n behalf of the Board of Supervisors, I would like to thank you for taking the time to read the
Fall 2015 Edition of the Maxatawny Township newsletter. We hope you enjoy this annual
publication and we encourage anyone with an idea for an article or story to contact us at the Township
Administration Building. Below is a brief snapshot of some highlights from 2015.

The Township continued to advance the new recycling program. Residents are now required to
have a curbside bin for recycling which a registered hauler of their choice must collect. The first
bin is free. So, if you have not picked up a bin or your hauler hasn’t provided you one, contact
the Township Office.

The Board of Supervisors appointed two new members to fill vacancies on the Planning
Commission. The new members are Earl Martin and Donald Bucci.

In March the Board of Supervisors authorized the process of ordinance codification to begin. This
process will organize 65 years of Township laws into one comprehensive book laid out in chapters.
Anticipated completion is spring of 2017 at which time the codified document will be available
online at our website.

The Board of Supervisors has appointed Dr. John Prange of Bowers to fill a vacancy on the
Township Municipal Authority. The appointment had been a diligent effort on the part of the
Board to seat someone from the Village of Bowers on the Municipal Authority due to lack of
representation from that area for the past several years.
•
The Township sustained severe damage to Church Road during an accident detour along Route
222. As a result, the Township bid the reconstruction of Church Road which came in at a cost of
$550,000.00. After a thorough review of the scope of work it was determined that the Township’s
Road Department could complete the work for $235,000.00. In August Roadmaster Richard Grim
began the project which was slated to be done in two phases.

The first phase was base road repair to be completed in ONE week. The second phase was
then a total overlay of the road in spring of 2016. With the help of our neighbors, Greenwich
Township, the work progressed much faster than expected and the entire project was
completed this year.

As a result of the damage to Church Road, the Board of Supervisors has passed
ordinances restricting truck traffic on Church Road, Grim Road, Kunkel Road, and
Siegfriedale Road. Signs have been posted on these roads which reflect the ordinances.
•
The Maxatawny Township Municipal Authority has been preapproved for funding
through the U.S. Department of Agriculture to replace an aging section of water line in
the Village of Bowers. The Municipal Authority is working through the application
process. It is projected that we are looking at a two (2) year turn around until
construction would begin.
•
Regarding the budget, the Board of Supervisors anticipates NO tax increase for 2016.

A Note from The Township Roadmaster - Richard P. Grim
s winter approaches we again remind residents, wherever possible,
please keep your vehicles, trailers, and boats off the roadway so
that the plows can efficiently clear the roadways. We understand that
there are areas where off street parking is not available, but wherever
possible, we ask that off street parking is utilized.

We also ask that you kindly DO NOT block any fire hydrants with
snow. If you live near a hydrant and you are capable of keeping the
snow clear from around the hydrant, it greatly reduces everyone’s risk
should there be an emergency in the neighborhood.
1 Change your oil and oil filter.
IMPORTANT: If trees or branches come down in a storm, or at any
time, it is the responsibility of the property owner to remove the debris
in a timely manner. The Township will continue to provide a drop
location at 127 Quarry Road, Kutztown, PA 19530 for residents to
bring their downed trees and limbs.
2 Have your batteries checked and charged.
3 Check you tires and consider winter tires.
Here are a couple important tips we’d like to remind everyone of (see
Top 6 Ways To Get Your Car Ready For Winter at right).
6 Always carry an emergency kit.
4 Inspect all the lights.

Shoulder Grading
he Township will be grading and cutting shoulders this fall season in an effort to remove years of buildup and to
allow storm water to exit the roadway. One of the major problems the Township roads face is damage from sitting
water. This problem compounds during cold months when the temperate fluctuates above and below freezing.

A Letter from Code Enforcement Officer Chris Paff:
Dear Residents,
axatawny Township is a rural community with a mix of uses including a large farming community, rural living, suburban residential
neighborhoods, a healthy mix of industrial, light industrial and commercial uses, and a State University. Any use has typically associated
impacts on the community as a whole, and we should all strive to live well together with respect and understanding.

