Consistentwiththoseattributes,youwillsigntheBadgerBoysStatePledgeconfirmingthatyouwillmonitoryourown

ATTENDANCE–AbsencefromtheBadgerBoysStateareaofRiponCollegeispermittedonlybywrittenpass,signed

PREAMBLE
We,thecitizensofBadgerBoysState,inordertopromote,promulgate,andpreservethe
constitutionalformofgovernmentinourStateandrespectivemunicipalities;tosubscribeour
devotiontothefreedomsandobligationsembodiedintheConstitutionoftheUnitedStatesand
theStateofWisconsin;andtomeettheresponsibilitiesinvestedinusbyBadgerBoysState,Inc.,
sponsoredbyTheAmericanLegion,DepartmentofWisconsin,doherebyordainandestablishthe
followingConstitutionofBadgerBoysState.

Legislative
ThelegislativepowershallbevestedinthehousesoftheSenateandAssembly.
TheSenateshallconsistofonerepresentativefromeachcity.TheAssemblyshallconsistoftwo
representativesfromeachcity.Suchrepresentativesshallbeelectedbypopularvoteofthecitizensof
BadgerBoysState.
Thestatelegislatureshallprovidegenerallawswhichshallbeuniformandconcurrentintheiroperation
throughoutthestate.
Thestatelegislatureshallbetheonlybodytopass,repeal,oramendstateStatutes.
ThelegislativepowersforcountyandcityareasshallbevestedintheCountyBoardofSupervisorsand
CityCouncils,respectively,unlessdelegatedtotheStateLegislature.
Eachhouseshalladoptitsownrulesofprocedureandelectitsofficials.
VacanciesinthestateofficesshallbefilledbyappointmentbytheGovernor,subjecttoconfirmationbya
majorityofbothhousesofthelegislature.
ARTICLEIV
Executive
TheexecutivepowershallbevestedinaGovernor,electedbypopularvoteofthecitizens,whoshallhold
hisofficeforoneyear;aLieutenantGovernorshallbeelectedatthesametime,inthesamemanner,and
forthesameterm.
PowerstoappointanAdjutantGeneral,DirectoroftheDepartmentofHealth,DirectoroftheDepartment
ofPublicWelfare,andStateFireMarshal,isvestedintheGovernor.Suchappointmentsand
appointmentsofotherassistantsshallbemadebytheGovernorwiththeconsentofthemajorityofthe
Senate.
TheGovernorshallperformallgubernatorialdutiesuntilsuchtimeasherelinquishesauthoritytothe
newGovernor.
TheGovernorshallhavevetopoweroveralllegislationmadebytheBadgerBoysStateLegislature
providedsuchauthorityisexercisedwithintwentyfourhoursofsubmittancetohisofficeofsaid
legislationexcludingSundays.Atwo-thirdsmajorityinbothhousesisnecessaryforover-ridinghisveto.
TheGovernoristheofficialrepresentativeofBadgerBoysStateandwillmakeappearancesasrequested
andapprovedbytheDirectorofBadgerBoysStateorTheAmericanLegion,DepartmentofWisconsin.
IncaseofdeathoftheGovernor,hisabsencefromthestate,orhisincapacitytocarryoutthedutiesofhis
office,heshallbeimmediatelyreplacedbytheLieutenantGovernor.
TheLieutenantGovernorshallactasPresidentoftheSenatewithonevotethereintobecastonlyinthe
eventofatie.Ifheisforsomereasonunabletofillhisposition,itshallbecomethedutyofthePresident
ProTempore.

