TOWN OF SPANIARD'S BAY
MUNICIPAL PLAN AMENDMENT No. 5, 2015
Under the authority of section 16, section 19 and section 18 of the Urban and
Rural Planning Act 2000, the Town Council of Spaniard's Bay.
a)
Adopted the Spaniard's Bay Municipal Plan Amendment No. 5, 2015, on
the 20th day of July, 2015.
b)
Gave notice of the adoption of the Town of Spaniard's Bay Municipal Plan
Amendment No. 5, 2015, by advertisement inserted on the 28th day of July
and the 3rd day of August, 2015, in The Compass newspaper.
c)
Set the 12th day of August, 2015, at 7:30 p.m. at the Town Hall, Spaniard's
Bay for the holding of a public hearing to consider objections and
submissions.
Now under section 23 of the Urban and Rural Planning Act 2000, the Town
Council of Spaniard's Bay approved the Town of Spaniard's Bay Municipal Plan
Amendment No. 5, 2015, as adopted (or as amended).

Under the authority of Section 16 of the Urban and Rural Planning Act 2000, the
Town Council of Spaniard's Bay adopts the Town of Spaniard's Bay Municipal Plan
Amendment No. 5, 2015.
Adopted by the Town Council of Spaniard's Bay on the 20th day of July, 2015.

TOWN OF SPANIARD'S BAY
MUNICIPAL PLAN AMENDMENT No. 5, 2015
BACKGROUND
The Town of Spaniard's Bay wishes to amend its Municipal Plan. The Council has
received a development proposal to construct a single family dwelling on a backlot of
Civic No. 55-57, Chipman's Road. Municipal Plan Amendment No. 3, 2013, introduced
a new Plan Policy 3.4.1.1, to allow backlot development at the discretion of Council in
developed areas behind existing dwellings where vacant parcels of land exist which are
of sufficient size for a building lot, but which do not have the required frontage on a
publicly maintained street provided certain criteria, as defined in Plan Policy 3.4.1.1,
were met.
The Spaniard's Bay Future Land Use Map has this area designated as Rural. The
purpose of this Amendment is to re-designate land located to the rear of civic No. 55-57
Chipman's Road, from Rural to Residential to accommodate the proposed backlot
residential development.
PUBLIC CONSULTATION
During the preparation of this amendment, Council undertook the following initiative so
that individuals and groups could provide input to the proposed Municipal Plan
Amendment. The Town Council of Spaniard's Bay published a notice in The Compass
newspaper on February 17, 2015, advertising the proposed amendment seeking
comments or representations from the public. The Town Council placed the proposed
amendment on display at the Town Council Office from February 17 to February 24,
2015, for residents to view and to provide any comments or concerns in writing to the
Council concerning the proposed amendment. No verbal and written comments were
received during the public consultation period.
