can offer our employer the very best skill set. If all of
our corporate co-workers have the same zeal as they pursue being fired and shaped, we will succeed. Our industry will thrive.

What to Expect from OSHA in 2012 and Beyond...
Mark Lies returns to address PPMA attendees. He will provide a comprehensive overview of OSHA’s current enforcement agendas, including expanded liability for enhanced penalties, repeat and willful citations, native language enforcement policy, multiemployer worksite liability, as well as expansion of the General Duty Clause liability to combustible dust, workplace violence, and
heat illness. Additionally, the program will discuss civil and criminal liability of employers and management representatives. Attendees will receive practical recommendations on how to address these liability issues and to successfully manage an OSHA inspection and respond to citations. Mark Lies will provide ‘take-away’ clarity so we can return to our workplaces with action plans to
continue to be compliant with regulatory requirements.
Mark Lies is a partner in the Chicago law offices of Seyfarth Shaw LLP. In his occupational safety and
health law practice he represents employers on a national basis in complying with occupational safety and
health regulations, and represents employers during OSHA inspections, OSHA citation enforcement proceedings and trials of OSHA cases before federal and state agencies and appeals to federal and state
courts. He defends civil tort actions involving mass personal injury and fatality accidents and property
damage claims resulting from fires and explosions at refineries and petrochemical plants, construction
accidents, toxic substance releases at food and other processing plants, as well as employee exposure to
ergonomic hazards, mold, tuberculosis, SARS, MRSA, lead, asbestos, benzene, cadmium, hydrogen sulfide
and other toxic substances. He has extensive experience in disaster preplanning and response.

Established in 2004 and located at Alabama Southern Community College, NPT2 is an Advanced Technology Education Center of Excellence funded, in part, by the generous support of the National Science
Foundation. NPT2 has community college members located in Alabama, Maine, Michigan, Minnesota,
Mississippi, Oregon, South Carolina, Washington, and Wisconsin.
TJ Murphy is Executive Director for NPT2.
His responsibilities include strengthening partnerships between industry and community colleges, designing recruitment and retention strategies, developing
specialized curriculum, enhancing curriculum delivery through the use of innovative technology & teaching methodologies, and providing professional development opportunities for faculty.
Prior to his current appointment, TJ served over 20 years in various management roles including manufacturing excellence, business analytics, marketing and communication, and organizational design and
development within the forest products industry. TJ holds an M.B.A. from the University of Alabama.
Labor Board Law, Organizing, and Appointments– What Do We Make of It All?
As Vince Lombardi used to say: “What the hell is going on out there?” For the last 18 months the same question can be asked
about developments in American labor law and union organizing. The Employee Free Choice Act (EFCA), as we knew it, is dead.
But that did not stop the Labor Board, while it still had a quorum at the end of 2011, from implementing changes in the postpetition/pre-election procedures, resulting in a “quickie” or “ambush” election. Add to that some of the Labor Board’s decisions
and positions on such things as appropriate units for elections, social media policies and arbitration agreements. Then in early
2012, our President named three new recess appointees to the Labor Board. Almost immediately these “recess” appointments
were challenged as unconstitutional. We have to ask: “What’s going on out there?” What does all of this mean for all employers
whether unionized or not?”
Some states have taken initiatives that impact labor unions in the public sector. Wisconsin requires
annual re-certification of unions and has eliminated the dues check-off feature for certain public employee unions. Ohio took action to limit public sector collective bargaining and was challenged. New
Jersey and other states are contemplating similar limitations. Indiana became the 23 rd state to pass
right-to-work legislation and the first such Midwestern “rustbelt” state to do so. What will be the fallout of these and other similar actions by states? What does it mean for the American labor movement? Will there be a spillover effect in the private sector?
Once again, PPMA members are privileged to have Dan Murphy help us sort out the facts from all the
recent decisions and actions at the National Labor Relations Board level, as well as new developments
in certain states. And, yes, this impacts all of us whether the PPMA member location is represented by
one or more labor unions or none at all.

has been practicing labor law with the firm since 1978. He has extensive experience in collective bargaining, arbitration, labor board matters, litigation and union organizing activity. Dan has conducted numerous training programs and seminars for members of upper, middle and front-line management on subjects including employee motivation, evaluation and discipline, documentation of employee conduct, application of the Family Medical Leave Act and Americans
With Disabilities Act in the workplace, sexual harassment and practical ways on maintaining a union-free status in the workplace as well
as managing in a collective bargaining environment. Dan has conducted seminars in London, Toronto, Vancouver and Montreal comparing the United States Labor and Employment Laws with those of
England and Canada.

