Responses:
Section 1 of the Freedom of Information Act 2000 places two duties on public authorities. Unless
exemptions apply, the first duty at Section 1(1) (a) is to confirm or deny whether the information specified
in a request is held. The second duty at Section 1(1) (b) is to disclose information that has been
confirmed as being held.
Where exemptions are relied upon Section 17 of the Freedom of Information Act 2000 requires Dyfed
Powys Police, when refusing to provide such information (because the information is exempt) to provide
you the applicant with a notice which: (a) states that fact, (b) specifies the exemption in question and (c)
states (if that would not otherwise be apparent) why the exemption applies.
I can confirm that Dyfed-Powys Police holds some of the information that you have requested. However, I
can confirm that we are withholding some of the information since we consider that the following
exemptions apply to it:
Section 31(1)(a)(b)(c) Law Enforcement
Section 38(1)(a)(b) Health and Safety
Section 40(2) Personal information
Section 40(2) Personal Information
Section 40(2) applies to third party personal data. This would not be released under the Freedom of
Information Act 2000 unless there is a strong public interest. This is because any release would
breach the Data Protection Principles contained within the Data Protection Act (1998), which in this
case is Principle 1 whereby data must be fairly and lawfully processed. One of the main differences
between the Freedom of Information Act (2000) and the Data Protection Act (1998) is that any
information released under FOI is released into the public domain, not just the individual requesting
the information. As such, any release that identifies an individual through releasing their personal
data, even third party personal data is exempt. Personal data is defined under the Data Protection
Act (1998) as data that is biographical in nature, has the applicant as its focus and/or affects the data
subject’s privacy in his or her personal, professional or business life. All members of staff and the
public have an intrinsic right to privacy and these rights are protected by virtue of the Human Rights
Act and the Data Protection Act. Release of the information subject to the exemption is likely to
compromise those rights.
The Section 40 exemption is an absolute, class-based exemption. This means that the legislators
when writing this piece of legislation considered that the release of this type of information would
cause harm to either the authority or the individuals involved. Therefore the Force does not need to
carry out a harm test for this exemption.
The Section 31 Law Enforcement and Section 38 Health & Safety exemptions are qualified,
prejudice-based exemptions and, as such I am required to apply both the harm and public interest
test and evidence the harm in disclosure. (See below)
Section 31(1)(a)(b)(c) – Law Enforcement
(1) Information which is not exempt information by virtue of section 30 is exempt information if its
disclosure under this Act would, or would be likely to prejudice –
(a) the prevention or detection of crime
(b) the apprehension of offenders
(c) the administration of justice
S38 (1)(a)(b) Health and Safety
Information is exempt information if its disclosure under this Act would, or would be likely to (a) endanger the physical or mental health of any individual, or
(b) endanger the safety of any individual
Evidence of Harm:
In relation to this particular request the applicant has requested the direct work contact details of all
ICT personnel.
First and foremost the Police service is charged with enforcing the law, preventing and detecting
crime and protecting the communities they serve. The ICT personnel identified in this request for
information are responsible for different areas of the ICT systems that are in place to provide frontline police officers with the information they need to become more effective and at the same time
provide "back office" systems, freeing officers to concentrate on the fight against crime. All this is
held together by a communications network that can deliver voice and data to where it is needed. In
terms of ICT security, this is in place to ensure that our systems remain secure through close
monitoring of our internal computer systems, internet and e-mail usage and by actively enforcing
System usage policies to ensure that we remain vigilant against potential threats we may face in the
future.
As a consequence, the release of the direct contact details of certain ICT personnel could endanger
the health and safety of not only the staff member, but also members of their family. Furthermore, to
release all direct contact details of ICT staff would not benefit the community, but would highlight that
certain staff members are responsible for the security of the Force ICT systems. This would give
potential offenders the opportunity to target those staff members to extract security measures
adapted to and within the premises, which would cause considerable harm not only to Dyfed-Powys
Police but to the police service in general as the release of the requested information would be likely
to compromise and possibly damage the law enforcement process as it would inhibit its efficacy to
fulfil its core functions of the prevention and detection of crime, the apprehension or prosecution of
offenders and or the administration of justice.
Therefore I am satisfied that the Section 40(2) Personal Information, Section 31(1)(a)(b)(c) Law
Enforcement and Section 38(1)(a)(b) Health and Safety exemptions are engaged and applicable to
the release of the information.
Public Interest Test:
Section 40:
This is a class based absolute exemption and there is no requirement to consider the public interest
test in this area.
Section 31:
Factors favouring disclosure:
The Police service is charged with enforcing the law, preventing and detecting crime and protecting
the communities they serve and there is a public interest in public awareness and debate where
disclosure of the requested information can assist individuals by raising awareness of issues which
may be of relevance to them.
Factors favouring non-disclosure:
To release direct work contact details that relate to ICT Security, would affect the efficient and
effective conduct of the force whereby the current or future law enforcement role of the force may be
compromised as it would inhibit its efficacy to fulfil its core functions of the prevention and detection
of crime, the apprehension or prosecution of offenders and or the administration of justice.
Section 38:
Factors favouring disclosure:
To release information concerning direct work contact details that relate to ICT personnel could
provide the public with information which could assist in an improved and factual public debate.
Factors favouring non-disclosure:
This has to be balanced against the evidence of whether there is a significant risk to the physical or
mental health of an individual or individuals. Some individuals within the Force feel that the
disclosure of their employment with Dyfed Powys Police and their direct contact details can affect
their health and safety outside of working hours. Furthermore, all members of the public can contact
Dyfed Powys Police through the 101 service for all non-emergency calls.
Balancing Test:
After considering the advantages and disadvantages in disclosure it falls upon Dyfed-Powys Police
to conduct a balance test on the issues. The strongest argument for release which is Public
Awareness and Debate needs to be weighed against the strongest argument for non release which
in this case is Efficient and Effective conduct of the force and Public Safety. The police service will
never disclose information that places the public at risk, unless the public interest in doing so is more
powerful than that risk. In this case there would be no tangible community benefit by the release of
certain direct ICT contact information which is the main focus in considering the public interest; as all
members of the public can contact Dyfed Powys Police for all non-emergency calls through the 101
service. Therefore, at this moment in time the balance of non disclosure outweighs the balancing test
for disclosure therefore disclosure is not made out.