TheStateTreasurershallbethecustodianofallthefundsandequipmentofthegovernmentofBadger
BoysState.HeshallbeclericalassistanttotheStateSupplyofficerandberesponsibleforcheckingin
BadgerBoysStateequipmentandsuppliesatthecloseofthesession.
TheAttorneyGeneralshallactasLegalAdvisortoallofficialstateagenciesandofficials.
a. HeshallrepresentBadgerBoysStateinalllegalactionsinwhichtheBadgerBoysStateisconcerned.
b. HeistoassistaDistrictAttorneyinprosecutingcitizensviolatingthelawsofthestateuponthe
requestoftheDistrictAttorneyortheGovernor.HeistoactasanAssistanttotheBadgerBoysState
ExecutiveOfficerinconnectionwiththeroutinemattersofdisciplinenotbroughtbeforethecourts.
ASuperintendentofPublicInstructionshallbeelectedbypopularvoteofthecitizensofBadgerBoys
State.HisdutiesshallbedeterminedassetforthintheCitizen’sManual.
Sheriffs,RegistrarsofDeeds,DistrictAttorneys,andallothercountyofficerswiththeexceptionofa
CountySurveyorandHealthOfficershallbeelectedbypopularvoteofthecitizensofBadgerBoysState
foratermofoneyear.TheaforementionedexceptionsaretobeappointedbytheCountyBoardof
Supervisors.
ARTICLEVI
Judicial
ThecourtforthetrialofimpeachmentsshallbetheSenate.TheAssemblyshallfulfillthatcapacityin
impeachingallcivilofficersofthisstateforcorruptconductinoffice,orforcrimesormisdemeanors;but
amajorityofallmemberselectedshallconcurinanimpeachment.Ontheimpeachmenttrialagainstthe
Governor,theLieutenantGovernorshallnotactasamemberofthecourt.WhentheSenatecommences
impeachmentproceedings,atwo-thirdsmajorityofthememberselectedshallconcurinfavorof
convictionbeforethepersonchargedisconvicted.Thevoteonimpeachmentisadvisoryonlyandthe
decisionwithrespecttoandmethodofremovalfromofficeofallofficersofBadgerBoysStateisleftin
thehandsofBadgerBoysStateInc.
TheJudicialpowersofBadgerBoysStateshallbevestedinaSupremeCourt,CircuitCourt,CountyCourt,
andMunicipalCourt.JudgesfromsamecourtsshallbeelectedbypopularvoteofthecitizensofBadger
BoysStateforatermofoneyear.
TheSupremeCourtshallhaveappellatejurisdiction.Itshallhaveageneralsuperintendingcontrolofall
inferiorcourts;itshallhavethepowertoissuewritsofHabeasCorpus,injunction,mandamus,quo
warrantor,certiorariandotheroriginalandremedialwrits,andtohearanddeterminethesame.
Thejurisdictionofothercourtsshallbedeterminedbylaw.
ARTICLEVII
Thelegislature,whenevertwo-thirdsofbothhousesshalldeemitnecessary,shallproposeamendments
tothisConstitution.Thoseamendmentsshallbeconsideredacceptedwhentwo-thirdsofthecitizensof
BadgerBoysStateareinagreementforsame.Ifmorethanoneamendmentbesubmitted,theyshallbe
submittedinsuchmannerthatthepeoplemayvotefororagainstsuchamendmentsseparately.Said
amendmentsmustbepublishedtwenty-fourhoursbeforeavoteisasked.
ThelegislatureisrequiredtoconsideramendmentswhensopetitionedbyamajorityofcitizensofBadger
BoysState.
ARTICLEVIII
BecauseofcertainspecialcircumstancesthatarecreatedhereatBadgerBoysState,includingthatweare
requiredtoattendgeneralassembliesandothereducationalprogrammingandthatouronlyareasof
privacyinourroomsareourclosetsanddrawers,BadgerBoysStatecitizensshallretainthefollowing
rightsuniquetothemwhileattendingBadgerBoysState:
Therightoffreedomofspeechshallbeguaranteedbutwiththatright,freespeechshallberesponsible,
respectfulanddignified.Bothspeakersandlistenersdeservetherighttosuchrespectsothatboth
speakerandthelistenercanparticipate,respectingtheprocessutilizedatBadgerBoysState.
Section2Nothingoutofplainviewshallbethesubjectofanysearch/routineorotherwise.Nosearchorinspection
ofanyBadgerBoysStatecitizen’sprivateareasshallbeconductedwithoutreasonablesuspicionor
probablecausethatacitizenhascontrabandmaterialsorpropertythatmayviolatetheBadgerBoysState

principlestypifyingthecurrentpoliticalpartiesoftheStateofWisconsinoftheUnitedStatesshallbe
incorporatedintopartyplatformsorpartyactivitiesinBadgerBoysState.

NocitizenmaybenominatedforofficeinBadgerBoysStateoranyofitsgovernmentalsubdivisionson
anypartyticketotherthanthetwoauthorizedbythisact.

