objects of the Great Ocean Road Trust referred to in the
preamble to the Great Ocean Road (Lands Sale) Act 1920 NO.SOO*.
desires for the more effective carrying out of the purposes
of the said Act to exchange portion of the Jands described
in the Schedule to the said Act and held by the said
company solely for the purposes of the said Act (which
portion is described approximately in the First Schedule to First Schedule.
this Act) for certain Crown land approximately described
in the Second Schedule to this Act and forming portion of second
a reserved forest under the Forests Acts known as the Schedu'e'
Otway East State Forest: And whereas it is expedient to
authorize such exchange as in this Act provided and to
make provision for certain other matters relating to the
said company and the said lands when exchanged: Be it
therefore enacted by the King's Most Excellent Majesty by
and with the advice and consent of the Legislative Council
and the Legislative Assembly of Victoria in this present
Parliament assembled and by the authority of the same as
follows (that is to say): —
1. This Act may be cited as the Great Ocean Road Short title
(Lands Exchange) Act 1922 and shall be read and construed SSiSSSS.

Act may be cited together as the Great Ocean Road Lands
Acts.

2 . (1) Notwithstanding anything in the Land Acts or
the Forests Acts or the Principal Act, but subject to this
Act, the Governor in Council, on the joint recommendation
of the Commissioner of Crown Lands and Survey and the
Minister of Forests, may by Order authorize the excision
of the land approximately described in the Second Schedule
to this Act (and to be more fully and accurately described in the said Order) from the reserved forest
within the meaning of the Forests Acts known as the
Otway Fast State Forest and the exchange of the land so
excised for the portion approximately described in the
First Schedule to this Act (and to be more fully and
accurately described in the said Order) of the lands described
in the Schedule to the Principal Act.
(2) The said Order—
(a) shall not be made unless the Board of Land and
Works and the Forests Commission certify
that—
(i) the proposed exchange is desirable ; and
(ii) the boundaries of the lands approximately
described in the Schedules to this Act
have been fully and accurately determined to the satisfaction of the said
Board and the said Commission ; and
(b) shall contain full and accurate descriptions of the
lands approximately described as aforesaid
and of the boundaries thereof as so determined.
Excision of
forest land
and inclusion
of other land
in State forest.
(o) On the publication of the said Order in the
Government Gazette—
(a) the land approximately described in the Second
Schedule to this Act and more fully and
accurately described in the said Order shall on
a date to be specified in the said Order be
excised from the said reserved forest as if it
had been excised therefrom by Act of Parliament
and a Crown grant of the said land may be
issued to the said company and thereupon the
said land shall be subject to the provisions of
the Great Ocean Road Lands Acts as if it were
included in the Schedule to the Principal Act;
and
(b) the

(b) the land for which the said land is exchanged shall
on the said specified date by virtue of this
Act cease to be subject to the provisions of the
Principal Act and be deemed to be dedicated
as a permanent forest within the meaning of
the Forests Acts and to be part of the reserved
forest thereunder known as the Otwav East
State Forest.
(4) Notwithstanding anything in the Principal Act the Power of
said company shall have full power and authority to agree agree to

SCHEDULES.
FIRST
SCHEDULE.
Preamble.
Land held by the Great Ocean Road Trust proposed to be exchanged for
land approximately described in the Second Schedule to this Act.
Two hundred and sixty acres more or less, County of • Polwarth,
parish of Boonah, being parfc of the land described in the Schedule to the
Principal Act: Commencing at the soufch-wesfc angle of the land described
in the said Schedule ; bounded thence by the south boundary thereof
bearing S. 89° 41' E. eleven chains eighty-nine links more or less; thence
north-easterly by a line parallel to and distant ahout ten chains from
the north-west boundary of such land to the left bank of Grassy Creek ;
easterly by the said bank to the boundary of the land described in the
Principal A c t ; thence north-westerly ; easterly ; north ; west; and
south-westerly by the boundary of the aforesaid land to the point of
commencement.
SECOND
SCHEDULE.
Preamble.
Portion of reserved Forest to be excised therefrom, and exchanged for
land approximately described in the First Schedule to this Act.
Two hundred and fifty acres more or less, county of Polwarth,
parish of Boonah : Commencing a t the north-east angle of Allotment 1,
Section 2 : bounded thence by the east boundary of Allotment 4 and a
line bearing north thirty-eight chains more or less by a line bearing
N". 66° E . eighty-five chains more or less to the east boundary of the
parish; south by t h a t boundary thirty-three chains more or less to
a road; by the road bearing S. 6'6° 0 ' W . twenty-seven chains thirtythree links more or less and S. 46° 0' W. to the point of commence ment.