Sometimes, we may experience minor impacts that are simply part of the neighborhood in which we live. Other times, impacts from any use
may exceed acceptable and allowable limits. To help eliminate such excesses before they begin, and to provide methods for resolution if they should
begin, Federal, State and local regulations and ordinances are in effect. Often, outside agencies such as PennDOT, Department of Environmental
Protection (EPA), PA Department of Agriculture, Berks County Conservation District, and others may be the regulating authorities.
In many instances, Township ordinances will apply – often times in conjunction with other regulating authorities. Some local ordinance

You may note that many of the above are commons complaints as published in this newsletter on page 4. If we all work together, if before
anyone does something that they think may be offensive to their neighbors, if something you are considering doing with your property causes
you to wonder if regulations are in effect that may apply to your consideration, please contact the Township Office and we will help you to
find answers to your questions.
If you have concerns with something a neighbor may or may not be doing, we strongly encourage you to first seek discussion with your
neighbor. If the situation is appropriate, explain to them that you intend also to check with the Township to answer any of your concerns.
Many times concerns can be resolved amicably between neighbors. Gather as much information as you can, including a name, address and
phone number for the person against whom you will be making the claim. (This way, we can make personal contact with them.) Most
residents prefer to have a neighbor approach them personally instead of having the issues escalate to enforcement notices from the Township.

Township Building Permits - Rules and Regulations
For Zoning & Building Permits
ermits are required for, but not limited to, all new construction, additions, agricultural
buildings, decks, pools, hot tubs, sheds, fences/walls, garages, driveways, outdoor
furnaces, windmills, solar panels, rental units, any impervious additions including many
patios, walkways, etc., electrical, plumbing and mechanical, any change of means of egress.

Permits are not required for: re-roofing without structural alterations, replacement
windows, doors, siding, non-structural alterations, except as they may affect means of egress
or occupant travel pattern.
Fences and walls require a permit and shall be setback two feet (2’) from the property line and shall not be placed in any easement or
right of way.
Every impervious addition to any property requires storm water controls.
Maxatawny Township enforces the State Uniform Construction Code (UCC). Information is available at www.dli.state.pa.us for UCC
information and www.maxatawny.net for local information and forms.
All contractors required to comply with the Pennsylvania State Home Improvement Contractors Law shall submit their PA License
Number prior to making application or performing any work in Maxatawny Township. All contractors shall register by providing
record of insurance and, as appropriate, PA Contractor Number.
All residential building and zoning permit applications shall be submitted in TWO (2) sets of complete documents with sufficient
detail to indicate compliance with all applicable codes and ordinances. As a general rule, the documents explain exactly what you
propose in detail that anyone reviewing the documents would be able explain what you intend to build.
All commercial building applications shall be accompanied by all documents in THREE (3) sets. All sets must be signed and sealed
by a licensed design professional and in compliance with all UCC requirements.

COMMON COMPLAINTS:
The following items are common complaints registered with the Township Code
Office:
1. Property Maintenance – High grass, weeds, rubbish, etc.
2. Zoning – Vehicles without current PA State Inspections / license plates
3. Ordinances – Animal complaints, noise, odors
We can process complaints received by phone, in person or in writing. We need the
complainants name, address, and phone number in order to properly process a
complaint.
When a complaint is founded, the Township must follow legal procedures in order to
resolve the matter. At times, this process can be quite lengthy. The Township will do its
best to keep the lines of communication open and resolve the matter as soon as possible.
As a reminder, it is always a good policy to talk with your neighbor first when there is
a problem. Most residents prefer to have a neighbor approach them personally instead
of receiving an enforcement notice from the Township.

