The meeting convened at 7:56 p.m.
I. Discuss request from Kasey Crawford Kellem for a conditional use permit for an
arts and wellness center for children at 27366 Center Ridge Road.
Applicant requested prior to the meeting to postpone this request until a future time.
The item will remain in committee until notification from applicant.
II. Discuss Ordinance 2016-149, amending §1216.03 footnotes (0)(1) and (0)(5) as to
licensed child care facilities and preschool facilities in business districts.
Planning Director Bedell explained that this draft evolved during several meetings with
the planning commission. (See attached memo dated 4/10/17.) The original request was to
remove the requirement in General Business and Shopping Center districts that licensed day
care centers are only permitted in standalone buildings and the sole use on the parcel and also
to increase the maximum building coverage from 15 to 35 percent. The planning commission
had concerns regarding safety as there could be multiple uses in a shopping center, and a
playground may be near uses that are dangerous for children, such as dumpsters. compactors or
driveways. They also noted that a comprehensive look at day care in the zoning code was
needed because regulations for them are located in multiple places, and there may be limited or
conflicting regulations.
The first step is to add a new Chapter 1226, Standards for Specific Uses. This provides
a location to consolidate regulations for uses that are permitted in various chapters of the
zoning code. It eliminates the need to duplicate regulations in multiple chapters that may result
in inconsistent regulations.
The second step is to relocate all ofthe existing licensed child day care center and adult
day care facility regulations throughout the code to this new Chapter 1226 and make
corrections where needed, such as using standardized language. This better organizes the code
and makes it easier for the public to find the requirements for licensed child day care centers.

The third and final step is to add regulations specific to licensed child day care centers
in a new section 1226.02 to address the aforementioned concerns regarding safety and
playground design with an emphasis on licensed child day care centers being largely the same,
whether in a standalone building or in a shopping center. To this end, regulations were drafted
specific to playground design and location, parkingand loading requirements, pedestrian safety
features, security, etc. The planning commission recommended that Council adopt the
proposed regulations to improve Westlake's standards for licensed child day care centers, with
the caveat that, when located in the General Business and Shopping Center districts, they will
continue to be only permitted in standalone buildings and the sole use on the parcel with the
maximum building coverage remaining at 15 percent. Any existing licensed child day care
centers that do not meet the new regulations may continue to operate as legally non
conforming uses. These recommendations were reviewed by the Police and Law departments.
No suggested changes were made for adult day care facilities.
Motion by Mr. Brady, seconded by Mr. Getsay, to recommend to Council that
legislation be drafted relative to planning commission's recommendations as outlined in
Mr. Bedell's memo dated 4/10/17. Motion carried, 3 yeas, 0 nays.

This draft evolved during several meetings with an emphasis on providing language that would
make a daycare center the same in a shopping as it would be in a standalone building. These
recommendations were reviewed by the Police and Law Departments.
Timeline
10/18/16 - application is received.
11/9/16 - PZL moves to have the Law Director draft an ordinance (see original ordinance
on page 2 of this memo), cited safety concerns from the Police Department when day
care regulations were drafted in 1997-98.
11/17/16 - meeting with applicant. Planning and Captain Turner to discuss safety
concerns noted in his memo.
11/17/16 - Council refers ordinance to the Planning Commission.
11/30/16 - Police Chief, Planning Director and applicant meet to discuss Captain
Turner's safety concerns.
12/5/16 - the commission tabled the ordinance because they required time to consider
information presented at the meeting, such as a traffic report that was received from the
applicant earlier in the day that they had not been reviewed by them or staff.
1/9/17 - the commission asked staff to provide additional draft regulations to address
safety concerns from the Police Department along with a holistic view of them.
2/2/17 - Planning Director meets with applicant to discuss draft changes resulting from
prior meeting.
2/6/17 - the commission reviewed the revised draft and made additional suggestions for
text amendments including reorganization and/or consolidation of the regulations and
comprehensive recommendations for safety and legal measures.
2/23/17 - this was a work session where the commission reviewed suggested code
amendments and discussed the proposal with the applicant. After this meeting, staff
incorporated additional language regarding parking lot safety, playground design and
dumpster locations.

