Divorce – The denouement of Marital disputes
In the fast paced 21st century everything is dynamic and changes within a blink of an eye. Our cultures,
traditions and social values are also not spared from this change. Admist juggling jobs, trying to achieve
economic security and independence we have lost hold of the basis of the foundation of our institution
of marriage. once known as a sacrament and a bond that would cease only on the death has now been
put down to the standard of just a civil union. Infidelity, lack of communication, building stress due to
day to day life, emotional in availability and because of various such other reasons the couples lose the
compatibility they once shared leading to quarrels, fights and as we all are aware these eventually are
settled on by way of 'divorce'.
Divorce causes a great deal of emotional instability and trauma on the partners and their families. Unlike
the movies which are highly romanticized, real life marriages require constant efforts from both the side
to keep it stable and working. However, this doesn’t work out in some cases and they end up being in
Family Courts asking for a settlement.
The sufferings due to marital disputes causes deleterious effects on the children because, they are
dependent on their parents. During the court proceedings and settlements it's the children who become
a commodity which is juggled from one guardian to the other.
The causes of a failed marriage varies and due to this variation the Supreme Court of India has taken the
liberty to access the degree of severity of friction between the spouses and liberate the restrictive
clauses of the Hindu Marriage Act, 1955.
The concept of marriage has changed with economic independence and has been overshadowed by the
glamour of the 21st century. Once termed as bond of a lifetime has been dragged down to the standard
of a civil union which can be easily broken off leaving no strings attached.