ThedivisionofthecitizensofBadgerBoysStateintotwopoliticalpartiesshallbeaccomplishedbythe
assignmentofserialnumberstocitizensintheirorderofregistration.Allcitizenswhoareassignedodd
numbersshallautomaticallybecomemembersofonepartyandcitizensassignedevennumbersshall

WisconsinandBadgerBoysStatehaveatripartitegovernmentalsystemofthreeseparatebutequal
branches—thelegislative,executive,andjudicial.Thistripartitegovernmentalstructuregiveseachbranchthe
powertocheckandbalancethepoweroftheotherbranches.
LEGISLATIVEBRANCH
Thelegislativebranchisresponsibleforenactinglaws.Membersoflegislativebodiestypicallyproposebills,
whichothermembersdebate,andifasufficientnumberagree,votetomakethosebillsintolaws.The
legislativebranchhasbroadauthoritytoenactlawsthataddressnearlyallareasofthegeneralpublicwelfare,
includingthepowertosetgovernmentpolicy,taxcitizensandcompanies,borrowmoney,fundgovernment
programs,regulatecommerce,careforpublichealth,andprovideforsecurity.

CITYORGANIZATION
Citygovernmentisthelocalpublicjurisdictionestablishedtoprovideforthephysical,economic,social,and
culturaldevelopmentofitsresidents.Citieshavebroadauthoritytogovernthemselveswithoutstate
interference.Underthedoctrineof“homerule,”citiesmayexerciseauthoritynotspecificallygrantedbythe
state,providedthatthestatehasnotprohibitedthatlocalauthority.Commonareasofcityregulationand
servicesincludepublicsafety,economicdevelopment,publicutilities,infrastructure,waterandsewer

COUNTYORGANIZATION
IntheUnitedStatestherearesome3,100counties(254inTexasalone).Wisconsinhas72counties.County
governmentgenerallyservesdualpurposes—itprovidesservicesforstategovernment,anditservesasaunit
oflocalgovernment.Inserviceofthestate,forexample,thecountysheriffenforcesstatelawsandthe
districtattorneyprosecutesviolationsofstatecriminallaw.Asaunitoflocalgovernment,thecountymay
buildparks,maintaincountyforests,takecareofcountyhighways,providemental-healthservices,and
operatecountyhomesfortheelderlyandphysicallydisabled.
ThelegislativebranchofcountygovernmentisadministeredbytheBoardofSupervisors,whichiscomposed
ofSupervisorselectedfromthecitieswithinthecounty.

STATEORGANIZATION
Likeotherlocalgovernments,stategovernmentprovidesforthephysical,economic,social,andcultural
developmentandwelfareofitsresidents.TheTenthAmendmenttotheU.S.Constitutionspecifiesthat“[t]he
powersnotdelegatedtotheUnitedStatesbytheconstitution,norprohibitedbyittotheStates,arereserved
totheStates,respectively,ortothepeople.”Althoughthepowersdelegatedtothefederalgovernmentand
thepowersreservedtothestatesmightappeartobepreciselydelineated,governmentresponsibilitiesand
activitiesbetweenjurisdictionsoftenoverlap.Typicaldutiesofstategovernmentincludingcollectingtaxes,
buildingroads,borrowingmoney,establishingcourts,makingandenforcinglaws,charteringbanksand
corporations,spendingmoneyforthegeneralwelfare,andtakingprivatepropertyforpublicpurposeswith
justcompensation.

POLITICALPARTIES
Thepurposeofapoliticalpartyistoorganizepeoplewhosharesimilarviewsonpoliticalissuessothatthose
peoplecanpersuadevoterstoelecttheircandidatestopublicoffice,achievecontrolofgovernment,and
developandenactpoliciesfavorabletotheirinterests.
AlthoughtheDemocraticandRepublicanPartiesmaybethemostcommonlyknown,manyotherpolitical
partiescurrentlyexist,includingtheGreenParty,TeaParty,andReformParty,andothersarenolongeractive,
suchastheWhigPartyandLaborParty.AtBadgerBoysState,citizensareinitiallyorganizedintotwopolitical
parties—theFederalistPartyandtheNationalistParty.Thosenameshavenoinitialmeaning,andtheparties
havenoinitialpositionsonanyissues.Throughouttheweek,membersofthosepartiesatthecity,county,
andstatelevelswillorganize,identifytheissuesofimportance,andcampaignonbehalfoftheircandidates.
DuringaPartyCaucus,membersorganizebyselectingindividualstoleadtheparty(e.g.,PartyChairmanand
CampaignManager),developaPartyPlatform(i.e.,identifyingtheparty’spositionsontheissues),and
establishaCampaignStrategy.DuringaPartyConvention,membersselectcandidatesfromthepartytorun
forpublicoffice(e.g.,MayorandCountyExecutive).AtBadgerBoysState,nominatingpartycandidatesfor

