The regular meeting of the Groveland Town Board was held on Thursday February 9, 2017 at the Town Hall. Present: Bill Carman, Supervisor; John Driscoll, Town Councilman & Deputy Supervisor, Bill Devine, Craig Phelps, Councilman Absent: Steve Atterbury, Councilman Other Town Official’s in Attendance: Highway Superintendent, James Love; Alternate member to Traffic Safety Board, Phyllis Applin Other Attendees: Ron Niedermaier; Jennifer Bow; Livingston County Traffic Safety Executive Secretary, Pattie Niedermaier Supervisor called the meeting to order @ 7:59 p.m. He asked Councilman Driscoll to lead us in the pledge to the flag. A motion by Councilman Driscoll and seconded by Councilman Phelps the audited bills be paid. General Fund vouchers numbered 19-41 for $6,661.94; Highway Fund vouchers numbered 7-30 for $14,935.38. Motion carried. A motion by Councilman Devine and seconded by Councilman Phelps to accept the regular meeting minutes of 1/12/17 as written. Motion carried. Supervisor handed out copies of the Town Clerk & Supervisors monthly financial reports. The supervisor reports were previously emailed to give additional time for review. In addition, the revised December 2016 supervisor report was supplied. A motion by Councilman Phelps and seconded by Councilman Devine to accept both financial reports. Motion carried. Information handed out/or acknowledged: 1. Payroll & Vehicle Mileage Log available for review 2. Fireman’s breakfasts 2nd Sunday only two left for 8am – 11am on Feb 12th & March 12th 3. Blood Drive 2/20/17 @ Groveland Fire Department 2 p.m. – 7 p.m. Old/New Business: HIGHWAY UPDATE – Before Mr. Love was given the opportunity to give his report, Supervisor Carman recommended a report be given ahead of time in case some of his items require public input. As Mr. Love has asked other agencies to attend, the board will hear it tonight so their time is not wasted; but we have an obligation to meet Open Meeting requirements to place items on the agenda ahead of time. Mr. Love reported he would like to see stop signs added to Barber Hill Road north and/or Morris Road as he feels there is a blind spot coming between Rosebrugh and Morris Road. He asked the County Traffic Safety Board to assist in the process. Public & board discussion: Groveland Alternate Member Representative to the Livingston County Traffic Safety Board, Phyllis Applin stated in her observation she doesn’t see the blind spot and doesn’t see it necessary to place stop signs up, she recommends maybe reduced speed signs as stop signs is harder for rural areas. Livingston County Traffic Safety Board Executive Secretary, Patti Johnston asked the board “what are the reasons for stop signs?” – Board responded to control the flow of traffic. Yes that is correct and the state does not recommend rural areas to use them in unpopulated areas. Resident, Jennifer Bow stated there was an accident at the intersection in 2015 and when the auctions are going on the drivers are confused. Applin stated the accident was due to driver error, the driver failed to stop at the stop sign. 2/9/2017 Town Board Minutes 1 Supervisor Carman asked Patti what are the town’s options. She stated to get counters and speed spy tests going to do a traffic study. Carman says we have road counters but not speed spy. Once study is complete if the town wants a yellow sign then basically the board only has to do a resolution but with any black and white sign it would require a TE-9 form which then has to go to the county highway superintendent and then to the state for review. Applin stated the town should request the use of speed spy through the sheriff department. Jim asked if the board will approve buying a 1-ton truck. Clerk said you already have it advertised and it is in the budget they will review any bids at the March meeting. He stated he has 3 light quotes to convert the shop to LED – board said to table it until we get the work complete on the front town hall door. He stated he has 2 quotes for new flooring to be installed in the shop office, bathroom and breakroom. Board tabled. He stated he has quotes to install steel roofing with caps for the Lake View cemetery vault building. He says we can have the crew install just paying for materials. Board tabled until they verify budget. Supervisor Carman asked why we have more overtime this January compared to last January. The new guy is supposed to help offset all the overtime. This year is 108 overtime hours. Jim’s response was we call out whenever there is 2 inches of snowfall. Jim told board he got the Chips money taking care of for reimbursement. HIGHWAY AGREEMENT TO SPEND TOWN HIGHWAY FUNDS – RESOLUTION 29-2017 – Board reviewed what Highway Superintendent, Jim Love prepared that requires all board to sign. Board reviewed and made changes to the form to be clear of the roads Jim intends to be worked on. WHEREAS, in the sum of $98,000 may be expended for general repairs upon 43.98 miles of town highways, including sluices, culverts and bridges having a span of less than five feet and boardwalks or the renewals thereof, and WHEREAS, Jim has designated road improvements on Servis Road and leading to East Groveland Road, a distance of .31 miles there shall be expended not over the sum of $13,000 with using a 20ft. width of stone and oil surface to ditch culverts, trimming tree stone and oil, and WHEREAS, on the road commencing at Wilson Road from Barber Hill Road and leading to Groveland Hill Road a distance of .94 miles shall be expended not over the sum of $80,000 with 24ft. gravel surface to stone and oil, 6” more lift to do, and WHEREAS, on the road commencing at SWAN HILL Road from Groveland Station Road – Route 63 and leading to East Groveland Road, a distance of .94 miles shall be expanded not over the sum of $5,000 to the gravel road a 22ft width traveled surface with a thickness of 1 inch sub base of 8 inch for tree trimming, culverts and ditching; now therefore be it RESOLVED, that pursuant to provisions of Section 284 of the Highway Law, the town board agrees that monies levied and collected for the repair and improvement of highways, and received from the state for the year 2017 will be utilized as specified above. The adoption of the foregoing RESOLUTION was duly out in vote on motion of Councilman Phelps and seconded by Councilman Driscoll and the results were carried with 0 nay 4. Councilman Atterbury was absent. TOWN OF GENESEO SHARED ASSESSOR CONTRACT – moved to next month as we identified some concerns that Geneseo wants to review with their board. CLEAN ENERGY WEBINAR – Sandy reported she watched it along with Councilman Atterbury & Devine. Atterbury provided an email statement. Devine & Bean both agreed his statement was pretty much what they got out of the webinar. 