CES Minimum Requirements
U.S. Department of Labor Compliance
The Department of Labor has advised U.S. Customs and Border Protection (CBP) that CES
facilities may be subject to the Service Contract Act (SCA) of 1965, as amended. If so, CES
Operator (CESO) compliance is strictly enforced. For further information, see Attachment 3, or
contact the Department of Labor.
McNamara-O’Hara Service Contract Act (41 U.S.C. § 6702) and Federal Acquisition
Regulations (FAR) Compliance
The CESO is responsible for complying with the McNamara-O’Hara Service Contract Act, 41
U.S.C § 6702, et seq. (formerly cited as 41 U.S.C. § 351, et seq.), where applicable, and the
Federal Acquisition Regulations (FAR) found at FAR 52.222-1 and 52.222-41 through 52.22243. For further information please see Attachment 3, or contact the General Services
Administration (GSA).
CES Operational and Facility Characteristics
The following criteria are the minimum standards for operational and facility characteristics that
must be present to be considered for designation as a CESO. Failure to meet any of the
minimum standards will preclude the applicant from consideration.
The CESO must be able to provide service and use of the Trade and Agriculture Enforcement
CES and/or the A-TCET CES (also referred to herein as the CES facility) based upon the needs
of CBP. Normal operating hours for CES facilities will be from 07:00 a.m. to 05:00 p.m.,
Monday through Friday, but may be increased to include a second (swing) shift and/or weekends
based upon workload.
Based upon the operational needs of CBP, the CES facility must be available for use on a 7-day,
24-hour basis. CBP will be responsible for advising the CESO when after-hours services will
need to be provided. After-hours availability may be required on a regular and recurring basis.
Access to all CBP designated office space and equipment storage areas within the CES must also
be available on a 7 day, 24 hour bases. Specific procedures for this access will be determined on
a case-by-case basis following the final determination of the designated CES locations.
The CES facility must have a permanent physical barrier separation between CES cargo and any
other cargo and/or items not specifically under CBP control or assigned to the CBP area by the
CESO. Permanent is to mean not capable of being moved without the use of heavy equipment
and not able to be physically scaled.
All CBP designated areas and the CES facility must have a professionally installed, working
alarm system. The system must be capable of monitoring all entrances (through either hard
point, motion detector, or any other means of effective coverage).

All CBP designated areas must have controlled/restricted access from the public and/or
unassigned personnel. All CESO employees involved in CES operations must be issued an
identification card by the operator, with a clear designation for CES access. This ID card must
be visible and worn by CES employees when engaged in CES operations.
The CES facility must be subject to security controls (i.e., viewed by Closed Circuit TV, roving
guard patrols, etc.) on a 7-day, 24-hour basis.
Entrance to CBP controlled gates and buildings must utilize a HSPD-12 compliant Physical
Access Control System. The access card readers must be both 125 kHz (proximity capability)
and 13.56 (HSPD-12 compliant) compatible.
CES Minimum Requirements
The CESO must provide an internal or company operated container tracking/availability system.
The tracking system must be capable of providing the ability to find information on current and
past inspections conducted at the CES. At a minimum, the information should be capable of
being organized by status, examination type, carrier, bill of lading number, and container
number.
The CESO is responsible for funding all fixed and recurring costs associated with the
acquisition, installation, and/or relocation of all office equipment, furniture, and data/voice
equipment and communication lines either through direct payment to a CBP approved vendor, or
by reimbursement to CBP.
The CESO must also provide an elevator within the CES facility.
The CESO offered facility must meet the American Disabilities Act (ADA) per local code
requirements.
The CBP Office of Administrations (OA) Project Manager (PM) has final written approval
authority for meeting CBP operational requirements and will provide official CBP specifications
to the CESO, as needed.
Area of Consideration
The geographic boundaries of the area of consideration for potential Trade and Agriculture
Enforcement CES locations for this announcement are within 10 miles of 2430C Mariner Square
Loop, Alameda, CA 94501. The boundaries for A-TCET Enforcement CES locations for this
announcement are within 6 miles of 700 Maritime St., Oakland, CA 94607.

