Minutes of the Work Session Meeting of the Mayor and Council, Borough of Keyport,
held on the above date in the Borough Hall Council Chambers, Keyport, NJ, pursuant to
the adoption of the Annual Notice on file with the Borough Clerk forwarded to the
Asbury Park Press, the Independent, Two River Times and Newark Star Ledger and
posted on the Bulletin Board in accordance with the Open Public Meeting Act, P.L.
1975, Ch. 231.
Mayor Aumack called the meeting to order at 7:03PM and Borough Clerk Heilweil read
the Sunshine Law Notice.
ROLL CALL
On Roll Call the following were present: Councilmembers Sheridan, Lamberson, Cooper
and Goode. Others present: Mayor Aumack, Borough Administrator Stephen Gallo and
Borough Attorney Jong Sook Nee, Esq. Councilman Chamberlain was absent.

PUBLIC COMMENT PORTION
The meeting was opened to the public for comments or questions on items listed on the
agenda at 7:05PM moved by Sheridan, carried by Cooper with ayes by all present
Mayor Aumack asked the new Keyport High School student representatives Alexis
Walsh and Samantha Aumack to give an update on the activities at the high school.
Councilman Goode asked about the $8,600 legal bill from former Borough Attorney
Litwin for work on Williamson Street.
Elmer Graham, Jr., 22 St. Peters Place – asked about R270-16 Governing Body
Certification of the Annual Audit for which Clerk Heilweil gave an explanation. He also
asked about R273-16 Capital Budget Amendment for which Administrator Gallo
provided a response.
Michael Lane, 51 First Street – stated the stormwater pipe at Beach Park was silted-up
during a recent rainstorm and flooded Division Street. He asked for feedback on the
recent meeting with the KBBC, including dumpster enclosures, and an update on the
sidewalk crossing Borough property by Unbowlievable.

COMMUNICATIONS
1. Request from Keyport Fire Department to place an ad in its program book in honor
of the 47th Annual Firemen’s Ball
Motion to receive, file and approve same as last year moved by Goode, carried by
Sheridan with ayes by all present
2. Letter of Resignation from Library Board of Trustees member Diane Calabrese
effective December 31, 2016
Motion to receive with regret moved by Sheridan, carried by Goode with ayes by all

3. Response from Planning Board regarding its review of the Ordinance Amending
Noise Ordinance and Land Use Regulation on Entertainment
Motion to receive, file and introduce at the next council meeting moved by Goode,
carried by Sheridan with ayes by all present
4. Email from Keyport Garden Club seeking permission to place a permanent marker
dedicated to the memory of the late Ted Miller at the Waterfront Rain Gardens
Ellie Cosgrove and Diane Calabrese came forward to describe the marker which will be
about 8”x10” in size.

5. Letter from Steven Caputi regarding the purchase of outstanding tax certificates and
Tax Collector’s information on the law and the certificates
There was a tax sale and these certificates were not sold so authorization is needed
from Council to sell them at this time. Now a private sale can be negotiated.
Motion to receive and approve the purchase of the tax certificates as well as any
additional liens moved by Goode, carried by Cooper with ayes by all present
UNFINISHED BUSINESS
Parking signs on Atlantic Street
Administrator Gallo – stated he had three meetings with the KBBC. One meeting was
about the list of those in the BID. Another was regarding its budget. Council ultimately
has the authority to approve the KBBC’s budget. An increase would be borne only by
those in the BID.
Mayor Aumack – stated he looked at the sidewalk by Unbowlievable which crosses
Borough property. He believes there are many areas in the Borough where sidewalks
go across Borough property. He thinks this is a nice sidewalk, although it was installed
without permits.
Councilman Sheridan – stated he reviewed the final drafts from the Master Plan
subcommittees and thinks this is a going to be an amazing document. He thanked the
Police and CERT for creative use of a rainstorm on Mischief Night.
Councilwoman Lamberson – asked about a discussion on parking on Atlantic Street.
The Administrator was going to prepare a map showing different time-parking
limitations. She would like to extend parking from 3PM to 8PM.
Administrator Gallo – stated we can have an ordinance prepared for the next meeting.

