You will be bound by the Visa Cardholder Agreement which we will send to you when we issue your card(s). Account material (including cards, checks, monthly statements, and notices) may be sent to any Cardholder who will be responsible for delivering them to other Cardholders. All terms are subject to change. Account and Agreement Terms are not guaranteed for any period of time; all term, including the apps APRs and fees, may change at any time for any reason. Utah Community Federal Credit Union VISA CARDHOLDER AGREEMENT Notice to Borrower: This document contains provisions for a variable interest rate. The following Cardholder Agreement is applicable to all accounts with Visa check cards, Visa credit cards, or credit card plans. The term "Card" in this Agreement refers to each and every Visa check card, Visa credit card issued by Utah Community Federal Credit Union (hereinafter "Credit Union"), and to any other method or means that the Credit Union provides to access Visa debit and credit card products and plans. The terms "you" and "Member" shall refer both individually and collectively to each and every person or entity who is an account holder on the account for which the Card is issued or made available. The term "your" shall be deemed the possessory form of "you" and shall be used to identify ownership by Member. The terms “we” and “us” shall refer to Credit Union. The Term “our” shall be deemed the possessory form of “we” and “us” and shall be used to identify ownership by Credit Union. Whenever the context requires, the singular shall include the plural, the plural shall include the singular, the whole shall include any part thereof, and any gender shall include both male and female. By signing, requesting, using or permitting others to sign or use a Card issued by us, you covenant and agree to comply with all procedures required by us and to be bound by the following terms and conditions. 1 . The Card is the property of Credit Union and you agree to surrender the Card upon demand. We may terminate this Agreement and retake the Card without notice at any time. You may terminate this Agreement by returning the Card to us and paying the outstanding balance on your account in full, including but not limited to interest, fees, and charges. 2. Your liability for lost, stolen, or other unauthorized use of a Visa-branded Card will be $0 if you immediately report the loss or theft of the Card to us . The limitation of liability just above does not apply to certain business transactions, ATM cash transactions, or non-Visa PIN-less debit transactions. If the Card is lost or stolen, call us immediately at 1-800-453-8188. Your losses may also be limited by the Electronic Funds Transfer Act (“EFTA”). By using your account, you acknowledge and agree that you have received a copy of our EFTA Disclosures. Note that if you wait for more than 48 hours to report an unauthorized use of your Card, you may lose up to $500.00 even if the charges in question would have been covered by the EFTA. If you wait longer than 60 days from the time we make your statement available, you may lose all funds in your account and the full amount of any overdraft line of credit. To the extent permitted by law, you may be liable for greater amounts than the amounts listed in this paragraph if you were grossly negligent or fraudulent in the handling of your account or Card. 3. You shall hold in strict confidence your Personal Identification Number (PIN). If you lose your card and/or PIN, you hereby agree to hold us harmless for any and all transactions from the time of loss until such notification. 4. You agree to cooperate fully with any and all investigations by us or law enforcement, including but not limited to, promptly and accurately completing affidavits and forms required to address concerns or attempt recovery of funds. 5. You shall pay us on or before the payment due date shown on your account monthly statement, either (a) the entire amount then due, or (b) minimum payment which shall not be less than 3.5% (Visa check cards), 2.5% (Visa Platinum and Platinum Rewards credit cards) of the outstanding balance or $25.00, whichever is greater. Balances less than $25.00 are payable in full. Payment is due each month. If you do not pay at least the amount of the minimum required payment shown on any periodic statement within TEN (10) days after the payment due date, we may impose a late charge up to $25.00. If you miss a payment or break any other promise made under this Agreement, we may declare the entire unpaid balance due and payable at once without notice or demand. We may also declare the entire unpaid balance due and payable at once without notice or demand if you have made any misrepresentation in applying for credit or if any occurrence indicates to us that you may be unable or unwilling to repay the loans made under this Agreement. We may accept late payments or partial payment or checks or money orders marked "payment in full" without losing any of our rights under this Agreement or any other Agreement with you. You acknowledge and agree that any payment marked "payment in full" or marked with a similar notation shall not constitute full payment unless the amount of the payment is sufficient to pay the full balance owed. 6. The acceptance, use, or signing of a Card by you shall constitute your consent to any change in the terms of this Agreement and disclosure statement as we may subsequently elect to make after we have provided notice if required by law. Without limiting the forgoing, you expressly acknowledge and agree that we may increase applicable interest rate(s) by giving notice of any such change at least 45 days prior to the effective date of such change. Your failure to exercise any right you may have to reject the change or close your account before the change goes into effect shall constitute your agreement to the change. Except as restricted or prohibited by law, any change in terms may, at our sole discretion, apply to your existing account balance as well as future transactions. 7. In the event of default under this Agreement, including but not limited to failure to make payment when due, your death, bankruptcy, or insolvency, or attachment or levy against any portion of your property, the entire amount of your outstanding indebtedness may be declared due and payable at our sole election. If you fail to pay said entire outstanding indebtedness on our demand, you agree to pay all our attorney's fees and collection costs incurred as the result of your breach, whether suit is initiated. 