This Annual Report tells of several significant achievements, each the culmination of years of effort, leading to fundamental changes in local, state, and federal water policy. The breadth and depth of our knowledge of the Charles River watershed continues to grow, and our work with sister organizations outside the watershed is helping them replicate much of our work. Our superb and dedicated staff is the key to our success. Our Green Streets/Blue Cities efforts in Allston-Brighton with Harvard University on water design principles for its new campus, and with Boston on the redevelopment of Peabody Square in Dorchester, are new approaches to engineering rainwater systems in urban areas. Our objective is to make rainwater work much as it would have before we built our cities and towns, and in so doing curb polluted runoff, infiltrate water back into the ground, and clean and restore our tributaries and the Charles while sustaining water supplies. We have published a manual outlining and illustrating the methods and principles we’ve developed entitled Building Blue Cities: Environmentally Sensitive Urban Development, with funding from the Boston Foundation. In partnership with the Mystic River Watershed Association, we completed extensive surveys of the Charles and Mystic Rivers, leading to further reductions in pollution to both rivers, a guidebook on conducting such surveys, and policy change on the discharge of sewage from boats to the Lower Charles and Boston Harbor. Most significantly, after years of investigation and computer modeling, and of meetings in partnership with Conservation Law Foundation, the U.S. Environmental Protection Agency (EPA) New England, and the Massachusetts Department of Environmental Protection (DEP), EPA and DEP have designated existing industrial, commercial, and institutional properties for new stormwater permits: all properties with two acres or more of paved and constructed surfaces in the Charles River watershed, and five acres or more statewide. Over time, owners of those properties will be required to reduce their phosphorus-polluted runoff in the watershed by 65 percent. Consequently, for the first time in the nation under the Clean Water Act, individual property owners will be held accountable for their heavily polluted stormwater runoff. Equally important, the regulation will require the use of green solutions, capturing runoff, cleaning it, and infiltrating it into the ground. This seminal shift in the way water is regulated will restore river flow, improve water quality, reduce flooding and help protect against drought. It is the first stage in re-engineering our cities and towns to make them work more naturally with water. Of course, much remains to be done. Any shift in policy and regulation of this magnitude will be controversial, and the complexities of making the new regulation work well need to be carefully considered and demonstrated. CRWA has already started that work in partnership with the regulatory agencies. The shift itself, however, is worthy of real celebration. We are extremely grateful for your support, which has made possible our very productive year. And so far, we are weathering the economic storm. In November, both the U.S. Environmental Protection Agency (EPA) and the Massachusetts Department of Environmental Protection announced important new regulatory programs designed to address the largest remaining source of pollution to the river: stormwater runoff from large paved areas. CRWA The new programs - the first of their kind - have attracted national attention, indicating significant positive changes in stormwater management and river cleanup. Unlike most regulations which apply only to new development, these will require existing large properties, such as shopping malls, to start cleaning up their stormwater pollution. Scientific analysis has clearly shown that we cannot meet water quality standards in the Charles River if the existing sources of pollution are not cleaned up. The new regulations are the fruit of more than four years’ collaboration between CRWA and the Conservation Law Foundation to develop the science, analyze the law, and advocate for the agencies to take this important step. CRWA has already begun work with the agencies, and several municipalities, to implement the new requirements. Massachusetts Highway Department Forced to Control Roadway Pollution MassHighway will be required to control pollution from its 2,500 miles of roadways and bridges, thanks to a landmark court case won by Conservation Law Foundation in partnership with CRWA. The federal district court found MassHighway in violation of the Clean Water Act, and ruled that it must clean up stormwater runoff, which pours nutrients, toxic metals, oil and grease, salt, and sand directly into rivers and streams when it rains. This ruling gives MassHighway two years to adopt a more effective stormwater pollution management plan, and requires it to deal immediately with three polluted areas, including two in the upper Charles River watershed. Page 2 www.charlesriver.org ACCOMPLISHMENTS 2008 Stormwater Regulations The“Find It and Fix It” stormwater assessment program, a collaborative effort between CRWA and the Mystic River Watershed Association with funding from the Massachusetts Environmental Trust, concluded its third and final year in 2008. Draft TMDL Development for Upper/Middle Charles Using water quality monitoring and modeling, CRWA is close to completing a nutrient Total Maximum Daily Load (TMDL) for phosphorus in the Upper/Middle Charles River, with the Massachusetts Department of Environmental Protection and the U.S. EPA. The phosphorus TMDL determines the maximum amount of this pollutant that the river can tolerate and still meet water quality or aesthetic standards. Excessive phosphorus from human sources (like human/animal waste, fertilizer, detergents and car exhaust) currently contributes to extremely high levels of algae and aquatic weeds in the Charles. Because about two-thirds of the total annual phosphorus load comes from stormwater, the