ORDINANCE NO. 2003-6 AMENDING THE SAN MATEO MUNICIPAL CODE CHAPTER 11.40 REGARDING PARKING ENFORCEMENT PRACTICES AND CHAPTER 11.44 REGARDING PARKING METERS RATE The Council of the City of San Mateo, California, ordains as follows: Section 1. Chapter 11.40 of the San Mateo Municipal Code is amended to read as follows: Chapter 11.40 PROHIBITED OR LIMITED PARKING* Sections: 11.40.010 11.40.020 11.40.030 11.40.035 11.40.040 11.40.050 11.40.055 11.40.060 11.40.070 11.40.080 11.40.090 11.40.100 11.40.110 11.40.120 Central traffic district--Prohibited when. For the statutory authority to regulate parking on the streets or portions thereof of the city during all or certain hours of the day see Cal. Veh. C. §§ 22507 and 22507.5. For the provisions authorizing the exercise of reasonable police power to adopt rules by ordinance regarding parking on hills upon grades in excess of three percent in a business or residential district see Cal. Veh. C. § 22509. 11.44-1 11.40.010 CENTRAL TRAFFIC DISTRICT -- PROHIBITED WHEN. When authorized signs are in place giving notice thereof, no person shall stop, stand or park any vehicle upon any street in the central traffic district between the hours of four-thirty p.m. and six p.m. of any day except Sunday for any purpose other than the loading or unloading of passengers or materials subject to the limitations of Section 11.48.020. 11.40.020 CENTRAL TRAFFIC DISTRICT -- LIMITED WHEN. When authorized signs are in place giving notice thereof, no person shall stop, stand or park any vehicle within the central traffic district between the hours of seven a.m. and six p.m. of any day except Sunday for a period of time longer than forty-five minutes. 11.40.030 OTHER BUSINESS DISTRICTS -- PARKING LIMITED. When authorized signs are in place giving notice thereof, no person shall stop, stand or park any vehicles within a business district outside of the central traffic district between the hours of eight a.m. and six p.m. of any day except Sunday for a period of time longer than two hours. 11.40.035 PARKING - PROHIBITED ON CERTAIN PUBLIC PROPERTY. No person shall stop, stand, or park any vehicle upon any city property, including but not limited to lawn, turf, flowers, shrubs, dirt, and the like, except in areas specifically designated or authorized as parking areas and in conformance with the restrictions stated on signs at the parking areas. The following areas are excepted from the foregoing: (1) areas specifically striped for parking or (2) areas otherwise specifically designated or authorized for parking by signing. For purposes of this section, the term "city property" shall include, but not be limited to, property owned (including easement interests) or leased by the City of San Mateo, including parks, recreation facilities, City Hall, Police and Fire Departments, and library facilities. Streets and highways are not regulated by this provision. (Ord. 1996-17 § 1, 1996) 11.40.040 LIMITATION IN CERTAIN LOCATIONS. (a) The City Manager may limit or prohibit the stopping, standing, or parking of any vehicle upon any City street or portion thereof owned or operated by the City. Such action may provide that the regulations shall not apply on Sundays and holidays. For the purpose of this section, holidays are defined as: January 1, known as "New Year's Day" The third Monday in January, known as "Dr. Martin Luther King Day" The third Monday in February, known as "Presidents Day" The last Monday in May, known as "Memorial Day" 11.44-2 July 4, known as "Independence Day" The first Monday in September, known as "Labor Day" November 11, known as "Veterans Day" Thanksgiving Day December 25, known as "Christmas Day" When authorized signs are in place giving notice thereof, no person shall stop, stand, or park any vehicle except as provided by that action. (b) The City Manager may limit or prohibit the stopping, standing, or parking of any vehicle upon the City Hall motor vehicle parking lots, or on any recreation building, area, or park motor vehicle lot, or on any public library motor vehicle parking lot, or other parking lots owned or operated by the City or a City parking improvement district, or the municipal golf course motor vehicle parking lot. Such action may provide that the regulations shall not apply on Sundays and holidays. For the purpose of this section, holidays are defined as: January 1, known as "New Year's Day" The third Monday in January, known as "Dr. Martin Luther King Day" The third Monday in February, known as "Presidents Day" The last Monday in May, known as "Memorial Day" July 4, known as "Independence Day" The first Monday in September, known as "Labor Day" November 11, known as "Veterans Day" Thanksgiving Day December 25, known as "Christmas Day" When authorized signs are in place giving notice thereof, no person shall stop, stand, or park any vehicle except as provided by that action. 