Book 96 • Page Agenda Item 9 1/4/95 RESOLUTION 95-7346 ARESOLUTION GRANTING A COASTAL CONSTRUCTION SETBACK LINE VARIANCE TO ENCLOSE AN EXISTING ROOFED, SCREENED PATIO SEAWARD OF THE COASTAL CONSTRUCTION SETBACK LINE AT 30 SEVENTH AVENUE SOUTH; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Chapter 114-33 of the Comprehensive Development Code of the City of Naples establishes a Coastal Construction Setback Line; and WHEREAS, Richard and Marilyn Maslow have petitioned for a variance from the Coastal Construction Setback Line in order to enclose an existing roofed, screened patio seaward of the Coastal Construction Setback Line; and WHEREAS, following an advertised public hearing, as required by Chapter 86205 of the Comprehensive Development Code, and taking into consideration the recommendation of the City staff, the City Council has determined that a variance from the City's Coastal Construction Setback Line should be granted at 30 Seventh Avenue South, to enclose an existing roofed, screened patio; NOW, THEREFO RE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NAPLES, FLORIDA: Section 1. That a Coastal Construction Setback Line variance is hereby granted to enclose an existing roofed, screened patio at 30 Seventh Avenue South. Section 2. Construction shall conform to the plan prepared by Frank Neubek, AIA, The Neubek Group, dated 26 August 1994, a copy of which is attached hereto, for the property described as: The south 22 ft. of Lot 11, all of Lots 12 and 13, and the north 22 ft. of Lot 14, Block 13, Tier 1, Plan of Naples, Plat Book 1, page 8. Section 3. Should the Department of Environmental Protection/Bureau of Beaches and Coastal Systems Coastal Construction Control Line permit result in changes to the above-referenced drawing the Natural Resources Manager will prepare an analysis of their effect on this resolution and submit a revised resolution for City Council consideration on their next regularly-scheduled consent agenda. Section 4. That local approval is hereby granted for the issuance of a permit by the State of Florida for construction seaward of the Coastal Construction Setback Line. Section 5.
