COMPLAINT 1 REVIEW I, Danielle Niangar, serving as the Attorney General for the Student Government Association at the University of Houston, certify that I have received and reviewed a complaint filed by Andrew Bahlmann against Winni Zhang, presidential candidate for the Spirit RED: Improve Parking, Improve Mental Health, Improve Textbook Prices party. After much consideration, the office of the Attorney General has found that this complaint does not have merit under the fact that Ms. Zhang lacked the mens rea of malicious intent or willful disregard necessary in the proposed complaint regarding that she had begun campaigning before the official start of campaigning season start, per Election Commissioner Austin Turman. The change made in Spirit RED: Improve Parking, Improve Mental Health, Improve Textbook Prices’ Facebook page was made with no intention of the change being made public until the official campaigning season and that the Facebook notification that had resulted from a digital miscalculation that lied outside of her control. The page was not published until after the official starting of the campaigning season: February 13th, 2017, 7:30PM. This complaint pertained to the General Election procedure and campaigning season, therefore the decision was to the discretion of the Chief Election Commissioner. This complaint will not be sent to the University of Houston Student Government Association Court of Appeals. Danielle Niangar Attorney General University of Houston COMPLAINT 2 REVIEW I, Danielle Niangar, serving as the Attorney General for the Student Government Association at the University of Houston, certify that I have received and reviewed a complaint filed by Andrew Bahlmann against Winni Zhang, presidential candidate for the Spirit RED: Improve Parking, Improve Mental Health, Improve Textbook Prices party. After much consideration, the office of the Attorney General has found that the complaint in which, “Project Red still exists and Spirit RED: Improve Parking, Improve Mental Health, Improve Textbook Prices is directly responsible for [this past party] and thus they should be held accountable…” is a complaint with no merit due to the following clause: Article 3, Section 6, Clause 2: “A party shall become official after being successfully registered to the election commission. The party shall cease to exist after the election concludes.” This clause from the Election Code pertains to the General Election procedure and campaigning season, therefore the decision was to the discretion of the Attorney General. This complaint will not be sent to the University of Houston Student Government Association Court of Appeals. Danielle Niangar Attorney General University of Houston COMPLAINT 3 REVIEW I, Danielle Niangar, serving as the Attorney General for the Student Government Association at the University of Houston, certify that I have received and reviewed a complaint filed by Andrew Bahlmann against Winni Zhang, presidential candidate for the Spirit RED: Improve Parking, Improve Mental Health, Improve Textbook Prices party. After much consideration, the office of the Attorney General has found that the complaint does not have merit. After interviewing the previous owner of Spirit RED: Improve Parking, Improve Mental Health, Improve Textbook Price’s Facebook Page and previous presidential candidate for the 2016 UH Student Government Association Election of the Project RED Party, Shane Smith, I was informed that the Facebook page was given with his consent. Additionally, I was able to interview Ms. Zhang and review her financial disclosure record. Ms. Zhang had recorded this Facebook page on her financial disclosure form as needed. This complaint pertained to the General Election procedure and campaigning season, therefore the decision was to the discretion of the Attorney General. This complaint will not be sent to the University of Houston Student Government Association Court of Appeals. Danielle Niangar Attorney General University of Houston COMPLAINT 4 REVIEW I, Danielle Niangar, serving as the Attorney General for the Student Government Association at the University of Houston, certify that I have received and reviewed a complaint filed by Andrew Bahlmann against Winni Zhang, presidential candidate for the Spirit RED: Improve Parking, Improve Mental Health, Improve Textbook Prices party. After much consideration, the office of the Attorney General has found that the complaint does not have merit regarding the fact that the University of Houston SGA Election Code holds no current legislation regarding the prices of “likes” on certain social media platforms. Additionally, I was able to interview Chief Election Commissioner Austin Turman, who stated that, for the sake of the 2017 Election, a “like” on Facebook is approximately equal to $0.05, and should be recorded as such on a candidate’s financial disclosure paperwork. Ms. Zhang was able to record such expenditure as needed as viewed in the financial disclosure paperwork. This complaint pertained to the General Election procedure and campaigning season, therefore the decision was to the discretion of the Attorney General. This complaint will not be sent to the University of Houston Student Government Association Court of Appeals. After much consideration, the office of the Attorney General has found that the complaint does not have merit regarding the fact that the University of Houston SGA Election Code holds no current legislation regarding character limits in party names. This complaint pertained to the General Election procedure and campaigning season, therefore the decision was to the discretion of the Chief Election Commissioner. This complaint will not be sent to the University of Houston Student Government Association Court of Appeals.