11.40.050 ALL NIGHT PARKING PROHIBITED. No person shall stop, stand or park a vehicle on any street for a period of time longer than thirty minutes between the hours of two a.m. and four a.m. of any day. 11.40.055 PARKING PROHIBITED FOR STREET CLEANING. No person shall park any vehicle on that side of any street on the days, and between the hours, designated by the City Manager for the purpose of street cleaning, and as posted with signs giving notice of the days, and the hours, of the parking prohibition effective on that side of the street. 11.40.060 GRADES -- CURBING WHEELS REQUIRED. No person shall stand, or park any vehicle upon any street, the grade of which exceeds five percent without setting the brakes thereon and blocking the wheels of said vehicle by turning them against the curb or by other means. 11.44-3 11.40.070 STREET OBSTRUCTION. No person shall operate, or stand or park any vehicle on any street in such a manner as to obstruct the free use of such street. 11.40.080 PEDDLERS -- VENDORS -- LIMITATION. (a) Except as otherwise provided in this section, no person shall stand or park any vehicle, wagon or pushcart from which goods, wares, merchandise, fruits, vegetables or foodstuffs are sold, displayed, solicited or offered for sale, or bartered or exchanged, or any lunch wagon or eating car, or vehicle, on any portion of any street within this city, except that such vehicles, wagons or pushcarts may stand or park only at the request of bona fide purchaser of such goods, wares, merchandise, fruits, vegetables or foodstuffs for a period of time not to exceed ten minutes at any one place. The provisions of this subsection shall not apply to persons delivering such articles upon order of, or by agreement with, a customer from a store or other fixed place of business or distribution. (b) No person shall park or stand on any street any lunch wagon, eating cart or vehicle, or pushcart, from which tamales, peanuts, popcorn, candy, or other articles of food are sold, or offered for sale, without first obtaining a written permit to do so from the city council, which shall designate the specific location in which such cart shall stand. (c) No person shall park or stand any vehicle, or wagon, used, or intended to be used, in the transportation of property for hire on any street while awaiting patronage for such vehicle or wagon, without first obtaining a written permit to do so from the city council, which shall designate the specific location where such vehicle may stand. (d) No person shall stand or park a vehicle upon any street for the purpose of displaying such vehicle for sale by sign or otherwise. (e) Whenever any permit has been granted under the provisions of this section, and a particular location to park or stand has been specified therein, no person shall park or stand any vehicle, wagon, or pushcart on any location other than as designated in such permit. In the event that the holder of any such permit has been convicted in any court of competent jurisdiction of violating any of the provisions of this section, such permit shall be forthwith revoked by the city council upon the filing of the record of such conviction with the city council, and no such permit shall thereafter be issued to such person until six months have elapsed from the date of such revocation. 11.40.090 WASHING VEHICLE ON STREET. No person shall dust, wipe, wash, or otherwise clean, use, or employ any method of dusting, wiping, washing or otherwise cleaning any vehicle, or portion thereof, while on any street unless such vehicle is owned by, or under the direct control or supervision of, the person doing any of the acts herein enumerated. 11.44-4 11.40.100 EMERGENCY PARKING SIGNS. (a) Whenever the city manager has determined that an emergency traffic congestion is likely to result from the holding of public or private assemblages, gatherings or functions, or for other reasons, the city manager shall have the power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing of vehicles is prohibited on such streets and alleys as the city manager shall direct during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency and the city manager shall cause such signs to be removed promptly thereafter. (b) When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs. 11.40.110 CONSENT REQUIRED. It is unlawful for any person to drive upon, or across, or to park, or leave standing or to cause, or permit to drive, park or leave standing, any vehicle upon any property in the city without the consent of the owner or person in control of such property. 