WHEREAS by sub-section (8) of section 18 of the Prices Justification Act 1973 the Tribunal has by resolution authorized me to
exempt ICI AUSTRALIA LIMITED from the provisions of section 18 of the Act, NOW I, LINDSAY HALE WILLIAMS,
Chairman of the Prices Justification Tribunal, HEREBY, AND
UNTIL FURTHER NOTICE, EXEMPT the said ICI AUSTRALIA LIMITED from the application of section 18 of the
Prices Justification Act 1973, in respect of:
(a) Venture trading in imported goods;
(b) Agency trading in respect of imported and locally manufactured goods;
(c) Competitive tenders;
(d) Contractural price escalations;
(e) One-off goods and services; and
(f) Goods manufactured by the company, subject to notification
to the Tribunal of the selling price index of goods manufactured by each of the following Divisions of the company:
Polythene,
Alkali Chemicals,
Rural Division of Biologicals,
Pharmaceuticals Division of Biologicals,
Plastics,
Nobel, and
Organic Chemicals
as of the month of July 1973 and as of 1st February 1974 and
thereafter at sbc monthly intervals.
Notwithstanding this exemption, the company is required to
abide by Section 18 of the Act and notify the Tribunal of any
increases in prices which the company forecasts would, either collectively or mdividually, have the effect of increasing, by 2Wo or
more for a six-monthly period, the selling price index for the
products manufactured by any of the above Divisions.

This exemption does not apply to service charges or the scale of

delivery charges.
The Division of the Company is required to notify the Tribunal
of any increase in unit prices of any items before increasing the
unit price if practicable or otherwise within seven days of the
increase. In cases where a supplier reduces the discount to the
Division of the Company, notice of this reduction shall be given
to the Tribunal.

- (g) goods and services provided by the company, to its employees
and which result in either an overall loss of nil profit to the
Company,
Provided that:
(i) the selling prices of goods in (a) above do not exceed the
company's list price at 1 August 1973 as supplied to the
Tribunal unless prior notification is given to the Tribunal
in accordance with the Act. The prices of future sales of
such goods in respect of which there have been no previous sales will also be advised to the Tribunal.
(ii) the selling prices of goods in (c) above will not exceed the
recommended price of established list price schedules issued
by Caterpillar of Australia Limited and Hyster Australia
Pty Limited in respect of such goods.
(iii) no increase in excess of the rate operating at 1 August
1973 will be made in the company's mark up on goods
and services referred to in (f) above without prior notification
to the Tribunal; and
(iv). audited, financial statements of the company are forwarded
to the Tribunal at half yearly intervals.