NEW BUSINESS
Councilwoman Lamberson – stated she was contacted about having a beach cleanup
done by the Keyport High School football team.
Motion by Lamberson carried by Sheridan to allow the football team to clean up the
waterfront this Saturday.
Administrator Gallo – stated Councilman Cooper sent an ordinance on water
conservation. It provides for year-round restrictions on watering lawns.
Administrator Gallo deferred to those requesting it.
Ed Carew, Laura Barecca and Sue Feinstein, members of the Green Team – came
forward and stated the restrictions would be limited to public water supplies. This
ordinance was approved by Sustainable New Jersey and would provide 20 points
towards the Borough’s next level. The Team also applied for water conservation
education. They feel we need to be proactive.
Mayor Aumack – stated the Borough is being proactive by investing millions of dollars
in our water treatment plant and water/sewer system.
ATTORNEY'S REPORT
Attorney Nee reported on the following:
 making final tweaks in the Developers Agreement for Williamson Street
 working with the Financial Advisor regarding Mariner’s Point
 Willow Street vacation
ADMINISTRATOR’S REPORT
Administrator Gallo reported on the following:
 met with Sal Costanza regarding union issues
 met with Holmdel Point Condo Association
 met with Ed Carew regarding stormwater issues
 met with T&M Associates regarding Longview Boatworks
 met with Linda Clifton regarding employee benefits
 met with the KBBC and several council members
 met with NJDEP regarding stormwater compliance
 interviewed an electrical sub code official and inspector
 met with Monmouth Telecom regarding our phone service
 met with Tom Grabowski
 met with Charlie Merla, Valerie and MD Abramowitz regarding proposed art
exhibit
 attended the monthly Planning Board meeting
 attending the monthly KBBC meeting
 Planning Board reviewed the proposed entertainment ordinance and reported
favorable. We can now proceed to a public hearing on the matter.

Mayor Aumack – explained why there is a “For Sale” sign on one our firehouses, at
Waverly and First Streets. We are looking to sell the property and place it back on the
tax rolls. He reminded everyone to vote on November 8th, General Election Day.

Jim Aumack, 103 Luppatatong – asked how concrete our Shorelands water contract is.
He requested a copy of the proposed water conservation ordinance be sent to the
Environmental Commission.
Ed Carew, 64 Broadway – thanked Diane Calabrese for her five years of service on the
Library Board.
Michael Lane – clarified that he does not advocate removing the sidewalk by
Unbowlievable. The licensing agreement with the Uptown provided the business would
maintain the sidewalk and accept liability. He asked which two days a week the
proposed water conservation ordinance would allow watering and whether it will be
defined.
Collette Kennedy, 421 Atlantic Street – asked about resuming upkeep at crosswalks
now that TTF projects are resuming.
Elmer Graham, Jr. – asked about the PRC Group and 45 Beers Street project. He also
asked about the Senior Building work at 50 Beers Street.

RESOLUTION #276-16
RESOLUTION OF THE BOROUGH OF KEYPORT, COUNTY OF
MONMOUTH, NEW JERSEY AUTHORIZING A MEETING NOT OPEN
TO THE PUBLIC IN ACCORDANCE WITH THE PROVISIONS OF THE
NEW JERSEY OPEN PUBLIC MEETINGS ACT, N.J.S.A. 10:4-12.
WHEREAS, the Borough of Keyport, County of Monmouth (the “Borough”), a
public body corporate and politic of the State of New Jersey, is subject to certain
requirements of the Open Public Meetings Act, N.J.S.A. 10:4-6, et seq. (the “Act”), and
WHEREAS, N.J.S.A. 10:4-12 provides that an Executive Session, not open to
the public, may be held for certain specified purposes when authorized by resolution;
and
WHEREAS, it is necessary for the Borough to discuss, in a session not open to
the public, discussions involving the transfer of interests in real property as authorized
by N.J.S.A. 10:4-12(b)(5), relating the potential acquisition of the former Stultz Fuel Oil
Co. site commonly known as Block 66, Lot 3 on the tax map of the Borough of Keyport
and also known as 213 Broad Street.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the
Borough of Keyport, County of Monmouth, State of New Jersey as follows:
1.
The aforementioned recitals are incorporated herein as though fully set
forth at length.
2.
The Mayor and Council assembled in public session on November 1, 2016
and determined that an Executive Session closed to the public shall be held on
November 1, 2016 at approximately 8:00 P.M. at the Borough Hall located at 70 West
Front Street, Keyport, New Jersey, for the discussion of matters relating to the specific
items designated above.
3.
This resolution will take effect immediately.
