The Praise is for Allah azwj Lordazwj of the Worlds, and Blessing be upon our Chief Muhammad saww and hissaww Purified Progenyasws, and greetings with abundant greetings. الر ُج ِل ا ْل ُح ِّر َي ْق ُتل ُ َم ْملُو َك َغ ْي ِر ِه أَ ْو َي ْج َر ُح ُه َو ا ْل َم ْملُوكِ َي ْق ُتل ُ ا ْل ُح َّر أَ ْو َي ْج َر ُح ُه َّ باب Chapter 23 – The free man kills a slave of someone else, or injures him, and the slave kills the free or injures him ) ير َعنأ أَ َح ِد ِه َما ( عليهما السالم َ ان َع ِن اب ِأن مُسأ َك َ ص أف َو َ َّار َعنأ ٍ ِان َعنأ أَ ِبي بَص ِ أَبُو َعلِيٍّ أاْلَ أش َع ِريُّ َعنأ م َُح َّم ِد ب ِ أن َع أب ِد أال َجب ُ ُ أ أ أ أ أ أ أ أ ُ َقا َل قُ أل ب َعلَ أي ُك ُم القِصاصُ فِي ال َق أتلى الحُرُّ ِبالحُرِّ َو ال َع أب ُد ِبال َع أب ِد َو اْل أنثى ِباْل أنثى َقا َل َف َقا َل َل ُي أق َت ُل َ َّللا َع َّز َو َج َّل ُك ِت ِ َّ ت لَ ُه َق أو ُل . ضرأ با ً َشدِيداً َو يُغَ رَّ ُم َث َم َن ُه ِد َي َة أال َع أب ِد َ ُحُرٌّ ِب َع أب ٍد َو لَ ِكنأ يُضأ َرب Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, from Safwan, from Ibn Muskan, from Abu Baseer, (It has been narrated) from one of the two (5th or 6th Imamasws), said, ‘I said to himasws, ‘The Words of Allahazwj Mighty and Majestic [2:178] O you who believe! The retaliation is Prescribed for you in the matter of the slain, the free for the free, and the slave for the slave, and the female for the female. So heasws said: ‘The free would not be killed due to the slave, but he would be whipped with intense whipping, and would be fined his value as wergild for the slave’.1 َّللا ( عليه السالم ) َقا َل َقا َل ِ َّ أن عِ ي َسى َعنأ َس َما َع َة َعنأ أَ ِبي َع أب ِد َ َّللا َعنأ ع أُث َم ِ َّ أن أَ ِبي َع أب ِد ِ ان ب ِ عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ أَحأ َم َد ب . َضرأ با ً َشدِيداً َح َّتى َل َيعُود َ ُُي أق َت ُل أال َع أب ُد ِب أالحُرِّ َو َل ُي أق َت ُل أالحُرُّ ِب أال َع أب ِد َو لَ ِكنأ يُغَ رَّ ُم َث َم َن ُه َو يُضأ َرب A number of our companions, from Ahmad Bin Abu Abdullah, from Usman Bin Isa, from Sama’at, (It has been narrated) from Abu Abdullahasws having said: ‘The Slave would be killed due to the free, and the free would not be killed due to the slave, but he would be fined his value, and he would be whipped with an intense whipping until he does not repeat’.2 َُّّللا ( عليه السالم ) َقا َل َقا َل َل ُي أق َت ُل أالحُر ِ َّ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب ِأن أَ ِبي ُع َمي ٍأر َعنأ َحمَّا ٍد َع ِن أال َحلَ ِبيِّ َعنأ أَ ِبي َع أب ِد . ًضرأ با ً َشدِيدا َ ب َ ِب أال َع أب ِد َو إِ َذا َق َت َل أالحُرُّ أال َع أب َد ُغرِّ َم َث َم َن ُه َو ض ُِر Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, (It has been narrated) from Abu Abdullahasws having said: ‘The free would not be killed due to the slave. And he asws said: ‘The wergild of the slave is his value’.4 َّللا ( عليه السالم ) َقا َل ِد َي ُة أال َع أب ِد قِي َم ُت ُه َفإِنأ ِ َّ ان َعنأ أَ ِبي َع أب ِد َ أن مُسأ َك َ أن عِي َسى َعنأ يُو ُن ِ س َع ِن اب ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ م َُح َّم ِد ب . ِّض ُل قِي َم ِت ِه َع َش َرةُ َآلفِ ِدرأ َه ٍم َو َل ي َُج َاو ُز ِب ِه ِد َي َة أالحُر َ ان َنفِيسا ً َفأ َ أف َ َك Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from Ibn Muskan, Abu Abdullahasws has said: ‘Wergild of the slave is his value. So if he was precious, so the highest of his value would be a thousand Dirhams, and the wergild of the free would not be exceeded by it’.5 ول َفإِنأ ِ َّ ِب َعمَّنأ َر َوا ُه َعنأ أَ ِبي َع أب ِد َ أن َت أغل ِ َّللا ( عليه السالم ) َقا َل إِ َذا َق َت َل أال َع أب ُد أالحُرَّ ُدف َِع إِلَى أَ أو ِل َي ِ اء أال َم أق ُت ِ ان ب ِ يُو ُنسُ َعنأ أَ َب ً ُ َ ُّ . َشاءُوا َق َتلُوهُ َو إِنأ َشاءُوا َح َبسُوهُ َو إِنأ َشاءُوا اسأ َت َرقوهُ َو َيكونُ َعبأدا ل ُه أم Yunus, from Aban Bin Taghlub, from the one who reported it, Abu Abdullahasws has said: ‘When the slave kills the free, he would be handed over to the guardians of the killed. So if they so desire to, they kill him, and if they so desire to, they imprison him, and if they so desire to, or leave him and he can be a slave to them’.6 ار َة َعنأ أَ َح ِد ِه َما ( عليهما السالم ) فِي أال َع أب ِد إِ َذا َق َت َل أال ُح َّر َ يز َعنأ ُز َر ٍ أن عِ ي َسى َعنأ َح ِر ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َعنأ َحمَّا ِد ب . ُول َفإِنأ َشاءُوا َق َتلُوهُ َو إِنأ َشاءُوا اسأ َت َر ُّقوه ِ ُدف َِع إِلَى أَ أولِ َيا ِء أال َم أق ُت Ali Bin Ibrahim, from his father, from hammad Bin Isa, from Hareyz, from Zurara, (It has been narrated) from one of the two (5th or 6th Imamasws) regarding the slave when he kills the free, he would be handed over to the guardians of the killed one, so if they so desire to, they kill him, and if they so desire to they keep him (as a slave for them)’.7 ُ ير َقا َل َسأ َ أل ) ت أَ َبا َجعأ َف ٍر ( عليه السالم ٍ أن َمحأ بُو ٍ ِأن َسال ٍِم َعنأ أَ ِبي بَص ِ ب َعنأ ِه َش ِام ب ِ أن م َُح َّم ٍد َع ِن اب ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ َم َد ب ً َ أ أ َ ُ َعنأ ُم َدب ٍَّر َق َت َل َرج ًُال َعمأ داً َف َقا َل ُي أق َت ُل ِب ِه َقا َل قُل ول َف َي ُكونُ لَ ُه أم ِر ّقا ً إِنأ َشاءُوا ِ ت َفإِنأ َق َتلَ ُه َخطأ َقا َل َف َقا َل ي أُد َف ُع إِلَى أ أولِ َيا ِء ال َم أق ُت ٌ أس لَ ُه أم أَنأ َي أق ُتلُوهُ َقا َل ُث َّم َقا َل َيا أَ َبا م َُح َّم ٍد إِنَّ أالمُدَ َّب َر َممأ لُو .ك َ َباعُوهُ َو إِنأ َشاءُوا اسأ َت َر ُّقوهُ َو لَي Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Hisham Bin Salim, from Abu Baseer who said, ‘I asked Abu Ja’farasws about the ‘Mudabbir’ (slave promised freedom upon the death of his master), who killed a man deliberately. So he asws said: ‘He would be killed due to it’. Then heasws said: ‘O Abu Muhammad! The ‘Mudabbir’ is a slave’.8 ُ ِيل َقا َل قُ أل َّللا ( عليه السالم ) مُدَ َّب ٌر َق َت َل َرج ًُال َخ َطأ ً َمنأ ِ َّ ت ِْلَ ِبي َع أب ِد ٍ أن أَ ِبي ُع َمي ٍأر َعنأ َجم ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب ُ َ َ أ َّ ول َي أخ ُد ُم ُه أم َح َّتى َيمُوتَ الذِي دَ ب ََّرهُ ث َّم َيرأ ِج ُع ُح ّراً َل َس ِبي َل َ َيضأ َمنُ َع أن ُه َقا َل ُي ِ صالِ ُح َع أن ُه َم أو َلهُ َفإِنأ أ َبى ُدف َِع إِلَى أ أولِ َي ِ اء ال َم أق ُت . َعلَ أي ِه َو فِي ِر َوا َي ٍة أ ُ أخ َرى َو يُسأ َتسأ َعى فِي قِي َم ِت ِه Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Jameel who said, ‘I said to Abu Abdullahasws, ‘A ‘Mudabbir’ (Slave promised freedom upon the death of his master), who killed a man in error, who is responsible from him?’ He asws said: ‘His master has to reconcile from him. But, if they refuse, he would be handed over to the guardians of the killed one to serve them until he dies, the one who had promised him freedom. Then he is returned as free, there not being a way against him’. And in another report: ‘And he has to work regarding his value’.9 ُ ب َعنأ أَ ِبي م َُح َّم ٍد أال َو ِابشِ يِّ َقا َل َسأ َ أل َّللا ( عليه السالم ) َعنأ َق أو ٍم ٍ أن َمحأ بُو ِ َّ ت أَ َبا َع أب ِد ِ أن م َُح َّم ٍد َع ِن اب ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ َم َد ب ُ ا َّد َع أوا َعلَى َع أب ٍد ِج َنا َي ًة ُيح َّع أوا َعلَى َ ِيط ِب َر َق َب ِت ِه َفأ َ َقرَّ أال َع أب ُد ِب َها َقا َل َل َيجُو ُز إِ أق َرا ُر أال َع أب ِد َعلَى َس ِّي ِد ِه َفإِنأ أَ َقامُوا أال َب ِّي َن َة َعلَى َما اد َ . ُأال َع أب ِد أُخ َِذ أال َع أب ُد ِب َها أَ أو َي أف َت ِد َي ِه َم أوله Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Abu Muhammad Al Wabishy who said, ‘I asked Abu Abdullahasws about a group which claimed upon a slave for a crime which (the damage of which) was more than his value. So the slave accepted with it. Heasws said; ‘The confession of the slave upon his master is not allowed. So if the proof is established upon what is being claimed upon the slave, the slave would be seized for it, or his master has to ransom him’.10 َّللا ( عليه السالم ) َقا َل إِ َذا ٍ أن ِر َئا ٍ أن َمحأ بُو ِ َّ ب َع ِن أال َحلَ ِبيِّ َعنأ أَ ِبي َع أب ِد ِ ب َع ِن اب ِ أن ِز َيا ٍد َع ِن اب ِ عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ َسه ِأل ب َ ب قِي َل َفإِنأ َكا َن أ . ار َ ت قِي َم ُت ُه عِ أش ِري َن أَ أل َ َق َت َل أالحُرُّ أال َع أب َد ُغرِّ َم قِي َم َت ُه َو أ ُ ِّد ِ ف ِدرأ َه ٍم َقا َل َل ي َُج َاو ُز ِبقِي َم ِة َع أب ٍد ِد َي َة أاْلحأ َر A number of our companions, from Sahl Bin Ziyad, from Ibn Mahboub, from Ibn Raib, from Al Halby, (It has been narrated) from Abu Abdullahasws having said: ‘When the free kills the slave, he would be fined his value, and be disciplined, so even if his value was twenty thousand Dirhams’. Heasws said: ‘It is not allowed for the value of a slave to exceed the wergild of the free ones’.11 َّللا ( عليه ٍ أن ِر َئا ٍ أن َمحأ بُو ِ َّ ار َعنأ أَ ِبي َع أب ِد َ ُب َع ِن أالف ٍ أن َي َس ِ ضي ِأل ب ِ ب َعنأ َعلِيِّ ب ِ أن إِب َأراهِي َم َعنأ أَ ِبي ِه َجمِيعا ً َع ِن اب ِ َو َع أن ُه َو َعلِيِّ ب ُ اح ُة ُتح ِيط ِب َر َق َب ِت ِه َو إِنأ ِ السالم ) أَ َّن ُه َقا َل فِي َع أب ٍد َج َر َح حُرّ اً َقا َل إِنأ َشا َء أالحُرُّ ا أق َتصَّ ِم أن ُه َو إِنأ َشا َء أَ َخ َذهُ إِنأ َكا َن َ ت أال ِج َر ُ ت َل ُتح أ أ أ ِيط ِب َر َق َب ِت ِه ا أف َت َداهُ َم أو َل ُه َفإِنأ أَ َبى َم أو َلهُ أَنأ َي أف َت ِد َي ُه َك َ أ َ َكا َن أ اح ِت ِه َو ال َباقِي لِل َم أولى َ ُوح م َِن أال َع أب ِد ِب َق أد ِر ِد َي ِة ِج َر ِ ان لِلحُرِّ ال َمجأ ر . ُي َبا ُع أال َع