ATEX 114 - DIRECTIVE 2014/34/EU The new ATEX Directive 2014/34/EU (referred to as ATEX 114) will come into effect as of 20 April 2016. The new directive will replace the current ATEX Directive 94/9/EC (referred to as ATEX 95). DEKRA is pleased to outline what this means for manufacturers of equipment intended for use in potentially explosive atmospheres. General - There are no changes in the Essential Safety Requirements and the ATEX standards will remain the same. A list of harmonized European standards will be published in the Official Journal of the EU, one list - referring to the old directive and an exact copy of this list referring to the new directive. Products made available on the market after 20 April 2016 should always refer to the new Directive ATEX 114. Certificates issued under ATEX Directive 94/9/EC EC-Type Examination - The EC-Type Examination certificates issued until 19 April 2016 will continue to be valid under ATEX 114. No actions needed to re-issue EC-Type Examination certificates under the new directive. Certificates to be issued under ATEX Directive 2014/34/EU EU-Type Examination - All ATEX Notified Bodies will need their accreditation and Notification for ATEX 114 before they will be able to issue certificates under this new directive as of 20 April 2016. DEKRA Certification B.V. expects to have this accreditation and notification in place in time. - Before 20 April 2016 Notified Bodies are not allowed to issue certificates under ATEX 114 even if they have the accreditation in place; however projects can be prepared under the ATEX 114 directive if the issue date of the certificate will be after 20 April 2016. EU Declaration of Conformity under ATEX Directive 2014/34/EU - The current EC Declaration of Conformity will be replaced by the EU Declaration of Conformity. Directive 2014/34/EU, ANNEX X shows a model indicating all details which should be mentioned in this DOC. - A copy of the EU Declaration of Conformity shall accompany every product other than a component after 20 April 2016. - An incomplete EU Declaration of Conformity is an official non-conformity. - Adding the following sentence to the EU Declaration of Conformity allows manufacturers to issue these already with their current production: "The object of the declaration described above is in conformity with the relevant Union harmonization legislation: Directive 94/9/EC (until April 19th, 2016) and Directive 2014/34/EU (from April 20th, 2016)". - When more than one Directive is applicable the manufacturer can choose to use one document wherein referrals to the right directives are made, or the manufacturer can choose to have several DOC’s. Attestation of Conformity - A copy of the Attestation of Conformity shall accompany every component. - The next changes in the Blue Guide / ATEX Guidelines will include details of documents which would be accompanied to components.