Yard Area
The CES facility must have a dedicated fenced container storage area. The yard facility must
consist of secured fencing that encloses the areas around cargo storage structures, support
buildings and exterior stored cargo. The area must be subject to security controls (i.e., viewed by
Closed Circuit TV, roving guard patrols, etc.) on a 7-day, 24-hour basis.
The Closed Circuit TV system must be recorded 24/7 with a minimum 30-day retention period.
The Closed Circuit TV system must be accessible to CBP at all times.
Bi-annual checks for fencing repair must be conducted and reported to the CESO. If repair is
needed due to inclement weather, accidents, etc., repairs must be conducted immediately by the
CESO.
The minimum standard for container storage capability of the CES is two container yard spaces
for each container space at the door (one is in front of the door outside and two additional spaces
in the common yard). For example, if the facility has 10 cargo doors each servicing 2 containers,
there must be a minimum of 20 container spaces available elsewhere in the yard. This would
result in a minimum ability of that yard to hold 30 containers. However, for every additional
door space two additional spaces must be provided.
A minimum of two yard tractors for the movement of containers within the complex is required.
The CBP OA PM has final approval authority for meeting CBP operation requirements and will
provide official CBP specification to the CESO, as needed.
Cargo Doors
The number of cargo doors is interpreted as the number of containers that can be worked
simultaneously at each entrance and dedicated full time for CES operations, regardless of
workload.
The cargo door entrances must be the same height as the dock. If not, specialized equipment
must be present to ensure that de-vanning/re-vanning of cargo is completed in an efficient
manner.
A minimum requirement of the Trade Enforcement and Agriculture Enforcement CES is 6 doors.
A minimum requirement of the A-TCET CES is 6 doors.
A minimum requirement for a CES operating as both an A-TCET and Trade and Agriculture
Enforcement CES is 12 doors each capable of servicing 2 containers simultaneously or a
warehouse apron capable of staging 24 containers, with the capacity of servicing 2 containers,
simultaneously.
The CBP OA PM has final approval authority for meeting CBP operations requirements and will
provide official CBP specification to the CESO, as needed.

Warehouse Facilities
The CES facility must fully comply with the occupational Safety and Health Act (OSHA)
standards.
At a minimum, electrical outlets must be available at every third door/container.
In the examination area, lighting must provide sufficient illumination to meet safety
considerations and examination requirements.
Container positions must include a safe, dependable, and recurring means of illuminating the
interior of container being unloaded.
The CES facility(s) must have a minimum of 10 outlets for refrigerated containers.
The CBP OA PM has final approval authority for meeting CBP operations requirements and will
provide official CBP specification to the CESO, as needed.
Floor Space
The CESO must have the ability to ensure that de-vanned cargo is repacked in the same manner
in which it was originally packed.
Minimum standard is the ability to unload a forty-foot container and stack cargo in one straight
line at each cargo door dedicated for CBP use.
In most cases, cargo must be stacked no higher than 4 feet high (depending on characteristics of
the cargo. For example, exceptions would be very large crates, machinery, etc.).
A minimum of 6 feet of open floor space (on each side) is required for each shipment staged for
inspection.
A minimum of 1,000 square feet of open floor space adjacent to the door and between the door
and the area where cargo is to be staged for inspection is required.
The minimum cargo staging area dedicated full-time for CES operations regardless of workload
for CBP at each CES designation is 25,000 square feet.
The CES must have an additional dedicated area for Containerized Freight Station (CFS) cargo.
This area must be dedicated full-time to CFS cargo regardless of workload.
Minimum CFS cargo area for Trade and Agriculture Enforcement is 2,500 square feet (25L x
100W, desirable). Minimum CFS cargo area for A-TCET Enforcement is 2,500 square feet
(25L x 100W, desirable).

