The delinquent was held guilty by Hon'ble Criminal Court of SDJM, Naraiangarh
but on Appeal before Hon'ble Session Court Ambala against the punishment order
passed by Hon'ble SDJM, Naraian Garh, the delinquent was acquitted on 31.03.2012.
During this period, the delinquent submitted his application for voluntary retirement
w.e.f. 31.07.2014 but the same was kept pending since the chargsheet under rule-7
was pending against him. Considering the facts on file, the chargsheet was dropped
his suspension
vide this office no. 14/31-2004 HRM-1(1) dated 03.07.2015 treating
and purposes but
period i.e 06.06.2004 to 13.09.2004 as duty period for all intents
before passing of this order dated 03.07.2015, the delinquent attained the age of
superannuation i.e 58 yrs on or before 31.01.2015.
It is worthwhile to consider that the delinquent remained absent from duty
voluntarily during notice period of three months for V.R.S w.e.f. 31.07.2014, therefore,
the same is not condoned and be considered as non qualifying period for pension.
Resultantly, the delinquent is not entitled to seek any pecuniary benefits of this notice

period. Official cannot be granted Voluntary retirement if any court case/departmental
enquiries/pending are against him. The departmental enquiries/penclini against Sh. Parampal
Singh, S.S. Master while submitting VRS notice. Therefore, he is not entitled to be granted
VRS with effects from 31.07.2014.
He has not attended the schools after expire of notice period i.e. 31.07.2014 actually
he has to be retired on 31.01.2015 at the age of Superannuation i.e. 58 years. The period
between 01.08.2014 to 31.01.2015 during which he has not worked in school will be treated
without pay on the basis of "No. Work No. pay.

Whereas, the delinquent i.e. Sh. Suresh Kumar, Math Master, GSSS Anaj
Mandi Barwala (Hisar) was appointed as Centre Superintendent during Annual
Secondary/Senior Secondary Examination, March 2015 at exam centre - GSSS Badhawara
(Hisar). He opened the packet of question paper before settled time period of 20 minutes
before the commencement of exam. The Question Paper Flying Squad visited the centre and
asked about the opening of question paper package before time. The delinquent failed to
reply satisfactory. He was put under suspension with immediate effect vide this office order
No. 14/17-2015-HRM-II (3)/619 dated 11.03.2015. He was reinstated in service pending
enquiry vide order dated 04.11.2015 without prejudice to the disciplinary action pending
against him and without prejudice to the decision that may be taken regarding the period of
suspension. A charge sheet was served upon him vide order dated 12.01.2016. Thereafter, Sh.
D. D. Gautam, IAS (Retd.) was appointed Inquiry Officer vide order dated 15.03.2016. He
submitted his report on 22.07.2016 stating therein that there were no sign of paper leak and
complaint against the delinquent and charges imposed upon him are not entirely proved.
Considering the facts on file and the enquiry report submitted by the Inquiry
Officer, being Appointing and Disciplinary Authority, I am satisfied with the contents of the
enquiry report, consequently, I am of the considered view that the charges leveled upon Sh.
Suresh Kumar, Math Master are deserves to be dropped and his suspension period i.e.
11.03.2015 to 04.11.2015 be allowed to be considered as duty period for all intents and
purposes.
I order accordingly.