SUMMER READING PROGRAM AT KCL - lots to read and
lots to learn about! One of the many highlights of the
programming at the library is the summer reading program. In
Summer 2015, the program theme was, “Every Hero Has a
Story.” One quote by prolific American author and poet Maya
Angelou states, “…it is for us to recognize and celebrate our
heroes and she-roes!”
LIBRARY HOURS:
Monday through Thursday:
9:30 am - 7:00 pm
As suggested in this quote, during the 2015 summer
reading program, there were he-ro and she-ro presenters
which were celebrated. Some of them were magician Al
Grout; characters in Yocum’s Institute’s Miss Electricity
production; and many others including the non-human
he-roes and she-roes Allentown Therapy Dogs. The
Patriot newspaper reported many stories about these
exciting times. The reading program was once again very
popular with record participation!

However at KCL, many opportunities for participating in KCL
events and for reading and learning are waiting for you each day
throughout the year! Of course, the library has many books.
However, there are DVDs, audio books, passport services (new or
renewals), free WiFi, access to computers, fax services, …
something for everyone of all ages! There are family movie
nights, special programs such as the Alzheimer’s Caregiver
Support Group, Garden Club, after school programs for teens,
Toddler Time and much more. Visit the library website or call for an updated listing
of events and special programs.
1000 BOOKS BEFORE KINDERGARTEN PROJECT: This
program is in its fourth year and has been very successful. The
program is designed to help parents prepare their children for
kindergarten. Every child who registers for this program
receives a book log folder for
recording books that are read.
Various prizes are awarded and,
upon completion, participants
receive a T shirt with a logo
designed by Kutztown University
students. Any time a child listens
to a whole book it counts! It can
be a library book, a book from home, a book read at
story time, even an audio book or e-book. Multiple
readings of the same book count, too.
What a
wonderful opportunity to introduce children to books!
The fox logo’s unique design drew national attention
when a library in Wisconsin contacted KCL to use it. A
special fox costume was designed and continues to be
used as a mascot for this project.

ABOUT
THE
LIBRARY:
There are nine members of the Board of Trustees who represent the Maxatawny and Greenwich
Townships, and the Kutztown and Lyons Boroughs. Steven Schnell, Mary Paterno, and Mary Laub
represent Maxatawny Township on the Board. Janet Yost is the Library Director and Joanne Englehart
is the Assistant to the Library Director. The 2015 officers include: Steve Schnell, President; Mary Laub,
Vice President; Amber Bungo, Treasurer; Dolly Yaggie, Secretary; Joanne Yoder, Corresponding Secretary.
BICENTENNIAL WINNING FLOAT: The Kutztown Community Library’s
float won the Judges Select Award for being the most original entry in
Kutztown’s Bicentennial August 1, 2015 parade. The float’s theme was
‘Cultivate Your Community’ and depicted a garden which included items such
as flowers made from pages in books and a packdrop with a hex sign which
featured items available in the library such as DVDs and passport services. In
addition, the mascot named Foxy which is used for our 1000 Books Before
Kindergarten project, attracted attention and was very popular. The library
will soon display the backdrop and the winning trophy in the library. Be
certain to stop by and see this!
FRIENDS OF THE LIBRARY: The Friends organization is a group that supports the library through volunteer time and fundraising
projects. One project that is well known is the holiday house tour. Plans are underway for the Sunday, December 6, 2015 tour. Don’t
miss out! Mark your calendar for this important event. More information will be available on the website or you can contact the library.
The Friends group also sponsors various bus trips throughout the year. In 2015, one of the tours was to Thomas Edison’s laboratory in
New Jersey. There is always something happening at the library!
LIBRARY FUNDING: The library’s capital campaign has begun. Your contributions in any amount are greatly appreciated. Make
checks payable to “Kutztown Community Library.” Or, you can use a MasterCard or Visa credit card for online donations on the library
website. An incentive for municipalities to contribute a minimum of one dollar per capita is supported by Berks County Public Libraries
that will match funds. In 2015, the Kutztown Borough and Lyons Borough and the Maxatawny Township municipalities met this
matching fund incentive. Thank you very much! It is hopeful that these per capita matching dollar amounts can be considered during
the 2016 budget preparation in all of KCL municipalities.
Some interesting facts for the 2014 year (final statistics are not yet available for 2015):
• the library is open 52.5 hours a week and 307 days a year
• visitors to the library checked out 108,561 books and DVDs
• there were 408 programs with 8,441 attendees
• there were 16,945 sessions on 17 public use computers
• there were 884 passports processed