11.40.120 ILLEGAL PARKING -- REMOVAL OR TOWING OF VEHICLE. (a) The owner or person in lawful possession of any private property may, subsequent to giving notice to the police department of the city, cause the removal of the vehicle parked on such property to the nearest public garage or other place of safety, if there is displayed in plain view on the property a sign prohibiting public parking and containing the telephone number of the police department of the city. The person causing the removal of such vehicle shall comply with the requirements of Chapter 10 of Division 11 (beginning with Section 22650) of the Vehicle Code of the state relating to notice when removing a vehicle from private property. (b) Pursuant to the authority granted by Section 22651 of the Vehicle Code of the state, any officer of the police department of the city or any regularly employed or salaried employee who is engaged in directing traffic or enforcing parking laws and regulations of the city may remove a vehicle from any street, alley or other public way within the city to the nearest public garage or other place of safety, or to a garage designated or maintained by the city, under the following circumstances: (1) When a vehicle is parked or left standing upon a street, alley or other public way, for seventy-two or more consecutive hours in violation of this section. (2) When a vehicle is illegally parked on a street, alley, or other public way in violation of any ordinance of the city forbidding standing or parking, and the use of such street, alley, or other public way or portion thereof is necessary for cleaning, repair, or construction of the street, alley, or other public way or the installation of underground 11.44-5 utilities, and signs giving notice that such vehicle may be removed, are erected or placed at least twenty-four hours prior to the removal by the authorities of the city pursuant to this section. (3) Where the use of the street, alley, or other public way or any portion thereof is authorized by the city for purpose other than the normal flow of traffic; or for the movement of equipment, articles or structures of unusual size, and the parking of such vehicle would prohibit or interfere with such use or movement and signs giving notice that such vehicle may be removed, are erected or placed at least twenty-four hours prior to the removal by the authorities of the city pursuant to this section. (4) Where any vehicle is parked or left standing when the city has, by ordinance or resolution, prohibited such parking, and signs giving notice of the removal have been posted pursuant to this section. (c) The owner or person having the right to possession of any vehicle removed pursuant to this section, shall pay all lawful removal, towing and storage charges. (d) Whenever a vehicle is removed under this section by an employee of the city, the person authorizing such removal shall comply with the California Vehicle Code provisions relating to notice and opportunity for hearing as set forth in Chapter 10 of Division 11 of that Code 11.44-6 Section 2. Deposit of slugs unlawful. Interference with enforcement unlawful. Police report--Penalties. Use of fees. 11.44.010 DEFINITIONS. The following words when used in this chapter shall be construed as defined in this section: (1) "Operator" includes every individual who operates a vehicle as the owner thereof or as the agent, employee or permittee of the owner; (2) "Street" means any public street, avenue, road, boulevard, highway, or other public place located in the city and established for the use of vehicles; __________________ * For the statutory provisions regarding parking meter zones see Cal. Veh. C. § 22508. For provisions relating to temporary removal of meters, see Chapter 17.08. (3) "Vehicle" means any device in, upon, or by which any person or 11.44-7 property is, or may be, transported upon a street, except a device which is operated upon rails or tracks. 11.44.015 PARKING METER PLACEMENT AND LIMITS. (a) Parking Meter Areas: Parking meters may be placed in any location along the public streets or the City or District parking lots in the area contained in the Central Parking & Improvement District. A determination as to where to specifically place parking meters within this area shall be made by the Public Works Commission. (b) Parking Time Limits. The time limits for each parking meter area and for each meter shall be established by the City Manager and shall apply between the hours of 8:00 a.m. and 6:00 p.m. each day except for Sundays and the holidays set forth in Subsection (c) below. (c) Holidays. The holidays excluded and during which the parking specified in this Chapter shall not be limited nor the payment of the parking charges collected shall be as follows: January 1, known as "New Year's Day" The third Monday in