Professor Allen will identify, clarify, and explore the underlying dynamics of human motivation. The same insights that enhance selfmotivation often contribute to being more effective in building trust
with others enabling them to be more motivated and contributory.
Trust-building is a process of social influence where we seek to impact the world in which we live. Credible and healthy relationships
are necessary to have influence and be capable of motivating others
to constructive behavior. Professor Allen will mix presentation with
Q&A to provide both an enjoyable and
valuable program.
Professor Emeritus C.Y. Allen joined the
University of Wisconsin Stevens Point
[UWSP] in 1969. He later chaired the Division of Communication’s Organizational
Communication Program Unit. He
taught courses in team-work, motivation,
change, and leadership. Allen was recipient of UWSP's Excellence in Teaching
Award. He served in the UW-Madison
School of Business Management Institute and the UW Madison
School of Medicine's Alzheimer Caregiver training project. Allen received ongoing recognition for his contributions to the campus,
community, and engagement as a speaker, consultant, and teacher
to diverse audiences across the US and Canada including the IRS,
paper companies, Wisconsin HRM, Wisconsin Healthcare
HRM, TAPPI, PIMA, IPMA, and UWSP Commencement speaker.

David Scheible is the President and Chief Executive Officer of Graphic Packaging International, Inc. headquartered in Atlanta, GA with revenues of $4.3B. Graphic Packaging is the world’s largest manufacturer of folding cartons for the consumer food and beverage markets supporting global brands like AB, Coca-Cola, General Mills,
Kellogg, Kraft, Miller Coors, Nestle, Pepsi Co., and many
more. Graphic Packaging has 13,000 employees and operate seven paperboard mills and over 70 converting plants
globally.
Mr. Scheible has held executive leadership roles in the
Company, including President and Chief Executive Officer,
Chief Operating Officer and Executive Vice President of
Commercial Operations.
He also served as President of the Flexible Packaging Division of legacy Graphic Packaging Corporation from January to June 1999. Mr. Scheible was previously affiliated
with the Avery Denison Corporation, where he was Vice

Eric Hobbs is a partner with Michael Best & Friedrich Law Firm whose practice focuses on labor and employment, with an emphasis on employment counseling and policy development, occupational safety and
health, worker’s compensation, wage and hour matters, clergy abuse and employment discrimination
litigation. He also has experience in wage-hour, employment discrimination and multi-district class action
cases.
Mr. Hobbs represents employers of all sizes in a variety of industries from service to heavy manufacturing.
He has litigated before state and federal agencies and courts throughout the United States and has experience in Canadian occupational safety and health law issues, as well. He also speaks and writes extensively
with and to employer groups, OSH professionals, judges, and government agency officials. Eric Hobbs and
Michael Best have been very helpful to PPMA over the years and we rely on Eric’s experience often.
Partners in Change – Insights Into Effective Labor Management Committees
The Federal Mediation and Conciliation Service (FMCS) is a U.S. Government Agency whose primary responsibilities are to promote sound and stable labor-management relations. One of their areas of emphasis involves assisting parties in establishing effective labor-management committees. Such committees can foster better communication, understanding, and enhance labormanagement partnerships to enable them to collaborate on workplace problems in a timely manner. Dan Van Wychen from FMCS
has provided organizations with training and facilitation in planning, problem solving, brainstorming and consensus building to create the building blocks for effective, useful, cooperative, and productive committees.
Dan will briefly discuss the model for structuring a L/M Committee. Then we will hear
some ‘first-person’ testimonials from PPMA members from Graphic Packaging who
have successfully structured this model and who have used it to everyone’s advantage
at their manufacturing locations.
Daniel Van Wychen is a commissioner of the Federal Mediation and Conciliation Service [FMCS]. Working in Green Bay, Wisconsin, he has mediated labor disputes in
both the private and public sectors in such diverse areas as manufacturing, health
care, education, services, power generation, construction, and transportation.
In addition to dispute mediation, he has assisted in the development of workplace and
area Labor-Management committees to promote labor and management relations in a cooperative and problem-solving setting.
His work includes conducting workshops and programs aimed at improving Labor–Management relationships, conflict resolution,
organizational effectiveness, and alternative dispute resolution processes.
Van Wychen received a Bachelor of Science degree in Industrial Engineering from the University of Wisconsin – Madison in 1972.
His business experience includes 27 years in the paper industry in a variety of positions including engineering, human resource
management and production.
Dan has assisted the Service with dispute mediations for the Public Employee Relations Board in Iowa, Postal Service, Federal Corrections, and the U. S. Department of Veterans Affairs.