2/9/2017 Town Board Minutes 2 “It basically covered the requirements for communities to receive grants for switching too energy sources to reduce greenhouse gases. There are 10 “High Impact Actions” that can be taken to apply for a grant. A town must complete at least four of the ten to qualify. The first four towns to qualify may receive $100,000. The next 10 $50,000. For a total of 14 grant awards per region. There is currently $16 million dollars allocated for this program. AMBUSCADE PARK – Committee member Bill Devine reported the contractor has not provided any new updates. Board asked Devine to see if the contractor has the design changes so we can meet with Mossien then the state then see what all our options are. The committee will draft a letter. SUPERVISOR FINANCIAL - Supervisor Carman and his secretary Christine Lennington provided all the items for the audit and was present while the board went through the checklist; all was verified and matched with the records. RESOLUTION 30-2017 PROCEDURE AUDITS OF SUPERVISOR, TAX COLLECTION/TOWN CLERK & COURT - Copy of audits passed around. Audits will be part of the official minute book. Resolution 30-2017 WHEREAS, the Town Board has met at the time and place at its regular meeting, to review the 2016 examination of the Justice Court, Tax Collection, Town Clerk & Supervisor policies and procedures of their account books. WHEREAS, two councilmen did meet with each department as indicated on audit sheets at the Town Hall to provide a process to monitor and review the work performed by those who handle money as part of their town duties; and RESOLVED: the town board performed the examination and verification of the 2016 account books with court, tax collection, town clerk & supervisor and appeared to be in good order in Pursuant to Town Law, Section 27(1), Section 64(1), and Section 123. The adoption of the foregoing RESOLUTION was duly out in vote on motion of Councilman Driscoll and seconded by Councilman Carman and the results were carried with 0 nays 4 aye votes. Atterbury was absent. Supervisor Communication: Water line update, the board has narrowed it down to 6 candidates for the Director for LCWSA. They also got another bill for $98 for the difference in delivery of the meter material counts as they decided they could use more. Bill stated he recommends the excess meter materials should be surplus as much of it contains lead. I am getting information having a 6 inch line extended to the town hall. I checked with our insurance agent to see if a hydrant was put in at the town hall if it would provide a discount in coverage, but they said no because we are already within 5 minutes of the fire station. The hope is to consider a water filling station at the town hall if the water line works out. I called Gallivan’s office again regarding the $50,000 excavator funds they promised us and same response, but now they might look further as Town of Portage is in the same boat. As we were looking into the county needing assistance with code enforcement and us using Ron Maxwell; the county has chosen to use the Central Services Foreman as acting code official, per guidance from Supervisor Babbitt, and research long-term possibilities from there. Salt Shed update with the warranty. Steve Burnette came up again and stated the shingles are not flying off just standing and not snapping; he does not foresee a warranty since none are missing other than where the raccoons ate. Ron has been working on a builder dispute with a property owner and asked to sign an affidavit of statement. I am thinking this is something we would want our attorney to review; board thoughts? The board discussed. They recommended not to entertain the affidavit. Also, please know that if a 2/9/2017 Town Board Minutes 3 subpoena is forthcoming that he should contact the Supervisor so he can decide if our legal counsel should need to meet with him. Happy to report a new design newsletter coming and should be mailed out in the next week or so. Other Communications: Town Clerk reported the Livingston County Seniorama 2017 will be held on May 20, 2017 – the local group has selected Bill Carman to be the recipient this year and suggested to the councilman that someone should do the presenting since Bill usually does it. Bill is a well deserving recipient with all he does in the community. Town Clerk reported the Assessor will not be in this Saturday as he has a family gathering to attend. Sign is on the door with the answering machine notification. Town Clerk asked the board how they would like her to handle the vouchers with truck repairs as most of the time the costs are unforeseeable and not able to meet the procurement policy. They agreed this is something that is unforeseeable and a blanket statement should be stated. Town Clerk will work on one and pass it along for board consideration via email. Town Clerk reported the 2016 Chips figures were submitted in the amount of $77,062.74; we were thankful for the efforts of Supervisor Carman in getting the Regional Representative out to assist with the paperwork along with Mark Caldwell for getting us the road details. With the gravel purchase in December 2016 it leaves almost $74,000 left to spend under Chips this year. I was able to make a training guide for the Highway Superintendent to help him for his future Chip submittals. A motion by Councilman Phelps and seconded by Councilman Devine to adjourn the meeting.