Storage
The CES facility must have a permanent enclosed high security storage area, capable of being
locked for temporary seizures/detentions. This area must be dedicated full-time for CES
operations regardless of workload.
The minimum space requirement for storage area for the Trade and Agriculture Enforcement
CES is 2,500 square feet. The minimum space requirement for storage area for the A-TCET
Enforcement CES is 2,500 square feet. (25ft L x 100ft W, desirable)
Permanent means NOT capable of being moved without the use of heavy equipment and NOT
able to be physically scaled. For instance, “Jersey” k-rail barriers alone would not meet both of
these requirements, unless it had specific fencing that could not be easily lifted running
completely to the ceiling and/or had barbed wire attached to it with a locking gate.
Minimum CBP Office Space Requirements
CBP office space must be secure and subject to security controls (i.e., intrusion alarms, CCTV,
access control at all entrances that default to coded cipher locks in event of an emergency, coded
cipher locks on all doors with warehouse access, etc.).
CBP office space Intrusion Detection System (IDS) must have a UPS and monitored by a central
monitoring office on a 24/7 basis. Further details, design and information will be provided.
Separate private offices within the CBP Office must be provided for CBP Supervisor(s) use.
The kitchen/break room should include tables and chairs for a minimum of 10-15 people, to
include a microwave, sink with hot and cold running water and a refrigerator. This area should
also be stocked with paper towels, and soap, and maintained by custodial staff. All furnishings,
equipment and supplies shall be provided by the CESO.
Minimum numbers of workstations required: 10/10




Each work station must be a minimum of 8ft x 8 ft.
Minimum of 3 private offices (minimum space requirement are 150 square feet
each; 10 ft. L x 15 ft. W is recommended.)
Separate office space for Canine Enforcement Officers (CEO) and the Detector
Dogs must meet CBP specifications. (Please refer to minimum requirements
portion for the Canine handling area.)
Separate storage area for training aids, in close proximity to the Canine
Enforcement Officer’s office space.

Additional consideration, in the form of a standardized points system, will be given to those
applicants who exceed minimum required standards as well as the evaluation criteria.
Agriculture CES Inspection Areas:
CBP requires a designated agricultural inspection area in conjunction with the Trade and
Agriculture Enforcement CES at ports of entry where agricultural shipments are regularly
received. These shipments should have a designated area for inspectional operations. The
designated area should be as follows:






Inspection area and tables must be located in a safe, uncluttered area away from the flow
of warehouse traffic, i.e., pedestrians, forklifts, pallet jacks, wind and rain.
Inspection tables must not be used for cargo storage or any purpose other than
agricultural inspection and must be kept clean and dry.
The inspection area must be adequately ventilated with fans; wherever possible, the fans
are permanently mounted either on the floor or wall.
The inspection area is easily accessible for specialists and officers, i.e., not blocked by
cargo or equipment.
The CES must provide a secure area capable of being locked with a USDA-APHIS seal
for storing quarantined products, to be located within the warehouse or cooler.
The inspection tables should be smooth and cleanable. The surface should be painted
white or covered with white laminate to provide the greatest visibility.

A sturdy large table that is 36 x 40 inches high is ideal. The minimum width and length
of the table should be 48 W x 96 L inches. The table may be greater than the minimum
standards, but should not be smaller. In addition, the table surface should not have any
raised edges.
Good strong lighting is necessary to inspect agricultural products. Fluorescent lighting is
the best. Where possible, supplement the overhead fluorescent lighting with a table lamp
with a magnifier.
Two 96 inch fluorescent bulbs centered directly over each 48 x 96 inch section of the
inspection table is a minimum.
The light fixtures must be installed 44 to 56 inches above the inspection surface; do not
install light fixtures more than 8 feet above the floor surface.
Up to four tables to inspect and cut fruits and vegetables and agricultural commodities
should be available. A rubber floor mat should be supplied for each inspection table.
The interior inspection location protected from inclement weather, away from open
doorways and drafts so pests do not blow away or escape.
Inspection area and tables will be located away from any stacked cargo.
The CBP OA PM has final approval authority for meeting CBP operations requirements and will
provide official CBP specification to the CESO, as needed.
CES Agricultural Lab Area:
(Agriculture: Inspection; Safeguards: Disposal (7 C.F.R. § 352.10))
Pursuant to 7 CFR 35210, Agriculture: Inspection; Safeguards: Disposal, all new and modified
existing CBP operational facilities require inclusion of a CBP Agricultural Laboratory and
Disposal Room. The CBP Agriculture Laboratory and Disposal Room is the receiving point for
the testing and disposal of illegal agricultural items detected in the CES.
Agriculture Lab Specifications:

Installation provisions for telephones, data, and power connectivity in the CBP
Agriculture Laboratory are required to support the laboratory and to transfer and receive
data to assist in proper examination and reporting.

Laboratory flooring shall be of a washable non-slip material.

Walls and ceilings shall be washable, and floor drains provided.

