AN ORDINANCE RELATING TO THE SALE OF ALCOHOLIC BEVERAGES; REPEALING
SECTIONS 3-2, 3-3 AND 3-4 OF THE CODE OF ORDINANCES OF THE CITY
OF NAPLES AND SUBSTITUTING A NEW SECTION 3-2 THEREFOR; AND
PROVIDING AN EFFECTIVE DATE.
PURPOSE: TO PROHIBIT THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES
DURING CERTAIN HOURS; AND TO PERMIT THE SALE OF ALCOHOLIC BEVERAGES
BY BONA FIDE RESTAURANTS AS DESCRIBED HEREIN, FOR CONSUMPTION ON
THE PREMISES ONLY, BETWEEN THE HOURS OF 12:00 NOON AND 12:00
MIDNIGHT ON SUNDAYS.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
NAPLES, FLORIDA:
SECTION 1. That Sections 3-2, 3-3 and 3-4 of the Code of
Ordinances of the City of Naples are hereby
repealed and the following Section 3-2 is
substituted therefor:
Sec. 3-2. Hours of Sale and Consumption.
(a) It shall be unlawful for any duly licensed
vendor of alcoholic beverages, whether for consumption
on or off the premises, to sell or serve alcoholic
beverages, or to permit the consumption thereof on
the premises, between the hours of two o'clock a.m.
and seven o'clock a.m. each Tuesday through Saturday;
and each Monday between the hours of 12:01 a.m. and
7:00 a.m.
(b) It shall be unlawful for any such vendor
as described in paragraph (a) hereof to sell or serve
alcoholic beverages, or to permit the consumption
thereof on the premises, between the hours of two o'clock
a.m. each Sunday and seven o'clock a.m. each Monday;
except that any bona fide restaurant holding a City
license as such and deriving at least fifty-one (51%)
of its gross income from the sale of food and nonalcoholic beverages, and which is also a duly licensed
vendor of alcoholic beverages of any kind for consumption on the premises, may sell and serve alcoholic
beverages for consumption on the premises only
between the hours of twelve o'clock noon and twelve
o'clock midnight on Sundays.
(c) On those certain Sundays occurring on
New Years' Eve (December 31) it shall be lawful for
a duly licensed vendor of alcoholic beverages to sell
and serve alcoholic beverages for consumption on
the premises only from twelve o'clock noon on Sunday
until two o'clock a.m. the following Monday.
SECTION 2. This ordinance shall take effect immediately upon
adoption at second reading.