8. You agree that we are not liable or otherwise responsible for the refusal of any merchant, financial institution, or other party to honor a Card. We shall not be liable or otherwise responsible for the failure of an ATM to honor your Card, disperse cash, or otherwise perform as you request. If you use your Card to purchase goods or services more than 100 miles from your home (outside of your home state) or for less than $50, we may refuse to submit a chargeback on your behalf. When dealing with a merchant, you are encouraged to carefully review the merchant’s return policy; you may be bound by that policy regardless of whether you obtain it. If we work with you to submit a chargeback through the Visa or other system and the chargeback is ultimately denied or not honored, you agree to pay for the item(s) at issue plus finance charges and any applicable fees published by us. 9. We are not liable or otherwise responsible if we decline a transaction or otherwise refusing to process a transaction even if you have sufficient funds in your account to pay for the transaction. We may limit the number and dollar amount of transactions that you can complete in one day. If we detect unusual or suspicious activity on your account, we may suspend your credit privileges until we confirm verify the activity, but we are not required to verify unusual or suspicious activities. We may approve transactions that cause the balance to go negative or exceed your revolving line of credit limit without waiving any rights under this Agreement. 10. You authorize us to investigate your credit standing when opening or reviewing your account. You authorize us to disclose information regarding your account to credit bureaus and creditors who inquire about your credit standing. A negative credit report reflecting your credit record may be submitted to one or more credit reporting agency if you fail to fulfill the terms of your credit obligations at any time and may thereafter remain reported as permitted by law. 11. You cannot transfer or assign your account to any other person (natural or otherwise). If there is any conflict between a receipt or slip you are given and this Agreement, this Agreement shall control. 12. This Agreement shall be governed by applicable federal and state law. When state law applies, this Agreement shall be governed by Utah law without regard to any conflict of law rules or principles. 13. This Agreement is binding upon your heirs, representatives, successors, and assignees. 14. If you move, you shall provide us with your new address within three (3) business days of moving. 15. We may assess you a research fee according to the current fee schedule for any research that you request on your account when the result of said research does not show any erroneous billing as defined by the Federal Truth in Lending Act or as defined by the Utah Consumer Credit Code. We may also assess any other fee disclosed to you in advance in accordance with applicable law. You hereby agree that you shall at all times be deemed to have received a copy of our latest Fee Schedule. 16. We may decline any transaction that causes you to go over your credit limit. If by chance a transaction does cause you to go over your credit limit, we will not charge an over-the-limit fee. Even if you do exceed your credit limit, you are responsible for all transactions you authorize or that result from your gross negligence if not prohibited by law. 17. Regarding Visa check card the following conditions 22) apply. (16- 18. The card must be signed with the same signature as required for your checking account. 19. If you apply and qualify, we may establish a pre-arranged line of credit in an amount determined by us as overdraft protection. If the credit limit is exceeded we may close the line of credit and recall any Cards issued to you. 20. In the event your checking account becomes overdrawn, you hereby request and authorize us to transfer from your overdraft protection account to your checking account, the amount necessary to cover said overdraft, up to your remaining overdraft protection account line of credit in accordance with this Agreement. 21. A transaction which overdraws your checking account shall be deemed an extension of credit by us to you. 22. You agree to maintain on deposit at all time, sufficient funds to cover all transactions and to pay all cash withdrawals, drafts, checks, and electronic funds transfers. Transactions created by use of a card are subject to the terms and conditions of this Agreement and any other agreement between you and us as modified by us from time to time. 23. In addition to the principal amount of transfers/payments made by us to cover overdrafts on your checking account, purchases or cash advances, you shall pay us a FINANCE CHARGE on the Visa check card as described below in Subparagraphs A and C, and on the Visa credit cards as described below in Subparagraphs B and C. A. Visa check card. (1) The FINANCE CHARGE is computed on a daily basis and is based on the actual amount of money outstanding for the number of days that amount is outstanding. (2) A FINANCE CHARGE is imposed on advances from the date of posting to your account until the date of repayment and is calculated using the actual balance in the loan account each day after payments and credits have been subtracted and advances and other charges have been added. The amount of FINANCE CHARGE is determined by multiplying this actual balance by the Periodic Rate for each day since the last payment was made on the account. B. Visa Credit with interest free period. (1) FINANCE CHARGE is imposed on advances, charges, and purchases (except as referred to in paragraph (2) below) from the date of posting to yours account until the date of repayment and is calculated by multiplying the Average Daily Balance by the Periodic Rate for each day since the last payment was made on the account. The Average Daily Balance is the sum of the unpaid daily ending balance on each day of the billing cycle divided by the number of days in the billing cycle. Said unpaid balances are determined by deducting payments and credits applied against such unpaid balances and by adding charges, advances and purchases as of the date posted to your account. may have with us. (2) FINANCE CHARGE is not imposed on: (A) new purchases posted during a billing cycle if (a) you paid the Payoff Balance shown on the billing statement covering the preceding billing cycle if paid within 25 days of the current statement date or such Payoff Balance was zero and (b) you pay the Payoff Balance shown on the current billing statement itemizing the new purchases by the Payment Due Date shown on the billing statement; (B) Old purchases posted for a billing cycle during which you pay the Payoff Balance shown on the billing statement covering the preceding billing cycle by the Payment Due Date shown on the billing statement. 