Two desks, complete with telephones and chairs, must be provided. Each must have
lockable drawers and a large enough surface to hold one microscope yet still provide
writing workspace.

All activities conducted in the Laboratory are visual inspections oriented toward finding
insects or diseases, soil and seeds/seed pods that may be associated with the agricultural
product. The inspection techniques may include shaking or lightly beating/banging the
plant or plant product to shake loose the soil or insects. This process may cause dust and

debris to be released into the air and requires that such activity be conducted under a
vented hood to reduce the likelihood of inhaling dust materials.

Fume Hood Vent – Although not required, extra points will be granted for inclusion of
this item. The primary purpose of the fume hood is to exhaust dust associated with dried
material during inspection. Fume hood should be vented to the outside, provide 100%
exhaust, and provide negative air pressure to the outside of the lab.

Security Access Control: Access control requirements will be determined by CBP.

Communications – Two phone and data outlets.

Fixed Equipment - Built-in Stainless Steel work counters with back splash and knee
space, wall cabinets, lockable drawers, low storage cabinets, and 2 drawer files.

Mechanical Equipment - HVAC: Normal ASHRAE HVAC standards. Individual room
control, vented to outside. Provide 100% exhaust, and provide negative air pressure to
the outside of the lab.

Plumbing: Minimum5hp grinder stainless steel sink, Double stainless steel sink, floor
drains, 6” waste line. Wall behind stainless steel sink should have 24-inch high stainless
steel washboard extending 36 inches at both ends of sink. Emergency cut off switch for
grinder.

Fire Protection: Pop-down sprinkler heads.

Electrical: Normal convenience power standards. Multiple dedicated computer circuits.
Emergency power backup. GFI/Power receptacle above work counters.

Lighting: Surface mounted fluorescent lighting; 100 fc. Provide dual switched fixtures
to switch inner and outer lamps separately. Under-cabinet task lighting as required.

Door Material: 1 ¾” solid core wood or 12 gauge steel clad hollow door and frame (no
window).

Window Material: Tempered transparent mirror glass. No window treatment. Maximize
glass area.

Construction and Finishes
-Floor: Non-Slip tile
-Walls: 5/8” gypsum board over metal studs. STC rating 50-55, washable.
-Ceiling: 5 / 8” gypsum board (acoustical tile not permitted). STC rating 50-55.

Sanitary Facilities
CBP office space must have separate sanitary facilities for CBP use only. Separate sanitary
facilities must be provided for male and female employees. There must be a sufficient number of
facilities to accommodate all CBP employees assigned to the CES, and the number of facilities
must be sufficient to comply with applicable state building codes, based on the number of CBP
employees assigned. Anticipated CBP staffing for the CES location is 10-15 persons. Facilities
must have running hot and cold water available and supplied soap, paper towels and toilet paper.
Shower are not required, however, extra points will be added for a minimum of one male, one
female shower dedicated for CBP use only.
Maintenance /Janitorial Services
Regular maintenance and janitorial services must be provided by the CESO . Custodial staff may
not be issued any keys to CBP designated areas. Cleaning services are to be provided during
CBP’s hours of operation. Custodial services will not be required outside of normal operating
hours. The types of services required and minimum mandatory frequency are:

Trash pick-up..........................................................Minimum of once a day

Windows and blinds, carpet, vent, and/or other major cleanings…Bi-annually or as

The CES facility must have an exterminator/pest control program. The CBP office space must be
constructed and/or modified to reasonably withstand/minimize the potential for vermin and/or
pest infestation/access. These areas include the walls, ceilings, and doors/entry ways. This is a
minimum standard. Failure to meet minimum standards will preclude the applicant from further
consideration.
Parking
All CBP parking areas must be available for CBP access on a 7-day, 24-hour basis.
The CES facility(s) must have a dedicated area for parking of all CBP employee vehicles and a
dedicated fenced area for parking Government Owned Vehicles (GOV). Controlled access to
CBP vehicle parking areas is mandatory. CBP parking areas must be subject to security controls
(i.e., within sight of the gatehouse, viewed by Closed Circuit TV, roving guard patrol, etc.).

