Performance of the system-issues
raised
• 15 November 2016: Indonesia started issuing FLEGT Licences
• Continuous and increasing influx of FLEGT Licences to EU
• Positive feedback on FLEGIT
• Also, various questions and requests for clarifications/guidance to the EC:
responses to most of them.
• Continuous communication with the LIU, in order to address all issues raised, to
find solutions and ensure the successful implementation the FLEGT Licencing
Main issues/questions raised my MS FLEGT CAs
- Clarifications on prefix "ex":
The prefix "ex" (or "ex-out") means "out of" and when applied to an HS code,
indicates that this code contains only part of the referenced subheading, as specified
in the description.
- Weight of shipment, cases where only wooden part net weight was stated on the
FLEGT Licence.
Addressed with IND: total net weight of the shipment and not just the wooden part in
the case of combination of materials.
- No FLEGT Licences issued for exhibition products and samples:
Addressed with IND: all products under Annex 1 need a FLEGT licence for import, no
exemptions for samples nor exhibition products.
Main issues/questions raised my MS FLEGT CAs
-FLEGT Licences for 15 additional HS codes not covered by FLEGT:
addressed to IND, only V-legal documents for these HS codes
-precision of species (to avoid .spp, in particular for species groups where some
species are protected): addressed with IND
-product name in English: addressed with IND
-Differences on information (weight, volume, units) between the FLEGT Licence and
the Invoice:
addressed with IND, checks and consistent approach.
Main issues/questions raised my MS FLEGT CAs
-mismatch between HS codes included in the FLEGT Licence and in customs
declaration, mismatches on the level of 6 digit WCO tariff codes: various cases were
reported by MS FLEGT CAs. AT will make a short presentation with specific
cases
a) Non paper with different scenarios and suggested ways to deal with
b) Issues addressed to IND.
c)IND will effectively put the WCO 2017 classification into implementation by 1.3.2017
in IDN Customs system

Samples of signatures and stamps of the Licensing
Authorities (LAs)
¾ Hard copies with samples of signatures and stamps of 22 Las and a
blank FLEGT Licence template available for the MS FLEGT CAs.
¾ Samples already incorporated in FLEGIT
¾ We have requested the LIU samples for the 23rd LAP(T. Borneo
Wanajaya Indonesia) that was recently added on SILK:

Issues for discussion with MS FLEGT CAs
-FLEGT reporting, question 2(a):
1) total quantities in FLEGT Licences or total quantities as cleared by
Customs?
2) HS codes as in FLEGT Licence or actual ones as in Customs Declaration
(in case of HS misclassification)?
3) Will ignored FLEGT Licences be reported?
*Do FLEGT CAs collect information on the actual quantities cleared by
Customs? If not, can they collect it?
-treatment of FLEGT Licences with HS misclassification
-treatment of FLEGT Licences in the case of differences in weight/volume
between the licence and the actual shipment
-any other issues
