bearing no. KA-29-A-2535 namely Sunil s/o Vithal Rathod, age 23 years, occ.
Business, r/o Zuarinagar, Sancoale, Mormugao- Goa driven by Shankar S/o
Lachappa Chavan, age 32 years, Occ. Driver, r/o Zuarinagar, Birla Vasco Goa n/o
Bagalkot, Karnatakawere engaged in levelling of ground in property bearing no. PT
sheet -99, Chalta No28having area of 1992.00 Sq. mtrs in Vasco City belonging to
complainant Mrs. Elsa Gomes and committed trespass in the complainant property
with their common intention.
Hence offence u/s 447 r/w 34 IPC stands registered.
12. Action taken: Since the above report reveals commission of offence (s) U/s as
mentioned at Item No.2, registered the case and took up the investigation/directed PSI
Vikas M. Deykar of Vasco P.S. to take up the investigation/transferred to P.S.----- on
point of jurisdiction.
F.I.R. read over to the Complainant/ Informant, admitted to be correctly recorded and a
copy given to the Complainant / Informant free of cost.

COMPLAINT
I Smt. Elsa Gomes w/o Romeo D’costa, age 56 years, r/o H.No.576, Opposite Goa Shipyard,
Vaddem Vasco Goa hereby lodge my complaint as under:
I am as above and residing at the above given address along with my family since birth. I
say that I am a Housewife.
I say that on 28/12/2016 at around 09.30hrs I was outside my house, I saw one JCB
Machine going towards my property at Khariyowado, opposite Goa Shipyard. I say that I went
inside my house and woke my son to go the property. I further say that I along with my son namely
Darren D’costa and my younger sister namely Lucia Gomes went towards my property. I say that on
reaching the spot, I saw one JCB bearing No. KA.29.A.2535 driven by one person engaged in leveling
the ground of our property, upon the direction of another person standing in our property, without
our permission. I say that accordingly I intervened and asked them as to who asked them to level
the ground where they informed that “sir ne bola hai, karne ko”, but did not disclose his name.
Further I called the Police by dialing 100 and when the Police arrived and started
conducting enquiry, the name of the driver of JCB was revealed as Shri. Shankar s/o Lachappa
Chavan, age 32 years, Occ. Driver, r/o Mugalolli L.T. No.2, Bagalkot, Karnataka-587111 and the
name of the person standing outside giving direction to the JCB was revealed as Shri. Sunil s/o
Vithal Rathod age 23 years, Occ- Business, r/o H.No. 77, Housing Board Colony, Zuarinagar, VascoGoa, who is the owner of JCB.
Further the Police then asked them to call the person who asked them to do leveling job.
Where they tried calling the person over their mobile but no any person came to the spot.
Accordingly, the machine was brought at the Police Station by the Police Staff.
I say that the said property belongs to me bearing Pt Sheet No. 99, Chalta No. 28 having area
of 1992.00 Sq. Mtrs. Vasco city. I say that without my prior permission the JCB driver Shri. Shankar
s/o Lachappa Chavan, age 32 years and owner of JCB Shri. Sunil s/o Vithal Rathod age 23 years had
trespassed in my property.
Hence I lodge my complaint against owner of the JCB Machine Shri. Sunil s/o Vithal Rathod
age 23 years, Occ- Business, r/o H.No. 77, Housing Board Colony, Zuarinagar, Vasco-Goa and driver
of JCB machine Shankar s/o Lachappa Chavan, age 32 years, Occ. Driver, r/o Mugalolli L.T. No.2,
Bagalkot, Karnataka-587111 bearing no. KA-29-A-2535 and request for action as per law. My
complain is recorded in English, read over, explained to me in understanding language and found to
be correctly recorded as per my say