nominatescandidatesforoffice.AtBadgerBoysState,nominatingcandidatesforcityandcountypositionsoccurs
duringapartyconvention.Butnominatingpartycandidatesforstateofficeoccursviaaclosedprimaryelectionby
ballot.
Aprimaryisanelectioninwhichvoterswithinapartydecidewhichcandidatewillrepresentthepartyonthegeneralelectionballot.Inotherwords,duringprimaryelections,eachpoliticalpartyselectsitsnomineesfortheupcoming
generalelection.Aclosedprimaryisatypeofdirectelectionlimitedtoregisteredpartymembers,thatis,thosewho
havedeclaredtheirpartyaffiliation.Anopenprimary,ontheotherhand,isopentovotersregardlessoftheirparty
affiliationorregistration.Inatraditionalopenprimary,votersmayselectoneparty’sballotandvoteonlyforthat
party’scandidates.
Afterthenomineeshavebeenselectbytheirpartieseitherduringapartyconventionorprimaryelection,those
nomineesappearontheballotforthegeneralelection.Duringageneralelection,votersmayselectanycandidate
regardlessofparty.Votersmayselect,forexampleamemberofonepartyforonepublicofficeandselectamemberof
adifferentpartyforadifferentpublicoffice.
VOTINGPROCEDURE
Tovoteduringanelection,acitizenmustpresenttotheelectionclerkhisBadgerBoysStateFileCardandsignthevoter
registrationformasinstructed.
CITYELECTIONS
Citizensmayvoteforanycandidate,regardlessofpartyaffiliation.Tovoteastraightticket,thatis,voteforallmembers
ofthesamepoliticalparty,thevoterselectsthecircleatthetopoftheballotnexttothedesiredparty.Selectinga

Votersmaycastballotsinsecret.Ifavoterisphysicallyunabletomarkaballotorhasquestionsaboutmarkingaballot,
theelectionjudgeandtheelectionclerkfromthepoliticalpartyoppositethatofthejudgemayassistthatvoterand
marktheballotasinstructedbythevoter.Afterselectingthedesiredcandidates,thevoterfoldstheballotfor
confidentialityandtomakeiteasytoseetheelectionjudge’sinitialsconfirmingthattheballotislegitimate.Attheend
oftheelectionperiod,allcitizenswhoareinlinetovoteorwhohavealreadyreceivedballotsmaycompletethevoting
process.
Thejudgeofelectionshallpermitnomorethanoneofficialfromeachpartytoobservethepollingplaceandthe
electionprocedure.Theseindividualsmaynotinstructanyonehowtovoteorassistanyonewithvoting.Buttheymay
identifyerrorsorviolationsoccurringduringtheelectionandnotifytheelectionjudge,whowilladdresstheissue.They
mayalsoobserveandreportanyerrorsorviolationsoccurringduringthecountofthevote.Electionjudgesmayconsult

BADGERBOYSSTATEMONEYPROGRAM
OVERVIEW
Tolearnaboutgovernment,wemust“dogovernment.”ThatisapartoftheBadgerBoysStatephilosophy.In
anattempttogiveallcitizensasmuchexperienceaspossibleinthefinanceofcitygovernment,a“Badger
BoysStateMoneyProgram”hasbeendeveloped.
Youwillfindthislearningexperienceachallenge.Newconceptsandideaswillbecomeasubjectofdiscussion
inyourcityandcounty.Youwilldiscoverwhatapropertyassessmenthastodowithtaxes.Youwillbeforced
tomakedecisionsaboutprioritiesasyourcityandcountyadoptabudget.Youwillkeepclearandaccurate
recordsofcampaigncontributions.Youwillseethatviolationsofcityandcountyordinancesarecostlyand
thatrunningforanelectedofficedemandsmanythings--includingaconcernaboutmoney.
WHEREDOWEBEGIN?
AftertheSaturdayeveningGeneralAssembly,everycitizenatBadgerBoysStatewillreceive$190in“Badger
Bucks.”TheBuckswillbedistributedinthefollowingdenominations:

