BEING A BY-LAW OF THE MUNICIPAL DISTRICT OF BRAZEAU NO. 77, IN THE
PROVINCE OF ALBERTA, TO PROVIDE FOR PAYMENT OF MOBILE HOME LICENCE
FEES BY A CERTAIN DATE AND THE LEVYING OF A PENALTY AFTER SUCH DATE.
WHEREAS,under the provisions of Section 116, 117 and 118 of the
Municipal Taxation Act being Chapter M-31 of the Revised Statutes of
Alberta 1989 and Amendments thereto, the Council, by By-Law may
require any or all taxes or any instalment thereof to be payable on a
certain day or days and may by way of penalty impose such additional
percentage charge, not exceeding Eighteen Per Cent (18%), as is
considered expedient, for the non-payment of the taxes or any
instalment thereof on any day or days named and,
WHEREAS, under the provisions of Section 116, of the aforementioned
Act the provisions of Section 117 and 120 of the said Act apply with
respect to the licence fees payable under the Municipal Government Act
for mobile unit licences as if the reference in that section to taxes
included a reference to the licence fees, and
WHEREAS, the Council deems it expedient and desirable that all mobile
unit licence fees be paid on a certain date and that a penalty be
imposed on all unpaid mobile unit licence fees or instalments thereof
after that date.
NOW THEREFORE the Council of the Municipal District of Brazeau No. 77
in regular meeting duly assembled hereby enacts:
1.
That all mobile unit licence fees, excepting those amounts
receivable under the provisions of the Property Tax Reduction Act
being Chapter P-19 Revised Statutes of Alberta 1980 and
subsequent amendments thereto, shall be required to be paid on or
before the last day of June in the year for which the licence
fees became due and payable. If after the aforesaid date any
licence fees which became due and payable in that year, or any
arrears of taxes, excepting those amounts receivable under the
provisions of the Property Tax Reduction Act, supra, remain
unpaid there shall be added thereto by way of penalty on amount
of 1.5% on July 1st in that year and 1.5% per month thereafter,
excepting the month of June, of each year.
The provisions of this By-Law shall come into full force and
effect the day on which it is finally passed.