January, known as "Dr. Martin Luther King Day" The third Monday in February, known as "Presidents Day" The last Monday in May, known as "Memorial Day" July 4, known as "Independence Day" The first Monday in September, known as "Labor Day" November 11, known as “Veterans Day” Thanksgiving Day December 25, known as "Christmas Day" (d) Parking Meter Rates. Rates for parking vehicles in a space governed by a parking meter shall be as follows: Meter Limits/Rate 24 minute meter 1 hour meter 2 hour meter 4 hour meter 10 hour meter Nickel 6 minutes 6 minutes 6 minutes Dime 12 minutes 12 minutes 12 minutes Quarter 24 minutes 30 minutes 30 minutes 1 hour 1 hour 11.44.020 METERED PARKING ZONE TEMPORARY PERMITS. The superintendent of streets is authorized to issue permits which specify particular metered parking spaces for the temporary exclusive use by persons occupying property adjacent to the specified metered parking spaces. 11.44.030 PERMIT -- APPLICATION -- REQUIRED. The permit shall only be issued, after due application as provided herein when the circumstances indicate to the satisfaction of the superintendent of streets that there is a need to limit the parking in certain parking areas 11.44-8 within the parking meter zone to parking for the purpose of construction, demolition, remodeling, repainting or refurbishing and maintenance of structures or grounds adjoining the meters during certain times. Application for the issuance of a parking meter loading zone permit shall be made on a form provided by the superintendent of streets. 11.44.040 HOOD -- APPLICATION -- FORM. The application form shall require the following information: (1) Name and address of applicant; (2) Name and address of person occupying the premises adjacent to the parking space concerned; (3) The number of the parking meter located at the parking space for which restricted parking is requested; (4) A statement of the reasons for the need for such parking restriction; (5) The estimated hours of the day during which such restriction may be necessary; (6) Such other relevant information as the superintendent of streets may require. 11.44.050 PERMIT -- ISSUANCE -- DENIAL -- APPEAL -HEARING. The superintendent of streets may grant such permit with such conditions as he may deem advisable, or deny such application. If such permit has been denied, or granted with conditions and applicant is dissatisfied with the denial, or the conditions, applicant may appeal therefrom to the public works commission. Such appeal must be filed within ten days after such action by the superintendent of streets. If appeal is not filed within such period of ten days, applicant shall be barred for a period of six months from making further application with reference to the same matter. In taking such appeal, applicant shall file notice thereof in writing within such period of ten days with the commission secretary, who shall set the hearing thereon for the next regular meeting of the commission, provided such next regular meeting is to be held not less than ten days from the date of filing such appeal. If such meeting is to be held within less than ten days thereafter, such hearing shall be set for the regular meeting next subsequent thereto. At such hearing the commission shall hear all evidence offered by applicant and the superintendent of streets, and may hear other evidence with reference thereto, and may continue such hearing from time to time. At the conclusion of such hearing, the commission shall make its findings thereon, and if it has found that the action of the superintendent of streets in denying, or conditioning the permit was discriminatory against applicant, or if it finds that the granting of such permit with or without conditions, or otherwise will not be injurious to the public health, safety, welfare or morals, it shall refer the appeal with 11.44-9 its findings and recommendations to the city council. Otherwise, it shall affirm the action of the superintendent and deny the appeal. Applicant may then appeal the matter to the city council within the same time and in the same manner as set forth above. The decision of the city council at such hearing shall be final, and conclusive, and applicant shall be barred for a period of six months after such decision from making further application with reference to the same matter. 11.44.060 PERMIT -- SIGNS -- NOTIFICATION. (a) A separate permit shall be required for each space. (b) A written permit shall be issued with a sign restricting use of the space to the vehicles and/or objects for which the permit was obtained. (c) The sign mentioned in subsection (b) above is to remain under the sole custody and control of the superintendent of streets, and he shall cause it to be affixed to the proper meter post throughout the permit period and shall cause it to be removed upon expiration, surrender or revocation thereof. (d) The superintendent of streets shall forward to the police department copies of each permit granted. 