WHATCANTHISMONEYBEUSEDFOR?
TherearethreeprimaryareasthatBadgerBuckswillbeusedforthisweek.
1. POLITICALCAMPAIGNS
Itcostsmoneytorunforoffice.EveryAmericanpoliticianiswellawareofthatfact.AtBadgerBoys
State,yourBadgerBucksarealsoapartoftheprocesstoelectourcitizenleadership.
Campaignsforofficemayrequirepostersandotheradvertising.Eachpoliticalpartyatthecity,county,
andstatelevelwillhavematerialsavailabletothem.Eachpartyatthecitylevelwillbecharged$500
forthesematerials.Atthecountylevel,thefeewillbe$1,000andatthestatelevel,eachpartywill
pay$5,000forthesecampaignmaterials.
ThecityandcountypartycaucuseswillelectaPartyTreasureronSunday.AnExecutiveCommitteeat
thestatepartylevelwillappointaStatePartyTreasurer.ThePartyTreasurerforeachpartywillhandle
allmoneytransactionsrelatingtocampaignmaterials.

Atthecityandcountycaucuses,thedelegateswilldeterminehowtoraisefundstopayforthose
campaignmaterials.Suggestionsinclude:
a. Partymembershipfees
b. Filingfeesfromeachnominatedcandidate
c. Purchaseofmaterialsbycampaigncommittees.
Atthestatepartylevel,theelectedpartyofficials(Chairman,CampaignChairman,PartySecretary)will
meetasanExecutiveCommitteeandwilldeterminehowthemoneyistoberaised.Theywillappointa
StatePartyTreasurer.Whatevermethodischosentoraisethenecessarymoney,underno
circumstanceswilltherequirementtopaymoneyprohibitacitizenfromseekingoffice.Citizenshave
therighttorunforofficeeveniftheydonothaveanymoney!
2. TAXESANDBUDGETS
AcompletepropertytaxationsystemhasbeendevelopedforBadgerBoysState.Cityclerks,treasurers,
mayors,aldermenandtheassessorswilllearnagreatdealaboutthecitytaxstructure.CountyBoard
memberswilllearnalsohowacountyspendsitsmoneyandpaysitsbills.Taxesonpropertywillbe
leviedandcitizenswillpaytheirshareofthecostofcityandcountygovernmentaloperation.Cityand
CountyTreasurerswillpaytheappropriatesalarieswithintwenty-four(24)hoursoftheadoptionof
thecity/countybudget.
3. FINES
CourtswithinBadgerBoysStatemaylevyafinefortheinfractionofcityandcountyordinances.Each
cityandcountyordinanceMUSTclearlystatetheamountofafinethecourtsmayimposeifacitizenis
convictedofviolatingsaidordinances.
Themaximumcityfinewillbeestablishedat$50.Thecountymaximumfinewillbenoamountgreater
than$100.Theordinancemaysetaminimumandamaximumfineandallowthecourttobeflexible.
Allfinescollectedbecomethepropertyofthecityorthecountytreasury.
Thecity,countyandstategovernmentsmaycreateotherusesfortheBadgerBoysStateBucks;
however,theymustnotconflictwiththelawsofBadgerBoysStateorthelawsofthestateof

