[19*/* June, 1957.] B E it enacted by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):— Short title construction and citation. N08. 4712, 6471, 5633. 1. This Act may be cited as the Weights and Measures (Amendment) Act 1957 and shall be read and construed as one with the Weights and Measures Act 1939 (hereinafter called the Principal Act) and any Act amending the same which Acts and this Act may be cited together as the Weights and Measures Acts. Amendment of No. 4712 s. 4. Interpretation. 2. At the end of section four of the Principal Act there shall be inserted the following sub-section:— " (2) In this Act any reference to weighing instruments or measuring instruments used in trade or used for trade or for use in trade or any like expression shall include a reference to public weighing instruments and public measuring instruments." 3. In sub-section (2) of section fifty-seven of the Principal Act after the words " such municipalities " there shall be inserted the words " immediately prior to the date of such dissolution ". Section eighty-one of the Principal Act as amended by any Act is hereby amended as follows :— Amendment of No. 4712 8. 81 as amended by No. 6471 8. 37. Weight, Ac., of loaves of bread. (a) In paragraph (b) of sub-section (2) for the words " three slashes across the upper surface " there shall be substituted the words " not less than three and not more than five slashes across the upper surface but not longitudinally along the loaf"; (b) In sub-section (2) for the expression commencing " and no bread " to the end of the sub-section there shall be substituted the expression " and for the purposes of this Division any bread which is marked in the way referred to in paragraph (b) of this sub-section shall until the contrary is proved be deemed to be Vienna bread, and any bread not so marked shall until the contrary is proved be deemed to be bread other than Vienna bread " ; (c) For paragraph (iv) of the proviso to sub-section (4) there shall be substituted the following paragraph:— " (iv) for the purposes of this sub-section— (a) subject to sub-paragraphs (d) (0) (/) and.(#) of this paragraph a loaf shall purport to be a one pound loaf if it weighs not more than one pound three ounces; (b) subject 1957. No. 6093 (6) subject to sub-paragraphs (d) (e) (/) and (g) of this paragraph a loaf shall purport to be a two pound loaf if it weighs more than one pound three ounces and not more than two pounds six ounces ; (c) subject to sub-paragraphs (d) (e) (/) and (g) of this paragraph a loaf shall purport to be a four pound loaf if it weighs more than two pounds six ounces ; (d) a Vienna loaf shall purport to he a twelve ounce Vienna loaf if it weighs not more than fourteen ounces ; (e) a Vienna loaf shall purport to be a twenty-four ounce Vienna loaf if it weighs more than fourteen ounces; (/) in the case of a type of bread which is specified for the purposes of paragraph (b) of sub-section (1) of this section and for which only one denomination is prescribed, a loaf shall purport to be of the denomination so prescribed ; (g) in the case of a type of bread which is specified for the purposes of paragraph (b) of sub-section (1) of this section and for which two or more denominations are prescribed, the denomination of which a loaf purports to be shall be as prescribed for the purposes of this sub-paragraph having regard to the standard weight of such loaf— and for the purposes of this proviso no loaf purporting to be of any denomination shall be taken into account 1957. No. 6093- account if it exceeds the weight prescribed for such denomination by more than— (h) in the case of a four pound loafsix ounces; (i) in the case of a twenty-four ounce Vienna loaf—four ounces; (j) in the case of a loaf of the heaviest or only denomination* prescribed for a loaf of a type of bread specified for the purposes of paragraph (b) of sub-section (1) of this section —the appropriate weight prescribed for the purposes of this sub-paragraph". 521