أب ُد َف َيأأ ُخ ُذ أال َمجأ رُو ُح َح َّق ُه َو ي َُر ُّد أال َباقِي َعلَى أال َم أولَى 8 Al Kafi – V 7 – The Book of Wergilds Ch 23 H 8 Al Kafi – V 7 – The Book of Wergilds Ch 23 H 9 10 Al Kafi – V 7 – The Book of Wergilds Ch 23 H 10 11 Al Kafi – V 7 – The Book of Wergilds Ch 23 H 11 9 5 out of 42 Alkafi Volume 7 www.hubeali.com And from him, and Ali Bin Ibrahim, from his father, both together from Ibn Mahboub, from Ali Bin Raib, from Al Fuzayl Bin Yasaar, (It has been narrated) from Abu Abdullahasws having said regarding a salve having injured a free: ‘If the free one so desires to he can retaliate from it, and if he so desires to he can seize him, if it was such that the injuries exceeded his freedom (price), and if it did not exceed his freedom price, his master has to ransom him. So if his master refuses to ransom him, there would be for the free one, the injured, a wergild of the measure of his injuries sustained, and the remainder would be for the master. The slave would be sold, so the injured would take his right, and return the remainder upon the master’.12 َّللا ( عليه السالم ) فِي َرج ٍُل َش َّج َعبأداً مُوضِ َح ًة َقا َل ٍ ابأنُ َمحأ بُو ِ َّ ار َة َعنأ أَ ِبي َع أب ِد َ أن ُز َر ِ يز أال َع أبدِيِّ َعنأ ُع َب أي ِد ب ِ ب َعنأ َع أب ِد أال َع ِز . َعلَ أي ِه ِنصأ فُ ُع أش ِر قِي َم ِت ِه Ibn Mahboub, from Abdul Aziz Al Abdy, from Ubeyd Bin Zurara, (It has been narrated) from Abu Abdullahasws regarding a man who fractured a bone of a slave. Heasws said: ‘Upon him is half of the tenth of his price’.13 ُ َّللا ( عليه السالم ) َعنأ َع أب ٍد َق َط َع َي َد َرج ٍُل حُرٍّ َو لَ ُه َث َال ُ صال ٍِح َقا َل َسأ َ أل ص ِاب َع ِمنأ ٍ ابأنُ َمحأ بُو َ َث أ ِ َّ ت أَ َبا َع أب ِد َ أن ِ ب َع ِن أال َح َس ِن ب َ َّ أن َو أ أ أ أ أ ُ ُ َ أ أ ُ ُ َ َ َ َت صأ نأ أ نأ اجأ أ ث ي ت ِيح ح ص َّ ال أن ي ع ب اْل ة ي د م ر ث ك أ د ب ع ال ة م ِي ق ان ك إ ل ا ق ئ ا م ا ه ل ع ت ل ق د ب ع ال ة م ِي ق ا م و ل ا َي ِد ِه َشلَ ٍل َف َق ِ الث َال ِ ِ ِ ِ ِش ِ َ َ َ َ َ َ َ َ َ َ َ َ َ َ َ َ َ ِ ِ ِ ِ َ َ أ أ أ أ َ َ َّ ُ َ َ َ َ َّ أ َ َ َ َ أن َ ص ِاب ِع الشل ِل َر َّد الذِي قطِ َعت َي ُدهُ َعلى َم أولى ال َع أب ِد َما ف َ َأ ِ اْلصأ َب َعي ِ ض َل م َِن القِي َم ِة َو أخذ ال َع أب َد َو إِنأ شا َء أخذ قِي َمة َ َّ َّ ص ِاب ِع ال شلَ ِل َّ ال ِ أن َو الث َال َ ثأ َ صح ِ ِيح َتي Ibn Mahboub, from Al Hassan Bin Salih who said, ‘I asked Abu Abdullahasws about a slave who cut-off the hand of a free man, and for him were three paralysed fingers from his hand. So he asws said: ‘And what is the value of the slave?’ I said, ‘Make it to be whatever youasws like’. Heasws said: ‘If his master so desires to he can pay the wergild to them, or else hand him over to them, for him to serve them. So when his master dies, meaning the one who (promised to) free him, he would return as free’. One of the two killed his companion, is it for him that he can retaliate with him besides the ruling authorities, if he so likes that?’ Heasws said: ‘He was his property. He can do whatsoever he so desires to with him. Heasws said: ‘Which thing are you all reporting with regards to this?’ I said, ‘We are reporting from Abu Abdullahasws having said: ‘He would be completely handed over to the guardians of the killed one. So when the one who promised his freedom upon his own death were to die, he is free’. Heasws said: ‘Glory be to Allahazwj! So the blood of a Muslim person has been invalidated?’ I said, ‘This is how we are reporting it’. Heasws said: ‘You are mistaken upon myasws fatherasws. He would be completely handed over to the guardians of the killed one. So heasws said; ‘If he has fulfilled something from his contract, he would be fined for his crime in accordance with what he has paid from his contract, to the free. So if he was frustrated from (paying) anything from the right of the crime, that would be taken from the wealth of the master who had contracted him’. ُ قُ أل ب َو ِ ت أال ِج َنا َي ُة ل أِل َع أب ِد َقا َل َف َقا َل َعلَى م أِث ِل َذل َِك ُدف َِع إِلَى َم أولَى أال َع أب ِد الَّذِي َج َر َح ُه أال ُم َكا َتبُ َو َل َت َقاصَّ َبي َأن أال ُم َكا َت ِ ت َفإِنأ َكا َن َ َ َ أ أ أ أ َ أ ان ال ُم َكا َتبُ َق أد أدَّى ِمنأ ُم َكا َت َب ِت ِه َش أيئا ً َفإِنأ لَ أم َي ُكنأ أدَّى ِمنأ ُم َكا َت َب ِت ِه َشيأئا ً َفإِ َّن ُه ُي َقاصُّ ال َع أب ُد ِمن ُه أ أو ُي َغرَّ ُم ال َم أولَى َ َبي َأن ال َع أب ِد إِذا َك َ ِ ُُك َّل َما َج َنى أال ُم َكا َتب . ً ْل َّن ُه َع أب ُدهُ َما لَ أم ي َُؤ ِّد ِمنأ ُم َكا َت َب ِت ِه َشيأئا I said, ‘If it was that the (compensation of the) crime was for the slave?’ So he asws said: ‘A similar amount would be handed over to the master of the slave whom the contracted slave injured, and there would be no retaliation between the contracted slave and the (owned) slave when it was that the contracted slave had paid something off from his contract. So he asws said: ‘If it was the case that his master had stipulated upon him when he contracted him, that if he was frustrated (from paying), so he would return it with regards to the slave, so he would be at the status of the owned slave. He would be handed over to the guardians of the killed one, so if they so desire to they can kill him, and if they so desire to they can sell him. And if it was that his master, when he contracted him, did not stipulate upon him, and it was such that he had paid something off from his contract, so Aliasws was saying: ‘He would be free from the contract in proportionate to what he has paid off from his contract’. ُ ب َو َل َيب ٍ مُسأ ل ٍِم َو أَ َرى أَنأ ِ ول م َِن ال ِّد َي ِة ِب َق أد ِر َما أُعأ ِتقَ م َِن أال ُم َكا َت َ اْل َم ِام أَنأ ي َُؤ ِّد ِ ي إِلَى أَ أولِ َيا ِء أال َم أق ُت ٍ أط ُل دَ ُم ا أم ِر ِ َفإِنَّ َعلَى أ َ . ُأس لَ ُه أم أَنأ َي ِبيعُوه ِ ون َما َبق َِي َعلَى أال ُم َكا َت َ ول َيسأ َت أخ ِدمُو َن ُه َح َيا َت ُه ِب َق أد ِر َما َبق َِي َعلَ أي ِه َو لَي َ َي ُك ِ ب ِممَّا َل أم ي َُؤ ِّد ِه ِر ّقا ً ِْل أولِ َيا ِء أال َم أق ُت Thus it would be upon the Imamasws that heasws pays the wergild to the guardians of the killed one in accordance to what he has been freed from the contract, and the blood of a Muslim person would not be invalidated. And Iasws see that whatever remains upon the contracted slave, from what he has not paid off, he would be enslave to the guardians of the killed one, to serve them for his life, in proportionate to what remains upon him, and it would not be for them that they sell him’.24 َّللا ( عليه السالم ) َقا َل فِي ِ َّ ان َعنأ أَ ِبي َع أب ِد ِ َّ س َعنأ َع أب ِد َ ار َعنأ يُو ُن ٍ أن سِ َن ِ َّللا ب ٍ َّأن َمر ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َعنأ إِسأ مَاعِ ي َل ب َب َق َت َل َرج ًُال َخ َطأ ً َقا َل َعلَ أي ِه ِمنأ ِد َي ِت ِه ِب َق أد ِر َما أُعأ ِتقَ َو َعلَى َم أو َلهُ َما َبق َِي ِمنأ قِي َم ِة أال َممأ لُوكِ َفإِنأ َع َج َز أال ُم َكا َتبُ َف َال َعا ِقلَة ٍ ُم َكا َت . ِين َ ك َعلَى إِ َم ِام أالمُسأ لِم َ ِلَ ُه إِ َّن َما َذل Ali Bin Ibrahim, from his father, from Ismail Bin Marrar, from Yunus, from Abdullah Bin Sinan, (It has been narrated) from Abu Abdullahasws having said regarding a contracted slave who killed a man in error. Heasws said: ‘Upon him from his wergild, is in proportion to what he is free, and upon his master is what remains from the value of the price. So if the contracted slave is frustrated (from paying), so there is no blood (compensation) for him. But rather, that is upon the Imamasws of the Muslims’.25 َّللا ( عليه السالم ) فِي َرج ٍُل حُرٍّ َق َت َل ٍ أن َمحأ بُو ِ َّ صال ٍِح َعنأ أَ ِبي َع أب ِد َ أن ِ ب َع ِن أال َح َس ِن ب ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن أال َح َس ِن ب َ َ َ أ ُ . ٍّف ِدرأ َه ٍم َف َقا َل َل َيجُوز أنأ ُي َت َج َاو َز ِبقِي َم ِة َع أب ٍد أكث َر ِمنأ ِد َي ِة حُر َ ُون أَ أل َ َعبأداً قِي َم ُت ُه عِ أشر Ali Bin Ibrahim, from his father, from Al Hassan Bin Mahboub, from Al Hassan Bin Salih, (It has been narrated) from Abu Abdullahasws regarding a free man who kills a slave who value is twenty thousand Dirham. So heasws said: ‘It is not allowed that the value of a slave should be more than the wergild of a free’.26 24 Al Kafi – V 7 – The Book of Wergilds Ch 24 H 3 Al Kafi – V 7 – The Book of Wergilds Ch 24 H 4 26 Al Kafi – V 7 – The Book of Wergilds Ch 24 H 5 25 10 out of 42 Alkafi Volume 7 www.hubeali.com ِّ ُ باب ا ْل ُم ْسل ِِم َي ْق ُتل ض ُُه ْم َب ْعضا ُ ص َب ْع ُّ الذ ِّم َّي أَ ْو َي ْج َر ُح ُه َو ال ِّذ ِّم ِّي َي ْق ُتل ُ ا ْل ُم ْسلِ َم أَ ْو َي ْج َر ُح ُه أَ ْو َي ْق َت Chapter 25 – The Muslim kills the Zimmy or injures him, and the Zimmy kills the Muslim or injures him, or they retaliate against each other َّللا ( عليه السالم ) َقا َل ِد َي ُة أال َيهُودِيِّ َو ِ َّ ان َعنأ أَ ِبي َع أب ِد َ أن مُسأ َك َ أن عِ ي َسى َعنأ يُو ُن ِ س َع ِن اب ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ م َُح َّم ِد ب . ال َّنصأ َرانِيِّ َو أال َمجُوسِ يِّ َث َما ُن ِما َئ ِة ِدرأ َه ٍم Ali Bin Ibrahim, from Muhammad Bin Isa, from Yunus, from Ibn Muskam, Abu Abdullahasws has said: ‘Wergild of the Jew, and the Christian, and the Magian, is eight hundred Dirhams’.27 َّللا ( عليه السالم ) َقا َل إِ َذا َق َت َل أالمُسأ لِ ُم َيهُو ِد ّيا ً أَ أو َنصأ َرا ِن ّيا ً أَ أو َمجُوسِ ّيا ً َفأ َ َرا ُدوا أَنأ ُيقِي ُدوا ِ َّ ان َعنأ أَ ِبي َع أب ِد َ أن مُسأ َك ِ َو َع أن ُه َع ِن اب . َُردُّوا َفضأ َل ِد َي ِة أالمُسأ ل ِِم َو أَ َقا ُدوه And from him, from Ibn Muskan, Abu Abdullahasws has said: ‘When the Muslim kills a Jew, or a Christian, or a Magian, so they intend that they retaliate, they have to return the excess wergild to the (guardians of the) Muslim, and retaliate him’.28 ِّ َّللا ( عليه السالم ) فِي َرج ٍُل مُسأ لِم َق َت َل َرج ًُال ِمنأ أَهأ ِل ٌ الذ َّم ِة َف َقا َل َه َذا َحد ِيث ِ َّ اع َة َعنأ أَ ِبي َع أب ِد َ َو َع أن ُه َعنأ ُزرأ َع َة َعنأ َس َم ٍ ُ ِّ أ أ . َشدِي ٌد َل َيحأ َت ِمل ُ ُه ال َّناسُ َو لَ ِكنأ يُعأ طِ ي الذمِّيُّ ِد َي َة المُسأ ل ِِم ث َّم ُي أق َت ُل ِب ِه المُسأ لِ ُم And from him, from Zurara, from Sama’at, (It has been narrated) from Abu Abdullahasws regarding a Muslim man who kills a man from the Zimmy people. So when he was seized, he became a Muslim. Heasws said: ‘He would be killed due to it’. So heasws said: ‘The wergild of an eye of a Christian is four hundred Dirhams’.36 ُ ث أالم َُرادِيِّ َقا َل َسأ َ أل َّللا ( عليه السالم ) َعنأ ِد َي ِة ال َّنصأ َرانِيِّ َو ٍ أن ُب َكي ٍأر َعنأ لَ أي ٍ ابأنُ َمحأ بُو ِ َّ ت أَ َبا َع أب ِد َ ب َعنأ أَ ِبي أَي ِ ُّوب َو اب . أال َيهُودِيِّ َو أال َمجُوسِ يِّ َقا َل ِد َي ُت ُه أم َجمِيعا ً َس َوا ٌء َث َما ُنمِا َئ ِة ِدرأ َه ٍم َث َما ُن ِما َئ ِة ِدرأ َه ٍم Ibn Mahboub, from Abu Ayoun, and Ibn Bukeyr, from Lays Al Murady who said, ‘I asked Abu Abdullahasws about the wergild of the Christian, and the Jew, and the Magian. Heasws said: ‘Regarding it is the complete wergild; and regarding the two eyes is the (complete) wergild, and regarding one of the two is half the wergild; and regarding the two ears is the (complete) wergild, and regarding of the two is half the wergild; and regarding the manhood when it’s tip is cut off and what is above, is the (complete) wergild; and regarding the nose when the soft parts are cut off, and regarding the two lips is the (complete) wergild’.42 َّللا ( عليه السالم ) فِي أاْلَ أنفِ إِ َذا ٍ أن َمحأ بُو ِ َّ ان َعنأ أَ ِبي َع أب ِد ِ َّ ب َعنأ َع أب ِد ٍ أن سِ َن ِ َّللا ب ِ أن م َُح َّم ٍد َع ِن اب ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ َم َد ب ُ ُ أ أ أ َ َ ت ِنصأ فُ ال ِّد َي ِة َو فِي اْلذ ِن إِذا قُطِ َع أ أن إِذا فُ ِق َئ أ ت ِنصأ فُ ال ِّد َي ِة َو فِي ال َي ِد ِنصأ فُ ال ِّد َي ِة َو فِي ِ اسأ ُت أؤصِ َل َج أد ُع ُه ال ِّد َي ُة َو فِي ال َعي َّ . الذ َك ِر إِ َذا قُطِ َع ِمنأ َم أوضِ ِع أال َح َش َف ِة ال ِّد َي ُة Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Abdullah Bin Sinan, (It has been narrated) from Abu Abdullahasws regarding the nose when its stump is eradicated, is the (complete) wergild; and regarding the ear is half the wergild when it is cut off from its roots, and when it is cut from its surroundings, so regarding it is a just value; and regarding the nose when it is cut, is the complete wergild; So when he intended to copulate with her, she kicked him with her leg and ruptured his testicles, so they became swollen. So after that he copulated with her and she gave birth to a child for him. So I asked Abu Abdullahasws about that, and about a man whose navel was ruptured. So he asws said: ‘Regarding all ruptures is a third of the wergild’.49 أن َخا ِل ٍد َ أن َسال ٍِم َعنأ ُسلَ أي َم ِ ان ب ِ أن س َُو أي ٍد َعنأ ِه َش ِام ب ِ أن َسعِي ٍد َع ِن ال َّنضأ ِر ب ِ أن ب ِ أن م َُح َّم ٍد َع ِن أال ُح َسي ِ عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ أَحأ َم َد ب ُ َقا َل َسأ َ أل ُ َّللا ( عليه السالم ) َعنأ َرج ٍُل ُكسِ َر بُعأ صُو ص ُه َفلَ أم َي أملِكِ اسأ َت ُه َف َما فِي ِه م َِن ال ِّد َي ِة َف َقا َل ال ِّد َي ُة َكا ِملَ ًة ِ َّ ت أَ َبا َع أب ِد A number of our companions, from Ahmad Bin Muhammad, from Al Husayn Bin Saeed, from Al Nazar Bin Suweyd, from Hisham Bin Salim, from Suleyman Bin Khalid who said, ‘I asked Abu Abdullahasws about a man who broke his tail bone (coccyx), so he lost control of his excretion, so what was with regards to it from the wergild. So he asws said: ‘The complete wergild’. َ ت إِ َذا َن َزلَ أ ضا َها َو َكا َن أ . ك أال َم أن ِزلَ ِة لَ أم َتل أِد َقا َل ال ِّد َي ُة َكا ِملَ ًة َ ت ِبت أِل َ ار َي ٍة َفأ َ أف ِ َقا َل َو َسأ أل ُت ُه َعنأ َرج ٍُل َو َق َع ِب َج He (the narrator) said, ‘And I asked himasws about a man who copulated with a slave girl, so he was rough with her, and when she came down from that situation, she could no longer give birth. So if he were not to pay the wergild to her, I asws would cut off his male part if she were to seek that’.54 ُ ير َقا َل قُ أل ب امأ َرأَ ًة َشاب ًَّة ٍ ابأنُ َمحأ بُو َ ض َر َ ت ِْلَ ِبي َجعأ َف ٍر ( عليه السالم ) َما َت َرى فِي َرج ٍُل ٍ ِأن َسال ٍِم َعنأ أَ ِبي بَص ِ ب َعنأ ِه َش ِام ب ُ َ َ ًان َطم ُأث َها مُسأ َتقِيما ً َقا َل ُي أن َت َظ ُر ِب َها َس َنة َعلَى َب أط ِن َها َف َع َق َر َر ِح َم َها َفأ أف َس َد َطمأ َث َها َو َذ َك َر أ َ ك َو َق أد َك َ ِت أ َّن َها َق ِد ارأ َت َف َع َطمأث َها َع أن َها لِ َذل ُ َفإِنأ َر َج َع َط َ َ ُ ار ُب َها ُثل ان َو إِ َّل اسأ ُتحأ لِ َف أ . اع َطمأ ِث َها َ ت َو ُغرِّ َم َ مأث َها إِلَى َما َك ِ ض ِ ث ِد َي ِت َها لِ َف َسا ِد َر ِح ِم َها َو ا أن ِقط Ibn Mahboub, from Hisham Bin Salim, from Abu baseer who said, ‘I said to Abu Ja’farasws, ‘What is yourasws view regarding a man who struck a woman upon her belly, so her womb was misplaced and it spoilt her menstruation’; and I mentioned, ‘It stopped her menstruation from her due to that, and her menstruations had been firm beforehand’. Heasws said: ‘It would be awaited for her for a year, so if her menstruations were to come back to what they used to be, or else she would be made to wear an oath (for her state), and her attacker would be fined a third of the wergild due to spoiling her womb, and cutting off her menstruations’.55 ) ِين ( عليه السالم ٍ ابأنُ َمحأ بُو َ ضى أَمِي ُر أالم أُؤ ِمن َ ير َعنأ أَ ِبي َجعأ َف ٍر ( عليه السالم ) َقا َل َق ٍ ِأن َسال ٍِم َعنأ أَ ِبي بَص ِ ب َعنأ ِه َش ِام ب ُ َ َ َ َ . ف ال ِّد َي ِة َ ي ا أم َرأ ِت ِه َقا َل إِذنأ أغَ رِّ َم ُه لَ َها ِنصأ َ فِي َرج ٍُل َقط َع ث أد Ibn Mahboub, from Hisham Bin Salim, from Abu Baseer, (It has been narrated) from Abu Ja’farasws having said: ‘Amir Al-Momineenasws judged regarding a man who cut off a breast of his wife. He asws said: ‘Upon him is the (complete) wergild if he had copulated with her before she had reached nine years of age’. Heasws said: ‘If he were to keep her and not divorce her, so there is nothing upon him, and if he had copulated with her, and she was nine years of age, so there is nothing upon him; if he so desires to he keeps, and if he so desires to, he divorces’.57 ِأن َع أب ِد أال َملِك ِ َّ ُّون َعنأ َع أب ِد ٍ أن َشم ِ أن َع أب ِد الرَّ حأ َم ِن َعنأ ِمسأ َم ِع ب ِ َّللا ب ِ أن أال َح َس ِن ب ِ أن ِز َيا ٍد َعنأ م َُح َّم ِد ب ِ عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ َسه ِأل ب َ َّ أ أ أ ب ِ َّللا ( صلى َّللا عليه وآله ) فِي ال َقل ِ ِين ( عليه السالم ) َقا َل َرسُو ُل َ َّللا ( عليه السالم ) َقا َل َقا َل أمِي ُر الم أُؤ ِمن ِ َّ َعنأ أَ ِبي َع أب ِد ير فِي َّ َّللا ( صلى َّللا عليه وآله ) فِي ال َ ِص َع ِر ال ِّد َي ُة َو الص ََّع ُر أَنأ ي أُث َنى ُع ُنقُ ُه َفيَص ِ َّ ار ال ِّد َي ُة َقا َل َو َقا َل َرسُو ُل َ إِ َذا َر َع َد َف َط . َنا ِح َي ٍة A number of our copanions, from Sahl Bin Ziyad, from Muhammad Bin Al Hassan Bin Shamoun from Abdullah Bin Abdul Rahman, from Misma’a Bin Abdul Malik, (It has been narrated) from Abu Abdullahasws having said: ‘Amir Al-Momineenasws said: ‘Rasool-Allahsaww said: ‘With regards to the heart when it is shaken so it is damaged, is the (complete) wergild’. Heasws said: ‘And Rasool-Allahsaww said: ‘With regards to the contortion of the neck is the (complete) wergild; and the contortion is that his neck gets bent and it comes to be on its side’.58 ُ َّار َقا َل َس ِمعأ ضى أَمِي ُر ٍ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب ِأن َمحأ بُو َ َّللا ( عليه السالم ) َيقُو ُل َق ِ َّ ت أَ َبا َع أب ِد ٍ أن َعم ِ ب َعنأ إِسأ َحاقَ ب َ ُ ُ ِِين ( عليه السالم ) فِي ال َّرج ُِل يُضأ َربُ َعلَى عِ َجا ِن ِه َف َال َيسأ َتمأ س . ك ال ِّد َي َة َكا ِملَ ًة َ ِك َغا ِئط ُه َو َل َب أول ُ ُه أنَّ فِي َذل َ أالم أُؤ ِمن Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Is’haq Bin Ammar who said, ‘I heard Abu Abdullahasws saying: ‘Amir Al-Momineenasws judged regarding the man who was struck upon his lower part, so he was no longer able to withhold his faeces nor his urine, that with regards to that is the complete wergild’.59 ( َّللا ِ َّ َّار َعنأ أَ ِبي َع أب ِد َ أن إِسأ مَاعِ ي َل َعنأ ٍ أن ُع أق َب َة َعنأ إِسأ َحاقَ أب ِن َعم ِ صال ِِح ب ِ أن َعنأ م َُح َّم ِد ب ِ أن أال ُح َسي ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ م َُح َّم ِد ب َ ً ُان أال َب أو ُل َيمُرُّ إِلَى اللَّي ِأل َف َعلَ أي ِه ال ِّد َية ُ أ ُ َ ب َرجُال َفقطِ َع َب أول ُه َف َقا َل إِنأ َك َ ض َر َ عليه السالم ) َقا َل َسأَلَ ُه َر ُج ٌل َو أ َنا عِ ن َدهُ َعنأ َر ُج ٍل ان إِلَى َ ار َف َعلَ أي ِه ُثل ُ َثا ال ِّد َي ِة َو إِنأ َك َ ار َف َعلَ أي ِه ال ِّد َي ُة َو إِنأ َك َ ِْلَ َّن ُه َق أد َم َن َع ُه أال َمعِي َش َة َو إِنأ َك ِ ان إِلَى ِنصأ فِ ال َّن َه ِ ان إِلَى آخ ِِر ال َّن َه ُ ُ ار َف َعلَ أي ِه ُثل . ث ال ِّد َي ِة ِ اع ال َّن َه ِ ارأ ِت َف Muhammad Bin Yahya, from Muhammad Bin Al Husayn, from Muhammad Bin Ismail, from Salih Bin Uqba, from Is’haq Bin Ammar, (It has been narrated) from Abu Abdullahasws, said, ‘A man asked himasws and I was in hisasws presence, ‘A man struck a man, so his urine was intermittent. He asws said: ‘Half the wergild’. I said, ‘So a man whose hand is cut off?’ He asws said: ‘Regarding it is half the wergild’. I said, ‘So the man, one of his testicles goes away?’ Heasws said: ‘If it was the left one, so with regards to it is the (complete) wergild’. I said, ‘And why? Did youasws not say; ‘Whatever were two in the body, so with regards to each one is half the wergild?’ Heasws said: ‘Because the birth is from the left testicle’.61 أن َع أب ِد الرَّ حأ َم ِن َعنأ ِمسأ َم ٍع َعنأ أَ ِبي َع أب ِد ِ َّ ُّون َعنأ َع أب ِد ٍ أن َشم ِ َّللا ب ِ أن أال َح َس ِن ب ِ أن ِز َيا ٍد َعنأ م َُح َّم ِد ب ِ عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ َسه ِأل ب ُ ُت َف ُثل ت ال ِّد َي َة َكا ِملَ ًة َفإِ َذا َن َب َت أ ِين ( عليه السالم ) فِي اللِّحأ َي ِة إِ َذا ُحلِ َق أ ث ِ ت َفلَ أم َت أن ُب َ ضى أَمِي ُر أالم أُؤ ِمن َ َّللا ( عليه السالم ) َقا َل َق ِ َّ .ِال ِّد َية A number of our companions, from Sahl Bin Ziyad, from Muhammad Bin Al Hassan Bin Shamoun, from Abdullah Bin Abdul Rahman, from Misma’a, (It has been narrated) from Abu Abdullahasws having said: ‘Amir Al-Momineenasws judged regarding the beard when it is shaved-off, so it does not grow back, is the complete wergild. So if it does grow back, so it is a third of the wergild’. 62 ُ َّللا ( عليه السالم ) َقا َل قُ أل ُّت الرَّ ُج ُل َي أد ُخ ُل أال َحمَّا َم َف َيصُب ِ َّ ض ِر َجالِ ِه َعنأ أَ ِبي َع أب ِد ِ أن َخالِ ٍد َعنأ َبعأ ِ َس أه ُل بأنُ ِز َيا ٍد َعنأ َعلِيِّ ب ُ صاحِبُ أال َحمَّام َما ًء َحا ّراً َف َيمأ َتع ُ ِط َشعأ ُر َر أأسِ ِه َف َال َي أنب . ُت َف َقا َل َعلَ أي ِه ال ِّد َي ُة َكا ِملَ ًة َ َعلَ أي ِه ِ Sahl Bin Ziyad, from Ali Bin Khalid, from one of his men, (It has been narrated) from Abu Abdullahasws, said, ‘I said, ‘The man enters the (public) baths, so the owner of the baths splashes hot water upon him, so the hair of his head withers away, so it does not grow back’. So heasws said; ‘If it was such that his hand was cut off during a crime which was committed against himself, or it was cut so he took a wergild from the one who had cut it, so if his guardians (of the killed) one intend that they kill him (the killer), they can kill him and pay to the guardians of the killer a wergild of his hand which was retaliated from; even if it was that he had taken the wergild of his hand, and they kill him; and if they so desire to they subtract the wergild of his hand from it, and take the remainder’. ت َي ُدهُ قُطِ َع أ َقا َل َو إِنأ َكا َن أ ت ِمنأ َغي ِأر ِج َنا َي ٍة َج َنا َها َعلَى َن أفسِ ِه َو َل أَ َخ َذ ِب َها ِد َي ًة َق َتلُوا َقا ِتلَ ُه َو َل ي أُغ َر ُم َشيأئا ً َو إِنأ َشاءُوا أَ َخ ُذوا ِد َي ًة َكا ِملَ ًة Heasws said: ‘If it was that his hand was cut from other than a crime committed against himself, and a wergild was not taken by it, his killer would be killed and would not be fined anything; and if they so desire to, they take the complete wergild’. . ) ب َعلِيٍّ ( عليه السالم ِ َقا َل َو َه َك َذا َو َج أد َنا فِي ِك َتا Heasws said: ‘And this is how weasws have found it to be in the Book of Aliasws’.64 باب َنادِر Chapter 28 - Miscellaneous َّ يش َعنأ أَ ِبي َجعأ َف ٍر الثانِي ( عليه السالم ) َقا َل َقا َل أَبُو ِ أن أال َح ِر ِ َّاس ب ِ أن أال َعب ِ أن ِز َيا ٍد َع ِن أال َح َس ِن ب ِ عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ َسه ِأل ب َ َ َّ َّ َّ أ أ أ ُ َّللا َت َعالَى اخت َِالفٌ َقا َل َف َقا َل َل َقا َل َف َما ِ َّللا َه أل فِي ُحك ِم َ َّاس أنش ُد ِ َجعأ َف ٍر أاْلَ َّو ُل ( عليه السالم ) لِ َع أب ِد َ ك ٍ َّاس َيا أ َبا َعب ٍ أن َعب ِ َّللا ب ُ ت َف َذ َه َب أ ص ِاب َع ُه ِبال َّس أيفِ َح َّتى َس َق َط أ َ ت َو أَ َتى َر ُج ٌل َأك َو أَ أنت َ ار َكفَّ َي ِد ِه َفأت َِي ِب ِه إِلَي َ آخ ُر َفأ َ َط َ َب َرج ًُال أ َ ض َر َ َت َرى فِي َرج ٍُل صا ِن ٌع ٍ َق َ َأف أَ أنت َ اض َكي A number of our companions, from Sahl Bin Ziyad, from Al Hassan Bin Al Abbas Bin Al Hareysh, (It has been narrated) from Abu Ja’farasws the 2nd having said: ‘Abu Ja’farasws the 1st said to Abdullah Bin Abbas: ‘O Ibn Abbas! Iasws hereby adjure you with Allahazwj, is there a discrepancy in a Judgement of Allahazwj the High?’ He said, ‘No’. So they come up with him to you, and you are a judge. How would you deal with it?’ ُ َ أ َ َ َ َ أ ُ صالِحأ ُه َعلَى َما شِ أئتَ أَ أو أَ أب َع ث إِلَي ِأه َما َذ َويأ َع أد ٍل َف َقا َل لَ ُه َجا َء َ وع ِ َقا َل أقُو ُل لِ َهذا ال َقاطِ ِع أعأ طِ ِه ِد َي َة َكفٍّ َو أقُو ُل لِ َهذا ال َم أقط َ َ َ َ َّ َّ أ أ أ أ أ َض ا أقطعأ َ َّللا َو َن َقضأ تَ ال َق أو َل اْل َّو َل أ َبى َّللا ُ أنأ يُحأ د َ َث فِي َخل ِق ِه َشيأ ٌء م َِن ال ُح ُدو ِد َو لَي ِ ِال أخت َِالفُ فِي ُح أك ِم ِ أس َت أفسِ ي ُرهُ فِي اْلرأ َ َ ُ َِّ ص ِابع َه َذا ُح أك ُم أ َ عأ . َّللا َت َعالَى اْل ة ي د ه أ م ث َ ِ ِ ِيَدَ َقاطِ ِع أال َكفِّ أَصأ ًال َّ ط ِ َ He said, ‘I would say to this cutter to give a wergild for the palm, and I would say to his cut one that he should reconcile whatever he so desires to, or I would sent to them two just persons (for reconciliation)’. So heasws said to him: ‘There would be differing in the Judgement of Allahazwj and the first words would be overturned. Allahazwj has Refused that anything from the legal penalties (Hadd) be innovated among Hisazwj creatures, and there is no interpretation for it in the earth. Cut off the hand of the palm cutter then give him a wergild for the fingers. This is the Judgement of Allahazwj the High’.65 َ َباب ِد َي ِة َع ْي ِن ْاْلَ ْع َمى َو َي ِد ْاْل س َو َع ْي ِن ْاْلَ ْع َو ِر َ ِشلِّ َو ل ِ ان ْاْلَ ْخ َر ِ س Chapter 29 – Wergild for the eye of the blind, and a hand of the paralytic, and a tongue of the mute, and an eye of the one-eyed أن ُح َم أي ٍد َعنأ م َُح َّم ِد َ أن أَ ِبي َنجأ َر ِ ان َعنأ َعاصِ ِم ب ِ أن م َُح َّم ٍد َجمِيعا ً َع ِن اب ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َو م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ َم َد ب ِين ( عليه السالم ) فِي َرج ٍُل أَعأ َو َر أُصِ ي َب أ ِيح ُة َّ ت َع أي ُن ُه ال َ صح َ ضى أَمِي ُر أالم أُؤ ِمن َ أس َقا َل َقا َل أَبُو َجعأ َف ٍر ( عليه السالم ) َق ٍ أن َقي ِ ب َ َ َ ً ً َ أ ُ َ َ َففُ ِق َئ أ . صاح ِِب ِه َ صاح ِِب ِه َو يُعأ َق َل ل ُه ِنصأ فُ ال ِّد َي ِة َو إِنأ َشا َء أ َخذ ِد َية َكا ِملة َو يُعأ َفى َعنأ َعي ِأن َ ت أنأ تف َقأ إِحأ دَ ى َع أي َنيأ Ali Bin Ibrahim, from his father, and Muhammad Bin Yahya,f rom Ahmad Bin Muhammad, both together from Ibn Abu Najran, from Aasim Bin Humeyd, from Muhammad Bin Qays who said, ‘Abu Ja’farasws said: ‘Amir Al-Momineenasws judged regarding a one-eyed man whose correct eye was hit, so it was blinded: ‘He can blind an eye of his companions and pay him half the wergild, and if he so desires to, he can take the complete wergild, and forgive an eye of his companion’.66 َّللا ( عليه ِ َّ ير َعنأ أَ ِبي َع أب ِد ٍ ِأن أَ ِبي َح أم َز َة َعنأ أَ ِبي َبص ِ أن أال َح َك ِم َعنأ َعلِيِّ ب ِ أن م َُح َّم ٍد َعنأ َعلِيِّ ب ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ مَدَ ب ُ . أن أاْلَعأ َو ِر ال ِّد َية ِ السالم ) َقا َل فِي َعي Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ali Bin Al Hakam, from Ali Bin Abu Hamza, from Abu Baseer, Abu Abdullahasws has said: ‘With regards to an eye of the one-eyed, is the (complete) wergild’.67 أن أاْلَعأ َو ِر ِ َّ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب ِأن أَ ِبي ُع َمي ٍأر َعنأ َحمَّا ٍد َع ِن أال َحلَ ِبيِّ َعنأ أَ ِبي َع أب ِد ِ َّللا ( عليه السالم ) َقا َل فِي َعي . ال ِّد َي ُة َكا ِملَ ًة 65 Al Kafi – V 7 – The Book of Wergilds Ch 28 H 1 Al Kafi – V 7 – The Book of Wergilds Ch 29 H 1 67 Al Kafi – V 7 – The Book of Wergilds Ch 29 H 2 66 22 out of 42 Alkafi Volume 7 www.hubeali.com Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, (It has been narrated) from Abu Abdullahasws having said: ‘With regards to an eye of the one-eyed, is the complete wergild’.68 أن َخالِ ٍد فِي َرج ٍُل َق َط َع يَدَ َرج ٍُل َش َّال َء ٍ أن َمحأ بُو َ ب َعنأ َحمَّا ِد ب ِأن ِز َيا ٍد َعنأ ُسلَ أي َم ِ ان ب ِ أن م َُح َّم ٍد َع ِن اب ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ َم َد ب ُ ُ َقا َل َعلَ أي ِه ُثل . ث ال ِّد َي ِة Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Hammad Bin Ziyad, from Suleyman Bin Khalid – With regards to a man whose paralysed hand was cut by a man. He asws said: ‘Upon him (the cutter) is a third of the wergild’.69 أن أَ ِبي ِ َّ ان َعنأ َع أب ِد َ أن ُس َل أي َم ِ َّ أن َع أب ِد أال َحمِي ِد َعنأ أَ ِبي َجمِيلَ َة َعنأ َع أب ِد ِ َّللا ب ِ َّللا ب ِ أن أال َح َس ِن َعنأ م َُح َّم ِد ب ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ مُو َسى ب َ َ ً أ أ َ أ ُ ُ َّ َ َ َ َ َ َ َ أ ب ٍ ِضى فِي َها َعلِيُّ بأنُ أ ِبي طال َ أن ال َعو َرا ِء تكونُ قا ِئ َمة فتخ َسفُ فقا َل ق ِ َّ َجعأ َف ٍر َعنأ أَ ِبي َع أب ِد ِ َّللا ( عليه السالم ) [أن ُه قا َل] فِي ال َعي أ . ِيح ِة َّ أن ال َ صح َ ( عليه السالم ) ِنصأ ِ ف ال ِّد َي ِة فِي ال َعي Muhammad Bin Yahya, from Musa Bin Al Hassan, from Muhammad Bin Abdul Hameed, from Abu Jameela, from Abdullah Bin Suleyman, from Abdullah Bin Abu Ja’far, (It has been narrated) from Abu Abdullahasws having