CITYASSESSMENT
OVERVIEW
“Taxesarethepricewepayforcivilization.”Thatoldsayingistrue.Theoperationofgovernmentrequires
money.Salaries,streets,buildingandcivicprogramsallforceunitsofgovernmentstospendtremendous
amountsofmoney.AtBadgerBoysState,wewillseehowlocaltaxesareleviedandbudgetsdevelopedto
carryoutthewillofthepeople.
InWisconsinandhereatBadgerBoysState,themunicipaltaxsystemisbaseduponthepropertytax.Inorder
tomakethistaxstructureas“firm”aspossible,asystemofpropertyassessmenthasbeenenactedintolaw.
Propertytaxesareleviedagainstapieceofpropertybaseduponitsvalueandupontherevenuerequirements
ofthecommunity.Thus,aparceloflandthatisworthtwiceasmuchasanotherparceloflandwithinthe
sametown,village,orcityshouldowetwiceasmuchinpropertytax.
Itistheassessor’sresponsibilitytoappraisethetaxablepropertywithinhistaxingdistrictandtoattachto
eachpieceofpropertyanassessedvalue.Theassessedvalueshouldbe“fairmarketvalue,”thatis,the
assessedvalueistobewhatabuyerwouldbewillingtopayforthepropertyifitweretobeboughttoday.
Theassessedvalueofthepropertyismultipliedbytherateoftaxation(calledthemillage)todeterminethe
taxdue.Themillagecanonlybesetoncethecityandcountygovernmentshavedeterminedhowmany
dollarsoftaxisrequiredforthebudget.
TheBadgerBoysStateassessmentandtaxationprogramisasclosetotheactualWisconsinexperienceas
possible.Wewantyoutolearnthefinanceofcitygovernmentbyworkingthroughtheprocess.Assessorsare
responsibleforestimatingthe“fairmarketvalue”oftaxablepropertywithintheircity.Wewillassumethat
everycitizenisapropertyownerandthatheisanownerofhisroom.Further,whentwoormorecitizens
sharearoom,eachoneisconsideredanequalpartnerinthevalueofthatroom.Onlytheroomsthatthe
citizensoccupyaretaxable.Allotherpropertywithinthecityisheldbythepublicandisthusexemptfrom
taxation.Onceanassessmentisdeterminedbytheassessor,citizenswillhavetheopportunitytochallengeit
ata“BoardofReview,”whichwillfollowtheWisconsinstatelawasfaraspossible.IftheBoardofReview
failstosatisfythecitizen,alegalpetitionmaybefiledwiththeCircuitCourt.
Oncethecityandcountyhaveestablishedtheirbudgets,thepropertytaxlevycanbesetandcitizensbilledfor
theirpropertytaxes.EverycitizenatBadgerBoysStatebenefitsfromhiscityandcountyandwillpaytheprice
ofthatbenefit--taxes!
ASSESSMENTPROCESS
FIRST:
TheCityAssessorshouldwalkaroundthecityandmeetthepropertyowners.TheAssessor
surveystheroomswithinacityandappraisesthevalues.TheAssessorisdoingthissothatafair
propertytaxcanbeplaceduponeachcitizen’srealestate.Askeachcitizenifyoumayviewhis
room.Takenotesontheproperty.Isitaspaciousroom?Arethewindows,doorsandclosetsin
goodshape?Arethereanyspecialqualitiesabouttheroomthatmakeitattractiveandthusworth
moreorless?
SECOND: Assignadollarvaluetoeachroom.AssumethatthelowestvalueofaBadgerBoysStateroomis
$1,000andthehighestvalueis$5,000.Itisyourjobtoplaceavalueuponeachroom!
THIRD:
Notifyeachtaxpayerofyourassessmentusingthe“NoticeofAssessment."Besuretodividethe
roomassessmentbythenumberofcitizenslivingwithinit.Remember,youareassessingthe
roomitselfandnotthefurnitureorpersonalpropertyfoundwithinit.Thosethingsareexempt
fromtaxationunderWisconsinlaw.

FOURTH: Totalthevaluesyouhaveplaceduponalltheproperty.SigntheAssessmentRollandpresentitto
theBoardofReview.Youwillbeinattendanceattheirmeetingstodefendyourassessment.
FIFTH:
AftertheBoardofReviewhasfinisheditsworkandyourcityandcountyhaveenactedbudgets,
assistyourcityclerkandtreasurerindeterminingthemillageagainstpropertyinyourcity.Amill
isadollaroftaxperthousanddollarsofassessedpropertyvalue.Yourcitymillageistheamount
ofdollarsperthousanddollarsofassessedvaluethatareneededtoraisethenecessarytaxesto
operateyourcity.Thecountywillalsohaveataxmillagetobeappliedagainstyourassessed
value.
FOREXAMPLE:Ifthetotalmillage(cityandcounty)is50andtheassessedvalueofaparcelofpropertyis
$2,000,thetaxesare$100.(.050x$2,000=$100).
Todeterminethecitytaxmillagewhichthencanbeappliedagainstproperty,usethisformulawithyourcity

SIXTH: Reportyourassessmenttotalstothecountyclerk,whowilltotaltheassessmentsinyourcounty

bothcityandcounty,taxbillsaretobepreparedandgiventoeachcitizenusingthePropertyTax
Notice.Thetreasurerswillcollectthetaxesandissuereceipts.Treasurersshouldroundoffthe
taxduetothenearesttendollarstoeasecollection.Thecitytreasurerwillpaythecounty
treasurerthecountyportionofthetaxcollectedassoonaspossible.