The Return of the Gypsy Moth
EWARE of the Return of the Gypsy Moth! According to the U.S. Forest Service,
the gypsy moth is one of North America’s most devastating forest pests. About 30
years ago, there was an explosion of the gypsy moths in the area which defoliated
thousands of acres of woodland. And it appears that they are on the rise again!
Gypsy moth caterpillars prefer to feed on oak and aspen trees, but can attack other
trees as well. The moth has few natural predators and the extensive amounts of hair
on the body of the caterpillar larva makes them undesirable to birds. The caterpillars
hatch from tiny eggs in spring, generally in late April or May, which were deposited in
a brown egg “patch” on trees the previous summer by the female moth. There can be
up to 1000 eggs in each “patch”. Once they hatch they hang by silken threads and are
caught on the wind, allowing them to travel many distances. Hence, the name gypsy
moth because they travel so quickly and easily. After several weeks of feeding on
leaves, they spin a cocoon. The males emerge as smaller brownish moths with bushy
antennas while the females are larger and whitish in appearance. In 2016, many acres
of woodland are in jeopardy of being effected by the potential gypsy moth explosion.

RECYCLING
BRUSH RECYCLING DROP SITE
s most of you know, the Township operates a brush recycling yard. The purpose of the program
is to collect brush from RESIDENTIAL properties in the Township and recycle the brush into
mulch. This service is for TOWNSHIP RESIDENTS ONLY. The bin is located at the rear of the
property at 127 Quarry Road. We accept any form of brush up to FOUR (4) inches in diameter. We
do not accept firewood or construction material.

As part of the grant that established the recycling program in Maxatawny Township, a set of secure
gates were installed to control dumping times. Currently, the Township has decided to keep the gates
open so the residents have 24 hour access to the brush drop site and mulch pile. If leaving the yard
open 24/7 leads to the dumping of undesirable material, the Township will proceed to restrict access
to the dump site. If that happens, a sign will be placed by the gates announcing the hours of operation.
LEAF COLLECTION 2015
he Township will be doing leaf collection for a two week period beginning November 2. The
first week will be November 2 through November 6. The second week will be November 16
through November 20th. Residents are asked to rake the leaves to the curb or gutter if they want the
leaves collected. Please DO NOT place anything other than leaves at the curbside or gutter. ALSO
– Leaf collection WILL NOT occur along Route 222 for safety reasons.

• Food-soiled materials
• Soaked and/or wet papers or cardboard

Recyclables must be placed in a separate bin from trash and are picked up by
your trash hauler. Replacement bins are available at the Township
Administrative Office.

MAXATAWNY TOWNSHIP SEWAGE PUMPING CYCLES
s mandated by the Pennsylvania Sewage Facilities Act 537, the Township is required to provide for adequate sewage treatment facilities
and for the protection of the public health by preventing the discharge of untreated or inadequately treated sewage. The Official
Sewage Facilities Plan for Maxatawny Township indicates that it is necessary to formulate and implement a sewage management program
to effectively prevent and abate water pollution and hazards to the public health caused by improper treatment and disposal of sewage. To
this end, the Township has adopted a mandatory sewage-pumping schedule, which requires all on-lot systems to be pumped every three
years. Systems are required to be pumped according to the last digit of their address, as follows.
CYCLE 1 –
addresses ending in the digits 0, 1, or 2 must be pumped by 06/30/2016, 2019, 2022.
CYCLE 2 –
addresses ending in the digits 3, 4, or 5 must be pumped by 06/30/2017, 2020, 2023.
CYCLE 3 –
addresses ending in the digits 6, 7, 8, or 9 must be pumped by 06/30/ 2018, 2021, 2024.
