 FACT SHEET Washington County A‐Engrossed Ordinance 775 Area 93: Applying Washington County’s FD‐20 District October 23, 2013 Background Oregon House Bill 3067 (2013) established a process to transfer Area 93 from Multnomah County to Washington County. In August 2013, both counties’ Boards of Commissioners approved a Transfer Plan Agreement for Area 93 as required by House Bill 3067. In September 2013, Gov. Kitzhaber issued a proclamation declaring approval of the county boundary change, which will become effective at midnight on January 1, 2014. General information regarding Area 93 can be obtained on the Washington County website at www.co.washington.or.us/area93. In July 2013, Washington County filed Ordinance No. 775 to apply Washington County’s Future Development 20‐Acre District (FD‐20) land use designation to Area 93. On October 1, 2013, the Board of County Commissioners directed staff to engross (amend) the ordinance. On October 22, 2013, following two additional public hearings, the Board approved A‐Engrossed Ordinance 775. The ordinance will apply the FD‐20 land use district to Area 93 properties effective January 1, 2014 to coincide with the effective date of Area 93’s transfer to Washington County. What is the Future Development 20‐Acre District (FD‐20)? Future Development 20‐Acre District (FD‐20) is a Washington County urban land use designation applied to unincorporated urban lands added to the Urban Growth Boundary after 1998. It is an interim designation that will remain in effect until Washington County completes its comprehensive planning for future urban development of the area. The intent of the FD‐20 designation is to encourage and retain limited interim land uses, until the planning process is complete, at which time final land use designations will be applied to accommodate urban development. How does FD‐20 compare to current Multnomah County RR zoning? Washington County’s FD‐20 is similar to Multnomah County’s RR zoning in several key respects:  FD‐20 also allows for a single‐family dwelling on a vacant parcel.  FD‐20 also allows for accessory structures, such as storage sheds, greenhouses and workshops.  FD‐20 continues to allow farm use, as defined by Oregon Revised Statutes. FD‐20 allows some additional uses that are not allowed under current RR zoning, including:  Contractor’s establishment  Church  Cemetery  School  Commercial equestrian uses  Public utility However, FD‐20 has a 20‐acre minimum lot size, and does not allow several of the conditional uses permitted in RR zoning, including:  Community service uses  Raising of fowl or processing by‐products for wholesale or  Feed lots retail sale  Commercial dog kennels  Mining and processing of  Cottage industries geothermal, aggregate and other  Commercial processing of mineral or subsurface resources agricultural products  Limited rural service commercial  Planned development for single uses (such as local stores, shops, family residences offices, repair services and similar  Raising of 4 or more swine more uses) than 4 months of age  Raising of fur‐bearing animals for wholesale or retail sale Will existing uses that don’t meet FD‐20 standards be “grandfathered”? Generally most existing uses could remain. However, this may vary depending on your specific situation. Will I be able to develop my property once the FD‐20 designation is applied to it? As noted above, the FD‐20 District has a 20‐acre minimum lot size. Therefore, no division of land less than 20 acres in size will be allowed, and development of property within Area 93 will be limited to uses allowed in the FD‐20 District until Washington County’s comprehensive planning for urbanization of the area is complete. The natural resource areas previously identified by Multnomah County will remain in effect as well. When will the community planning process start to identify permanent land use designations? Washington County’s community planning process is anticipated to begin in the spring of 2014, following the Area 93 transfer to Washington County. We anticipate building upon Multnomah County’s previous planning efforts for Area 93. The planning process is expected to consist of four phases, described below. Based on similar planning projects the County has undertaken, the time estimate for completion of all four phases is between 20 and 24 months. Phase 1: Project Initiation Activities in this phase include:  Develop a detailed project scope and task list  Review, select and contract with selected consultants  Develop a Public Involvement Plan  Form separate or combined Community Advisory and Technical Advisory Committees  Initiate project website  Convene the first community‐wide project introduction event Phase 2: Preferred Concept Plan Alternative  Assess existing conditions  Develop concept plan alternatives  Identify a preferred draft concept plan Phase 3: Finalize Area 93 Concept Plan  Builds upon Preferred Draft Concept Plan through continued community, stakeholder and jurisdictional partners’ review  Feedback will be incorporated in a final concept plan Phase 4: Adopt Comprehensive Plan Changes based on the Final Concept Plan  Public hearings before the Planning Commission and Board  Final result will be adoption of the Area 93 Concept Plan, including the application of final urban land use designations that will allow urban development Who can I contact for more information?