EverycitizenatBadgerBoysStateisconsideredapropertyowner.Heownsaportionoftheroomheoccupies
alongwiththeotherresidentsoftheroom.Hispropertywillbeassessedbythecityassessorandavalue
placeduponit.ThetaxpayerhasarighttoappealthisassessmentundertheprovisionsoftheWisconsinstate
constitution.GetaFormalObjectiontoPropertyAssessmentformfromyourCityAssessor.
AtBadgerBoysState,asinWisconsinmunicipalities,theBoardofReviewamountstoacourtanditischarged
withthedutyofactinguponprotestsagainstassessmentsaswellascorrectingerrorsintheassessments.Itis
thedutyoftheBoardofReviewtocarefullyexaminetheassessmentrollandcorrectallapparenterrorsin
descriptionsorcomputations,andtoaddanypropertytotherollwhichtheassessormayhaveomitted.
NoticeoftheBoard’sdeterminationsistobegiventothepropertyownerastheBoardcompletesitswork.
Oncetheassessorhasvaluedthepropertyandpostedthesevaluesontheassessmentroll,thevaluesmustbe
acceptedascorrectunlessthetestimonyofswornwitnessesindicateotherwise.TheBoardofReviewhasno
authoritytochangeanassessmentwithoutsworntestimonyprovingtheassessor’svalueisincorrect.
TheBoardofReviewisresponsibleforraisingandloweringanyincorrectvaluation.Itisimportanttonote
thattheBoard’sfunctionisnotoneofvaluation,butofdecidingthevalidityofthefactspresentedorally,
underoath,beforeit.
AtBadgerBoysState,theBoardofReviewwillmeetonWednesdayat11:15amineachcity.TheBoardwill
meetintheCityCouncilChamberoratsomeotherplacedesignatedbythemayor.AllmeetingsoftheBoard
ofReviewareopenmeetingsunderWisconsinlaw.AlldeliberationsandactionsofthisBoardmustbetaken
inpublicmeetings.CitizensarewelcometoattendanyandallmeetingsoftheBoardofReview.
TheBoardofReviewisthefirststepintheappealprocessforataxpayerwhoprotestsanassessment.The
taxpayercannotappealtotheCircuitCourtunlessanappearancehasfirstbeenmadebeforetheBoardof
Review.

APPOINTMENT–ThemayorshallappointfivecitizenstotheBoardofReview.Thecityassessorandclerk
cannotbemembersoftheBoardbutmustattendallofitsmeetingsintheircapacityascityofficials.
Thechairmanmusttakeseriouslytheseproceedingsandrunacontrolledmeeting.Taxpayerspresenting
objectionstotheBoardshallberestrictedtotalkingaboutmattersdirectlyrelatedtotheappealoftheir
assessment.Testimonywhichdoesnothaveanybearingonthecomplaintshouldnotbeallowed.
DUTIESANDPROCEDURES
1. TheBoardofReviewshallselectoneofitsmembersaschairman.Thecityclerkwillactasclerktothe
BoardofReviewandwilltakecarefulminutesoftheproceedings.Theassessorshallbepresentatall
meetingsoftheBoard.
2. TheBoardwillchecktherollforomittedpropertyandfordoubleassessments.Omittedpropertyshallbe
placedonthetaxrollandtheownernotified.
3. TheBoardshallcorrectintheassessmentrollallerrorsindescriptionandcomputation.
4. TheBoardmembersarenottodoovertheworkoftheassessor,andmembersoftheBoardmaynot
substitutetheirjudgmentorideaofvaluefortheassessor‘s.
5. TheBoardmusthearanyoneappearingbeforetheminrelationtoassessments.Awrittenobjectionon
theformprovidedtothetaxpayerisrequired.Thetaxpayerorhisrepresentativeandwitnessesshallbe
heardfirst.Thetaxpayer‘scasemustfirstbepresentedtotheBoardofReviewbeforetheassessorcanbe
adverselyexamined.TheclerkswearsallpersonstestifyingbeforetheBoard(includingtheassessor).The
oathwillbe:
“Doyousolemnlyswear,inthematternowinhearing,totellthetruth,sohelpyouGod?”
Thewitnessshallreplyintheaffirmative.
6. Decisionsaretobemadeonlyfromswornoraltestimony.Fromtheevidencebeforeit,theBoardshall
determinewhethertheassessor’svaluationiscorrect.AmajorityofthemembersoftheBoardpresentat
themeetingshallconstituteaquorumforpurposesofmakingthedeterminationandamajorityvote
necessaryforchangingtheassessor’svaluation.Intheeventthereisatievote,theassessor’svaluation
shallbesustained.
7. Priortofinaladjournment,theBoardofReviewshallprovidetothepartycontestinganassessmenta
writtennoticeoftheamountoftheassessmentfinalizedbytheBoardandanexplanationofappealrights.
ThetaxpayermayappealtheBoardofReviewdecisionwithin24hourstotheCircuitCourt.
BOARDOFREVIEWAPPEALS–If,afterpresentingaformalobjectiontotheBoardofReview,ataxpayerisstill
dissatisfiedwithanassessment,hemayappealtotheCircuitCourtbyaWritofCertiorari.AWritmustbe
filedwithin24hoursoftheactionoftheBoardofReviewbythetaxpayer.AllwrittenrecordsoftheBoard
mustbesubmittedtothecourt.Nonewevidencemaybesubmitted,andthecourtdecidesthecaseusing
solelythewrittenrecordsoftheBoard.Thecourtwillmakeadeterminationandwillchangetheassessmentif
itfindserrorsintheproceedingsoftheBoardwhichrendertheassessmentvoid.

