Discretionary Publicity The Council normally publicises by ‘neighbour notification’ letter applications for the variation of any Conditions imposed as a result of a previous grant of planning permission or applications for Lawful Development Certification. Applicants and Agents also receive a site notice which the Council asks them to display at the site of the application. Weekly List A weekly list of planning applications is published in local newspapers and also sent to local libraries, community and amenity groups, as well as special interest groups such as the Society for Sussex Downsmen. A copy of this list is available for inspection at the reception of the Planning Department at Haywards Heath and on the Council’s website [www.midsussex.gov.uk]. All Town and Parish Councils are sent copies of the applications received from their own areas. This information leaflet sets out the publicity procedures that this Council operates, which is line with advice contained in the Department of Environment Circular 15/92. Types of Publicity This Council has four basic types of publicity: letter to occupiers or owners of adjoining properties [‘Neighbour Notification’]; ii posting a site notice, visible to the general public; iii publishing a notice in the local newspaper: iv publishing a weekly list of applications. [also available on the Council’s website www.midsussex.gov.uk] The ‘Neighbour notification’ Letter The ‘Neighbour notification’ letter will be sent out soon after the planning application is received. The letter provides the location, the proposal, the applicants name and the planning reference number. The letter also explains that the application can be examined, during normal office hours, at the District Council Offices at Haywards Heath, online at www.midsussex.gov.uk or at the offices of the relevant Town or Parish. In some Parishes the application can be examined, by appointment, at the home of the Parish Clerk. i Worth East Grinstead Ashurst Wood A Planning Officer will visit all application sites and will check that letters have been sent to all relevant properties. West Hoathly Balcombe Horsted Keynes Ardingly Ansty and Staplefield Slaugham Lindfield Haywards Lindfield Heath Rural Bolney Cuckfield Twineham Hurstpierpoint and Sayers Common Mid Sussex Parishes Newtimber Hassocks Poynings When an application is received for a development that affects a Public Right of Way, is a departure from the Development Plan, or requires an Environmental Impact Assessment, or, if a development would change the setting or character of a Listed Building or a Conservation Area further publicity is required. In these cases that additional publicity would be through advertisements in the local newspaper and notices on site. Some proposals will be classified as ‘major developments’ ie: i. ten or more dwellings/site are more than 0.5 hectares [1.25 acres] ii. floor space over 1000m/site area more than 1 hectares [2.5 acres] iii winning and working of minerals iv all waste developments Burgess Hill Albourne Fulking When an application has been received for a domestic extension within an urban area, letters will be sent to immediate neighbours, including those opposite and to the rear. Additional Compulsory Publicity Neighbour notification These letters are sent out at the earliest possible stage in the processing of a planning application. As a general rule, those neighbours within four metres of the site boundary are notified of a planning application by letter. Where the application site is surrounded by open land that does not obviously belong to a nearby property, individuals may not be notified although a site notice will be displayed. The letter encourages neighbours to pass on details to others who may be interested in any proposed development. The Plan below details the relevant Parishes. Turners Hill ‘Neighbour notification’ letters are sent as a result of the majority of applications. These are of particular benefit to the house-bound or when the development affects close neighbours. Any comments in respect of the application must be sent to Planning Services of the District Council within 21 days of the date of the letter. Any relevant comment will be considered before any planning application is decided. In addition the Planning Officer may decide that the proposed development is ‘major’ if they have a wider impact in the locality - for example, if it creates noise, vibration, dust or attracts crowds to a generally quiet area. ‘Major’ applications are publicised by advertisements in the local newspaper ‘Neighbour notification’ letters will also be sent, but where there are many neighbours, notices will also be displayed around the site to draw attention to the application.
