Minimum Sentence: 3 YEARS COUNT II Charge: Assault-2nd Degree-Dangerous Weapon-Substantial Bodily Harm Minnesota Statute: 609.222.2, with reference to: 609.222.2, 609.11.5(a), 609.101.2 Maximum Sentence: 10 YEARS AND/OR $6,000-$20,000 Offense Level: Felony Offense Date (on or about): 04/02/2016 Control #(ICR#): 16114522 1 Charge Description: That on or about 4/2/2016, Minneapolis, in Hennepin County, Minnesota, PERCY EDWARD JACKSON , assaulted JDL and inflicted substantial bodily harm, while using a firearm. Minimum Sentence: 3 YEARS 2 STATEMENT OF PROBABLE CAUSE Complainant has investigated the facts and circumstances of this offense and believes the following establishes probable cause: On April 2, 2016, at approximately 6:00 p.m., police received reports of a shot fired in the area of Hy’s Pawn and Jewelry Shop, located at 11th Street North and Currie Avenue North, Minneapolis, Hennepin County, Minnesota. Upon arrival, officers spoke with witnesses who described two cars fleeing the area, and provided general descriptions of the males associated with those vehicle. Police obtained video surveillance from businesses in the area, and located a single discharged cartridge casing in the parking lot. Simultaneously, officers received information that a male with a gunshot wound had been admitted to the U of M hospital. Officers responded to the hospital and learned that the victim (whose initials are JDL) had suffered a gunshot wound to his arm. Officers located victim’s vehicle, and observed a broken driver’s door window, blood on the outside of the driver’s door, and an apparent bullet hole in the driver’s seat. The vehicle matched the description of one of the vehicles that had fled the scene of the shooting. Officers learned that the victim had been seated in the driver’s seat of his car, in the parking lot at Hy’s, when a male approached him and offered to sell weed to the victim. Victim declined. The male then pulled a handgun from his waistband and fired one shot directly at the victim. The gunshot hit victim in the arm. Victim was afraid that the gunman was trying to kill him. Victim drove from the scene to the hospital. Victim provided a general physical description of the gunman, as well as the gun. In addition to speaking with witnesses on the scene, investigators reviewed video surveillance of the shooting from multiple sources and angles, and developed PERCY EDWARD JACKSON, the Defendant herein, as a possible suspect. Multiple individuals reviewed still photographs of the shooter in the video, and identified the shooter as DEFENDANT. Investigators displayed a sequential photographic line-up containing Defendant’s photograph to the victim. Victim stated the photograph of the Defendant, looked like the suspect, but the person in the photograph had a different hair style. Investigators accessed Defendant’s Facebook page and observed Defendant wearing similar clothing and distinctive jewelry, which matches the shooter’s clothing and distinctive jewelry in the video. On April 28, 2016, police responded to a report of a person with a gun in the area of Lake Street and Hennepin Avenue, Minneapolis, Hennepin County, Minnesota. Upon arrival, officers met with two uniformed bail bondsmen, who had just apprehended Defendant on an outstanding warrant. At the time that the bondsmen apprehended Defendant, he was seated in the driver’s seat of a vehicle, and wore distinctive jewelry. Officers searched the vehicle, and located a loaded handgun under the driver’s side dashboard. The handgun was loaded, with a large capacity extended magazine, containing hollow-point bullets. Officers also located multiple tablets of suspected narcotics under the driver’s seat, where Defendant had been seated. Defendant has a lengthy criminal history, including a June 6, 2014, conviction for Controlled Substance Crime in the 5th Degree, and a September 13, 2011 conviction for Simple Robbery, both felony crimes of violence. He is therefore prohibited from possessing a firearm.