OVERVIEW
InBadgerBoysState,eachCityCouncilandCountyBoard,withtheadviceofotherelectedandappointed
officials,shallenactabudget.Everyagencyanddepartmentofthegovernmentneedsfinancingbeforeits
workcanbecompleted.TheCityCouncilandCountyBoardareresponsibletoseethatthistaskis
accomplishedinademocraticfashion.
PROCEDURE
1. Inthecity,themayorshallappointaFinanceCommitteemadeupoftwoaldermen,thecitytreasurer,city
clerkandhimself.Inthecounty,theCountyExecutiveshallappointaFinancecommitteemadeupofthree
CountySupervisors,theCountyClerk,CountyTreasurerandhimselfTheywillreviewthisprocessand
discussitwiththeCityCounselorsometimeTuesday.
2. OnWednesday,theCityCounselorwillworkwiththeCityCouncilasitconvenes,andonThursday,the
CountyCounselorwillworkwiththeCountyBoard.Theywilladviseonly,asitisthelegalresponsibilityof
eachCounciltoenactthebudgetastheorderoftheday.
3. TheFinanceCommitteewillpresenttheproposedcitybudgettotheirconstituents.Citizenswillbeinvited
tospeakonthebudgetandmayoffersuggestionsatthispublichearing.
4. TheCityCouncilandCountyBoardwilldebateintheirrespectivemeetings,amendandadoptabudget.
Thisbudgetshallbebalanced!Revenuesandexpendituresmustbeequal.Adeficitorasurplusisnot
allowed.
5. Tocompletethebudget,beginwiththe“Revenue”page.Youwillnoticethatyourcityandcountyreceive
grantsandrevenuesharingfromthestateandfederalgovernments.Thestate“StreetandHighway
Grant”isdeterminedbyyourcity’slocation.Thetheoryhereisthatyourcityneedsincomeotherthan
localtaxdollarstocarryoutitswork,andthestateandfederalgovernmentswishtoencouragecertain
typesofspending.
6. Afterthe“Revenue”pagehasbeencompleted,goontothe“Expenditures”page.Thisiswherethework
begins.Everyelectedandappointedofficialwithinthecityandcountyshallbevitallyconcernedaboutthe
amountofmoneyallocatedtohisarea.
7. Salariesareyourdecision.Minimumsarerequiredinmostareas,buttheamountsetoverthatisachoice
you,asacityandcounty,makedependentonyourrevenueandtherequirementsofthepaidposition.
8. Youwillnoticethatmuchofwhatacityandcountyspendsisnotflexible.Mortgages,fixedcostsandlarge
programcostsaresetyearsinadvancebypreviouscitycouncilsandcountyboards.
9. Afteryouhavecompletedrevenueandexpenditurepages,youthenwillbeabletodeterminethedollars
intaxesrequiredfromyourcitytaxpayersandthentocomputethemillage.Amillisadollaroftaxper
thousanddollarsofassessedvalue.TheCountyClerkmustasktheCityAssessorsfortheirtotalcity
assessedvalues.Thecombinedsumcanthenbeusedtodeterminethecountymileage.Thecounty
mileageplusthecitymileage(assetbyeachCityCouncil)willthenbeappliedagainsttheindividual
assessmenttoyieldthepropertytax.
10. AmotiontoadoptyourbudgetandtolevythepropermillagewillbethefinalagendaitemforyourCity
CouncilandCountyBoardinthisprocess.