27. If you utilize a Card for internet transactions, you are required to register for VERIFIED BY VISA at www.visa.com/ verified or at www.uccu.com. If you do not do so, you may lose any charge back rights for internet transactions. C. The term Periodic Rate as used herein is 1/365th of the Variable Annual Percentage Rate. The Periodic rate changes monthly as the Variable Annual Percentage Rate changes. The Variable Annual Percentage Rate is tied to the Prime Index rounded up to the next one quarter percent plus (i) 8% for Visa Platinum Rewards accounts with limits $3,000 and above, (ii) 10% for Visa Platinum Rewards accounts with limits below $3,000, (iii) 5% for Visa Platinum credit card accounts with limits $3,000 and above, (iv) 7% for Visa Platinum credit card accounts with limits below $3,000, (v) 6% for Visa Check Cards with limits $3,000 and above, and (vi) 9% for Visa Check Cards with limits below $3,000. The rates are subject to change on the first day of each month. We will use the most recent Index value available to us as of the 15th day of the month prior to any annual percentage rate adjustments. The minimum rates are 9% for Visa Platinum Rewards, 6% for Visa Platinum credit card accounts with limits $3,000 and above, 8% for Visa Platinum credit card accounts with limits below $3,000, 7% for Visa Check Cards with limits $3,000 and above, 10% for Visa Check Card with limits below $3,000. The maximum rate will never be greater than that allowed by law. The rate applicable for each month will be set forth in your regular statement. 24. We may delay enforcing any of our rights or remedies under this Agreement without losing said rights or remedies. You agree that failure by us to enforce any provision of this Agreement shall not constitute waiver of ours right to enforce said items in the future. 25. To secure payments of all amounts charged under this Agreement, you hereby grant to us a security interest in all of your's property in our possession or control and in any and all deposit accounts, savings accounts, and checking accounts you 26. You may not use a Card to initiate any type of electronic gambling transaction or any illegal activity. You agree to indemnify and hold us harmless from any suits, liability, damages or adverse action of any kind that results directly or indirectly from such illegal use. 28. Visa Platinum Rewards Benefits. We reserve the right to make changes to the Visa Platinum Rewards credit card benefits or any other reward program(s) we may offer to you. 29. Purchases and cash advances made in foreign countries and foreign currencies will be billed to you in U.S. dollars. The conversion rate in dollars will be a rate selected by Visa from the range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate Visa itself receives or the government mandated rate in effect for the applicable central processing date, increased by up to two percent (200 basis points) or an amount determined by Visa International. YOUR BILLING RIGHTS KEEP THIS NOTICE FOR FUTURE USE This notice contains important information about your rights and our responsibilities under the Fair Credit Billing Act. NOTIFY US IN CASE OF ERRORS OR QUESTIONS ABOUT YOUR STATEMENT. If you think your statement is wrong, or if you need more information about a transaction on your statement, contact us at: Utah Community Credit Union P.O. BOX 1900 Provo, Utah 84603-1900 Contact us as soon as possible. We must hear from you no later than sixty (60) days after we sent you the first statement on which the error or problem appeared. You can telephone us to block the card immediately; if you do call us, however, we are not required to investigate the error or problem and you may have to pay the amount in question. A written statement will need to be filled out to preserve your rights and must contain: - your name and account number; - the name of any involved merchant and the dollar amount of the suspected error; and - a detailed description of the error and any attempt you have made to resolve it with any third party. If you have authorized us to pay your credit card bill automatically from your savings or checking account, you can stop the payment on any amount that you think is wrong. To stop the payment your letter must reach us three business days before the automatic payment is scheduled to occur. YOUR RIGHTS AND OUR RESPONSIBILITIES AFTER WE RECEIVE YOUR WRITTEN NOTICE. We must acknowledge your letter within 30 days, unless we corrected the error by then. Within 90 days, we must either correct the error or explain why we believe the bill was correct. After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent until we have completed our investigation. We can continue to bill you for the amount you question, including finance charges, and we can apply any unpaid amount against your credit limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of your bill that are not in question. If we find that we made a mistake on your bill, you will not have to pay any finance charges related to any questioned amount. If we didn't make a mistake, you may have to pay finance charges, and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due. If you fail to pay the amount that we think you owe, we may report you as delinquent. However, if our explanation does not satisfy you and you write to us within ten (10) days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your bill. And, we must tell you the name of anyone we reported you to. We must tell anyone we report you to that the matter has been settled between us when it finally is. STATE AND LOCAL LAW The foregoing summary of your rights under federal law does not cover any rights you may have under state and local law. If, under State or local law, you have a longer period of time in which to send an inquiry to Credit Union concerning your statement, reliance on any such longer time period may result in your losing important rights which could be preserved by acting more promptly under federal law. State or local provisions, if any, only become operative upon the expiration of the time period provided by Federal Regulation Z for submitting a proper written notification of an error.