11.44.070 PERMIT -- ISSUANCE FEES. The person issued a parking meter loading zone permit shall pay the fees therefor as shall be set from time to time by resolution of the city council. Payment for each day of each metered space for which application if made, shall be paid prior to the granting of a permit. Any adjustment in fees shall be made at the time the permit expires, or use is discontinued. 11.44.080 PERMIT -- USE REVOCATION. The superintendent of streets may revoke the permit authority granted herein to use such metered spaces for any of the following reasons: (1) When the person has failed to pay the fee as provided herein; (2) When the superintendent is satisfied that the circumstances no longer require the existence of such authority; (3) When the person is found to be using the permit for purposes other than for which it was granted. 11.44.090 PERMIT ONLY SIGN -- PARKING ADJACENT TO UNLAWFUL. It is unlawful for any person to cause, allow, permit or suffer any vehicle operated or controlled by him to be parked in any parking space within a parking meter zone while a parking-by-permit-only sign is properly in place on the post for such space. Any vehicle found to be improperly occupying any part of a posted permit-only parking space shall be cited and, on the demand of the permittee, the police shall have the offending vehicle towed and impounded under the authority of Section 11.40.120 of this code. 11.44.100 PERMIT -- NOT A WAIVER. A permit allowing 11.44-10 temporary exclusive use of metered parking spaces as set forth in this chapter shall not waive the necessity of obtaining any and all other encroachment and/or building permits, or any other permit or license specified as required under other provisions of this code 11.44.110 PURCHASE AND INSTALLATION AUTHORITY. The City Manager is directed to provide for the purchase, acquisition, installation, operation, maintenance, supervision, regulation and use of the parking meters provided for in this chapter, and to maintain such meters in good workable condition, and he is vested with power and authority to enter into a contract of purchase on approval of the terms and conditions thereof by the city council. 11.44.120 LOCATION. Parking meters, installed in the parking meter zones, shall be placed upon the curb immediately adjacent to the individual parking places hereinafter described. Each parking meter shall be placed or set in such manner as to show or display by a signal that the parking space adjacent to such meter is or is not legally in use. Each parking meter installed shall indicate by a proper legend the legal parking time established by the city, and when operated, shall indicate on or by its dial and pointer the duration of the period of legal parking, and on expiration of such period shall indicate illegal or overparking. 11.44.130 CURB MARKINGS. The City Manager shall have lines or markings painted or placed upon the curb and/or upon the street adjacent to each parking meter for the purpose of designating the parking space for which such meter is to be used and each vehicle parking adjacent or next to any parking meter shall park within the lines or markings so established. No person shall park any vehicle across any such line or marking or park such vehicle in such position that the same is not entirely within the area so designated by such lines or markings. 11.44.140 PARALLEL PARKING. When a parking space in any parking meter zone is parallel with the adjacent curb or sidewalk, any vehicle parked in such parking space shall be parked with the foremost part of such vehicle nearest to such meter. 11.44.150 DEPOSIT – REQUIRED AMOUNT. When a vehicle is parked in any space adjacent to which a parking meter is located in accordance with the provisions of this chapter, the operator of such vehicle shall, upon entering such parking space, immediately deposit, or cause to be deposited, coinage in such parking meter, and put such meter into operation, and failure to deposit such coinage of the specified value, and put the meter into operation is unlawful. Upon the deposit of such coins and placing such meter in operation, the parking space may be lawfully occupied by such vehicle during the period of parking 11.44-11 time which has been prescribed for the part of the street in which such parking space is located. If such vehicle remains parked in any such parking space beyond the parking time limit fixed for such parking space, the parking meter shall, by its dial and pointer indicate such illegal parking and in that event, such vehicle shall be considered as parked overtime, and beyond the period of legal parking time, and the parking of a vehicle overtime or beyond the period of legal parking time in any such part of a street where any such meter is located is a violation of this chapter and punishable as hereinafter set out. (a) Commercial trucks may park in the parking zones to load or to unload merchandise, without depositing coins or tokens for a period not to exceed thirty minutes. Should any truck or delivery car be parked longer than thirty minutes, such violator will be given a ticket and classed as a violation, and the regular penalty imposed. 