ORDINANCE NO.
313
AN ORDINANCE RELATING TO A SPECIAL ANCHORAGE AREA FOR BOATS
WITHIN THE CITY OF NAPLES, FLORIDA; PROVIDING FOR RULES AND
REGULATIONS; PROVIDING FOR THE DESIGNATION OF A HARBOR MASTER;
AND PROVIDING AN EFFECTIVE DATE. PURPOSE: TO PROVIDE LOCAL
CONTROL AND ADMINISTRATION OF THAT AREA ESTABLISHED AS A SPECIAL
ANCHORAGE AREA.
WHEREAS, the City of Naples has requested that the hereinafter
describd area be established as
Area"; and
a
"Special Anchorage
WHEREAS, in conjunction therewith, the City is required to
designate a Harbor Master for the purpose of providing local control and administration of said
anchorage area;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
NAPLES, FLORIDA:
SECTION 1.
DEFINITIONS. For the purposes of this ordinance,
the following words and terms shall have the
meanings respectively ascribed to them, as follows:
(a) Special Anchorage Area. That area designated
and approved as a "special anchorage area"
by the U.S. Coast Guard, lying within 200 feet
south and east of the-city-owned bottomlands
used for the City Docks and more particularly
described as follows:
Beginning at the southwest corner of said
city-owned bottomlands at a point on the
bulkhead line established by Resolution No.
674, run south 200 feet; thence east 450 feet;
thence north 535 feet; thence west 200 feet to
the easterly property line of the city-owned
bottomlands as referred to above, said area
being depicted on the attached Exhibit "A" as
the"special Anchorage Area."
SECTION 2.
(b)
Boat or vessel. Every description of a selfpropelled watercraft used or capable of being
used as a means of transportation on water,
including all types of boats and all uses thereof.
(c)
Harbor Master. The person charged with the
responsibility of directing the mooring and
removal of vessels within the special anchorage
area herein defined and enforcing and executing
the rules and regulations pertaining thereto.
(d)
Moor. To secure a vessel or boat by line, cable,
or other device to any anchoring facility provided within the special anchorage area.
The Director of Parks and Recreation shall be the
Harbor Master and is hereby authorized and directed
to promulgate and enforce rules and regulations for
the use and operation of the anchoring facilities
within the special anchorage area, subject to the
approval of the City Manager. In addition thereto,
all rules and regulations pertaining to the City of
Naples Municipal Docks and all health and sanitary
regulations governing the use of boats shall be observed
by persons mooring boats in the special anchorage area.
The Harbor Master may designate such deputy Harbor
Masters as ma y be necessary to assist the Harbor Master
in performing his responsibilities.

SECTION 3. Any person desiring to moor a boat in the special
anchorage area shall pay the following rental fee
in advance at the City of Naples Municipal Docks:
(a) Transient - $3.00 per day, plus state sales
tax.
(b) Regularly moored boats - $45.00 per month,
plus state sales tax, payable in advance on
the first day of each month.
SECTION 4. Enforcement of the rules and regulations pertaining
to the special anchorage area and collection of the
rental fees provided herein shall be the responsibility
of the Harbor Master. The Harbor Master shall have
the right to order any boat or vessel moored within
the special anchorage area to vacate the facility
for violation of any rule or regulation pertaining
thereto, for nonpayment of the rental fee herein
provided, or for any good or reasonable cause related
to the safety, peace and quiet of the special anchorage
area or the City Dock area. Upon the owner's failure
or refusal to comply with said order, the Harbor Master
shall cause such vessel to be removed from the anchoring
facility and assess reasonable charges therefor against
the owner of the vessel.
SECTION 5. The use of the anchoring facilities in the special
anchorage area shall be on a first-come, first-served
basis. Said area is for the general use of the public
and no vessel may be denied the use thereof without
good cause. The Harbor Master may designate one or
more of the mooring facilities within said anchorage
area for the use of transient boats as defined in
the City Dock regulations. Said determination shall
be made with a view toward providing a reasonable
number of docking or mooring facilities for transient
boats in the Naples area and may be changed from time
to time, depending upon the demand for such facilities
and the demand for permanent mooring facilities.
SECTION 6. The City shall not be liable for damages to any
vessel utilizing the anchoring facilities in the
special anchorage area or for damages resulting from
the removal of any vessel pursuant to Section 4 hereof.
SECTION 7. This ordinance shall take effect immediately upon
adoption.