TMDL has sharply focused attention on this issue. The result is comprehensive new stormwater permits for Massachusetts (see page 2). A final implementation plan will develop the regulatory process to achieve TMDL loads that will yield a cleaner, more useable river. scottkennedyphotography.com ACCOMPLISHMENTS 2008 Stormwater Assessment Throughout Watershed CRWA Annual Report 2008 Page 3 In March 2008, CRWA concluded its Environmentally Sensitive Urban Development Project, a three year effort to research and evaluate ways to integrate urban watershed restoration into redevelopment. Focusing on North Allston, Zakim North and the Longwood Medical and Academic Area, CRWA set out to develop concrete plans to restore natural hydrology, identify “green infrastructure” opportunities, increase vegetation at a range of scales, and improve the pedestrian environment. The work culminated in CRWA’s Blue Cities Guide, which presents a cohesive framework for urban watershed restoration, from the assessment of existing conditions, through development of a public participation process, to the production of a schematic design. While every location has site-specific needs and potential, the Guide offers a broadly applicable analytical framework, along with recommendations for advocacy. The Guide serves as a model for retrofitting urban areas in general, taking lessons learned in the Charles watershed to the national scale and beyond. Thanks to CRWA’s partnership with the City of Boston, the first model for street-greening retrofits in the city will be in Peabody Square, Dorchester. Working with the Boston Transportation Department, the Department of Public Works, and its consultant, Nitsch Engineering Inc., CRWA is integrating Best Management Practices (BMPs) like porous pavers, a rain garden, and stormwater planters into the redesign for Peabody Square. CRWA Pilot Green Street Project at Peabody Square Publication of Green Streets Guide CRWA created the Green Streets Guide for Allston-Brighton with a dual purpose: to help Allston Brighton Green Space Advocates promote neighborhood green street retrofits, and to encourage the City of Boston to incorporate these design considerations into area street improvements. The Green Streets Guide has served as a reference for the Boston Redevelopment Authority’s Community-Wide Plan for North Allston-Brighton (under development), and Harvard University’s Institutional Master Plan for the new campus. Public outreach and planning for the Green Streets Guide spurred a number of “greening” projects led by local green space advocates and residents along Everett Street. Page 4 www.charlesriver.org ACCOMPLISHMENTS 2008 Environmentally Sensitive Urban Development & Blue Cities Guide scottkennedyphotography.com In the latest version of its Institutional Master Plan (IMP) for the new Allston campus expansion, Harvard University has incorporated many of CRWA’s recommendations to make this major development effort more waterfriendly and environmentally sensitive. Since 2005, CRWA has been working to incorporate a greenway and green streets in the IMP, and to focus attention on stormwater management strategies; these concepts will mitigate pollution to the Charles. Charles River Report Card Improves For the first time in three years, the U.S. EPA has raised the Charles River’s “grade”: from B+ to B++! The new grade, announced in April, shows a measurable result of our work to improve water quality. Each year, the river’s grade is determined by the percentage of time that the Lower Basin (from Watertown Dam to Boston Harbor) meets the state’s standards for bacterial pollution, an analysis based primarily on data collected by CRWA staff and volunteers. Since 2006, CRWA has been under contract to the Executive Office of Environmental Affairs, working with the ESS Group to apply this methodology to small sub-basins in Massachusetts. Application to the Charles has enabled us to produce color-coded impact maps that highlight the most seriously affected sub-basins in the watershed. These maps will be extremely useful in planning efforts to fix problems and “balance” the water cycle. Using the Law to Protect Streamflow Continuing our legal battle to protect streamflow, CRWA went to the state Appeals Court to: • Defend the Massachusetts Department of Environmental Protection’s requirement that water conservation conditions be included in water withdrawal permits; and • Argue that mitigation was required when withdrawals exceed the safe yield, or carrying capacity, of a river basin. CRWA Annual Report 2008 Page 5 Pamela Joy Smith ACCOMPLISHMENTS 2008 Influencing Harvard’s Allston Campus Expansion 9th Annual Earth Day Charles River Cleanup CRWA coordinated a collaborative effort organizing more than 2,200 volunteers from 105 groups who joined forces to clean approximately 60 miles of riverbank in April. Robby Mason Volunteer Water Quality Monitoring More than 70 faithful volunteers continue to take water samples at 37 sites along the river, giving CRWA and government agencies a monthly “snapshot” of water quality conditions. Volunteers pile baskets of invasive water chestnuts Pulling Weeds for a Healthy River In partnership with Charles River Canoe and Kayak, more than 250 CRWA volunteers removed invasive water chestnuts from the river in Newton and Waltham during the month of July, helping to restore the natural ecosystem. Advocacy & Public Outreach River & Watershed Education Workshops, public meetings, festivals, presentations and school demonstrations are a few of the ways CRWA reaches out to share the complexities of our urban river. Advocacy CRWA develops and supports sound watershed management policies and regulations, works with watershed partners and coalitions, reviews and provides comment on specific development projects, and protects public access to the river. 26th Run of the Charles Canoe and Kayak Race 1,500 paddlers and hundreds of spectators celebrated the ongoing improvements in the Charles at North America’s largest canoe and kayak race, hosted by CRWA each spring.
