ACCORDING TO THE FEDERALIST,
HOW DOES FEDERALISM PRESERVE
LIBERTY?
Federalism preserves liberty in these main ways:
• Reduces possibility of a single majority power having all the control.
• The states could nullify overpowering acts formed by central government.
• Each level of government could go as far but to declare war to defend its
self. (national Gov. can declare war)
• Central government could create programs to improve the life of citizens.
Overall, the division of two tiered government distributes the power so that
no one government entity can become too powerful.
DUAL SOVEREIGNTY?
• Divide power to avoid tyranny of one ruling group.
• Divided sovereignty between state and nation.

NEW NATION? HOW WOULD THE
ELECTION OF 1800 SUPPORT THIS?
• Must cede power to rival political faction
• 1800: feds accepted defeat by Democratic Republicans.

WHAT WAS THE PRICE OF DUAL
SOVEREIGNTY?
• According to President Lincoln, the Union was to be preserved at all costs,
which led to the civil war.
• Because of the war, one million lives were lost , the southern economy was
destructed, African Americans were emancipated from slavery, the demise
of the doctrine of nullification occurred, and early federalism ended.
• Since the termination of the war, Americans realized that they cant trust
their liberties to federalism.
SINCE THE NEW DEAL, WHY HAS THE
CONSTITUTIONAL POWER OF THE NATIONAL
GOVERNMENT EXPANDED SO DRASTICALLY
• New deal: group of government programs established in the 1930s by
president Franklin D. Roosevelt to help revive the population after the
great depression.
• Many argue that the 1st and 2nd New Deals were an unconstitutional
extension of federal power. The deal extended over capitalist economy.
• Since the Great Depression was so crushing, the New Deal gave the
federal governemnt power over every aspect of agriculture, banking and
industries. Such as when farmers planted crops, union organizing and
where money was placed.
• Nothing was moving without the federal governments implementation of
a program.
WHY DO MOST NATIONAL EFFORTS TO
INFLUENCE STATE/LOCAL GOVERNMENTS
COME IN THE FORM OF FEDERAL MONEY.
• Called federal grants, influence local government (towns and school
districts, countries at the largest.
• Money provided, with condition that a prerequisite is met.
• 1987- grant for state highway maintenance, provided that states raise the
drinking age.