The Storm Around Reform – What’s the Latest Regarding Health Care?
The evaluation sheets PPMA members complete at the close of each conference are unmistakably apparent. PPMA members
want to continually be updated about health care and surrounding issues.
The Patient Protection and Affordable Care Act (PPACA), more commonly called simply ‘healthcare reform’ was signed into law on
March 23, 2010. The initial changes regarding the new health care law were effective on or after September 23, 2010. Where
does the implementation of this health care reform stand now?
Dennis will help us by pointing out items that will likely be dealt with at the federal health care level.
Dennis Smith was appointed by Governor Scott Walker to serve as Secretary of the Department of
Health Services on January 3, 2011. The agency is responsible for Wisconsin Medicaid programs which
provide health care and long-term care services to more than 1 million enrollees, operates four mental
health facilities, regulates state hospitals and coordinates the public health response for the state of
Wisconsin.
Secretary Smith previously served as Director of the Center for Medicaid and State Operations at the
Centers for Medicare and Medicare Services under Secretaries Tommy G. Thompson and Michael O.
Leavitt. Smith served on various staff positions in the U.S. Senate and U.S. House of Representatives. In
previous state roles, he also served as Medicaid Director for the Commonwealth of Virginia and as Chief
of Planning for the California Department of Developmental Services. In addition to his state and federal government service, Secretary Smith has worked as Managing Director of Medicaid Practice at
Leavitt Partners, a partnership that advises clients in the practice areas of health, environment and trade. He was also a Senior Fellow at the Heritage Foundation, a Washington, D.C. think tank.
The Future of Your Professional Association
The status of professional associations is in a state of flux.
Associations must become more innovative, more creative, act faster,
take more risks, invite younger members to the table, and deliver value to these members while synthesizing the newer members
with the veteran members. PPMA has taken some major steps to accomplish these things. However, the association management
can’t do these things on their own, but rather looks to involve members in making the organization fun, vibrant, dynamic and professionally valuable.
Dick Kendall, PPMA Executive Director since 2002 will engage attendees in a fast-moving time slot to capture your insights, perceptions and viewpoints to growing and expanding PPMA’s value proposition.
Dick Kendall has been Executive Director of PPMA since 2002. He plans and organizes annual conferences, training programs and educational events for member and non-member companies. He provides training to member and non-member companies in areas including but not limited to teamwork,
team development, supervisory development, strategic planning, conflict resolution and attitude enhancement. Dick conducts surveys on a variety of topics for PPMA corporate members. Additionally,
PPMA maintains a database of labor information for members.
He also is Chairman for the Town of Doty in Oconto County, Wisconsin. He serves on the Land Use
Planning Committee and several other governing bodies for local towns. Dick is a certified biblical
counselor and has been a lay pastor for 16 years. He has served as a Board member of the Bay Lakes
Council, BSA Board of Directors for several years.
