Earned Compliance Credits

Defines what it means for an offender to
be “current” with their payments
Section 1, 5(a): “A person shall be deemed to be current with any
such fee and payment of restitution if, during that month, the
person makes at least the minimum monthly payment . . .”

Clarifies when an offender may receive
credits
Section 1, 6: “A person must be allowed a deduction . . . regardless
of whether the person has satisfied the requirements of the other
paragraph . . .”

Removes “compliance” as a factor in
determining probation credits
Section 1, 5: removes “if the offender is in compliance with the
terms and conditions of the probation as determined by the
Division . . .”

Removes court fines and fees as a factor
in determining probation credits
Section 1, 5: removes requirement for offender to be “current with . . .
any fines, fees . . . ordered by the court . . .”
