3.3 Special terms and conditions Accidents
Particulars
Our medical adviser determines the degree of permanent disability. He does this on the basis
of the information obtained from the treating physician(s). Or we shall engage an independent
physician. We make use of the tables of the American Medical Association if we determine
permanent functional disability. We take into consideration the degree to which the insured
was already disabled prior to the accident.
If you have concluded several accident insurances with us, we shall never reimburse more than
€125,000.00.
In the case
of death or
disability
If you die within a period of 2 years as a result of the accident, we shall reimburse the amount
for death. Have we already paid reimbursement for permanent disability? This amount shall be
deducted.
Can the degree of disability not be determined within a period of 2 years? In this case, we are
entitled to discontinue payment. We shall pay the legal interest due for the amount that we
have not paid out.
We never pay more than the insured amount, even if this involves several accidents together.
Does the event involve death as a result of an accident? In this case, the heirs must agree to us
instructing a post-mortem to be carried out. Otherwise there is no cover.
Did you have an accident? In this case you must be examined by a medical specialist.
Or you can have the examination performed at a hospital appointed by us.
A physician must declare whether there is a chance of permanent disability. This must be done
within a period of twelve months following the accident. We cannot make any reimbursement
without this declaration.
In the event of death, we shall pay the sum to the legal heirs. They must submit a certificate of inheritance. The State of the Netherlands and creditors that are not heirs have no right to payment.
In the event of permanent disability, we shall pay the sum to you. This shall take place once the
degree of permanent disability has been determined.
For a more detailed overview, please refer to the article ‘Your obligations in the event of damage.’