3/6/17 - the commission reviewed the revised draft and made suggestions for additional
code amendments regarding playground location in relation to existing equipment such as
compactors behind buildings and parking lot safety. The applicant asked that it be tabled
so they can see these changes before they are acted on by council.
4/3/17 - the commission reviewed the revised draft and an additional amendment was
requested to include mechanical equipment in the section regarding distances from
dumpsters and compactors [1226.02(c)(l)(e)(7). In spite of these efforts, concerns
remained about the number of locations that would be available if the code were amended
to allow child day care centers in multi-tenant buildings in General Business and
Shopping Center Districts and the appropriateness of them in shopping centers where
there may be conflicting uses within the centers and behind them where playgrounds may
be located. Therefore, the commission recommended the draft amendments, including
provisions for mechanical equipment as stated above, and with day care facilities to
continue to be in stand-alone buildings and the sole use on a parcel in the General
Business and Shopping Center zoning districts.

New Draft Recommended from the Planning Commission
1. The first action is to add a new chapter, Ch. 1226 Standards for Specific Uses. There
currently is not a Chapter 1226 in the zoning code. There are Chapters 1225 and 1227.

To include uses that are permitted in various areas of the Zoning Code, as there is less
chance for overlap and it is more likely to be found by the public than the scattered
fashion we have today, where regulations are located throughout the code and at
times inconsistently.

Not to be confused with Chapter 1230, General Provisions, which was added in 2015
for typical regulations that apply throughout the code, such as for unobstructed sight
zones at corners and parking lot lighting.

This new chapter will provide a location for standards relative to specific uses
permitted in various districts of the Zoning Code.
This eliminates the need to duplicate regulations in each chapter and is one of the
reasons for the current question of whether the code is inconsistent in regard to
daycare centers.

Should eventually include specific regulations for uses that are scattered throughout
the code, such as car washes, shopping centers, restaurants, institutional uses, etc.
2. The second part is to relocate all of the day care text scattered throughout the code to
this new Chapter 1226 and make corrections where needed.

Buildings and land shall be used and buildings shall be designed, erected, altered, moved,
added to or maintained in a Planned Unit Development (PUD) District only for those uses set
forth in this chapter and in schedules and regulations of this Zoning Code,
(g) In addition to the uses set forth in this section, the following uses may be permitted in
Planned Unit Development (PUD) Districts of more than fifty acres of contiguous land defined
as the development area, with the approval of the Planning Commission, Council and, if required
by Charter, the majority vote of the electors:

(2) Applicant must apply for, obtain and maintain annual certification from the Ohio
Department of Human Services, the Ohio Department on Aging and/or their designated regional
agency to operate as a PASSPORT provider, or in the event that the PASSPORT program is
discontinued, apply for. obtain and maintain a similar license from the State of Ohio for adult
day care facilities. Applicant must comply with any and all future applicable State licensing
requirements as they are implemented.
{$)—All adult day care facilities to be located on a single floor with ground level access to all
doors without stairs.
(4)—Adult day care facility shall contain not less than 90 square feet of gross floor area per
person with not less than 60 square feet per person of net indoor activity and living area. In
addition, adult day care facility shall provide not less than 35 square feet per person of outdoor
sitting, walking and activity area.
(§}—The outdoor activity area shall be completely enclosed in a minimum 5 foot high fence
with locks and alarm monitored gates.
(&)—A drop off and pickup area shall be provided with handicap accessible access within 30
feet of the main entrance and provide a vehicle storage lane for not less than six vehicles.
(7) The main entrance to the building and all emergency exits shall be accessible to
emergency medical vehicles and fire emergency vehicles.