said regarding the eye of the one-eyed which was firm, then it blurred out. So he asws said: ‘Aliasws Bin Abu Talibasws had judged with regards to it being half the wergild for the healthy eye’.70 او َي َة َعنأ أَ ِبي َجعأ َف ٍر ( عليه السالم ) َقا َل ٍ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب ِأن َمحأ بُو َ ب َعنأ أَ ِبي أَي ِ أن ُم َع ِ از َعنأ ب َُر أي ِد ب ِ ُّوب أال َخ َّز ُ ُ أن أاْلَعأ َمى َو َذ َك ِر أال َخصِ يِّ َو أ ُ أن َث َي أي ِه ُثل . ث ال ِّد َي ِة ِ س َو َعي ِ ان أاْلَ أخ َر ِ فِي ِل َس Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Abu Ayoub Al Khazaz, from Bureyd Bin Muawiya, (It has been narrated) from Abu Ja’farasws having said: ‘With regards to a tongue of the mute, and an eye of the blind, and one of castrated manhood and his testicles, is a third of the wergild’.71 ير ٍ أن َمحأ بُو ٍ ِأن َسال ٍِم َعنأ أَ ِبي بَص ِ ب َعنأ ِه َش ِام ب ِ أن م َُح َّم ٍد َجمِيعا ً َع ِن اب ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َو م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ َم َد ب ُ َ َ ان َولَ َد أت ُه أ ُّم ُه َ س [ َقا َل] َف َقا َل إِنأ َك َ ان َرج ٍُل أ أخ َر َ ار َة َعنأ َرج ٍُل َقط َع لِ َس َ آل ُز َر ِ َُعنأ أَ ِبي َجعأ َف ٍر ( عليه السالم ) َقا َل َسأَلَ ُه َبعأ ض ُ ُ َو ه َُو أَ أخ َرسُ َف َعلَ أي ِه ُثل َ ُان َي َت َكلَّ ُم َفإِنَّ َعلَى الَّذِي َق َط َع ل َِسا َن ُه ُثل ث ِد َي ِة َ ب ِب ِه َو َج ٌع أَ أو آ َف ٌة َبعأ َد َما َك َ ان ِل َسا ُن ُه َذ َه َ ث ال ِّد َي ِة َو إِنأ َك أ أ ار ِح َ ك أال َق َ ِل َِسا ِن ِه َقا َل َو َك َذل ِ ضا ُء فِي ال َع أي َني ِ أن َو ال َج َو Ali Bin Ibrahim, from his father, and Muhammad Bin Yahya, from Ahmad Bin Muhammad, both together from Ibn Mahboub, from Hisham Bin Salim, from Abu Baseer, (It has been narrated) from Abu Ja’farasws, said, ‘One of the progeny of Zurara asked himasws about a man who cut the tongue of a mute man. So he asws said: ‘If it was such that his mother gave birth to him and he was mute, so upon him is a third of the wergild; and if it was such that his tongue went with away by illness or affliction after 68 Al Kafi – V 7 – The Book of Wergilds Ch 29 H 3 Al Kafi – V 7 – The Book of Wergilds Ch 29 H 4 70 Al Kafi – V 7 – The Book of Wergilds Ch 29 H 5 71 Al Kafi – V 7 – The Book of Wergilds Ch 29 H 6 69 23 out of 42 Alkafi Volume 7 www.hubeali.com him having spoken beforehand, so upon the one who cut his tongue is a third of the wergild of his tongue; and similar to that is the judgement regarding the two eyes, and the limbs’. . ) ب َعلِيٍّ ( عليه السالم ِ َقا َل َه َك َذا َو َج أد َناهُ فِي ِك َتا Heasws said: ‘This is how weasws found it to be in the Book of Aliasws’.72 ان َعنأ أَ ِبي َع أب ِد َ أن ُسلَ أي َم ِ َّ صال ٍِح َعنأ َع أب ِد َ أن ِ َّللا ب ِ أن أَ ِبي َنصأ ٍر َعنأ أَ ِبي َجمِيلَ َة َعنأ ُم َفض َِّل ب ِ أن م َُح َّم ِد ب ِ َعلِيٌّ َعنأ أَ ِبي ِه َعنأ أَحأ َم َد ب . أن َ َّللا ( عليه السالم ) فِي َرج ٍُل َف َقأ َ َعي َأن َرج ٍُل َذا ِه َب ًة َو ه ِ َّ ِ ِي َقا ِئ َم ٌة َقا َل َعلَ أي ِه ُر ُب ُع ِد َي ِة أال َعي Ali, from his father, from Ahmad Bin Muhammad Bin Abu Nasr, from Abu Jameela, from Mufazzal Bin Salih, from Abdullah Bin Suleyman, (It has been narrated) from Abu Abdullahasws, regarding a man who blinded an eye of a man, (whose vision) had gone, and it (the eye) was firm’. He asws said: ‘Upon him is the quarter of the wergild of an eye’.73 صاص َ ِباب أَنَّ ا ْل ُج ُرو َح ق Chapter 30 – (For) the injuries there is retaliation ُان أَ َتاه َ َّللا ( عليه السالم ) َقا َل إِنَّ ع أُث َم ِ َّ اع َة َعنأ أَ ِبي َع أب ِد َ َّان َعنأ ِر َف َ َّال َعنأ ُسلَ أي َم ٍ أن َفض ِ ان ال َّده ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب ك ال ِّد َي َة َفأ َ َبى َ أس ُي أبصِ ُر ِب َها َش أيئا ً َف َقا َل لَ ُه أُعأ طِ ي َ ِي َقا ِئ َم ٌة لَي َ أس ِب َم أولًى لَ ُه َق أد لَ َط َم َع أي َن ُه َفأ َ أن َز َل أال َما َء فِي َها َو ه ٍ َر ُج ٌل ِمنأ َقي Ali Bin Ibrahim, from his father, from IBn Fazzal, from Suleyman Al Dahhan, from Rafa’at, (It has been narrated) from Abu Abdullahasws having said: ‘They came to Usman with a man from Qays along with a master of his who had slapped his eye, so the water kept dripping in it, and it was firm but he could not visualise anything with it. So he said to him, ‘I can give you the wergild’. But, he refused. ُ أن َفأَعأ َطاهُ ال ِّد َي َة َفأ َ َبى َقا َل َفلَ أم َي َزالُوا يُعأ طو َن ُه َح َّتى أَعأ َط أو ُه ِ َقا َل َفأَرأ َس َل ِب ِه َما إِلَى َعلِيٍّ ( عليه السالم ) َو َقا َل احأ ُك أم َبي َأن َه َذي اص َ ص َ ِأس أ ُ ِري ُد إِ َّل أالق َ أن َقا َل َف َقا َل لَي ِ ِد َي َتي Heasws said, ‘So he sent someone with both of them to Aliasws and said, ‘Judge between these two’. So heasws gave him the wergild, but he refused. So he asws did not cease to give him until heasws gave him two wergilds. So he said, ‘I do not want anything except for the retaliation’. َ ُ أس ٍ َقا َل َف َد َعا َعلِيٌّ ِب ِمرأ آ ٍة َف َح َما َها ُث َّم َد َعا ِب ُكرأ ُس ِ ار َع أي َن أي ِه َو َعلَى َح َوالَ أي َها ُث َّم اسأ َت أق َب َل ِب َع أي ِن ِه َعي َأن ال َّشم ِ ف َف َبلَّ ُه ث َّم َج َعلَ ُه َعلَى أ أش َف ُ َقا َل َو َجا َء ِب أال ِمرأ آ ِة َف َقا َل ا أن اب ال َّشحأ ُم َو َب ِق َي أ . ص ُر َ ب أال َب َ ت َع أي ُن ُه َقا ِئ َم ًة َو َذ َه َ ظرأ َف َن َظ َر َف َذ Heasws said: ‘So Aliasws called for a mirror, so heasws heated it. Then heasws called for the cotton, so heasws put fuel in it, then made it to be upon the lids of his eyes, and around them. So heasws said: ‘Look (into this)!’ So he looked, and the grease melted, and his eye remained firm, and his vision was gone’.74 ُ ير َقا َل َس ِمعأ ت أَ َبا َع أب ِد َ ص أف َو َ َّار َعنأ ٍ َِّار َعنأ أَ ِبي بَص ٍ أن َعم ِ أن َيحأ َيى َعنأ إِسأ َحاقَ ب ِ ان ب ِ أَبُو َعلِيٍّ أاْلَ أش َع ِريُّ َعنأ م َُح َّم ِد ب ِ أن َع أب ِد أال َجب أ . اص َ َّللا ( عليه السالم ) َيقُو ُل ُت أق َط ُع َي ُد الرَّ ج ُِل َو ِرجأ َالهُ فِي ال ِق ِ َّ ِ ص Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, from Safwan Bin Yahya, from Is’haq Bin Ammar, from Abu Baseer who said, ‘I heard Abu Abdullahasws saying: ‘The hand of the man and his leg would be cut regarding the retaliation’.75 ُ أس َقا َل قُ أل ) ت ِْلَ ِبي َجعأ َف ٍر ( عليه السالم َ أن أَ ِبي َنجأ َر ٍ أن َقي ِ أن ُح َم أي ٍد َعنأ م َُح َّم ِد ب ِ ان َعنأ عَاصِ ِم ب ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب َ َ ُ ِيح َف َقا َل ُت أف َقأ ُ َع أي ُن ُه َقا َل قُ أل . ُت َي أب َقى أعأ َمى َقا َل أال َح ُّق أعأ َماه َ أَعأ َو ُر َف َقأ َ َعي َأن ٍ صح Ali Bin Ibrahim, from his father, from Ibn Abu Najran, from Aasim Bin Humeyd, from Muhammad Bin Qays who said, ‘I said to Abu Ja’farasws, ‘A one-eye man blinded an eye of a correct one’. So he asws said: ‘His eye would be blinded’. I said, ‘He would remain as blind’. He asws said: ‘It is the right (of the victim) who has been blinded’.76 ُ ب ال ِّس ِجسأ َتانِيِّ َقا َل َسأ َ أل ت أَ َبا َجعأ َف ٍر ( عليه ٍ ب َعنأ ِه َش ِام ب ِأن َسال ٍِم َعنأ َح ِبي ٍ أن َمحأ بُو ِ أن م َُح َّم ٍد َع ِن اب ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ َم َد ب ُأن َقا َل َف َقا َل َيا َح ِبيبُ ُت أق َط ُع َيمِي ُن ُه لِلرَّ ج ُِل الَّذِي َق َط َع َيمِي َن ُه أَ َّو ًل َو ُت أق َط ُع َي َسارُ ه ِ أن أال َيمِي َني ِ أن ل َِر ُجلَي ِ السالم ) َعنأ َرج ٍُل َق َط َع يَدَ ي َ َ َ أ أ صاصٌ لِلرَّ ج ُِل اْل َّو ِل َ ِير َو َيمِي ُن ُه ِق ِ لِلرَّ ج ُِل الَّذِي َق َط َع َيمِي َن ُه آخِراً ِْل َّن ُه إِ َّن َما َق َط َع َي َد الرَّ ج ُِل اْلخ Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Hisham Bin Salim, from Habeeb Al Sajistany who said, ‘I asked Abu Ja’farasws about a man who cut two right hands of two men. O Habeeb! His right hand would be cut for the first man whose right hand he had cut, and his left would be cut for the last man whose right hand he had cut, because he cut the hand of the last one, and his own right hand had already been cut in retaliation for the first man’. ُ َقا َل َفقُ أل ان َي أف َع ُل َذل َِك فِي َما َي ِجبُ ِمنأ َ ان َي أق َط ُع أال َي َد أال ُي أم َنى َو الرِّ جأ َل أاليُسأ َرى َقا َل َف َقا َل إِ َّن َما َك َ ت إِنَّ َعلِ ّيا ً ( عليه السالم ) إِ َّن َما َك اص أال َي ُد ِب أال َي ِد إِ َذا َكا َن أ ُ َّللا َفأَمَّا َيا َح ِبيبُ ُح ُق ت ل أِل َقاطِ ِع َي ٌد َو الرِّ جأ ُل ِب أال َي ِد إِ َذا َ ِين َفإِ َّن ُه ي أُؤ َخ ُذ لَ ُه أم ُحقُوقُ ُه أم فِي أال ِق َ وق أالمُسأ لِم ِ َّ وق ِ ص ِ ُُحق أ لَ أم َي ُكنأ لِل َقاطِ ِع َي ٌد He (the narrator) said, ‘But rather, Aliasws used to cut the right hand and the left leg?’ So heasws said: ‘But rather, heasws used to do that with regards to what was Obligated from the Rights of Allahazwj. O Habeeb! So, as for the rights of the Muslims, he asws used to take their rights for them with regards to the retaliation, the hand for the hand, if it was such that the cutter had a hand and a leg, and the leg for the hand when there did not happen to be a hand for the cutter’. ُ َفقُ أل ُ ت لَ ُه أَ َو َما َي ِجبُ َعلَ أي ِه ال ِّد َي ُة َو ُي أت َر ان َو َل َ ك لَ ُه ِرجأ ل ُ ُه َف َقا َل إِ َّن َما َي ِجبُ َعلَ أي ِه ال ِّد َي ُة إِ َذا َق َط َع َي َد َرج ٍُل َو لَي ِ َأس ل أِل َقاطِ ِع يَد َ ٌ ُ َ أ َ َ َّ َ َ َ ِّ . ار َحة ُيقاصُّ ِمن َها َ ِرجأ َال ِن فث َّم َي ِجبُ َعل أي ِه الد َية ِْلن ُه لي ِ أس ل ُه َج 74 Al Kafi – V 7 – The Book of Wergilds Ch 30 H 1 Al Kafi – V 7 – The Book of Wergilds Ch 30 H 2 76 Al Kafi – V 7 – The Book of Wergilds Ch 30 H 3 75 25 out of 42 Alkafi Volume 7 www.hubeali.com So I said to him, ‘Or does it not Obligate the wergild upon him, and his leg is left for him?’ So heasws said: ‘But rather, it Obligated the wergild upon him when a hand of a man is cut, and there are no two hands or two legs for the cutter, so then the wergild would be Obligated upon him, because there is no limb for him to be retaliated from’.77 ِين ٍ أن َمحأ بُو َ ضى أَمِي ُر أالم أُؤ ِمن َ َّللا ( عليه السالم ) َقا َل َق ِ َّ َّار َعنأ أَ ِبي َع أب ِد ٍ أن َعم ِ ب َعنأ إِسأ َحاقَ ب ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب . اح ِة َفيُعأ َطا َها ِ احا َ اص أَ أو َي أق َب َل أال َمجأ رُو ُح ِد َي َة أال ِج َر َ ص َ ت أال َج َس ِد أَنَّ فِي َها أال ِق َ ان ِمنأ ِج َر َ ( عليه السالم ) فِي َما َك Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Is’haq Bin Ammar, (It has been narrated) from Abu Abdullahasws having said: ‘Amir Al-Momineenasws judged with regards to what was from the injuries of the body, that regarding these is the retaliation, or the injured one can accept the wergild for the injuries, so he should be given it’.78 ض أَصأ َح ِاب َنا َعنأ أَ َح ِد ِه َما ( عليهما السالم ِ اج َعنأ َبعأ ِ أن َحدِي ٍد َعنأ َجم ِ ِيل ب ِ أن م َُح َّم ٍد َعنأ َعلِيِّ ب ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ َم َد ب ٍ َّأن َدر ) فِي َرج ٍُل َك َس َر َي َد َرج ٍُل ُث َّم َب َرأَ أ .ش َ ِصاصٌ َو لَ ِكنأ يُعأ َطى أاْلَرأ َ أس فِي َه َذا ق َ ت َي ُد الرَّ ج ُِل َقا َل لَي Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ali Bin Hadeed, from Jameel Bin Darraj, from one of our companions, (It has been narrated) from one of the two (5th or 6th Imamasws) regarding a man who broke a hand of a man, then the hand of the man was cured. So he asws said: ‘His eye would be blinded’. I said, ‘He would become (completely) blind’. He asws said: ‘He would be placed under surveillance and would be awaited with for a year. So if he hears, or two men testify against him that he can hear, or else he would be made to swear an oath, and he would be given the wergild’. َّ ان . ً مأع ُه لَ أم أَ َر َعلَ أي ِه َشيأئا َ َّللا ُ َع َّز َو َج َّل َر َّد َعلَ أي ِه َس َ ك أَ َّن ُه َيسأ َم ُع َقا َل إِنأ َك َ ِِين َفإِنأ ُعث َِر َعلَ أي ِه َبعأ َد َذل َ ِير أالم أُؤ ِمن َ قِي َل َيا أَم It was said, ‘O Amir Al-Momineenasws! So if it was discovered afterwards that he can hear?’ Heasws said: ‘If Allahazwj Mighty and Majestic Returns his hearing, Iasws do not see anything upon him’.85 َّللا ( عليه السالم ) فِي َرج ٍُل وُ ِج َئ فِي ٍ أن َمحأ بُو ِ َّ ير َعنأ أَ ِبي َع أب ِد ٍ ِأن أَ ِبي َح أم َز َة َعنأ أَ ِبي بَص ِ ب َعنأ َعلِيِّ ب ِ َعلِيٌّ َعنأ أَ ِبي ِه َع ِن اب ُ ُ ُ َّ أ ُ ً ً ُ َ أ ِيحة َفيُضأ َربُ ل َها َّ ص ِمنأ َس أم ِع َها َشيأ ٌء َقا َل َقا َل ت َس ُّد التِي ض ُِر َبت َس ّدا َشدِيدا َو تف َت ُح ال َ صح َ أ ُ ُذ ِن ِه َفا َّد َعى أَنَّ إِحأ دَ ى أذ َن أي ِه َن َق ُ ُ س ِح َيا َل َوجأ ِه ِه َو ُي َقا ُل لَ ُه اسأ َمعأ َفإِ َذا َخف َِي َعلَ أي ِه الص أَّو ت ُعلِّ َم َم َكا ُن ُه ث َّم يُضأ َربُ ِب ِه ِمنأ َخ أل ِف ِه َو ُي َقا ُل لَ ُه اسأ َمعأ َفإِ َذا َخف َِي ِ ِب أال َج َر َ ُ ِّ ُ َّ ُ َ َ َ َ َ َ َ أ َص َدق َ َعلَ أي ِه الص أَّوت ُعل َم َمكان ُه ث َّم ُيقاسُ َما َب أين ُه َما فإِنأ كانا َس َوا ًء ُعلِ َم أن ُه قد Ali, from his father, from Ibn Mahboub, from Ali Bin Abu Hamza, from Abu Baseer, (It has been narrated) from Abu Abdullahasws regarding a man was hit in his ear, so he claimed that one of his ears is deficient from hearing anything. Heasws said: ‘The struck ear would be covered up with an intense covering, and the correct ear would be kept open. So the bell would be sounded towards his face and it would be said to him, ‘Listen’. So when the sound is hidden to him, its place would be noted. Then it (the bell) would be sounded from behind him, and it would be said to him, ‘Listen’. So when the sound is hidden from him its place would be noted. Then it would be measured what is between the two. So if it was the same, it would be known that he is speaking the truth. ُ ُ ُ ُ ُث َّم ي أُؤ َخ ُذ ِب ِه َعنأ َيمِي ِن ِه ُث َّم يُضأ َربُ َح َّتى َي أخ َفى َعلَ أي ِه الص أَّو ار ِه َفيُضأ َربُ َح َّتى َي أخ َفى َعلَ أي ِه ِ ت ث َّم ي َُعلَّ ُم َم َكا ُن ُه ث َّم ي أُؤ َخذ ِب ِه َعنأ َي َس َ ُ الص أَّو َص َدق َ ان َس َوا ًء ُعلِ َم أ َّن ُه َق أد َ ت ُث َّم ُي َعلَّ ُم َم َكا ُن ُه ُث َّم ُي َقاسُ َما َب أي َن ُه َما َفإِنأ َك Then he would be seized by it from his right. Then it (the bell) would be sounded until the sound is hidden from him. Then its place would be noted. Then he would be seized by it from his left. So it (the bell) would be sounded until the sound is hidden from him. Then its place would be noted. There it would be measured what is between the two. Then the bell would be struck from in front of him. Then the sounds would be hidden from him, and he would be dealt with just as he had been dealt with the first time around, with his healthy ear. Then to find the difference of the hearing (abilities) of both ears to calculate a fair compensation on the basis of the differences that may have happened between the two ears.86 ب الرَّ ُج ُل َ َّللا ( عليه السالم ) َقا َل إِ َذا ض ُِر ِ َّ أن أَ ِبي ُع َمي ٍأر َعنأ َحمَّا ٍد َع ِن أال َحلَ ِبيِّ َعنأ أَ ِبي َع أب ِد ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب ُ ض أ ت ِ ت ال ِّد َي ُة َعلَى ُحرُوفِ أالمُعأ َج ِم َف َما لَ أم ُي أفصِ حأ ِب ِه أال َك َال َم َكا َن ِ ت َعلَ أي ِه ُحرُوفُ أالمُعأ َج ِم َي أق َرأ ُث َّم قُسِ َم َ َعلَى َر أأسِ ِه َف َثقُ َل لِ َسا ُن ُه ع ُِر .ك َ ِاس ِمنأ َذل ِ ال ِّد َي ُة ِب أال ِق َي Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, (It has been narrated) from Abu Abdullahasws having said: ‘When the man is struck upon his head, so his tongues becomes heavy, the letters of the alphabet would be presented to him. He would read, then the wergild would be divided upon the letters of the alphabet. So whatever he could not pronounce eloquently with the speech, the wergild would be quantified by the measurement from that’.87 ِير َعنأ أَ ِبي ِه َقا َل َقا َل أُصِ ي َب أ ت َ أن ع أُث َم ِ أن م َُح َّم ٍد َعنأ َبعأ ٍ أن َكث ِ ان َع ِن أال َح َس ِن ب ِ ان ب ِ ض أَصأ َح ِاب ِه َعنأ أَ َب ِ م َُح َّم ُد بأنُ َيحأ َيى َعنأ أَحأ َم َد ب ِين ( عليه السالم ) َفر ُِب َط أ أض ٌة َيقُو ُل َّ ت َع أي ُن ُه ال َ ِيح ُة َو أَ َقا َم َرج ًُال ِب ِح َذاهُ ِب َي ِد ِه َبي َ صح َ ِي َقا ِئ َم ٌة َفأ َ َم َر أَمِي ُر أالم أُؤ ِمن َ َعيأنُ َرج ٍُل َو ه َ أ ً ِّ َ َ َ َ َّ َّ أ َ َ َ َ َ َ ُك ال َمكان َ َِه أل َت َرا َها َقا َل َف َج َع َل إِذا قا َل ن َع أم تأخ َر قلِيال َحتى إِذا خ ِف َيت َعل أي ِه ُعل َم ذل Muhammad Bin Yahya, from Ahmad Bin Muhammad, from one of his companions, from Aban Bin Usman, from Al Hassan Bin Kaseer, from his father who said, ‘An eye of a man was hit, and it was firm (in its place). So Amir Al-Momineenasws ordered for his healthy eye to be tied up (blindfolded), and got a man to stand in front of him with an egg in his hand. Heasws said to him: ‘Can you see it?’ So when he said, ‘Yes, heasws made him to stand away a little more, (repeating the process) until it was hidden from him (could not see it anymore), heasws noted that place. ُ ُصا َب ُة َو َج َع َل الرَّ ُج ُل َي َت َبا َع ُد َو ه َُو َي أن يح ِة َح َّتى إِ َذا َخ ِف َي أ ص َب أ ِّ َقا َل َو ُع ِيس َما َب أي َن ُه َما َّ ظ ُر ِب َع أي ِن ِه ال َ ت َعلَ أي ِه ُث َّم ق َ ص ِح َ ت َع أي ُن ُه أالم .ك َ ِش َعلَى َذل َ َفأُعأ طِ َي أاْلَرأ Heasws said: ‘And heasws tied up (blindfolded) the struck eye and made the man to be remote, and he was looking with his healthy eye, until it was hidden to him (could not see it anymore). So the struck one claimed that he could not visualise anything, nor smell the aromas, and that his tongue had gone. So Amir Al-Momineenasws said: ‘If he is speaking the truth, there would be three wergilds for him’. ٌ صا د ُ َّعاهُ أَ َّن ُه َل َي َش ُّم الرَّ ائ َِح َة َفإِ َّن ُه ي أُد َنى ِم أن ُه أالح َُر ان َك َما َ اق َفإِنأ َك َ ِق َف َقا َل أَمَّا َما اد َ أف يُعأ لَ ُم أَ َّن ُه َ ِين َو َكي َ ِير أالم أُؤ ِمن َ َفقِي َل َيا أَم أ َيقُو ُل َو إِ َّل َنحَّ ى َرأ َس ُه َو دَ َم َع أ ِّض َ ان َكاذِبا ً لَ أم َي َت َمالَكأ َح َّتى يُغَ م َ ت َع أي ُن ُه َو أَمَّا َما ا َّد َعاهُ فِي َع أي ِن ِه َفإِ َّن ُه ُي َقا َب ُل ِب َع أي ِن ِه ال َّشمأسُ َفإِنأ َك َ َ َ ُ َ َّ َ َ َ َ َ َ َ ب َ أن َو أمَّا َما ا َّد َعاهُ فِي لِ َسا ِن ِه فإِن ُه يُضأ َربُ َعلى لِ َسا ِن ِه ِبإِب َأر ٍة فإِنأ خ َر َج ال َّد ُم أحأ َم َر فق أد كذ َ صادِقا ً َب ِق َي َتا َم أفت َ ان َ َع أي َن ُه َو إِنأ َك ِ وحتي َ . َص َدق َ َو إِنأ َخ َر َج ال َّد ُم أسأ َو َد َف َق أد So it was said, ‘O Amir Al-Momineenasws! And how does one know that he is truthful?’ So heasws said: ‘As for what he claimed that he could not smell the aromas, the tinder (firewood) would be brought near him. So if it was as he is saying, or else he would turn his head away and his eyes would water. And as for what he is claiming regarding his eyes, so he would be made to turn to face the sun with his eyes. So if he was lying, he would not be able to control himself from closing his eyes, and if he was truthful, they would both remain open. Which thing would he be given?’ Heasws said: ‘One of it (eyes) would be covered and an egg would be placed for him, then it would be said to him, ‘Look!’ So for as long as he claims that he can see its place, (it would be moved away) until it ends up at a place that he is helpless (from seeing it), so he says, ‘I cannot see it’. It would be brought nearer until he can visualise it, then a note would be made of that place. Then it would be compared with that from behind him, and from his right, and from his left. So it comes to be the same, or else it would be said to him, ‘You are lying’, until he speaks the truth’. I said, ‘Can he not be trusted?’ Heasws said: ‘No, and there is no honour, and he would be dealt with the other eye similar to that. The hit eye would be covered, and he would look what his correct eye can end up visualising. Then his correct eye would be covered, and he would look at what his hit eye can end up (visualising). So he would be given a wergild based upon that accounting. And similar to that are the sworn endorsements, all of these regarding the injuries. َ ُان ُثل ص ُرهُ َمنأ َيحأ لِفُ َم َع ُه ضُوعِ َف أ ث ِ ُصا َ ف َمرَّ ًة َوا ِح َد ًة َو إِنأ َك َ َص ِر ِه َحل َ س َب َ ان ُس ُد َ ت َعلَ أي ِه أاْلَ أي َمانُ إِنأ َك َ ب َب َ َو إِنأ لَ أم َي ُكنأ ل أِلم َ أ أ ُ َ َ أ أ َ َ َّ َ َ َ َ ص ِر ِه ِ ان أكث َر َعلى َهذا ال ِح َسا َ ب َو إِن َما الق َسا َمة َعلى َم أبل ِغ ُمنت َهى َب َ أن َو إِنأ ك َ َص ِر ِه َحل َ َب ِ ف َمرَّ َتي And if there does not happen to be for the one whose eyesight was hit, anyone who would swear an oath along with him, the swearing would be additional upon him. If it was such that a sixth of his vision had gone, he would swear once; and if it was such that a third of his vision had gone, he would have to swear twice; and if it was more, it would be upon this counting. So if it was such that all of his hearing (was lost), and mischief was feared from him, so he would be left to sleep until when he had slept a little, he would be shrieked at. Then his hit leg would be compared. Thus it would be known, the measurement of the deficiency of his leg, or his hand. So if the injury was to the leg or the arm, so it is from (the measuring device) for the thigh and the upper arm that he would be compared, and the judge would look at the measurement of his thigh’. ُّوب ٍ أن َظ ِري َ َّللا بأنُ أَي ِ َّ أن َناصِ ٍح َعنأ َرج ٍُل ُي َقا ُل لَ ُه َع أب ُد ِ ف َعنأ أَ ِبي ِه َظ ِريفِ ب ِ أن ِز َيا ٍد َع ِن أال َح َس ِن ب ِ عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ َسه ِأل ب ُ َقا َل َح َّد َثنِي أَبُو َع أم ٍرو أال ُم َت َطبِّبُ َقا َل َع َرضأ .) َّللا ( عليه السالم ِ َّ اب َعلَى أَ ِبي َع أب ِد َ ت َه َذا أال ِك َت A number of our companions, from Sahl Bin Ziyad, from Al Hassan Bin Zareyf, from his father Zareyf Bin Nasih, from a man caled Abdullah Bin Ayoub, (It has been narrated) from Abu Amro Al Mutatabbab who said, ‘I presented the book to Abu Abdullahasws’. صحِي ٌح َ ضا ( عليه السالم ) َف َقا َل لِي ارأ وُ وهُ َفإِ َّن ُه َ ِّأن أال َجه ِأم َقا َل َع َرضأ ُت ُه َعلَى أَ ِبي أال َح َس ِن الر ٍ و َعلِيُّ بأنُ َفض ِ َّال َع ِن أال َح َس ِن ب . ُث َّم َذ َك َر م أِثلَ ُه And Ali Bin Fazzal, from Al Hassan Bin Al Jahm who said, ‘I presented it to Abu Al-Hassan Al-Rezaasws, so heasws said to me: ‘Report it, for it is correct’. With what thing would that be known?’ Heasws said: ‘By the timing’. I said, ‘And how by the timing?’ Heasws said: ‘At the emergence of dawn, he is breathing, and it is from the right nostril. So when an hour goes by, he (comes to be) breathing by the left nostril. So you would look at what (difference) there is between your breathing, and his breathing. So it pierced him to the extent that it arrived to the brain. So his intellect went’. So heasws said: ‘If it was that the struck one did not have the intellect for the Prayer, nor any intellect of what he says, nor what is said to him, so he would be awaited with for a year. So the one strike committed two crimes. Therefore, it necessitates him the harshest of the two crimes, and it is the (complete) wergild. And had he struck him with two strikes, so the two strikes would have committed two crimes, it would necessitate him one crime, so whatever was it was, except if there happens to be the death in it, so his striker would be retaliated (due to one strike and the other would be dropped). So if he had struck him with three stroked, one after the other, so he would have committed three crimes, it would necessitate him with one crime what the three strikes had committed, as it if was such, for as long as there does not happen to be the death in it, so his striker would be retaliated with. So heasws said: ‘If there was a separation between that (different times), he would be retaliated from, then he would be killed. Amir Al-Momineenasws judged regarding wergild for the injuries of the limbs, all of them, in the head and the face and the rest of the body, from the hearing and the vision and the voice, and the intellect and the two hands and the two feet, regarding the cutting and the breaking and the dysfunction, and the tear, and the bone-exposing injury, and the bloody, and displacement of the bones, and the piercing, which happen to be regarding something from that. ب َو لَ أم ُي َن َّق أل ِم أن ُه عِ َظا ٌم َفإِنَّ ِد َي َت ُه َمعأ لُو َم ٌة َفإِنأ أُوضِ َح َو لَ أم ُي َن َّق أل ِم أن ُه ٍ ان ِمنأ َع أظ ٍم ُكسِ َر َفج ُِب َر َعلَى َغي ِأر َع أث ٍم َو َل َع أي َ َف َما َك عِ َظا ٌم َف ِد َي ُة َكسأ ِر ِه َو ِد َي ُة مُوضِ َح ِت ِه َفإِنَّ ِد َي َة ُك ِّل َع أظ ٍم ُكسِ َر َمعأ لُو ٌم ِد َي ُت ُه َو َن أق ُل عِ َظا ِم ِه ِنصأ فُ ِد َي ِة َكسأ ِر ِه َو ِد َي ُة مُوضِ َح ِت ِه ُر ُب ُع ِّ ت أ ُ ُ اْلصأ َبع َو فِي َقرأ َح ٍة َل َتب َأرأ ُ ُثل ث ِد َي ِة َذل َِك أال َع أظ ِم الَّذِي ه َُو فِي ِه ِ ار َ الث َيابُ َغي َأر َق َ ِد َي ِة َكسأ ِر ِه َف َما َو ِ ِ ص َب َتيِ السَّاعِ ِد َو So whatever was from the bones which were broken, which are set by the splints and there is no displacement of the bone, so its wergild is known. So if it were exposed and the bone was not broken from it, so its wergild is its breaking, and wergild of exposure, for a wergild of every broken bone is known; and for the displacement of his bone is half the wergild of breaking it; and for the exposure is a quarter of the wergild for breaking it. Then he sought (forgiveness) so he gifted it to him. Then it (injury) worsened, so it killed him. So heasws said: ‘He is responsible for the wergild except for the price of the bone exposed, because he had gifted it to him, and he had not gifted the self; and regarding the cut which reaches the bone, and it is less than the exposure, being of five hundred Dirhams, and with regards to it when it was in the face, it would be double the wergild upon the measurement of the shame (it caused); and regarding the skull fracture being a third of the wergild, and it is which had been plunged in and did not reach to the middle, so it is regarding what is between the two; and regarding the piercing of the hole is a third of the wergild, and it is which had reached the middle of the brain; and regarding the bone displacement being fifteen from the camels, and it is which had become a blister, the bone being displaced from it’.103 أن ٍ ب َعنأ َعلِيِّ ب ِأن ِر َئا ٍ أن َمحأ بُو َ ُب َع ِن أالف ِ ضي ِأل ب ِ أن ِز َيا ٍد َو َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َجمِيعا ً َع ِن اب ِ عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ َسه ِأل ب ِّ َّ ب َفا أن َك َس َر ِم أن ُه ت مِ أن ُه أال َكفُّ َف َشلَّ أ الز أن ُد َقا َل َف َقا َل إِ َذا َي ِب َس أ ُ ار َقا َل َسأ َ أل ت َ اع إِ َذا ض ُِر ِ َّ ت أَ َبا َع أب ِد ٍ َي َس ِ َّللا ( عليه السالم ) َع ِن الذ َر َ ُ أ أ أ ُ َت ُثلُثيأ َّ َ ُّ ُ ص ِاب ِع َو َب ِق َي َبعأ ضٌ َفإِنَّ فِي ُك ِّل إِصأ َب ٍع َشلَّ أ أ َ َ َ َ َ ص ِاب ُع الكفِّ كل َها فإِنَّ فِي َها ثلثيِ ال ِّد َي ِة ِد َي ِة ال َي ِد قا َل َو إِنأ شلت َبعأ ضُ اْل َ َأ َ أ أ أ َّاق َو ال َق َد ِم إِ َذا َشلَّ أ . ص ِاب ُع ال َقد َِم َ تأ ِ ِد َي ِت َها َقا َل َو َك َذل َِك ال ُح أك ُم فِي الس A number of our companions, from Sahl Bin Ziyad, and Ali Bin Ibrahim, from his father, both together from Ibn Mahboub, from Ali Bin Raib, from Al Fuzayl Bin Yasaar who said, ‘I asked Abu Abdullahasws about the upper-arms when it is hit, so the wrist breaks from it. So heasws said: ‘If the palm is dried up from it, so the fingers of the palm are paralysed, all of them, so regarding it is two-thirds of the wergild of the hand. And if some of the fingers are paralysed, and some remain (healthy), so with regards to each of the paralysed finger is two-thirds of its wergild. Some of the people have thirty two teeth in their mouths, and for some of them are twenty eight teeth. So upon how much would be the distribution of wergild of the teeth?’ So he asws said: ‘The creation, rather, it is of twenty eight teeth – twelve in the front of the mouth, and sixteen at the end of it. And regarding every tooth from the back when it breaks until it is gone, so its wergild is two hundred and fifty Dirhams, and these are sixteen teeth, all of it being four thousand Dirhams. So the entire wergild of the front and the back from the teeth is of ten thousand Dirhams. But rather, the wergild would be placed upon this, so whatever increased upon twenty eight teeth, so there is no wergild for it, and whatever is deficient, so there is no wergild for it. This is how we asws found it to be in the Book of Aliasws ُ ت إِ َّن َما َكا َن أ ُ َقا َل َف َقا َل أال َح َك ُم َفقُ أل ك فِي أال َب َوادِي َق أب َل ِ ت إِنَّ ال ِّد َيا َ ِان َذل َ اْل ِب ِل َو أال َب َق ِر َو ا أل َغ َن ِم َقا َل َف َقا َل إِ َّن َما َك ِ ت ُت أؤ َخذ َق أب َل أال َي أو ِم م َِن أ َ ُ أ أ أ َ َّ َ ُ َ َ ِين ( عليه السالم ) َعلى ال َو ِر ِق ِ اْلسأ ال ُم َو كث َر َ اس ق َس َم َها أمِي ُر الم أُؤ ِمن ِ ت ال َو ِرق فِي الن ِ اْلسأ َال ِم َفلَمَّا َظ َه َر أ ِأ He (the narrator) said, ‘So Al-Hakam said, ‘So I said, ‘But rather, the wergilds used to be taken before today, from the camels, and the cows, and the sheep’. So he asws said: ‘But rather that used to be in the villages, before Al-Islam. So when Al-Islam appeared, and the currency became abundant among the people, so Amir AlMomineenasws named it upon the currency’. َ ُ َ ُ َقا َل أال َح َك ُم َفقُ أل اْل ِب ُل َ ت لَ ُه أَ َرأَيأتَ َمنأ َك ِ ان أال َي أو َم ِمنأ أهأ ِل أال َب َوادِي َما الَّذِي ي أُؤ َخذ ِم أن ُه أم فِي ال ِّد َي ِة أال َي أو َم إِ ِب ٌل أ أو َو ِر ٌق َقا َل َف َقا َل أ أ ُ َ أ ً أ أ َ أ أ ُ ُ ُ َّ اْل ِب ِل يُحأ َسبُ ِبك ِّل َ ض ُل م َِن ال َو ِر ِق فِي ال ِّد َي ِة إِن ُه أم َكانوا َيأخذ َ ِي أف َ أال َي أو َم م أِث ُل أال َو ِر ِق َب أل ه ِ ون ِمن ُه أم فِي ال ِّد َي ِة ال َخطإِ مِا َئة م َِن ُ ِير ِما َئ ُة ِدرأ َه ٍم َف َذل َِك َع َش َرةُ َآلفِ ِدرأ َه ٍم قُ أل . ِير َقا َل َف َقا َل َما َحا َل َعلَ أي ِه أال َح أو ُل ُذ أك َرانٌ ُكلُّ َها ٍ ت لَ ُه َف َما أَسأ َنانُ أالمِا َئ ِة َبع ٍ َبع Al-Hakam said, ‘So I said to himasws, ‘What is yourasws view of the one who was from the people of the villages today. What is that which would be taken from him regarding the wergild today, camels or currency?’ So heasws said: ‘The camels, today are like the currency. But it is preferable than the currency regarding the wergild. It used to be taken from them, regarding the wergild of the erroneous (killing), one hundred from the camels by the reckoning of every camel being one hundred Dirhams. So that is ten thousand Dirhams’. I said to him asws, ‘So what are the ages of the one hundred camels?’ So heasws said: ‘Whatever a year has passed upon, males, all of them’.108 ُ أن ُع َت أي َب َة َقا َل َسأ َ أل ص ِاب ِع ٍ ابأنُ َمحأ بُو َ َت أَ َبا َجعأ َف ٍر ( عليه السالم ) َعنأ أ ِ أن سُو َق َة َع ِن أال َح َك ِم ب ِ أن َسال ٍِم َعنأ ِز َيا ِد ب ِ ب َعنأ ِه َش ِام ب َ َ ِ أال َي َدي َ جأ ِّالر ص ِمنأ َع َش َر ٍة فِي َها ِد َي ٌة َقا َل َف َقا َل لِي َيا َح َك ُم أالخ أِل َق ُة ي ل ع اب ص َ ص ِاب َع أ أو َن َق َ َأن أَ َرأَيأتَ َما َزا َد فِي َها َعلَى َع أش ِر أ َ ِ ِ ِ أن َو أ الَّتِي قُسِ َم أ ص َ أن َف َما َزادَ أَ أو َن َق َ َص َف َال ِد َي َة لَ ُه َو َع َش َرةُ أ َ أن َف َما َزا َد أَ أو َن َق َ َت َعلَ أي َها ال ِّد َي ُة َع َش َرةُ أ ِ ص ِاب َع فِي الرِّجأ لَي ِ ص ِاب َع فِي أال َي َدي َ َ َ َ أ أ أ ان ِمنأ َ أن ألفُ ِدرأ َه ٍم َو ُك ُّل َما َك َ أن ألفُ ِدرأ َه ٍم َو فِي ُك ِّل إِصأ َب ٍع ِمنأ أ َ َف َال ِد َي َة لَ ُه َو فِي ُك ِّل إِصأ َب ٍع ِمنأ أ ِ ص ِاب ِع الرِّجأ لَي ِ ص ِاب ِع ال َي َدي ُّ َشلَ ٍل َفه َُو َعلَى . اح ِ ُالثل ِ ث ِمنأ ِد َي ِة الص َِّح Ibn Mahboub, from Hisham Bin Salim, from Ziyad Bin Sowqat, from Al Hakam Bin Uteyba who said, ‘I asked Abu Ja’farasws about fingers of the two hands, and toes of the two feet, ‘What is yourasws view with regards to these, upon ten fingers, or deficient from ten, regarding wergild?’ So heasws said to me: ‘O Hakam! The creation upon which the wergild is to be distributed is ten fingers in the two hands. So whatever is additional 108 Al Kafi – V 7 – The Book of Wergilds Ch 35 H 1 40 out of 42 Alkafi Volume 7 www.hubeali.com or deficient, so there is no wergild for it; and ten toes in the two feet, so whatever was additional or deficient, so there is no wergild for it; and regarding every finger from the fingers of the two hands, is a thousand Dirhams; and regarding every toe from the toes of the two feet, is a thousand Dirhams; and regarding everything what was from the paralysed, so it is upon the third from the wergild of the healthy’.109 َ باب آخ ُر Chapter 37 – Another chapter َ ِير َ س َجمِيعا ً َق َال َع َرضأ َنا ِك َت َ أن عِ ي َسى َعنأ يُو ُن ِ اب أال َف َرائ ٍ أن َفض ِ َّال َو م َُح َّم ِد ب ِ َعلِيُّ بأنُ إِب َأراهِي َم َعنأ أَ ِبي ِه َع ِن اب ِ ِض َعنأ أم أ . صحِي ٌح َ ضا ( عليه السالم ) َف َقا َل ه َُو َ ِين ( عليه السالم ) َعلَى أَ ِبي ال َح َس ِن ال ِّر َ أالم أُؤ ِمن Ali Bin Ibrahim, from his father, from Ibn Fazal and Muhammad Bin Isa, from Yunus, both together said, ‘We presented a book of the Obligations, from Amir Al-Momineenasws to Abu AlHassan Al-Rezaasws, so heasws said: ‘It is correct’.110 َّللا ٍ أن َظ ِري ِ َّ أن َناصِ ٍح َقا َل َح َّد َثنِي َر ُج ٌل ُي َقا ُل لَ ُه َع أب ُد ِ ف َعنأ أَ ِبي ِه َظ ِريفِ ب ِ أن ِز َيا ٍد َع ِن أال َح َس ِن ب ِ َو عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ َسه ِأل ب َ َ َ َّ أ أ َ َّللا ( عليه السالم ) َقا َل أ أف َتى أمِي ُر الم أُؤ ِمنِي َن ( عليه ِ ُّوب َقا َل َح َّد َث ِني أَبُو َع أم ٍرو ال ُم َتطبِّبُ َقا َل َع َرضأ ُت ُه َعلَى أ ِبي َع أب ِد َ بأنُ أَي ُ ُوس أَجأ َنا ِد ِه َ ب ِب ِه أَمِي ُر أالم أُؤ ِمن َ ب ال َّناسُ فُ أت َياهُ َو َك َت َ السالم ) َف َك َت ِ ِين إِلَى أ َم َرا ِئ ِه َو ُرء A number of our companions, from Sahl Bin Ziyad, from Al Hassan Bin zareyf, from his father Zareyf Bin Nasih, from a man called Abdullah Bin Ayoubm from Abu Amro Al Mutatabbab who said, ‘I presented it (book of Obligations from Amir Al-Momineenasws) to Abu Abdullahasws. Heasws said: ‘Amir Al-Momineenasws issued Verdicts, so the people wrote down hisasws Verdicts, and (what) Amir Al-Momineenasws wrote to his governors, and the heads of hisasws battalions. ُ ُ شت َِر َف ِد َي ُت ُه ُثل ُ أن أاْلَعأ لَى َف ار َو إِنأ َ ار َو سِ َّت ٌة َو سِ ُّت َ ِان فِي ِه إِنأ أُص َ َف ِممَّا َك ٍ ون دِي َناراً َو ُثلُ َثا دِي َن ٍ أن مِا َئ ُة دِي َن ِ ث ِد َي ِة أال َعي ِ يب َش أف ُر أال َعي ُ َ أ أ أ أ ُ َ أ ً ُ ُ َ َ َ َ َ َ َ َ َ نأ أ صأ سأ ُب ُف ُ ُ ُ ب َشعأ ُرهُ ُكلُّ ُه ه ذ ف ج ا ح ال يب أ إ و ا ار ن ِي د ُون س م خ و ار ن ِي د ة ئ ِا م أن ي ع ال ة ي د ن ه ت ي د ف ِر ت ش ف ل ف اْل أن ي ع ال ر ف ش يب ِص ِ ِ ِ ِ َ َ َ َ ٍ َ َ َ ِأُص ِ َ َ ِ َ ِ َ َ ِ َ ك ِ يب ِم أن ُه َف َعلَى ِح َسا َ ِب َذل َ ُِون دِي َناراً َف َما أُص َ ار َو َخمأ س ٍ أن مِا َئ َتا دِي َن ِ َف ِد َي ُت ُه ِنصأ فُ ِد َي ِة أال َعي So from what was in it – If an upper eyelid is hit, so it tears, its wergild is a third of the wergild of the eye, being one hundred and sixty-six and two-third Dinars. And if the lower eyelid is hit, so it tears, its wergild is half the wergild of the eye, being one hundred and fifty Dinars. And if the eyebrow is hit and all of its hair is gone, so its wergild is half the wergild of the eye, being two hundred and fifty Dinars. So whatever is hit from it, so it is based upon the accounting of that. ار إِنأ أ ُ أن ِف َذ أ ت فِي ِه َنافِ َذةٌ َل َت أن َس ُّد ِب َسه ٍأم أَ أو رُمأ ٍح َف ِد َي ُت ُه َث َال ُثمِا َئ ِة َ أاْلَ أنفُ َفإِنأ قُطِ َع َر أو َث ُة أاْلَ أنفِ َو ه ٍ ِي َط َرفُ ُه َف ِد َي ُت ُه َخمأ ُسمِا َئ ِة دِي َن ُ ُ ون دِي َناراً َو ُثل ت َو أال َتأ َ َم أ ت َنا ِف َذةٌ َف َب َرأَ أ ار َو إِنأ َكا َن أ ار َف َما َ ار َو َث َال َث ٌة َو َث َال ُث ٍ ت َف ِد َي ُت َها ُخمُسُ ِد َي ِة َر أو َث ِة أاْلَ أنفِ مِا َئ ُة دِي َن ٍ ث دِي َن ٍ دِي َن َ أ َ ك ِ يب ِمن ُه َف َعلى ِح َسا َ ِب ذل َ ِأُص The nose – So if the side of the nose is cut, and it is its edge, so its wergild is five hundred Dinars. So whatever was hit from it, so it would be based upon the accounting of that. ُ أن إِلَى أال َخ أي َو إِنأ َكا َن أ ُون َ أن َف ِد َي ُت َها ُع أش ُر ِد َي ِة َر أو َث ِة أاْلَ أنفِ َخمأ س ِ وم َو ه َُو أال َحا ِ ج ُز َبي َأن أال َم أنخ َِري ِ ت َنا ِف َذةٌ فِي إِحأ َدى أال َم أنخ َِري ِ ش َ ٌ أ أ أ أ َون دِي َناراً َو ُثلُثا َ ُ أن أ ِو ال َخ أي دِي َناراً ِْلَ َّن ُه ال ِّنصأ فُ َو إِنأ َكا َن أ َ وم إِلَى ال َم أنخ ِِر اْل َخ ِر َف ِد َي ُت َها سِ َّتة َو سِ ُّت ِ ت َنا ِفذةٌ فِي إِحأ َدى ال َم أنخ َِري ِ ش . ار ٍ دِي َن And if it was pierced in one of the two nostrils to the nasopharynx, and it is the barrier between the two nostrils, so its wergild is a tenth of the wergild of the nose, being fifty Dinars, because it is the half. And if it was pierced in one of the nostrils, or the nasopharynx to the other nostril, so its wergild is sixty-six Dinars and two-thirds of a Dinar’.111 أن َع أب ِد الرَّ حأ َم ِن َعنأ ِمسأ َم ٍع َعنأ أَ ِبي َع أب ِد ِ َّ ُّون َعنأ َع أب ِد ٍ أن َشم ِ َّللا ب ِ أن أال َح َس ِن ب ِ أن ِز َيا ٍد َعنأ م َُح َّم ِد ب ِ عِ َّدةٌ ِمنأ أَصأ َح ِاب َنا َعنأ َسه ِأل ب َ ُ ضى فِي َخرأ ِم أاْلَ أنفِ ُثل . ِث ِد َي ِة أاْلَ أنف َ ِين ( عليه السالم ) َق َ ِير أالم أُؤ ِمن َ َّللا ( عليه السالم ) أَنَّ أَم ِ َّ A number of our companions, from Sahl Bin Ziyad, from Muhammad Bin Al Hassan Bin Shamoun, from Abdullah Bin Abdul Rahman, from Misma’a, (It has been narrated) from Abu Abdullahasws that Amir Al-Momineenasws judged regarding (piercing of a) hole in the nose, being a third of the wergild of the nose’.112 111 112 Al Kafi – V 7 – The Book of Wergilds Ch 36 H 2 Al Kafi – V 7 – The Book of Wergilds Ch 36 H 3 42 out of 42