11.44.160 DEPOSIT -- EXCEEDING TIME LIMIT UNLAWFUL. No person shall cause, allow, permit or suffer any vehicle registered in the name of, or operated by, such person to be parked overtime or beyond the period of legal parking time established for any parking meter zone as herein described. 11.44.165 REPEAT VIOLATIONS. If a vehicle receives a second citation for violation of the overtime parking regulations within the same calendar day, and the vehicle was not moved from the parking space between violations, the bail for the second citation shall be increased to that amount as is established upon the schedule of bail for violation of this section. 11.44.170 ALLOWING VEHICLE TO REMAIN PAST TIME LIMIT UNLAWFUL. No person shall permit any vehicle to remain, or be placed, in any parking space adjacent to any parking meter while such meter is displaying a signal indicating that the vehicle occupying such parking space has already been parked beyond the period of time prescribed for such parking space 11.44.180 DEFACING UNLAWFUL. No person shall deface, injure, tamper with, open, or willfully break, destroy, or impair the usefulness of any parking meter installed under the provisions of this chapter. 11.44.190 DEPOSIT OF SLUGS UNLAWFUL. No person shall deposit, or cause to be deposited, in any parking meter, any slugs, devices or metallic substances or any other substitute, for the coins, or specified tokens in lieu of the coins. No person shall deposit coins, tokens or metallic substances indiscriminately in such meter, without the intent, or right to park the motor vehicle which he is then operating, at the parking space adjacent to such meter. 11.44-12 11.44.195 INTERFERENCE WITH ENFORCEMENT UNLAWFUL. No person shall interfere with, or obstruct in any way, any police officer, traffic enforcement representative, or other officer or employee of this city in their enforcement of the provisions of this title. The removal, obliteration, erasure or concealment of any chalk mark or other distinguishing mark used by any police officer, traffic enforcement representative, or other officer or employee of this city in the performance of their duties to enforce the parking regulations of this title, if done for the purpose of evading the provisions of this title, shall constitute unlawful interference or obstruction of enforcement 11.44.200 POLICE REPORT -- PENALTIES. It shall be the duty of police officers of the city, acting in accordance with instructions issued by Chief of Police, to report: (1) The number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is, or has been, parking in violation of any of the provisions of this chapter; (2) The state license number of such vehicle; (3) The time during which such vehicle is parking in violation of any of the provisions of this chapter; (4) Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation. Each such police officer shall also attach to such vehicle a notice to the owner or operator thereof that such vehicle has been parked in violation of a provision of this chapter. Each such violation shall constitute an infraction for which a penalty shall be imposed which shall be the same as the penalty for all other overtime parking violations as enforced by the municipal court, central judicial district, San Mateo County. 11.44.210 USE OF FEES. The specified coin or coins required to be deposited in parking meters as provided herein are levied and assessed as fees to provide for the proper regulation and control of traffic upon the public streets, and to cover the cost of supervision and regulation of parking of vehicles in the parking meter zones, and to cover the cost of purchase, installation, operation, maintenance, supervision, regulation and control of the parking meters, and to cover the cost to operate, maintain, and improve the garages and lots within the parking district. Section 3. PUBLICATION. This Ordinance shall be published in summary in the San Mateo County Times, posted in the City Clerk’s Office, and posted on the City’s website, all in accord with Section 2.15 of the Charter and shall take effect upon publication.