1226.01 INTENT AND SCOPE OF APPLICATION. (Note: this is at the start ofevery
chapter)
Each use listed in this article, whether permitted by right or subject to approval as a
conditional use, shall be subject to the site development standards specified, in addition to
applicable standards and regulations for the district in which the use is located. These
standards are intended to alleviate impacts and assure that such uses are compatible with
neighboring properties and the orderly development of the district.
Unless otherwise specified, each use listed in this article shall be subject to all
applicable yard, bulk and other standards for the district in which the use is located.
Compliance with the standards in this article does not relieve the owner or operator of a
permitted use from complying with additional standards in other applicable city ordinances.
1226.02 LICENSED CHILD DAY CARE CENTERS, PRESCHOOLS, ADULT DAY
CARE FACILITIES
(a)
Conditional Use Permits. In addition to the requirements of this chapter, conditional use
permits for licensed child day care centers, preschools. and adult day care facilities shall
be in accordance with the general conditions of Section 1227.03 (Note: this was moved
herefrom footnote (k) and (n), but it is here because it really applies anywhere that
these uses are established).
(b)
Development Plans. When required, development plans shall be provided in accordance
with Chapter 1220. (Note: this is new but useful in conveying what is expected).
Licensed Child Day Care Centers and Preschools shall be permitted in accordance with

the following requirements:
(1) General requirements:
a. The lot contains sufficient land and size to provide adequate open space,
safe vehicular, pedestrian, and emergency vehicle access, good circulation
patterns and vehicle queing on the property. (Note: this was formerly just
for footnote (o) but apply anywhere these uses are established)

b. Child day care centers shall be licensed through the Ohio Department of
Job and Family Services pursuant to Section 5101:2-12 of the Ohio
Administrative Code (OAC) as may be amended from time to time.
c. An access site plan shall be provided indicatingthe following:
1. All building entrances shall have entry password protected locking
doors.
2. Safe pedestrian routes and access for parkinglots and driveway
areas used for the licensed child day care center including safety
measures, such as:
i. Pedestrian signage and pavement word and symbol
markings at pedestrian crossings, driveways, travel lanes,
and other key locations within the parking lot to warn
motorists of a potentially high concentration of children,
such as pavement text and/orstriping, warning lights, stop
signs, yield signs, signs with "Caution - Children's
Crossing" or other cautionary messages.
ii. Pedestrian refuge islands.
iii. Speed bumps or speed tables.
d. Dedicated vehicular drop-off/pick up locations:
1. Shall be within 30' ofthe entrance, unless otherwise provided at
the street by school bus or public transportation.
2. Shall be provided at sidewalks leading to the licensed child day
care center and marked clearly with signs and/or striping in
parking lots and driveways.
3. May be provided as a reserved parking areaor a paved
unobstructed drop-off/pick-up lane adjacent to the licensed child
day care center.
4. If parking spaces are not contiguous to the entrance sidewalk, then
a walkway shall be provided with diagonal striping to spaces.
5. The number of reserved parking spaces or stacking spaces in a
drop-off/pick-up lane shall be provided in accordance with the
following formula:

e. Playgrounds shall be provided in accordancewith the requirements of the
OAC and the following regulations:

exterior by a series of steel bollards.
2. Playgrounds shall not be located within a required setback area.

3. Playground equipment shall be in earth tone colors when visible
from adjacent streets or residences.

parochial primary or secondary school. Licensed child day care centers
and preschool facilities are not permitted as main uses in residential
districts. (Note: This is new)
b. Planned Unit Developments. Licensed child day care centers and
preschool facilities shall be a conditional main or accessory use in
accordance with this chapter or as otherwise provided for in the PUD
and/or conditional use permit ordinances. (Note: This is new)
c. Planned Office District and Office Building Districts. (Note: similar
regulations for both districts are combined here). Licensed child day
care centers and preschool facilities shall be a conditional main or
accessory use in accordance with this chapter. The following additional
requirements shall apply when located in a new standalone building
constructed for the purpose of a licensed child day care center or preschool
facility:
1.

(7) The main entrance to the building and all emergency exits shall be accessible to
emergency medical vehicles and fire emergency vehicles.
(8) Compliance with Chapter 1383 of the Building Code is required.
