MINUTES VILLAGE OF LISLE SPECIAL BOARD MEETING LISLE VILLAGE HALL BOARD ROOM THURSDAY, AUGUST 28, 2014 I. SPECIAL BOARD MEETING OPENING A. Call to Order Mayor Broda called to order a special meeting of the Village of Lisle Board of Trustees at 7: 00 p. m. on Thursday, August 28, 2014 in the Lisle Village Hall Board Room, 925 Burlington Avenue, Lisle, Illinois 60532. The following minutes constitute a summary of the events and discussions that transpired during the subject meeting, and do not purport to be a transcript of such. Where transcripts exist, they are available for inspection under the Illinois Freedom of Information Act. B. Roll Call of Attendance Present: Mayor Broda; Trustees Boyle, Carballo and Cawiezel Absent: Trustees Getz, Hettich and Mandel Also Present: Village Manager Sprecher, Community / Economic Development Director Budzikowski, Staff Engineer / Stormwater Administrator Sucoe, Village Clerk Seeden and Deputy Village Clerk Arnold C. II. Pledge of Allegiance Rayme' s Parking Lot / Request for Compensatory Storage Mr. Jiun -Guang Lin, Ridgeline Consultants, Montgomery, explained that their company failed to notify their surveyor of a plan revision which lead to the vast majority of Rayme' s parking lot being constructed higher than it was supposed to be. Because the construction was not performed per the revised plan the parking lot, located within the floodplain, is not able to accommodate the needed water storage if a 100 year storm event would take place. Mr. Lin stated that his company takes full responsibly for this error and will do whatever the Village wishes and hopes this will not impact the construction time line that Rayme' s has set forth. Mayor Broda asked what the error means and what it caused. Mr. Budzikowski stated that the parking lot was constructed higher on the west end than what was approved, dilemma of needed additional compensatory storage of 8400 cubic feet. and this brings the Mr. Budzikowski discussed the pond and what it was designed to hold and how much would remain if the condition was granted. Trustee Cawiezel asked if DuPage County may be approached to see if they would grant relief from their requirements. Ms. Sucoe did not believe that a variance would be granted due to it being too big of an impact on their regulations. Mr. Budzikowski noted that with the 12 inches it complies with the County code. Trustee Cawiezel stated that Mr. Lin spoke on his insurance carrier and she was not sure why. Mr. Lin explained that he has contacted his insurance carrier regarding the mistake and stated that it may take a lot of time for the claim to be processed and the insurance carrier may not allow the same company who has been working on the site to redo the job. Village of Lisle Special Board Meeting —August 28, 2014 Page 2 Trustee Carballo questioned if any estimates have been done to see what it would take to repair the parking lot. Mr. Lin stated that an engineer's cost estimate was approximately $ 84, 000. Trustee Carballo asked what will need to be completed and how long will it take. Mr. Lin stated that 2/ 3 of the curb in the west parking lot will need to be removed, as well as the parking lot that has been installed; they would then have to excavate the subgrade to where it should have been and re- asphalt and re -curb. Mr. Lin stated it would take approximately a month to complete. Mayor Broda inquired if Mr. Lin believes his insurance will cover the repair cost. Mr. Lin stated that he has spoken with his insurance agent, but has not filed a claim, but his insurance agent is aware of the problem. Trustee Boyle confirmed that there will be no financial impact to Rayme' s. Mr. Lin stated Ridgeline is taking full responsibility, by either paying out of pocket or via insurance. Trustee Carballo asked what the plan would be for the parking lot if the Village allowed the construction to continue. Mr. Lin stated that if the Village would allow the compensatory storage then construction would continue and Rayme' s opening date would not be as impacted. Dirk Gundersen, contractor for the property, explained that yes, it is only 2/ 3 of the parking lot, but there will be no parking, the lot will be torn to pieces and there will be large equipment. Mr. Gundersen added that insurance companies tend not to act quickly and this will not be resolved in time for paving season or the tentative reopening date. Trustee Boyle asked if the insurance company will cover the cost of the compensatory storage. Mr. Lin stated yes, they are comfortable with both solutions; paying for storage or redoing the parking lot. Mr. Gundersen explained his interpretation of compensatory storage. Mr. Budzikowski explained that any money received would need to do toward another smaller pond in the area to allow for more compensatory storage for future development. Mr. Gundersen asked if Garfield Avenue is located within the floodplain, because if it is, no one will build on it. Ms. Sucoe stated that a portion of it is in the floodplain, much like it was with Rayme' s. Trustee Carballo asked if Mr. Lin' s insurance would cover business interruption. Mr. Lin stated that he is not sure. Mr. Lin added that the portion of the parking lot that does not have to be torn up is the one closest to the building where handicapped stalls are located. Trustee Cawiezel asked what the delay would be to start the reconstruction work tomorrow. Mr. Gundersen stated that a contactor would not do the work without know that the finances would be available. Trustee Cawiezel suggested having the Village front the money, and be reimbursed when the insurance comes through, because she does worry that the storage will not be there if someone does decide to redevelop another area of Garfield. Mayor Broda inquired how much compensatory storage would be required if a parking lot was constructed and how much would be needed for the area that the Village knows is developable. Ms. Sucoe spoke about areas near Garfield and how it could be redeveloped without the needed storage in Garfield. Village of Lisle Special Board Meeting —August 28, 2014 Page 3 Trustee Boyle questioned what will happen if the insurance company does not pick up the cost. Mr. Lin stated that Ridgeline will pay for it. Mayor Broda stated that it is his recommendation to allow this to move forward as incorrectly designed and allow the use of the compensatory storage. Trustee Carballo agreed with Mayor Broda adding that there are other options for storage if there is future development. Trustee Boyle moved to allow the request to use up to 8, 400 cubic feet of compensatory storage at PrarieWalk Pond for the property at 4801 Lincoln Avenue as an alternative to corrective action by the owner' s contractor in the construction of the parking lot. Further, that fees for this storage be assessed at $ 62, 000 consistent with fee -in -lieu provisions for the pond established by Village Code. Trustee Carballo seconded the motion. ROLL CALL Ayes: Trustees Boyle, Carballo, Cawiezel, and Mayor Broda None Abstain: None Absent: Trustee Getz, Hettich, and Mandel Nays: AYES APPROVED THE MOTION. III. MOTION CARRIED.