Data Processing and Telecommunications (LAN/TELCO) Room
Each CES location must provide dedicated room within the CBP CES office area to house
automated data and voice support equipment and systems. The minimum space and other
requirements for the Data Processing and Telecommunications support room are:
A minimum 150 square feet support room must be constructed with 9 gauge expanded metal
diamond mesh expanded metal wall/ceiling reinforcement or 8” CMU. The room must be
inspected by CBP prior to covering. Support room requires an intrusion detection system that
provides perimeter and volumetric protection/detection of unauthorized access.











Support room must have one dedicated computer room type A/C unit with individual
microprocessor control; Unit shall provide a room temperature ranging from 65 – 75
degrees Fahrenheit and relative humidity from 40 to 60 %.
Provide make-up water connection and condensate drain (and pump) to computer room
A/C unit.
Climate control must be operational on a 24-hr, 7-day basis;
Support room must have a dedicated 30 amp quad outlet;
Support room must have three standard phone line jacks;
Support room must have high security coded cipher lock;
Support room should be lit with florescent 50 c lighting;
Support room must NOT have sprinklers but a type of dry fire suppression system.
Support room must be highly resistant and/or impenetrable to vermin and/or pest
infestation/access from the walls, ceilings, and doors.
Support room must have ¾” thick 4’x4’ minimum fire-rated plywood backboard
Support room must have anti-static tile flooring.

Support room must have telecommunication grounding bus bar installed.
For additional data processing and telecommunications requirements, please refer to
Attachment 4. The CBP OA PM has final approval authority for meeting CBP operations
requirements and will provide official CBP specification to the CESO, as needed.
Additional support equipment required:








Each desk/workstation must have two data jacks;
Each desk/workstation must have one phone jacks;
Each desk/workstation must have two duplex electrical outlets (preferably on opposing
sides of the workstation);
CAT6 cable is required;
The common workroom shall contain a minimum of 8 of each above requirements;
No more than 4 workstations may be placed on any one dedicated circuit;
4 additional data jacks for network printers; and
9 dedicated circuits (for workstations, each location)
The CBP OA PM has final approval authority for meeting CBP operations requirements and will
provide official CBP specification to the CESO, as needed.
Canine Office/ Holding Area
At a minimum sufficient space for two canine officers and two canine portable kennels must be
provided by the CES operator(s) for the Trade and Agriculture Enforcement CES.
Minimum space requirements for canine enforcement office:
 75 square feet per canine officer
Additional points will be granted for the inclusion of a canine holding area in close proximity to
the Canine officers work area.
If provided, minimum space requirements for canine holding areas:
 72 square feet (12ft X 6ft), to accommodate two dogs
 Floor: Seamless epoxy-resin flooring system sloped to floor drain.
 Walls: 8” CMU finished with epoxy paint
 Ceiling: 5/8”gypsum board, STC rating 50-55. Acoustical tile not permitted.
If provided, the holding area may not be situated in an area that would be accessible to
unauthorized access by the public and/or non-CBP personnel; and preferably not situated in a
common passage route used by CBP personnel, thereby causing distractions to the detector dogs.
If provided, the holding area must be adjacent and/or within reasonable visual vicinity of the
Canine Officer’s office space.

In any event, a separate storage space area is required for canine training aids and equipment.
Canine rest areas must be segregated from storage of training aids. The storage area must be:
 100 square feet – must accommodate 2 full size refrigerators & bins for training
aids
The CBP OA PM has final approval authority for meeting CBP operations requirements and will
provide official CBP specification to the CESO, as needed.
NII Equipment:
The CESO is responsible for funding all costs associated with the potential acquisition and/or
relocation of all NII equipment, either through direct payment to a CBP approved vendor, or by
reimbursement to CBP, as determined by CBP upon tentative selection.
Lactation Room:
The CESO is responsible for creating a permanent room/office for a lactation room. This room
should be for CBP employees only.
 The room/office should have a lock on the door (locks from inside).
 The room must be kept clean at all times.
 The lactation room should have a refrigerator, small table and chair available.
 The room shall have one standard 110v outlet.
 The room shall be supplied with paper towels, hand sanitizer disinfectant wipes and
wastebasket.
Security Requirements:
The CESO is responsible to insure that all space provided meets current CBP Security Policy and
Procedures Handbook HB1400 -02B as it applies to the space individually and as a whole.
The CBP OA PM has final approval authority for meeting CBP operations requirements
and will provide official CBP specification to the CESO, as needed.
